Whitaker Re-elected to OC Water Board

Last night the City Council voted to appoint Bruce Whitaker To the OC Water District Board of Directors. The term of the previous incumbent, Ahmad Zahra had expired at the end of 2020.

The vote was 3-1-1, with Whitaker, Jung and Dunlap voting for Whitaker; Zahra nominated and voted for himself; Jesus Silva decided that discretion was the better part of valor, and abstained.

It was not for lack of trying to keep this paying gig that Zahra relinquished his job. No, Indeed, for a line of scripted commenters tried valiantly to praise Zahra to the Heavens, why, Good God! The man practically invented water!

The funniest commenter was none other than Fullerton’s Mistress of Disaster, Jan Flory, who joined in to share in the hosannas for Zahra. She read her script okay, but it included her statement that Zahra had actually authored articles about water,,,for the Fullerton Observer.

Whitaker was clearly the better choice. The water board has jurisdiction over the aquafer on which we sit. The district has massive financial reserves paid by us in ad valorem taxes. And in the past decade the OCWD has been at the center of a massive rip-off called Poseidon, a desalinization scam meant to provide more water to OC county for the purposes of south county development.

Unlike Zahra, Whitaker will not posture on the board for publicity and to be able to pretend some imagined expertise. He won’t use the agency to promote his own agenda and his own political prospects. And Whitaker is not currently charged with crimes by his own police department; nor is he under threat of recall by his district constituents.

The recall against Fullerton City Council member Ahmad Zahra has cleared the first hurdle and the required number of signatures on the “Notice of Intention” have been verified by the Fullerton City Clerk.

The reasons for recalling Zahra, for those new to the story, are that he lied to his constituents and that he’s charged with vandalism and battery against a woman. From the copy of the Notice of Intention I was sent:

Soon the question of removing Zahra from office will head to the voters of Fullerton’s District 5. Ultimately they will decide if a man accused of battery against a women should be allowed to continue to serve on Fullerton’s City Council.

Until then our council needs to decide if he should be allowed to represent Fullerton on boards and commissions going forward. Do we want him as our public face right now in light of his pending criminal charges? Or should we look to public servants to have honesty, integrity and to stand up for what’s right?

There are a few more procedural hurdles before the fine folks of District 5 can sign the official recall petition to force an election to remove Zahra from office.

Parks Director Told to Hit Road

Today the City Manager, Ken Domer notified the Parks Commission that he was canning Hugo Curiel, the guy who’s been in charge of the Parks Department for 7 years, or so. Here’s the mealy-mouthed text:

So there was “no one single issue” leaving us to wonder what the real reasons were for letting Hugo go-go. We know it wasn’t the extravagant waste of money on a Hillcrest Park bridge; we know it wasn’t for the incredibly bungled wooden stairs project; we know it wasn’t because he ignored maintenance of existing parks; we know it wasn’t for the Strange Case of the Flipped Over SUV; we know it wasn’t because he proposed almost a million bucks to buy a 15,000 square foot lot to build a park on. Mr. Curiel survived all those disasters with his Fullerton career doing just fine.

So what was it? I don’t know but it must have been something very bad, even though Domer is clear that the firing wasn’t “for cause.” So maybe it was just personal in some way, requiring “a different direction” whatever the Hell that means. And maybe it was meant as a pre-emptive bloodletting meant to forestall future personnel whackings closer to the Domer domicile.

Fullerton Police Chief Accused of Whistleblower Retaliation

In a recently discovered set of claims [Link HERE] it is being alleged amongst other things that the Fullerton Police Department, up to and including Police Chief Dunn, retaliated against a former officer for exposing wrongdoing and corruption.

The Officer is claiming targeted harassment.

Is Fullerton now in the business of retaliating against women to hide corruption? Has our city stooped so low as to attack whistleblowers?

There’s a lot to unpack here but first…

I should probably mention that the officer in question is former Lieutenant Kathryn Hamel and that she’s claiming that Chief Dunn gave us, the Friends for Fullerton’s Future, info about Hamel in violation of several laws.

