US Attorney General Sings Familiar Tune

We’re good guys. Or else…

A long-standing tradition of inveterate and knee-jerk police apologists here on FFFF is to suggest, with no subtlety at all, that they sure hope the cops or “fire fighters”come a callin’ when we are in need of them. Behind the hostility of the threat there lays a vague sense of entitlement that only a long-standing monopolist could love.

But is this the sort of talk that should be emanating from the mouth of America’s top cop, a lawyer who has sworn many times over to defend the Constitution? Apparently our AG William Barr thinks so. At a recent cop fest he uttered almost verbatim the same veiled threat to “communities” that don’t offer police their proper respect and deference.

Wow. It’s not enough for this bloated and corrupt sack of crap to turn looking the other way for his boss into a full-time job. He has now found it necessary to threaten citizens just like so many anonymous commenters on this blog.

 

Fullerton’s Veritable Serpico Problem

Fullerton, like most departments, has a problem reminiscent of Serpico and this problem is years in the making. This problem is part of the story of the sordid “Culture of Corruption” that was documented after the Kelly Thomas beating. This veritable Serpico problem is a cancer within the system where once in uniform even good people turn a blind eye to corruption and stand idle as their unions and water carriers work to stomp on both people working towards and laws aimed at transparency.

For those unfamiliar with Frank Serpico he was an officer in the NYPD who stood up against widespread corruption and suffered for this crime against the Blue Wall of Silence. When he was shot in the face in the line of duty his fellow officers went so far as refusing to call for help.

This reverse Serpico problem is the common issue of Officers refusing to speak out, refusing to stand up and refusing to be good ethical humans for fear of reprisals from their brothers and sisters in blue.

Today I want to tell a story that should have been told some time ago – the tale of how ethics can get you fired at Fullerton PD.

I’d like to tell you about one Corporal Paul Irish.

You see, Corporal Irish was fired for dishonesty. A year or so ago I spoke to Paul and I was given copies of the files related to his termination. Honestly I didn’t know what to do with what he gave me and I sort of let it sit waiting for the time to really dig into it. Life, kids, you know the drill. That box sat in my garage patiently waiting for me to have time. Skip ahead and, well, the city cost me my job recently and I find myself with more time on my hands. So I got to reading.

To sum up hundreds of pages of paperwork — what Corporal Irish DID was, allegedly, tell his supervisors he was giving a talk on seat belt safety when he actually gave a talk on ethics. When they hammered him for his dishonesty on what his talk was about they ran a full investigation into the issue which ultimately led to his termination for more alleged dishonesty.

FPD Manual Conduct

That’s a bunch of jargon so I’ll allow the Fullerton Police Department’s Policy Manual chapter on Conduct explain all that legal speak:

(h)Knowingly making false, misleading or malicious statements that are reasonably calculated to harm or destroy the reputation, authority or official standing of the Department or members thereof.

(i)The falsification of any work-related records, the making of misleading entries or statements with the intent to deceive, or the willful and unauthorized destruction and/or mutilation of any department record, book, paper or document.

(l)Any knowing or negligent violation of the provisions of the department manual, operating procedures or other written directive of an authorized supervisor. Employees shall familiarize themselves with and be responsible for compliance with each of the above and the Department shall make each available to the employees.

(n)Criminal, dishonest, infamous or disgraceful conduct adversely affecting the employee/employer relationship, whether on or off duty.

(z)Any other on-duty or off-duty conduct which any employee knows or reasonably should know is unbecoming a member of the Department or which is contrary to good order, efficiency or morale, or which tends to reflect unfavorably upon the Department or its members.

Remember, this all stems from Corporal Irish giving a talk on ethics that his supervisors didn’t approve of him giving and being mad at being “lied to” about said briefing.

This should be put into some context with current events in order to explain the aforementioned Serpico problem. When some cops are fired for seemingly trivial issues while others are given a pass for egregious conduct it sets bad examples. It tells Officers who to follow, which lies are okay and where things stand in regards to the Blue Wall of Silence. This is how a cancer grows in a department. A blind and subservient government is how it remains untreated and metastasizes.

This year, thanks to this blog, we learned that Fullerton PD and Fullerton City Hall worked to enter into an agreement in order to shield Lieutenant Kathryn Hamel from the disclosure of her crimes. The city was willing to stop investigations in order to protect her, the wife of Irvine Police Chief Mike Hamel, from any sustained findings of dishonesty which would have made her crimes public records under the CA law known as SB1421.

Currently there is an also an officer, Jeff Corbett, being charged with a felony for falsifying his reports as related to the drinking and driving of former Fullerton City Manager Joe Felz in November 2016. That Sergeant was only terminated after a friend of this blog filed a citizen complaint which triggered an investigation which led to a sustained finding of dishonesty. Only AFTER that investigation was concluded in September of 2017 did FPD open their own investigation and terminate Corbett.

