Word has reached me that Fullerton might have leak problem – and that problem is that City Manager Ken Domer is quite mad that people would dare tell the public the things he intends to hide from us.
Such things as our Chief of Police and a Captain being caught up alleged Felony Battery on an EMT charges.
Or that one of our now former officers is being indicted for his cover-up work on the Joe Felz DUI incident.
When I first heard the rumors that Domer was hopping mad about the “leaks” coming out I brushed it off as hearsay. Then I heard it again from a different source. And again. And again still.
At this juncture I’m willing to chalk this rumor up as “Credible but without citation”.
If our city management would worry more about what their own staff is doing and the corruption therein and would be honest about it we wouldn’t need to rely on leaks from anonymous sources. And without those leaks, Domer would have nothing to be mad about in the first place.
Ultimately if he is mad it’s because he believes himself to be a part of the Ruling Elite above we the chattel and is more worried about appearances than solving problems.
The funny part for me is that I’ve tried to cultivate leaks within the city to no avail. All of the people who know me in City Hall are smart enough to not tell me anything for fear of guilt by association.
Yet here we are breaking stories of corruption and malfeasance and we get these leaks at FFFF because enough employees are fed up with the nonsense happening in Fullerton and FPD.
I salute the people who have sent us information because one of the last things Fullerton needs these days is a continuing culture of cover-ups. We respect your privacy and value the contribution to improving accountable, intelligent, and responsible leadership in our town’s government.
We received information today that (former?) Fullerton Police Sergeant Jeff Corbett is to be charged with a felony. Could this be from the recent Grand Jury investigation and relating to his mishandling of the Joe Felz DUI incident of election night 2016?
We’ll find out soon enough as a Press Release is forthcoming from the District Attorney’s office as I type.
Well over a year later, this letter shows that some of the accusations leveled at Sergeant Jeff Corbett and Lieutenant Goodrich, under the leadership of the since-departed Chief Danny Hughes, were indeed sustained.
Can we expect an Instagram Press Release from FPD? Maybe photos from the scene of the crime? A booking photo? Or are those only reserved for people not promised a government pension?
For those of you playing along at home we know that two of Fullerton’s Finest (Chief Hendricks & Captain Oliveras) have been put on a paid stay-cation (costing us approximately $1,955/day) for their conduct at a Lady Antebellum concert in Irvine. With City Manager Ken Domer putting Captain Bob Dunn in charge of FPD we are now being run by… Dunn & Domer.
It’s too bad this isn’t a comedy. Instead we’re finding ourselves in more typical Fullerton drama that a little transparency might have avoided. Alas instead of openness and honesty City Manager Ken Domer couldn’t be bothered to let anybody outside of the police department know what was happening in our town at the time, the next day or even the day after that.
In fact per a statement to the OC Register by Jennifer Fitzgerald it took Domer at least 3 days to inform his employers (City Council) of any details (if they have gotten any) and it has taken him 4 days to bother to release information to our fair city by way of a press release. It’s almost like he doesn’t know who he works for anymore.
Fullerton Councilwoman Jennifer Fitzgerald said she knows little about the incident, but “what I know of Chief Hendricks and Captain Oliveras is that they are fantastic guys and fantastic public servants and I look forward to the investigation being complete.”
Let us peruse this fascinating bit of PR garbage:
That’s quite a few words to say almost nothing of substance. What happened? How long is the leave? Was it criminal? Who’s investigating the case?
The City will not provide further information at this time, out of respect for the integrity of the ongoing investigations.
In other words “F U. You don’t have a right to know anything at all because integrity of an ongoing case”.
Except no.
We already know from an email from the City of Irvine there is plenty to see here and we deserve details. I’m tired of this mentality that it’s okay to publicly and loudly (Instgram?!) shame societal nobodies when they screw up but when our overlords do the same all of the sudden we need to worry about “integrity” and bury the details behind a wall of BS.
The first bit of BS that we need to knock down here is that this isn’t just some boilerplate investigation that “related entirely to allegations of off-duty conduct”.
This is an allegation of battery against an EMT. By possibly armed off-duty officers. The alleged battery alone falls under CA Penal Code 243(c)(1) unless the injury was serious and then it elevates.
