Will Ahmad Zahra Hold Firm?

Back in December, in his first at-bat, Ahmad Zahra surprised me by speaking of the Constitution and transparency whilst simultaneously voting against FitzSilva in their attempt to appoint Jan Flory to Council. Zahra was on fire with gems such as:

“My decision is going to be contingent upon us making sure that the appointment process is fair and open and transparent. So until we can make that decision, I don’t see how we should take votes away from people.

“The question is, is there a fairer and open and more transparent process than voting itself? Can we come up with that? Can we come up with something better than what the Constitution come up with? That is my question for the council. I’m leaving my decision until I hear other council members.”

Tonight we get to find out if Zahra is a man of principle standing by his own talking points at the last meeting or if that was all simply a clever flex to show who has the real authority on this issue in an effort to get his preferred pick onto council.

For those new to the story here’s the gist as I understand it —

Jesus Silva wanted incumbency in 2022 and thus opted to run for the District 3 seat on council.

Council then chose to change the law ON ELECTION DAY in the case Silva beat Sebourn in order to limit the options for voters.

Silva took home the ring on election day and in winning he vacated his at-large seat which runs until 2020.

Then in December the dynamic duo of Jennifer Fitzgerald and Jesus Silva testily complained that they needed Ahmad to go along to get along in order for them to get what they wanted. Zahra didn’t go along which brings us to today.

Tonight we’ll watch as FitzSilva likely tries to lay it on thick and blame Ahmad for the cost of the election should he choose transparency and an election (as he did back in December). This is posturing bollocks but I’m wondering if he’ll stand firm. Both he and our residents need to know that the fault here lies partially with Silva for running, partially with council for changing the city ordinance, ON ELECTION DAY, to facilitate this choice between the devil and the deep blue sea, but really the fault lies with our City Attorney The Other Dick Jones for offering terrible advice and putting us in this situation in the first place. Zahra is blameless here on the issue of cost should he choose openness and transparency by way of a special election.

Prepare for the same shenanigans with FitzSilva promising a fictionally transparent process in this city which is allergic to the very premise of transparency. The same transparency which had Jan Flory meeting with at least 2 (if not 3) current council members and bringing a cabal of people to lobby for her to be appointed without the citizenry any the wiser. THAT type of so-called transparency should be rejected and here’s hoping that Councilman Zahra continues to impress the way he did during at his last at-bat.

A Hill. Wrapped in Plastic

A few weeks ago while at a local eating establishment in the Downtown area a gentleman stopped me by name, which isn’t always a good thing in malcontentville, and asked me to inquire about the plastic sheeting up near the YMCA.

You may have seen it while driving North on Harbor Blvd:

So ask I did. Here is the recent answer according to some undisclosed source at the Public Works Department as communicated by the Clerk’s office:

“Plastic sheeting the slope on Harbor Blvd is done with City staff and costs about $12,000. We have been sheeting the slope for 6+ years.”

I’ve not sent in followup requests for invoices or details about this particular project but I’m sure if somebody wanted to do so the city would be happy to explain why spending at least $72K for this particular issue/area is the best solution and has been the best solution for over half a decade.

What say you friends? Is this project worth $12k/year for who knows how long?

More for Less in Public Works

It looks like Fullerton is again in the business of paying more for less when it comes to hiring bureaucrats to bureaucrat. One of our newest hires, Mary “Meg” McWade, who is set to replace Don Hoppe is going to be paid $195,000 + bennies. This despite some questions about qualifications.

Being that the Director of Public Works is also the City of Fullerton’s “Civil Engineer” it is preferred that our Director be, well, a certified engineer.

It’s SB1421 Day

Today is the Day.

Today Police records are supposed to become a little more transparent and officers with “sustained” complaints (and a few other issues) get to share with the world their bad deeds by virtue of some Sacramento mandated sunshine disinfectant. With SB1421 to the rescue we might finally get to see what happens behind union closed doors when officers misbehave.

The law changing and becoming effective today, owing to the holiday, convinced some friends to put in a few records requests based on suggestions which we complied and others which were emailed to us after this post dropped.

Thanks to everybody who shared what they knew and pointed us in a few interesting directions. I was copied on the request and it contains over 40 officers both current and former, most of whom we believe to have had sustained findings against them. Because police departments refuse to tell us who has findings against them we had to take quite a few guesses based on the best information we could obtain. That or pay FPD $250+ to maybe compile a list per their Public Information Officer.

