The Culture of Vodka, Vomit & Vehicular Mayhem (Part Two); or The Parasites Have Found a Host

In the first installment of this two-part series we saw examples of how a mere two downtown Fullerton bars (one illegally operating as a night club) had racked up a massive inventory of misdeeds, amounting to hundreds of cop calls in a few years. Just imagine how tough it is for the Fullerton Police Department to manage all this madness, night after night. And what happens to cop service calls in the rest of the city. Poor cops, right?

Yet before we shed any tears over the FPD and the horrible burden they bear, let us contemplate a “story” from the cop union website that glowingly talks about the special relationship that exists between downtown booze peddlers and our boyz in blue. Here are some choice quotations from the article:

Business in downtown Fullerton is booming.

Thousands of people flock from all over Southern California for the food and atmosphere – and to have a good time.

Police officials want to keep it that way.

In downtown Fullerton last year, officers made 562 drunken driving arrests, including 13 DUI crashes. There were also dozens of assaults.

“We could put 100 cops downtown, but we’d be swatting flies,” said Lt. Andrew Goodrich. “We want to work together to solve this.”

Added Police Chief Dan Hughes: “We want downtown to continue to flourish.”

Slidebar owner Jeremy Popoff had already convened a group of owners, calling it the “Downtown Restaurant Association.”

Do you see the absurd disconnect? Booming, flourishing business? Sandwiched between the happy horseshit talk are the startling statistics of our downtown, open-air saloon. The police are not only tolerating Crazytown, a situation they admit they can’t control, they are aiding-and-abetting it. Why? We certainly know that some bar owners like Popoff are politically connected – his place operates without the CUP the City legally requires of a night club. Then there are the recurring and disturbing stories about cops getting free food and drink at some of these bars – like Popoff’s place. These are stories that nobody has denied.

So are the cops just trying to make the best of a bad situation, or has the culture of the department finally become as gin-pickled with downtown booze as the rest of the City political establishment? I believe the department has enjoined a pretty sick symbiotic relationship with the downtown culture. And notice how the good ladies of MADD, the FPDs 5th Column, have never been mobilized against this massive affront to sober driving? Coincidence? I think not.

The closer you look, the worse it looks…

It’s obvious that there is zero political will from our city council to do a damn thing about the problem they created over the years. Just the reverse, in fact. Notice how our council unanimously agreed to carving up downtown among five separate council districts so as to dilute the influence of actual voters in that undeniable “community of interest?” The ballot statement supporting that mess was written by none other than our Lobbyist-Mayor, Jennifer Fitzgerald. Hmm.

The sign of fine dining. And drinks. Don’t forget the drinks. That’s where the real dough is.

As for Popoff, he can join with his fellow merchants of martinis and call themselves a”restaurant association;” they can pretend to play nice even while they are racking up ever-lengthening lists of police calls; what they can’t do, at least now that people are finally paying attention, is pretend that their operations aren’t draining financial resources from the average Fullerton family and putting it in their own bank accounts.

The annual downtown fiscal deficit to the taxpayer is well over a $1,500,000 – that’s ten bucks for every man, woman and child in Fullerton; somehow business is booming – but not the City’s General Fund.

And now, returning to the “article” cited, above: let’s have our new amigo, Mr. Gregg Honour, the control-your-bars consultant, whose attention has been drawn to downtown Fullerton and to FFFF, take us home:

Gregg Hanour, former owner of the Shark Club in Costa Mesa and author of “A Business Approach to Reducing Drunk Driving,” said police departments typically conduct undercover stings to build a case to remove a troubled bar.

“You’re lucky,” he told the bar owners. “Your police department wants to work with you.”

It is often said that nature abhors a vacuum. I think government ineptitude and corruption does, too. For a void created in the latter case attracts all sorts of opportunists looking to get ahead. Just consider the Gennaco affair for a moment: an out-of-control police department and a city government that wanted it to stay that way, called on the “professional” services of Michael Gennaco to make sure nothing was done at all.

The other day our crack team of investigators discovered that a fellow named Gregg Hanour had made public records requests for police calls to two of downtown Fullerton’s ~~fine dining establishments~~ night clubs – Bourbon Street and our old friends at Slidebar Rock ‘N Roll Something-or-other. Mr. Hanour is a former bar owner who now makes it his business to explore ways in which bars can quit annoying the municipalities in which they are located, abide by the permits that let them operate, and control their rowdy and inebriated customers, etc. Apparently, one of the main strategies offered by Mr. Hanour is to get bartenders to quit serving alcohol to drunks.