These are current issues at the Fullerton Police Department as ignored by our current City Council, City Hall and police brass.

The hearings over Irish’s termination went through 2016 and well into 2017 while Sergeant Corbett was being given a pass for clearly violating department policy during the Felz incident. This is at best an inconsistent application of policy and a strong indicator of favoritism in the department – ergo, cancer.

If you think I’m being hyperbolic about comparing Paul Irish to Frank Serpico in premise, in the notion that the Department will crush one of their own to cover their corruption or incompetence – remember that I’m being sued, along with David Curlee and this blog, for allegedly clicking links and posting stories that showed police misconduct. Stories that showed the Kathryn Hamel deal. A story about a pervert cop at Fullerton High School that FPD and City Hall wanted kept secret. The city has never disputed those stories, or others – they’ve just demanded we remove the truth from this site while defaming us as thieves and hackers.

Your tax dollars are being used to punish us not because we allegedly clicked links and thus broke a federal law in the process. We’re being sued because we, yet again, embarrassed Fullerton PD by pointing out corruption and malfeasance and my records requests, if fulfilled as required by law, would embarrass them further. They’re using your money and the courts to intimidate and attempt to silence us because we again stepped out of line. We got in the way of the Blue Wall of Silence and both those in uniform and those in charge at City Hall are too self-interested and too cowardly to stand up for what is right. Too worried about their pensions, campaign dollars and cronyism to be ethical. They preach integrity and practice treachery.

Sadly the tale of Paul Irish is just another in a long line of such stories. A story of the government using it’s weight to silence dissent. A story about government arrogance crushing a voice even when it comes in the form of an officer talking about the things the Police Department hypocritically displays on their own walls. Ethics used during times of convenience are no ethics at all.

Fullerton Retaliates, Threatens Family to Cover for Bad Cops

For some lawyers, every problem is a nail. Don’t like what you see? Take it personally and swing a hammer as hard as you possibly can. Damn the consequences and damn the people involved, what matters is your pride and smiting that heretical nail.

Unfortunately for Fullerton taxpayers, that’s exactly the mentality of the legal wunderkind at Jones and Mayer. Annoy the city and get the legal equivalent of “See these fists? They’re getting ready to fuck you up.” We all know how well that strategy of bullying and brunt stupidity worked out for all of us the last time around. Yet here we are, repeating history, and somehow expecting a different result.

Many of you wonder why the many writers associated with this humble blog post under fake names. Some of us own property, some of us have kids, some of us have parents in Fullerton, and some of us own businesses in town. All of us have been threatened by city employees as a result of our participation in local politics. Most of us don’t want to have our lives turned upside down because we want the city to fix potholes instead of covering for employees who lie, cheat, steal, and occasionally beat members of the public. A few of us are made of tougher stuff and attach the real and personal consequences of speaking up for the public to their livelihood. Sometimes it’s a black sedan parked across the street from your house, sometimes it’s a little something special left in your trash can, others it’s anonymous letters sent to clients and employers, and for some (now former) contributors to this blog it’s literally two men dressed in black wearing a silver badge showing up on your doorstep at 11pm telling you and your wife it’s time to leave town. Most of you won’t believe any of that, but to one degree or another, every single one of us had something occur within six months of criticising a member of city council or a senior employee at the city or union. Fullerton plays for keeps, so keep your mouth shut or bad things will happen.

Why? Because if voters really understood that brass at FPD really do intimidate submitters of official complaints from women sexually assaulted by officers, really do lie under oath to protect those on their side of the thin blue line, and really do withhold backup from officers who report evil cops to internal affairs, they’d revolt and throw enablers like Jennifer Fitzgerald, Jan Flory, Doug Chaffee, and the recalled bald tires out of town on a rail. While the abuse at the fire department and non-public safety positions is comparatively much less severe, we still have evidence of employees drinking on the job, destroying city assets, stealing property, and using their official capacity to profit both on and off the taxpayer clock. This stuff literally happens every single month and FFFF is the only local information provider willing to publish accounts exposing just how bad things are.

Want to know why our roads look like shit? Well, read the archive. You’re not dealing with decision makers who are pure as the driven snow. They have a vested personal monetary and political interest to keep the public in the dark.

So, I put it to you reader. If you were a city official wanting to keep the voters in the dark, what’s the best way to make sure facts, accounts, or even just rumors make their way out into the public for consumption?

Clean up the city? Stop the lying, cheating, stealing, pussy grabbing, and beating of people?

Come clean and ask for forgiveness? Simply tell the truth about lying, cheating, stealing, pussy grabbing, and beating of people?

