The Second Try

Nothing says 1962 like Fullerton City Hall

Back in 2020 our Lords and Masters at City Hall cooked up a plan to impose a sales tax increase upon people buying stuff in Fullerton. It was staff-driven natch, and lazy liberals Zahra, Quirk-Silva, Flory and Fitzgerald were on board. It was called Measure S. See, they figured the path of least resistance was deploying a new tax rather than finally exercising fiscal restraint.

Measure S Covid Lie
The Big Lie

Measure S soon found itself in the crosshairs of Fullerton anti-tax advocates and some well-placed signs describing the true nature of the beast doomed it to failure come election time.

Well guess what? They’re at it again. This time the idea is something called a Pension Obligation Bond, a mechanism for paying off part of Fullerton’s massive unfunded pension actuarial liability at CalPERS, the State’s giant pension administrator.

An introductory briefing was on the Council’s agenda last Tuesday to start the cheerleading process – a process that will entail the employment of an “expert” who will certainly benefit from a positive result; and of course “bond counsel” the legal camp-followers who push bonds on lazy elected officials after a hot meal and a few glasses of wine.

As everybody knows, the interest on the bonds are ultimately backed up by the collateral of new property taxes. This revenue would go to pay down the pension debt and free up money owed to CalPERS for staff salaries and benefits that will ultimately, and ironically, increase pension debt.

Here’s the second kicker: because a pension obligation bond is not deemed new debt, per se, but a sort of pea-under-the-walnut shell maneuver, no vote of the people is required – as it is in the case of general obligation bonds. It just gets “validated” by a judge and goes through on the nod unless challenged. Ouch. Of course the Council, if it wanted to could put the issue on a ballot anyhow, if they chose to move ahead with this scheme.

Of course the strategy for this type of thing is to reprimand opponents by citing the fact that the daily cost is little more than a Big Mac, or some other trifle and in return we get…what do we get again? Our loyal and devoted “public safety” club will almost certainly gobble up the lion’s share of this taxpayer largesse, just like they already do, and we’ll be even worse off than we already are, and no desperately needed cultural changes will have been made.

I looked over the agenda material on line and found nary a clue as to how this was even agendized. Another smoke screen protecting somebody.

Joe Felz’s Wild Ride -The Full Monty

Starring former Fullerton City Manager, Joe Burt Felz who got drunk on Election Night 2016, drove over a tree, and tried to escape from his own cops. There is something sort of pathetic about Felz, errand boy and water bearer for Jennifer Fitzgerald, saying over and over that his turn blinker wasn’t working and how he became befuddled, until one of his own policemen tells him to stop yammering about it.

As one of the cops said: “it’s the Chief’s call.” Subsequently Chief Danny “Gallahad” Hughes lied to the Council about the affair even as Felz tried to quietly pay for the tree and move on.

The City of Fullerton tried for years to keep this under wraps because it implicated our MADD rewarded police themselves in incompetent and illegal activity. FFFF sued the City to get the videos, and in retribution two bloggers were personally sued by the City for legal activity, a lawsuit that cost the taxpayers hundreds of thousands and that finally exonerated David Curlee and Joshua Ferguson.

Mayhem Continues in Downtown Fullerton

Hook ’em horns…

The Florentine Mob may be gone; the douchebag Jeremy Popoff has popped off somewhere; but the battlefield known as Downtown Fullerton – created and nurtured by our own government is still in fine form. And by fine form, I mean gunfire.

The FPD has announced that it has apprehended one of our stand up DTF patrons who allegedly fired shots a the JP23 “restaurant” following an altercation therein.

Somebody got shot. Here’s part of the cop’s statement (self-congratulatory bullshit omitted):

On Tuesday, July 6, 2021, at approximately 1:03 AM, Fullerton Police Officers responded to 101 S. Harbor Boulevard, JP23 Urban Kitchen and Bar, regarding a subject who had been shot.