Downtown Fullerton must occupy a bunch of Hanour’s business development resources, given the completely out-of-control booze and barf culture that appertains. Good God! Just look at these two rap sheets:

Of course we are all familiar with the Slidebar and its checkered history. What most people in Fullerton don’t realize is that Slidebar is currently operating illegally as a night club. That’s right. This establishment has no conditional use permit, and every time something untoward goes on there a tremor of fear should pass through the City’s Risk Management Department. That’s because the City has intentionally looked the other way while Slidebar and it’s politically connected owner Jeremy Popoff keep the doors open and the drink flowing.

The real possibility of injury or assault or worse is evident in the long list of police calls to this bar. Can the City be held responsible for the consequences of letting this place run without the necessary permits? I don’t know. Shall we ask the City Attorney?

Good Bye and Good Riddance

Our old friend the historian Karl Marx wrote: History repeats itself, first as tragedy, second as farce.

And so in Fullerton we have had the spectacle of Jan Flory, a councilperson who worked us over good for two dismal terms in office, was driven out, and who returned 10 years later to provide the final act of a deplorable career.

I know who I came to work for…and it isn’t you!

Back in 1994 Flory ran as the Establishment candidate to push back against the reform-minded Recall that dared to drive out the incumbent stooges who imposed an unnecessary utility tax. She was the perfect candidate to advertise the fear and loathing the Old Guard had for anybody outside their inner circle.

In her first go-round she obligingly put her fingerprints on every big-government, no accountability scam put in front of her. She supported the illegal “in-lieu fee” water tax; she voted the cops and firemen the bank-breaking 3@50 retirement formula. She approved massive apartment projects in downtown Fullerton and actually voted to give away public streets to private business interests. She voted for every Redevelopment boondoggle that crossed her path. She bought the “Poisoned Park.”

And every step along this trail of tears she palpably dripped bitter venom for those who dared cross the “experts” at City Hall. Tragedy, indeed.

From 2002 to 2012 we were mercifully spared the the effluence of vindictive spleen sprayed on anybody who had the temerity to question what was going on in their own government.

But in 2012 the moribund Establishment needed someone to ride to their rescue; and to defend, deny, excuse, ignore and cover-up the serial crimes committed by the police department; and to fight the agenda begun by a new council majority, ushered in by yet another recall perpetrated by unwashed outsiders. Who better to call upon than the old warhorse, herself.

Yes she won, by a scant 29 votes, and she immediately resumed her old role. Yet something was missing. Yes, the muumuus and wood beads were still there, and so was the old, surgically implanted steel rod. The complete lack of humor, grace or introspection suggested the Flory of old. But you could tell. Her heart wasn’t in it. Her performance was thin, shadow-like, even as she continued the water rip-off, covered-up the FPD Culture of Corruption with gargantuan out-of-court settlements, approved four non-balanced budgets – raiding reserves $43,000,000, approved more massive apartment blocks – activities that in the past would have brought a smug, self-satisfied smirk to her sneer. But the old joy was gone.

The third act was a farce – even until the inevitable bitter end: as left she hoped to give Fullerton a parting gift – the sad sack and detumescent Larry Bennet, whose job would have been to keep the “For Sale” sign over the sliding doors of City Hall.

Ah, well. Now, Mrs Flory departs again, hopefully for the final time. And as we see this petulant shrew out the door, let’s always remember her words from the 2012 campaign: to my lights… the city department heads are the heart of the city.

Okay, Friends here’s a pop quiz. What do Jan Flory, Bud Chaffee, Jennifer Fitzgerald, Bruce Whitaker and Greg Sebourn have in common? Think for a second…

Got it? Of course, it was an easy question.

They are collectively responsible for the overdevelopment of Fullerton. Look around: Commonwealth, Orangefair, Santa Fe, each now, or soon to be home for massive, overbearing penitentiary-like apartment blocks.

Follow my easy method, and one of us will get rich!

You remember him, right? County Supervisor Shawn Nelson’s crony who stood to make a $100,000 commission as Nelson tried to ram through the County’s big homeless shelter next to Fullerton’s Commonwealth Elementary School.

Nelson wears his game face. Too bad we’re not on the same team.

And there’s very little need to hold our breath until the “College Park” upzone Godzilla rears its ugly head, once again.

Whatever the motivation of our “representatives” to jam ever more high-density residential projects into Fullerton, the result is the same: more burden on the City’s utilities and infrastructure, and above all, more traffic cramming our streets, costs that are carried by all of us as the developer makes his bundle and skips off to his next monster.

Is it really too much of an exaggeration to say that soon the major intersections at Harbor, Orangethorpe and Lemon will become virtually gridlocked at certain times of the day? Soon we may all have to find alternative ways to get around Fullerton.