What about just locking it down and staying quiet. Just don’t acknowledge the lying, cheating, stealing, pussy grabbing, or beating of people?

Nope.

Fullerton goes with it’s version “WE ARE SPARTA!” method of attacking the messenger. Don’t like that your lying, cheating, stealing, pussy grabbing and beating of people is getting out in public? Break the knees of anyone telling that story and your problem gets solved real quick. After all, if it fails, it’s not like you’re going to jail for wrecking someone’s life.

Last week, one of our writers Joshua Ferguson, announced he had filed suit to get access to documents Fullerton is legally required to produce concerning city employees lying, cheating, stealing, pussy grabbing, and beating of people. Guess what FFFF received a week later as a direct consequence of standing up to the entrenched and belligerent interests at city hall?

That’s right, two of our named authors are being sued. Along with an employer.

Why? Because the city knows exactly what will happen. Screw mortgage payments, screw tuition bills, and screw putting food on the table: You didn’t shut up when we told you to, so now we’re doing to take your whole fucking life away because we can. Enjoy these fists fucking you up. Good-bye paycheck and hello desperation.

In the end, perhaps the court will see this isn’t even a thinly veiled attempt to attack the public’s right to know, free speech, and the fundamental precept that the government shouldn’t use its resources to go about wrecking lives. If that happens, it will be years or months from now, you will pay the bill, and the damage caused by Jones and Mayer swinging their hammer will be done. This blog has 3236 articles and counting. Hundreds of news stories emanating from bad things at city hall were broken here. All of that threatens to come to an end because our writers won’t risk being attacked by the local powers at be for telling the truth.

Be that as it may reader, remember this: Your roads look like shit because people like Jennifer Fitzgerald and those who support her would rather spend her time attacking messengers and threatening families than make hard choices about how big the raises should be for those who endorse her campaigns for office.

This is your Fullerton. If the endless supply of stories concerning lying, cheating, stealing, pussy grabbing, and beating of people hasn’t gotten your attention yet, maybe this latest round of intimidation will. In the meantime, your roads are as shitty today as they were yesterday, and they’ll still be shitty tomorrow when this lawsuit moves forward.

Fullerton School Board Ignored Issue of Campus Police Pervert

For those of you paying attention to the story of Perv Cop Paez, I’ll direct your attention to some correspondence with the Fullerton Joint Union High School Board of Trustees from back in December 2018 when rumors of this story first came to light.

This is an email a friend of ours sent to each member of the school board:

Hi,

I just heard a rumor that a school officer working with Fullerton police, officer Paez, had naked photos of at least one student on his phone. If the student is underage I understand a name not being released but how many victims are there and do I need to be worried about my children?

Should parents be concerned about their child being victimized?

Is this true and if so is the school district covering this up?

I would hope that you learned something about honesty after Lindgren molested students at Nicholas. Please let me know if these allegations have merit and that Fullerton isn’t in the habit of covering up sexual predators.

So there you have it folks. A Fullerton Police Officer, in his capacity of School Resource Officer, was allowed to roam campus unchecked, film up the skirts of teachers and students, delete his own Body Camera videos with no oversight and allegedly store child pornography on his (department issued?) phone and you the public get to know nothing.

The Fullerton High School Board of Trustees won’t even bother to respond to you if you’re concerned about such things as predatory officers abusing their power to peep on your daughters.

To this day the school board has remained mum, the police chief put out a press release extolling his own virtues and you can bet our useless council will pat the department on the back for the bare minimum that was accomplished here.

How many students were victims of Fullerton PD while on campus? How many have a #PaezMeToo story to tell? Are your kids safe from predators while on campus? You don’t have a right to know according to the Fullerton Joint Union High School Board and Fullerton Police Department.

Fullerton Officer Paez Charged with Filming up 16yo Student’s Skirt

Former Fullerton Police Department School Resource Officer Jose Anthony Paez has been charged with a misdemeanor.

From the District Attorney’s Press Release:

FORMER FULLERTON POLICE SCHOOL RESOURCE OFFICER CHARGED FOR VIDEOTAPING UP HIGH SCHOOL STUDENT’S SKIRT

SANTA ANA, Calif. – A former Fullerton Police Department school resource officer has been charged with secretly photographing and videotaping up the skirt of a 16-year-old high school student.

The Fullerton Police Department initiated an internal investigation into accusations that Officer Jose Anthony Paez was acting inappropriately while on duty. The investigation spanned the last five years of the officer’s on-duty interaction with the public.

The internal investigation revealed several photos and video clips taken on Paez’ personal cell phone in November 2017 that were shot up the skirt of a 16-year-old high school student while Paez was conducting a police investigation on school grounds.

Paez stopped working for the Fullerton Police Department in May 2019. The Fullerton Police Department referred the case to the District Attorney’s Office for criminal prosecution.