(c) (1) When a battery is committed against a[n][…] emergency medical technician […] engaged in the performance of his or her duties, whether on or off duty, […] and an injury is inflicted on that victim, the battery is punishable by a fine of not more than two thousand dollars ($2,000), by imprisonment in a county jail not exceeding one year, or by both that fine and imprisonment, or by imprisonment pursuant to subdivision (h) of Section 1170 for 16 months, or two or three years.
Next we have to ask who will oversee this investigation? Why were no arrests made for this alleged battery?
How is the District Attorney involved? Which internal investigator are we planning to hire? Is Irvine being allowed to investigate this case?
These are all pertinent questions especially considering the incestuous relationships we have with other departments. Remember that Irvine’s Chief of Police, Mike Hamel, is married to Katherine Hamel who herself is a Lieutenant under Captain Oliveras and Chief Hendricks.
Is Irvine’s Chief Hamel really going to investigate his wife’s boss? Is this why no arrests were made?
Regarding the “ongoing investigation” angle – that’s the same claptrap the city is still throwing at us over the Joe Felz accident and cover-up that happened 657 days ago. #SorryNotSorry that we can’t trust you and your comrades in obfuscation in the City Attorney’s office to come clean Mr. Domer.
If Fullerton’s City Manager Ken Domer really cared about transparency and “integrity” he wouldn’t hide behind subterfuge and lies of omission. He would tell we the citizenry about what is happening, how it is happening and how we can be assured that another Danny Hughes Felzian cover-up isn’t taking place in our city.
Domer would do well to read his own interview with the OC Register when he said;
You cannot operate local government without partnerships, without collaboration, without openness, transparency.

As you may have heard, once again Fullerton has a police chief in hot water. First we had Mike Sellers run away from his post after bungling the Kelly Thomas case, then Danny Hughes decided to give Joe Felz a pass on drunk driving & alleged hit and run and now Chief Hendricks is in trouble for unspecified reasons.
There is no official word on what’s going on from the City because City Manager Ken Domer doesn’t think we have a right to know who’s running our police department and what is happening in our city. However, thanks to a diligent city employee who shall remain nameless reaching out to several of us we know that Hendricks is on a paid vacation (with the benefit of not needing to use his vacation time) for his bad behavior and Captain Bob Dunn is now acting Police Chief.
But who is Bob Dunn?
We wrote about Dunn back in January when he came to our fair city from Anaheim. He was a Lieutenant there and somehow promoted to the position of Captain in Fullerton without much fanfare.
Now he’s been moved to acting Chief. That’s one heck of a jump in 7 months time. Is he really the best man for the job? Is he up to the task? What will he be doing and for how long? Who’s investigating Hendricks? Is Dunn overseeing an IA whitewash or has another agency been called in?
Nobody knows because Ken Domer doesn’t think you have the right to know and the city council can’t be bothered to make him talk.
Numerous officers within the Fullerton Police Department are receiving Grand Jury Subpoenas like the one pictured below.
Probably not a coincidence that the lucky recipients are, reportedly, the same officers on scene when former City Manager Joe Felz ran over the tree in November 2016.
You know what, I’d really hate to be former police chief Dan Hughes, or former Sergeant Jeff Corbett, right now!
Sometimes problems are complicated. Sometimes they’re not.
Fullerton’s biggest problems aren’t really that complicated. The real reason our problems get worse and worse every year is because our elected officials insist on spending their time and energy on inane and self-serving gobbledygook that serve no real public purpose and/or accomplish nothing beyond weak symbolism.
Look no further than tonight’s agenda. Fullerton is going to spend a few hours (after Jesus Silva approves cutting yet another tax payer check to one of his campaign donors– Townsand Public Affairs– so the city can pay to lobby his wife) accomplishing exactly nothing. We’re going to vote to support spending time and money to weigh in on a legal discussion between the United States Federal Government and the entire State of California concerning immigration enforcement.
Because Fullerton and it’s 140,000 residents need to say something special that can’t or won’t be said by the Federal Government, who represent nearly 400,000,000 people.
Here are some topics not on tonight’s agenda:
1) Fullerton’s $5,000,000-$8,000,000 structural deficit for the current fiscal year.