Being that we’re volunteers who don’t run ads or try to monetize FFFF we opted against the $250 check to FPD.

With the requests in the virtual mail we should be seeing some interesting things provided that the records aren’t obfuscated, buried and denied. We’ll keep you posted as things come back or don’t.

We’re also always open to suggestions so if we missed anybody let us know the details in the comments or via email. Who did what and where should we look? What officers had sustained findings in other departments? We’ll send requests for those records as well.

Who Are the Bad Apples?

Over the years we here at Friends for Fullerton’s Future have written about what feels like countless stories on the culture of corruption. A lot of facts, some rumors and a lot of annoyance as the city, police department and union goons do everything in their power to keep all of us from knowing anything even slightly negative happening behind the badges of our betters.

Well, on January 1st, 2019 California law changes to allow a little bit of information to eek its way past the Blue Wall of Silence. Thanks to the usually ridiculous California legislature and soon to be former Governor Jerry Brown, we’ll be able to learn about some of the actions perpetuated by some of the officers around the state. Here’s the law in question.

You’ll want to read section C and the bits about lies and dishonesty. I previously had it quoted it here but it’s too much legalese to blockquote. Basically if it’s proven that a cop lies or falsifies a report you can get the records of those findings.

This is Fullerton’s best and brightest.

Seriously, according to Fullerton’s own Comprehensive Financial Audit Report, as received and filed at council last night, we’re in the black because we’re understaffed and we only hire the best.

Or, rather:

“Expenditures decreased $1.5 million over the prior year due to increased vacant positions as a result of increased hiring scrutiny and the region’s competitive work force with low unemployment.”

We might need to work on that increased scrutiny thing what with alcohol related shenanigans being such a problem at FPD lately.

Roseler-Stabbing-Investiation

A few months ago an unnamed Fullerton Police Officer was allegedly stabbed in Placentia by an unidentified “Hispanic male”. Four agencies swarmed (Placentia PD, Fullerton PD, CSUF State Police & OC Sheriff’s) and a suspect was picked up, had his info blasted on social media and in press releases — only later to be cleared and released.

This is where all four agencies left things and no new information has been publicly presented.

Here are the relevant news stories.

Per CBS (22 Sept):

The Fullerton Police Department, Orange County Sheriffs Department and Cal State Fullerton Police Department, made an extensive search of the area.

Officers detained and later arrested a parolee named James Carrera, a 19-year-old Placentia resident. Carrera was booked on an assault with a deadly weapon charge.

Police did not know if the officer was targeted but they said Carrera was out on parole for weapons violations and possibly knew the officer.

Per OC Register (23 Sept):

The victim was released hours after being treated at a local hospital for non-life-threatening injuries, according to Fullerton Police Lt. Tony Rios. He said the injured officer was at home recovering the day after the attack and is expected to return to duty in the next few days.

“I spoke to him this morning and he seems to be doing well,” said Rios. “He’s a strong young guy and he should be back soon.”

Per KTLA (23 Sept):

Investigators described the attacker as a Latino man in his late-teens or early-20s, of thin build. He had short, black hair and wore a baggie, black T-shirt.

Rumors lately have it that the officer made up the “Hispanic Male” and has been put on admin leave with nary a word or apology by the cites or agencies involved. Apparently now we’re hiring Leopold “Butters” Stotch’s mom at Fullerton PD:

Alas, that might turn out differently because ultimately Mrs. Stotch confessed. Instead we now actually know, thanks to diligent records requests, that the officer in question is one Nathan Roesler.

Circumstances of the Case

  • On Aug. 24, 2018, Hendricks and Oliveras were off-duty and attended a concert in Irvine with their spouses. Hendricks’ wife needed medical attention and EMTs responded to assess her condition.
  • Hendricks is accused of pushing two EMTs as they attempted to provide treatment and Oliveras is accused of putting one victim in a headlock.
  • The Irvine Police Department responded to the scene and the defendants are accused of obstructing and delaying the investigation.

This is Why Chief Hendricks Resigned

Today the City of Fullerton put out a Press Release stating that Fullerton Police Chief David Hendricks was resigning. They extolled the virtues of his employment and when I called to ask about the resignation I was told that I was making an assumption that the Chief was resigning owing to his current leave of absence and possible criminal prosecution.