Did Chief Dunn give us the very information that the city is suing us for having posted? Inquiring minds want to know.

If nothing else, seeing Hamel claiming damages for a million+ samoleans does seem to explain why the city is trying to shift the blame onto us for their gross negligence. Not that that plan is even going to work.

Her claim states that even IF Chief Dunn didn’t expressly retaliate against Hamel, the city is still screwed for being negligent (which by their own accounts in their lawsuit against us – they were).

Officer Christopher Wren, the dude who was seemingly banging his subordinate in a PD bathroom, is likewise claiming damages from the City of Fullerton over FFFF reporting because it’s his right to use his department issued phone to send nude photos while on the job without you knowing about it.

These claims for damages, usually the precursor to lawsuits, are just more examples of completely avoidable stupidity chalked up to the incompetency of Jones & Mayer and City Staff. Not to worry though, Jones & Mayer has likely investigated Jones & Mayer and found they did nothing wrong and will rectify these problems by billing the city countless hours (at $200/hr) to cover up for their own ridiculously negligent behavior.

The Cost of The Florentine Sidewalk Scam

Of course everybody is now familiar with how, in 2003, the Florentine Mob successfully put a permanent building on an area that only had an “outside dining” encroachment agreement. The details of the case reveal an incompetence and misfeasance on the part of city staff that is truly mind-numbing, the principle party being F. Paul Dudley, Planning Director, who “approved” the illegal permanent structure as it was being built in June, 2003. He also  seems to have personally approved a loan to the Florentine crew, and rental terms on the space that weren’t approved by the City Council.

Of course it wouldn’t be Fullerton unless our legal-eagle Dick Jones also played a part in the fiasco, and in the inevitable cover-up. He actually put his signature on a completely different agreement in August, 2003 – two months after Dudley did his sleazy back-room deal. How’s that for staggering incompetence?

Note that “for some reason” the agreement was not formally executed until August. For some reason? Jesus H., Jones, did you even bother to ask why you signed something that was obsolete, or why in Hell you were signing it?

So the embarrassing enclosure was allowed to continue in July, 2003 even though the furor continued for months, and the deal was finally buried in 2004 whereby the parties involved, Shawn Nelson, Don Bankhead, Dick Jones, Mike Clesceri and Leland Wilson surely hoped it was forever interred.

Well, now it’s 2020. The legal party responsible to remove and restore the encroachment area has fled the scene, and the embarrassment of the Florentine addition that squats on public property, remains.

The owner of the rest of the building, Mr. Mario Marivic is apparently embroiled in a legal fight with the FloMob, and good luck to him. But good luck to us, too. Because we, the citizens of Fullerton, have an unowned room addition on our right-of-way, and the people on the hook for its possible removal are gone. Mr. Marovic is under no obligation to remove the structure, and he is not even under any obligation to pay the measly 25 cents per foot that the egregious F. Paul Dudley “negotiated” with the Florentines. The City’s options are limited: it can terminate the encroachment and pay to remove the building addition itself, or it can negotiate a new lease agreement with Marovic, and the sidewalk stays as is. Either way, the public loses.

So this Ghost of Incompetence Past continues to haunt us almost 20 years after the con was consummated. Mr. Dudley has been six-figure pensioned, and the inept councilmen who were indifferent to the notion of government accountability are dead or moved on. But Attorney Dick Jones is still around, profiting off of the gullibility, incompetence and militant ignorance of our “leaders.”

ACLU Joins EFF and Reporter’s Committee In Support of FFFF

Yesterday the American Civil Liberties Union (ACLU), the ACLU of Southern California & the Electronic Freedom Foundation (EFF) filed a joint amicus brief in support of us here at Friend’s for Fullerton’s Future in our ongoing legal battle with the City of Fullerton. Here’s a sample:

“Rather than accept responsibility for its own failure to limit public access to information, the City instead is attempting to stretch computer crime laws to punish those journalists—first, for uncovering unflattering information and, later, for publishing it.”