2) Fullerton’s $50,000,000 budget gap over the next five years.
3) Why recent property sales of $4,000,000 went to filing this year’s deficit instead of fixing roads like we were promised.
4) How Fullerton plans to address $100,000,000 in deferred road maintenance
5) When the zoning code will be amended to prevent another mosoleum from being errected on Harbor
6) What to do about downtown puke piles
7) What to do about downtown brawls
8) What to do about rampant drunk driving?
9) What to do about tax evasion on illegally collected revenue at downtown bars?
10) Finally, why after over a year, has the city council not ordered Councilwoman Fitzgerald to release unredacted phone records from the night of City Manager Joe Felz’s Druken Ride as well as police body cameras for the entire event?

When you drive home tonight, count the potholes you hit and the homeless you pass, then ask yourself why Fullerton needs to spend ANY of its time and money getting into a pissing contest between Donald Trump and Jerry Brown.
We hear drums, drums in the deep. They are coming.

Fullerton’s general fund hemorrhaged cash over the last half decade, losing tens of millions of reserves, and now stands at the bare legal minimum. This blog, and others, warned Fullertonians of the looming fiscal cliff for some time, only to be dismissed by the powers that be as the hateful screed and wails from malcontents.
Some things in life are perfectly predicable. Things like physics and math. They’re not really that difficult to understand, but some people in our society are a little slower than others.
For example, next week there will be idiots who put a frozen turkey into a vat of hot liquid fat because #Merica. Despite many public service announcements to the contrary, stupidity will have its unavoidable and predicable consequences.
Tonight Fullertonians will miss out on the discussion taking place behind closed doors at City Hall concerning the state of the city’s budget. Voters won’t get to hear about the new contract negotiations designed to help the massive multi-million dollar structural deficit, the $100,000,000 in deferred infrastructure maintenance, or the equally massive unfunded pension debt. Instead, we’ll get a null report from The Other Dick Jones ™, and the facade of all being well will continue into this year’s planned First Night festivities.
Like so many idiots with a tank of propane, recent City Councils had fair warning of the current financial crisis. The math just isn’t that hard to understand. Every year, every single year, since each of their elections, Fullerton has spent more from the general fund than it has taken in. Tens of millions of dollars in reserves have evaporated. *POOF* gone, without a trace.
At the current rate, Fullerton may be bankrupt in two years.
This Thanksgiving, while you’re enjoying your non-idiot prepared bird, I want you to remember tonight’s secret city council meeting. I also want you to remember a meeting held just last year.
Just last year, the council authorized the largest pay raises for staff in a decade.

Well, the math simply doesn’t lie. The budget was not balanced and the city was not in excellent financial shape. Jen and Jan dunked their frozen bird and lambasted all the chronic malcontents who protested their fine stewardship.
*POOF*
Like that, Joe Felz hit a tree, and their financial bird exploded, the raging predictable disaster apparent for all to see.
Tonight the Fullerton City Council will likely authorize reducing pay and benefits for city employees, just in time for the holidays. When this is over, some employees will have their salaries reduced or their hours cut. Others will simply lose their jobs. Many of those individuals are good people who do good work. This isn’t their fault, but it will be their house that gets burned down and it will be their life that gets ruined.
Now Jen and Jan, two of those responsible for dunking this turkey? Don’t worry. They’ll be fine. Jen just gave herself a $9000 raise and Jan retired.
Dan Hughes’ career as police chief came to a pretty embarrassing end in November 2016. OCDA investigator Abraham Santos opined that Hughes criminally obstructed justice when he ordered Joe Felz be driven home without an arrest after the now infamous DUI collision. As a result, Santos is now fighting for his career, the result of him blowing the whistle on the OCDA’s refusal to press charges.
Like any politician who lacks integrity, Hughes always tried to portray himself as an upstanding citizen. How ironic because this past July, the Fullerton Police Department learned that a toll was never paid on SR-73 all the way back in December 2015.
You guessed correctly — the vehicle involved was the unmarked City-owned sedan assigned to Dan Hughes.