It’s pretty clear that none of these lofty people have the best interests of ordinary Fullerton residents in mind. In fact, we seem to be nothing more than an annoyance to their big plans, that is if you can call helter-skelter development a plan.

Do Not Trust the Trustees

On Thursday, November 17, the North Orange County Community College District held an the Environmental Impact Report scoping session for the Measure J funded improvements to Fullerton College.

As you know from our previous report on this matter, the proposed improvements include a football field (estimated during the presentation to cost $4 million to build, so consider that a low floor to the likely final cost) but does not include improvements to the Veteran’s Center. When this discrepancy was addressed, Fullerton College President Greg Schultz gave the following explanation:

We have to understand that the NOCCCD cannot do everything it would like to do with Measure J funds, so they have not been able to make the improvements to the Veteran’s Center at this time;
The stadium will be funded through other funds, not Measure J money and he promises to not use Measure J money to build the stadium.

Let’s take these two responses one at a time, shall we?

First, the characterizing of the veteran’s center as just one of many improvements that the NOCCCD would like to perform is extremely dishonest. Let’s re-wind the clock again to back when NOCCCD sought voter approval for their $574 million construction bond:

Independent Person Wanted, Inquire Within

According to the City of Fullerton’s website the City Attorney is looking for an “independent person” to investigate the activities of our City Manager, Joe Felz. Here’s the PSA:

Now in the first place, the idea of of our mush-mouth City Attorney employing anybody not willing and able to deliver the right verdict on the events of Wednesday morning, November 9th, is ridiculous; but really, an independent “person?” Attorney Jones’s gardener? His CPA? His car detailer?

Seriously, though, the hiring of an investigator by the City and calling him (or her) independent is a complete farce. For there is a fundamental conflict of interest here, just as there is for the Fullerton Police Department to investigate their own boss. I can see it, you can see it. Probably even comically ardent FPD supporters like Chaffee, Flory and Fitzgerald can see it. But unlike us, they don’t care.

The truth of what I’m saying is pretty evidently contained within the facts of this situation: it is not a personnel matter. Joe Felz was driving home from a series of private parties in Downtown Fullerton’s Liquor Row. He was not on duty, he was not engaged in any official capacity. He was just a guy fidgeting with wires under his dashboard who ran off the road, knocked over a tree, churned up some dirt with spinning tires, moved on down the road a bit, was interviewed by the cops, was given an okie-dokie by them, was driven home by them, and was tucked into bed.

What does any of this have to do with Mr. Felz’s job as City Manager?

FFFF has always been a drop box for mail from sources that prefer not to be identified. Some are obviously credible; others perhaps less so – sort of like like Sgt. Andrew Goodrich the FPD spokeshole who claimed that the cops who killed Kelly Thomas suffered broken bones, etc.

Yesterday, we received an e-mail from one of our readers identifying himself as “DTF” who passed along what was presented as information sent out by a disgusted cop who was hired, and departed the FPD for a different agency during former POChief Danny Hughes reign:

And there’s more, relating to the Joe Felz incident:

I have excellent sources at FPD who hate the Hughes clan because of the lies and double standards.

Get a hold of those videos before they are erased, hopefully that hasnt already happen. Admin is trying to make the officers sign a new policy to prevent them from talking about the incident.

When the first two officers arived on scene, Felz was still in his car trying to free it from the sidewalk and tree. The officers pull up behind Felz just as he dislodges his car and drives away. The officers purse him and actually perform a semi pit maneuver to stop his vehicle. (There is minor damage to one of the police cars if not both)

This next part is sketchy. One version he was pulled out of his car at gunpoint and Felz identifies his self and immediately says to call Hughes. The other version is he flees his car when it has been immobilized and there is a short foot pursuit.

But one thing I know is that the officers on scene said Felz was HAMMERED there was no doubt he was drunk.

There is definitely video of the whole incident from the point the officers arrive on scene.

FYI no breathalyzer is necessary on scene. You can’t make a person take one at the scene. But the accident it self, coupled with his obvious impairment is plenty to have arrested him.

Put pressure on the PD to release the video. This is another huge cover-up by Hughes and his boys.

The Odd Case of the Client Newsletter

Okay, you may have painfully listened to the five-minute drone of Fullerton City Attorney Richard Jones on a previous post, explaining why no information was forthcoming in the Case of the City Manager and the Dead Parkway Tree. Sorry to inflict that on you, but no pain, no gain, as they say.

If your cerebral synapses are sufficiently recovered, reflect back on what Mr. Jones, Esq. said, and what he was asked to repeat twice by our Mayor, about electronic records generated at the scene and how they could not be released via PRA request because they were part of an “ongoing investigation;” but moreover, because they were somehow part of some sort of double-top secret “personnel” proceedings.