Likewise, The Reporter’s Committee for Freedom of the Press filed a separate amicus brief supporting FFFF against the City of Fullerton. Here’s a sample:

“Amicus is not aware of any case where a federal or state anti-hacking law has been misused so brazenly to target routine newsgathering—namely, the collection of government information available to any internet user.”

On the City’s side of the ledger is an amicus filed by the League of California Cities – a group the City PAYS to belong to with your tax money and they managed to argue nothing relevant to the case. Here’s a sample:

“However, hosting this information electronically presents a variety of cybersecurity issues for local governments, many of whom have limited budgets for network and security systems, outdated technology, and limited IT staff to implement organizational safeguards to protect against cybersecurity breaches and/or human error.”

They’re arguing that the City has a limited budget and it’s gosh darn tough to “implement organizational safeguards to protect against… human error”. I can’t laugh hard enough at that premise knowing their payroll and the gross negligence the city itself is claiming.

They’re all fascinating reads in different aspects.

Ultimately you know the City messed up big and that Jones & Mayer gave terrible legal advice when the ACLU et al are siding with us on the merits. The Fullerton City Council might want to consider taking a hard look at these new briefs before just blithely listening to Kim Barlow and The Other Dick Jones™ again.

I’d like to personally thank the ACLU, ACLU of SoCal, the EFF & the RCFP for their support in this exhausting case. Without their support, and the support you friends, this would be a much harder fight on all of us here at FFFF. It’s nice to have real allies when the other “journalism” outfit here in Fullerton enlisted a hack to fight against us.

Florentine Forgery/Fraud Case To Go to DA?

By now the Friends are well-aware of the attempt by Joe Florentine, the scofflaw proprietor of a restaurant and bar in downtown Fullerton, to fraudulently alter and submit official documents in pursuit of a Conditional Use Permit.

He even admitted it.

Reliable sources have indicated that a criminal investigation has been opened by the Fullerton Police Department based on a complaint filed by the property owner, Mario Marovic, and passed along to the District Attorney’s office.

Now the felonious miscreance of a Fullerton Florentine family member is about as newsworthy as a mailman bitten by a dog – no surprise there. Rather, the key facts of interest in this case are that Mr. Florentine had lots of help inside City Hall, including the Planning Director, the City Manager, and of course our top-notch City Attorney, Dick Jones, who finally had to recuse himself from dispensing laughable advice due to a conflict of interest.

Apparently, City Manager Ken Domer knew exactly what was happening and was determined to proceed with the fraud anyway.

It’s hard not to believe that some fall out from this conspiracy will land in the proximity of new Councilmembers Fred Jung and Nick Dunlap, who will certainly be averse to the radioactivity. The City Manager is already on the thinnest of ice after blowing $130,000 on a marginally legal PR campaign to promote Measure S, and then unsuccessfully trying to spend another 90 grand just before Christmas to hire an expert to try to fix the budget shortfall.  City Managers are protected by contract but there is no contractual protection for a person who has violated the law. Will we soon be hiring a management search firm?

As always, Jones and Meyer are likewise compromised by their corrupt and incompetent and self-serving practices. But Dick Jones, like Talleyrand, always seems to be able to keep his head on his shoulders despite all the revolutions.

And what was the role of Mayor-for-hire Jennifer Fitzgerald, who was the evident and malignant influence around so much of the Fullerton’s recent mismanagement and the cover-ups that inevitably followed? It’s difficult to believe that she wasn’t pushing this through for the benefit of her pals, the Florentines.

Finally, if in fact, City leaders are found culpable in this conspiracy to commit fraud, what is the legal exposure to the taxpayers of Fullerton for both the legal costs incurred by the property owner in the case, and for other damages he may have suffered?

As FFFF learns more about the status of the case we will certainly share it. City Hall probably won’t.

 

Should Cops Arrest People for Dining Based on One-Man Rule?