“As the elected District Attorney, I am charged with judging the conduct of police officers,” said Orange County District Attorney Todd Spitzer. “Law enforcement officers are entrusted with a tremendous amount of authority and trust. The actions this officer engaged in betrayed that trust and preyed on the very people he was charged with protecting.”

Paez is scheduled to be arraigned on October 2, 2019 at the North Justice Center in Fullerton. He faces a maximum of one year in the Orange County Jail if convicted.

Deputy District Attorney Laila Nikaien is prosecuting the case.

A quick phone call to the DA’s office reveals that Paez is being charged with PC 647(j)(2):

“(2) A person who uses a concealed camcorder, motion picture camera, or photographic camera of any type, to secretly videotape, film, photograph, or record by electronic means, another identifiable person under or through the clothing being worn by that other person, for the purpose of viewing the body of, or the undergarments worn by, that other person, without the consent or knowledge of that other person, with the intent to arouse, appeal to, or gratify the lust, passions, or sexual desires of that person and invade the privacy of that other person, under circumstances in which the other person has a reasonable expectation of privacy. For the purposes of this paragraph, “identifiable” means capable of identification, or capable of being recognized, meaning that someone could identify or recognize the victim, including the victim herself or himself. It does not require the victim’s identity to actually be established.”

The DA’s office seems to essentially be charging him with peeping when there are questions of possession of child pornography in the audit conducted by Fullerton Police.

The Fullerton Police Department issued a Press Release written to show how awesome they are and how committed to openness and accountability they are – despite have little to no details in the release itself.

The closest we get to details is as follows:

“When the criminal investigation concluded, Fullerton detectives requested the Orange County District Attorney’s Office to review the case for filing criminal charges against Officer Paez, whose employment with the Department ended in May 2019.”

Notice how as don’t even get to know if Paez was allowed to resign or if he was fired. The Press Release then goes on to extoll the unearned virtues of FPD:

“We are committed to being first to hold accountable those within our organization who do not meet the high standards we set for ourselves. That is exactly what happened in this case.”

This is the same city/department that worked out a settlement agreement with an officer to expunge Internal Investigations into her conduct specifically to bypass disclosure laws.

That settlement agreement, and this story about officer Paez are two of the things we wrote about a couple of months ago are some of the stories that led to the City of Fullerton threatening us with prosecution for telling you things we think you have a right to know about but they want kept quiet.

Prepare for City Manager Ken Domer, Police Chief Bob Dunn and the entire council and school board to keep you in the dark as this “ongoing case” works through the system. The city has yet to even give us a date for when Paez left the force or who’s phone the child pornography that FPD found in their audit was on – Paez’s personal one or his department issued phone. Nor have they explained why an officer had student sexts and underage pornography on any device so easily accessed.

Is this just another case of a badge giving somebody a slap on the wrist when a civilian would have been prosecuted to the full extent of the law?

For some people the release of video showing  the “justified” July 5th shooting of a female teenager by a Fullerton policeman is cause for celebration. Well, we can store that information in the Sad Troll folder and move on. Really, though, one must linger over the sad state of affairs when the FPD has to broadly publicize the fact that their man didn’t kill anybody illegally, with malice or by incompetence.

What a difference eight years make, right? For on July 5th, 2011, and in the months following, the FPD made every effort to hide, lie about, obfuscate, deflect, and misdirect information in the wake of their illegitimate killing of the homeless man, Kelly Thomas.

Has the FPD opened a new chapter in its relationship with the public that supports it?

Maybe. I don’t know, but I doubt it.

When there is exculpatory evidence, it seems, the police are only too happy to release information; thus, within one week of the recent event, the dead teenage girl’s demise was the subject of an FPD press video, complete with  slow motion footage showing what happened. And yet when police actions are reckless, incompetent, or even criminal, the PR apparatus retreats into the bunker and cannot say a word.

We’re gonna kick your ass…

This is the twisted legacy of former Chief Pat “I Hired Them All” McKinley and the goon squad he imported from the LAPD.

What we have here is failure to communicate…

As we saw with McKinley’s second successor, Chief Danny “Galahad” Hughes, when something bad goes down the department has taken the position that the best medicine is not overdue reform, clean-up and real accountability, but a stiff dose of community relations and departmental tours. This, even as Hughes himself participated in the most dubious undertakings.

We aren’t very nice, but we sure are expensive…

Maybe someday police departments like FPD will come to realize that covering up for bad police work is itself bad police work; that the public that pays for their salaries, benefits and early “retirement” ought to be served instead of abused; and maybe, just maybe, people in California will start getting honest answers and timely, truthful information instead of phony or non-existent “internal” investigations, shifting stories, and outright deception from the police.