Upon arrival, Officers located a 24-year-old male with a single gunshot wound. Officers immediately rendered aid to the victim, and he was transported to a local trauma center. It was determined the gunshot wound was not life-threatening and the victim was expected to survive.

So once again the establishment known as JP23 finds itself in the middle of crime, although most of the crime at this place comes from the refusal of the owner to obey the Fullerton Municipal Code and his own Conditional Use Permit.

Oh, well. I guess there’s a certain amount of psychological reassurance that some things just don’t change. And mayhem in Downtown Fullerton appears to be one of them.

Fullerton’s Nuisance Noise and The Ongoing Saga of Incompetence and Corruption. Part 2

Al Zelinka. Failing to the top.

In the past 10 years or so, Fullerton has had four different planning directors: Al Zelinka, Karen Haluza, Ted White, and most recently an individual named Matt Foulkes. Pop quiz: what else do these folks have in common?

Haluza. The closer you looked, the worse it got.

Time’s up. Answer: none of them enforced the city’s noise ordinances, and each seemed to be dedicated to ignoring zoning and land use regulations in downtown Fullerton. We’ll get to the “why” of it in a later post. For now I want to point out the trajectory of this mess. As scofflaws like Jeremy Popoff’s odious Slidebar and the Florentine Mob’s various enterprises refused to comply with our laws, the Planning Directors noted above began an ongoing project to lower and lower the legal bar until even the lowest nematode could wriggle over it.

Ted White didn’t leave his fingerprints…he thinks…

Now if we contemplate this downward spiral of our “experts” in the Planning Department and Code Enforcement we notice that it hit a virtual rock bottom in January 2019 when Matt Foulkes pretended that he didn’t know what a property owner was and approved the submission of an official document forged by Joe Florentine pretending that he, Florentine, was an “owner.”

Matt Foulkes. The downward spiral is complete.

Of course all of this malfeasance was amply documented here on the FFFF blog. And guess what? Nobody in City Hall cared; or to be more precise, nobody cares, still. See, in Fullerton incompetency and blatant corruption are so common on the part of our City Attorney, Dick Jones and the cadre of drunk, venal and just plain dumb City Managers and staff that our threshold for outrage is as low is almost worn away.

But not quite. Stay tuned for noise. And by noise I mean the noise generated by city staff to ignore, dilute, obfuscate and dodge the Noise Ordinances.

Friends for Ferguson Family’s Future

Many of you have asked how to help our named bloggers sued by the City of Fullerton for doing nothing more than telling the truth. In addition to being absurd, the City of Fullerton also decided to be cruel and named one of our blogger’s employers in their ridiculous lawsuit without cause or merit, which resulted in said blogger’s unemployment. It’s likely the city’s onslaught will continue for months if not years.

The First Amendment exists to prevent this exact occurrence: Government using its considerable resources to destroy the life of individuals who criticize those in power. Here we are in 2019 watching it happen. Joshua Ferguson and his wife have three children. As a result of the city refusing to accept responsibility for its actions and instead accusing Ferguson of being a criminal; rent payments, Christmas, and the basic necessities of life are all under serious duress.

Fellow Fullerton Friend and Fullerton Parks and Recreation Commissioner Erik Wehn established a fundraising page for Joshua Ferguson this morning. We encourage all of you who value speaking truth to power and our fundamental American liberties to donate to the Ferguson cause. I don’t have to tell those of you who know this particular family that the Fergusons value their own hard work and being put in a position to accept charity is extremely difficult, but desperate times call for corresponding measures.

Joshua Ferguson has taken on corruption in the city of Fullerton and needs your help!

Last week Joshua Ferguson announced he had filed suit to get access to documents Fullerton is legally required to produce (thanks to CA Senate Bill 1421) concerning police lying, cheating, stealing, molesting, and beating of people. Guess what he received a week later as a direct consequence of standing up to the entrenched and belligerent interests at city hall? A retaliatory, anti-First Amendment lawsuit including Joshua and his employer, who had no involvement in what the suit alleges.