“City Allows Outdoor Dining in Defiance of State Health Order” blares the front page headline of the Fullerton Observer. The article bemoans the lack of police response in chasing off outdoor diners and closing local restaurants whose only crime is feeding people. Strange sentiments from a “progressive publication”?

California state government is a democracy whose powers are divided among the legislative, executive and judicial branches. The “Regional Stay-At-Home Order” referred to by the Observer is the arbitrary edict of one man –Gavin Newsom– that has not been passed by the legislature. The Fullerton Police Department should not enforce it. It should not shut down hundreds of local businesses and throw thousands out of work.

Emergency powers granted the Governor are of limited scope, when there’s no time for legislative action. This pandemic has been with us now for 10 months, yet none of his 58 emergency edicts have been approved by the legislature, which has had plenty of time to act. On December 8, L.A. County Superior Court Judge ruled against that county’s outdoor dining ban, as there was no “risk-benefit analysis” showing any connection with Covid-19 spread. Newsom himself doesn’t think so either, as his crowded unmasked dinner at the French Laundry showed.

There are many places in the world where the police enforce one-man rule. Does the Observer really want Fullerton to be one of them?

We FINALLY Have the Joe Felz 911 Call

Here it is after 4 years of obfuscation by City Hall and Fullerton PD. Here is the 9-1-1 call from the night former City Manager Joe Felz ran over a tree and tried to flee the scene. Pay special attention to the squealing of his vehicle as it limps down Highland away from poor Sappy McTree.

You’ll recall that he was given a ride home by Fullerton PD and given a pass on his DUI thanks to the position of power he enjoyed. This treatment ultimately, thanks to this blog, led to the firing and charging of the responsible Fullerton PD Sargent.

Fullerton’s “Father” Dennis Casts the First Stone

A few days ago I broke the story of Fullerton Council member Ahmad Zahra being charged by the OC District Attorney for battery & vandalism. The Fullerton Observer picked up on it and quoted/cited us as the source. Fullerton’s “Father” Dennis then shared the Observer’s Facebook post on the issue and in doing so decided to besmirch my character and call me a fascist and Klansmen.

I was going to let this go with a snarky Facebook post but the more I thought about it, the more I wanted to lay waste to the idea that somebody can get away with being such a total dickbag without response simply by virtue of a fancy title.

First let us put aside the robes that shield him from much criticism because clearly he has ignored their meaning and supposed importance. Despite being a member of the Order of the Servants of Mary (OSM), he forgot that he’s supposed to, and I quote (emphasis added);

“be at the service of God and all people, drawing inspiration from Mary, Mother and Servant of the Lord”

I’m sure Mary, mother of Jesus and Servant of the Lord, would absolutely twist a local blog’s name  (It’s FFFF not FFF or Tri-F) to impugn them as fascists and members of the KKK. Right? I’m positive that passage is in a missing chapter of the Bible which is still locked in the Vatican archives. Maybe not.

Hey “Father” Dennis, on what grounds do you compare me to the KKK? Because I’m white and you don’t like my politics? You offer no other substance so let’s just go with self-loathing racism. It’s all the rage these days with commies and crybullies online so it would track with your politics. Is that the same basis for likening me to a fascist?

Like I said, total dickbag.

The stupidity here is that I’m called these things by intellectual cowards because I think the law shouldn’t favor one group of people over any others and that the State shouldn’t dictate how you live your life. I want you to keep what you earn and for private charity (like, *gasp*, the tax exempt Church) to pick up the slack instead of a useless government that fails on every level. My political ideology is directly opposite of fascism but alas Father Dennis knows as much – or he would if he bothered to get to know the people he insults.

When *I* insult somebody at least I get the insults and facts on which I base them correct.

But no, not “Father” Dennis. Not the savior of the poor who’s so piously busy saving Orange County’s downtrodden by demanding the State steal from you to give to them and attempting to turn a city sidewalk into a third world shantytown.