Let us clear a few things up here for the record.

First and foremost the City, per their Public Information Officer, agreed to waive the contractual requirement that Hendricks give 45 days notice upon his written resignation. It allowed them to appoint Acting Chief Dunn as…. Interim Chief Dunn, a distinction without a difference, unless you happen to have a pension stored at CalPERS.

Second, despite the Chief being on leave for over 2 months, this was announced on a Friday when City Hall is closed. Want further details? Too bad, you’re gonna have to wait until Monday when everybody is focused on Tuesday’s Mid-Term Election. This is government document-dump obfuscation 101. You don’t release information in this fashion unless you’re trying to bury the news and avoid answering questions.

Why did the City agree to waive the 45 day requirement? Why was this done now being that we already have an acting chief? Why didn’t the city work to fire Hendricks for contract violation owing to the ongoing investigation? What is the status of that investigation?

No clue. No responses. No answers. Gonna have to wait until Monday folks, sorry.

Let this be an abject lesson that City Manager Ken Domer does not believe in transparency contrary to his public and private statements. I had high hopes for Domer, but alas he is proving himself to be just another bureaucrat working to keep the bureaucracy funneling money into his and his cohort’s retirements. Don’t expect our tired and constantly campaigning City Council members to ask any of these questions or work to make things more transparent.

We want answers and I’m sure you want answers as well and thanks to an anonymous source from the great beyond we have some details that the city will never tell us because reasons.

Here is the redacted (for privacy) and highlighted (by me) highlights of what really happened at that Lady Antebellum concert back in August and why our Chief decided to resign with no notice.

Election Meddling – Silva’s $400,000 Arrogance

Make taxpayers shell out $400,000 or meddle in an ongoing election.

Pick one.

That’s the quandary in front of our city council tonight in the form of agenda item 4:

4. FULLERTON MUNICIPAL CODE AMENDMENT REGARDING CITY COUNCIL VACANCIES
Consideration of an ordinance to repeal Fullerton Municipal Code Section 2.02.020 and follow procedure for filling City Council vacancies as set forth in Government Code Section 36512.

Without getting too much into the weeds the problem the city is trying to address is specific to the costs and ramifications of Jesus Silva winning the race for the District 3 council seat.

The voters in District 3 have 3 choices on their ballots; Greg Sebourn, Jesus Silva & Nickolas Wildstar. If either Sebourn or Wildstar wins this municipal code change does nothing in the foreseeable future.

If Jesus Silva wins then he vacates his current At-Large seat and we, by law, must hold a special election. That special election could cost us between $391,532 – $428,150 per the OC Registrar of Voters.

Silva likely didn’t even know he was risking socking the taxpayers with that hefty bill until somebody else pointed it out to him. Or perhaps he just didn’t care. That his wife was on council when the to be repealed ordinance was passed points more towards didn’t care than didn’t know.

We went through 2017 knowing this was an issue and the City Manager couldn’t be bothered to deal with it. Then most of 2018 came and went. Nothing. Instead of worrying about a near half a million dollar liability Ken Domer had the council worrying about which volunteers to fire from the various boards and committees around town. As a former member, I’m glad the Economic Development Committee is gone but if you’re going to muck with the municipal code perhaps worry about the parts costing us, or potentially costing us, real money before worrying about a committee that rarely met because it rarely had quorum.

Now this issue is on the City Agenda for the coming City Council meeting tonight. During an election.

Yes, the election is on 06 November but absentee ballots are already in the mail and thus the city is asking council to change the rules of elections DURING AN ELECTION. People will have already voted in District 3 BEFORE the council decides what to do tonight.

This is ridiculous.

I don’t want the city to have to spend $400,000 to fill a vacated seat if Silva wins in District 3. However – and this is a big however – Jesus Silva decided to run knowing that his run could cost us that much money and he did it anyways. That he did it anyways speaks to his character.

That is a political consideration and changing the rules during the election screams of a partisan fix to a problem Silva could have avoided by not throwing his at-large seat away in the quest for 2022 incumbency. Voters make decisions on issues that cost and matter less than $400k and deserve to judge this issue without council interference after the fact.