Not wanting to cause harm to his employer of ten years, Joshua resigned.

Now Joshua has a very expensive fight ahead of him and a family to feed.

Out of concern for his family, Joshua hesitated to take this fight on, but he wants his three kids to learn to stand up for what’s right, no matter the risk.

Now it’s our turn to do our part, uphold that principle, and remind others that if you fight the good fight you won’t be alone.

Please consider donating what you can to help Joshua fight the culture of corruption in Fullerton.

Erik Wehn

We often take for granted the cost of defending our right to free speech. It’s hard to miss the young men and women fighting for our country, but it’s easy to miss the patriot at the podium during a town council meeting who gets abused by the state for exercising a fundamental right.

Not all of us are brave enough to stake a personal cost in the fight for freedom. Joshua’s wife and three kids will personally bear this burden for us, the very least we can do is lighten the load.

Donate, help Ferguson fight back, and share widely.

Flory’s Indecent Exposure

When Jan Flory came back to council she extolled her virtue of no scandals – and then her son Mike clearly decided – Challenge Accepted.

Mike Flory Photo

We really don’t want to write about this issue but it’s one which points to a pattern of problematic behavior that needs to be addressed. A pattern of behavior by a man who works around minors for the OC DA’s office and was recently convicted of PC 415(2) – Disturbing the Peace – in a case that originally involved a battery charge, PC M242, allegedly against a minor.

This new story is pretty simple. Somebody wanted a photo of Tickle from the show Moonshiners and that somebody asked the question of the wrong Mike. Instead of sending the message to Mike [Redacted] they sent it to Mike Flory. And instead of getting a photo of Tickle they got a photo of Flory’s junk.

To make this news it needs to be stated that that somebody – was Mike Flory’s niece.

Our victim’s own 8yo daughter was sitting with her when the offending message came in and she quickly deleted it so no, we will not be showing the photo here on FFFF but to satiate your dirty bird desires here is a stunt cock:

A Better Cock

When his niece, who we should clarify was a flower girl in his wedding, got upset he doubled down claiming to want to “get up in those guts”. To his niece.

Now we’re no prudes and we normally don’t care who sends what to whom consensually – but this was an unsolicited genital pick sent to a family member. All from a man works for the DA’s office in the Juvenile justice department.

How do we know this happened absent the photo? We had to verify a few things.

First we have the messages that came after the offending photo:

Flory Call Log 01

Flory Call Log 02

You’ll notice on that first screenshot that the phone # is 714-305-5648. How do we know that’s Mike Flory?

Well, that was a small problem. As many of us have to remain anonymous here on FFFF due to retaliation and threats we didn’t exactly want to call a Deputy DA so we punched the number into the internet and up camethe State Bar of California website with:

Mike Flory State Bar

The allegation then is that Mr. Flory is sending unsolicited dick pics from the phone # he has registered with the State Bar of California. Before people start complaining that this is Doxxing, no it isn’t as Mr. Flory has provided this to the State Bar as public information and it is easily searchable as just demonstrated.

But there’s no photo so how do we know one was sent? That’s what call logs are for:

Flory Call-Log

We wanted to make sure there was a “there” there before running this piece and after some due diligence have every reason to believe that this happened as described to us based on the phone calls and texts we have had with Mr. Flory’s niece as well as the supplied evidence and a few character witnesses we have spoken to in the last few weeks.

This is an issue of integrity and ethics but also one of propriety in a District Attorney’s office which has been plagued with years of scandals, cover-ups and bad actors. This is a chance for our new District Attorney, Todd Spitzer, to show us that he doesn’t tolerate such behavior in his ranks and that he expects his staff to be better examples to the public they serve. To be humble and apologetic instead of sickos with no sense of shame.

We offer this as a challenge. The ball is in your court Mr. Spitzer. Are you going to continue the sordid legacy of Tony Rackauckas and stand behind such behavior or are you going to try to finally bring some dignity to the OC DA’s office? We and many others will be watching.