I haven’t included all of the e-mails back and forth, but suffice it to say, several City employees wasted numerous hours trying to pin down whose car it was, and to ultimately reduce the toll penalties due.
Hughes has a couple of options here:
Own up to his mistake. Reimburse the City for the toll and penalties due. Prove to his old department, his peers, current employees and Disney management that he really is a man of integrity. If this was an error on the part of the toll roads, offer some sort of plausible explanation of what happened that day.
Be a coward. Do and say nothing. Make the residents of Fullerton pay for yet another one of his failures. Hide behind the half a million he rakes in annually between CalPERS and Disneyland.
This will be really interesting because I fully expect him to choose the second option. I hope he proves me wrong.
It looks like I might be a “hater”. As one of only a handful of people to come out against the “Pine Forest Staircase” I’m going to make the leap that Fitzgerald is talking about me and therefore will respond accordingly.
Let us take the points in reverse order.
This is not a “New” community amenity as this is one of Fullerton’s oldest parks. All of those people who remember the Duck Pond aren’t having a massive shared delusion as it really did exist. The city let this park fall apart and is now trying to sell it as a win that they’re finally fixing what they themselves broke.

Fixing something you broke isn’t an act of respect. The city let this park fall into complete disrepair owing to budget constraints and poor management as folks like Fitzgerald prioritized six-figure pensions for her friends (Danny Hughes, Joe Felz, et al). To make matters worse the city council has yet to budget for more staff to maintain this park once it is completed. Add to that the likely budget cuts coming thanks to her (and her cohort’s) over spending on FPD/FFD Overtime/Pensions.
The Pine Forest Stairs are shoddily constructed and were significantly overpriced. “People like them and use them” Fitzgerald and her friends claim. Do you know what else they’d like and use? Better made stairs that cost less.
Something didn’t line up…
This type of fiscal deflection is ludicrous from an elected official who should be demanding the best bang for our buck and not running interference for developers. To be fair this is a common refrain from elected officials. One needs only listen to Bruce Whitaker justifying overpaying for a park because it’s in the “Gem District“. The council literally rewarded owners for their negligence at a premium price in the instance of Pearl Park.
This project isn’t restoring the park to it’s “original grandeur” as you do not restore something by completely altering it. This is a renovation and not a restoration. A bridge nobody will have cause to use is further destroying what was the duck pond and the pine stairs are totally new. Words matters and the idea that this is a “restoration” is an outright lie. Is the city putting the trees back into the park? No. They were too busy pumping water into Laguna Lake to bother putting any of it on the trees they let die and then had to remove.
And finally let us talk about Fitzgerald’s economic illiteracy here.
“A fantastic use of park fees”.
Park Fees are fees the city takes for new development. When the city allows a new mega-apartment complex to go up they collect a bucket load of money for the purpose of adding or improving parks. I’ve addressed this issue before here.
If this is a legal use of fees is debatable but is it a good use let alone a “fantastic” use of fees?
No.
This is nothing more than Jennifer Fitzgerald perpetuating the ‘Broken Window Fallacy’ as explained by Frédéric Bastiat.
I’ll sum it up simply.
The city council and city management broke Hillcrest park and are now using millions of dollars that could have been used to buy land in Coyote Hills or to fix our long neglected “Poisoned Park” or even to purchase Fullerton’s now most expensive park which Whitaker was all too happy to overspend taxpayer’s money upon.
This money is being used in the least efficient way possible because it is fixing that which never should have been broken. It wasn’t an accidental breakage either. Hillcrest Park has suffered decades of neglect as council after council ignores any semblance of accountability while generation after generation of overpaid bureaucrats toil away on grand schemes to fix what they should have been protecting in the first place.
Fitzgerald’s reasoning logically follows that we should neglect and destroy all of our parks in order to spend money fixing them. Wouldn’t that just be “fantastic”?
After years of unbalanced budgets we can’t really expect much more from Fitzgerald or the Fullerton City Council but that doesn’t mean we shouldn’t be outraged at their cavalier attitudes or sheer incompetence.
I still naively expect elected officials to work for what is in our best interest and to be able to explain away criticisms without resorting to childish colloquialisms.
Fitzgerald might be correct in that “haters will always hate” but it is also true that economic illiterates will never math.