But wait! A quick trip to Jones and Meyer’s website newsletter to clients (we are clients, aren’t we?) reveals some interesting case law that seems to show exactly the opposite of the malarkey Jones was pitching to a remarkably incurious Council the other night. Here’s the synopsis:

See? The video was created before any administrative investigation, or internal affairs investigation even started.

So let’s get this straight. A “client alert” sent out less than four months ago seems to contradict what Jones said, and reiterated twice on Tuesday night. Hmm. Hopefully someone can drop by to explain why the case of City Manager Joe Felz isn’t covered by the Greenson case finding by the Court of Appeal.

Things never looked better for Fullerton.

An alert Friend directed our attention to the Fullerton Observer’s “reporting” of the recent Joe Felz/Danny Hughes Glenwood Ave. Road Rally. Here’s the article. As usual the Observer does its level best to downplay the incident – since for the Yellowing Observers City Hall can do no wrong. If you want, you can see it here. Below is a facsimile.

Let’s enjoy some of the unintended hilarity.

First notice that neither the chief player in this drama, nor even his august title are mentioned in the headline, a rather glaring omission, one would think.

It is not until the end of the second paragraph that we discover the tree killer is our beloved city manager; and it wasn’t until the next sentence that he is identified – only as “Mr. Felz.”

None of the pertinent facts are shared: that Felz had been drinking; that he had tried to drive away; that he had been given a pass on the breathalyzer test that would have been forced on you or me, or even Sharon Kennedy, editor of this mess.

Ironically, Page 6 contains a saccharine farewell to Chief Dan Hughes, whose last official task as chief was to make sure his boss got a safe ride home and tucked into bed without the worry of an annoying and embarrassing DUI rap. Thanks for the solid, man!

“Leaked to a local blog.” Ha ha! Yes, indeed! But no mention of the evil FFFF, where original and dangerous attitudes prevail! Jeez, even Sappy McTree got more shine than we did.

And finally: “…witnessing a driver (you mean THE driver) trying to maneuver his vehicle off the causeway.”

Causeway? Just like The Observer of old: error riddled, incompetent, supine and illiterate.

Hey, Wait A Minute! I’ve Seen This Show Before!

Friends, last week we received the following e-mail from some guy who ran afoul of the fine fellows who make up the FPD. The story’s a bit jangled but you’ll get the picture:

Sent: Sunday, February 10, 2013 1:46 PM
Subject: FPD

Hi Travis, I was recently arrested by the Fullerton PD. I had a professional recording device on my chest, which was recording for some time before I was stopped. There were 3 camera men and myself. We were basically trying to make a public reaction video. It shortly got out of hand. It was in broad daylight. The officers, myself and the camera man were all at the same intersection… All in plain site. I was eventually taken down, then an officer took my recording device and also an sd card from one of my camera men. I was the only one arrested, even though it was a group activity. I’m being charged with police obstruction, which has resulted in a hold on my employment. I’m also facing 100 days jail time. I’m a full time student and I work two jobs. I have no previous criminal record. No one got hurt, and we explained to the officers, what was going on. I feel like I’m being charged for something that shouldn’t have escalated this far.I also feel that they tampered with the audio… which apparently was 12 minutes long. I haven’t heard any one it.

They went through my cell phone, without any permission…

They didn’t want to give me clean water…

I was shackled and handcuffed, while sitting in a holding cell.

I was held down by multiple officers, while handcuffed. “Claiming I was resisting”

The DA read my case report and was hysterical… The Public Defender was the same way.

“They were joking about it in the court room.” Obviously It was a ridiculous case.I plead not guilty to the charges, and I’m now awaiting the pre-trial.If you have any information for me or any questions, I would appreciate it.

Hmm. Is any part of this story true? Was anything left out? I don’t know, but I’d say the burden of proof now lies squarely on the doorstep of Danny Hughes’ Culture of Corruption.

And now for a recap of this guy’s claims:

1. Likely peaceful situation escalated into a dangerous situation by undertrained or malevolent Fullerton cops. Check.

2. Citizen roughed up. Check.

3. Citizen told to stop resisting. Check.

4. Citizen thrown into jail, mistreated. Check.

5. Citizen’s recording devices confiscated without warrant; illegal search and seizure of evidence. Check.

6. Citizen being prosecuted for getting in the way of the cops. Check.

7. “Truthy” Fullerton cops to be called as witness in order to lock up citizen? Check.

Yes, I do believe I’ve seen this show before, starring Kelly Thomas, Trevor Clarke, Veth Mam, Edward Quinonez, Emanuel Martinez; and of course also the men and women of the Fullerton Police Department.

Good luck, dude. My advice is to go to the next City Council meeting and find out what your Police Oversight Commission can do for you.
