The Tale of Joe’s Tree, or The Day Government Acted Quickly

We all know that the gears of government grind slowly. Let a common citizen try to initiate some action or other and watch the January molasses flow.

Then, of course if there’s a real emergency – i.e. a need to hush something up, or cover the tracks – things move much more quickly.

Some folks thought it would be interesting to see how the City handled the issue of Sappy McTree, the Glenwood Avenue parkway youngster plowed over by former City Manager, Joe Felz on the night of his Wild Ride. Sappy was sent to the chipper, and a replacement was recently installed. Felz was sent home to spend more time with his family, and a replacement was recently installed.

Here are the relevant docs. Please note the dates.

We see that the cost of a new tree and a tree inspector (!) have been billed to Felz on November 14, 2016, five days after the incident. But note the due date – November 15th. Nobody produces an invoice with payment due in one day. In this case the invoice was produced on a Monday, and the due date on Tuesday. Why? Well, I can only speculate but it sure looks to me like Felz was trying his level best to close out the issue before the city council meeting the next day.

In the end it didn’t matter. Felz got The Phone Call, either from the City Attorney or from Jennifer Fitzgerald herself, advising him to take some time off, and that if he had a parachute, he’d better pack it.

Looks like the bill was finally paid on November 21 – six days late.

Enjoy as our Lobbyist-Mayor reads outgoing City Manager Joe Felz’s out-of-a can valediction.

Heartwarming, huh? There is no doubt Ms. Fitzgerald is sorry to see Joe go, but the reasons may have more to do with exercising authority in Fullerton than in any heartfelt sentiment. The important part of this speech, however, is in her description of Felz’s contributions to Fullerton and his legacy. These are important matters to Fitzgerald, as re-writing history always is to politicians.

Note how she credits Felz with bringing Chief Danny on board to “reform” the police department. And how he has masterfully handled the West Coyote Hills shambles, wherein a City government just gives its resident a big fuck you. Even his role in the everlasting Hillcrest Park embarrassment is embellished as some sort of grand victory.

Some people may be forgiven for refusing to accept this self-congratulatory nonsense as they address themselves to some obdurate facts. Such as refusing to reduce personnel, even as Redevelopment was shut down. For outsourcing graffiti removal but keeping the employees on the payroll. For four years of red ink baths to backfill an unbalanced budget. Hiring “Chief Danny?” The man who denied the obvious Culture of Corruption in the FPD. The man who claims to have watched the Kelly Thomas video 400 times, and who let the goons who killed him compare notes and re-write their reports? The man who promoted the only target of the Gennaco report – Goodrich. The man who covered up Felz’s Wild Ride Home on his next to last day of work? Is this supposed to be some sort of sick joke?

And yet for us citizens, no word on what really happened in the early morning of November 9th 2016; no word on what sort of “ongoing criminal investigation” is being pursued, if any; no word on what, if anything the DA has been asked to review.

Well, don’t worry Friends. We will be pursuing the details of Felz’s departure to see what sort of specifics may have been memorialized. And we will not give up getting those cop video records of the night when our former City Manager drove off the road, tried to get away from the scene of an accident, was stopped by the cops, and then given both a pass and a free ride home.

Inside Source: Felz is Out

One of our well-placed sources in the City administration has informed us that on-leave City Manager, Joe Felz will be quitting permanently soon, even as conversations now spin around who will replace Felz. Is this true? It has the ring of truth to it.

Speaking of spinning, Felz spun off the Glenwood Avenue in the early morning hours of November 9th, ran over a tree and tried to drive away. The cops on hand smelled alcohol but for reasons that have not yet been revealed, administered no breathalyzer test and instead drove Felz home.

The voice wasn’t soothing, but the words weren’t clear.

The City Attorney has been trying to protect Felz with illegal bogus claims of “personnel matters,” so that excuse would soon be gone if Felz flees the scene. Then there’s the matter of the rather bizarre “ongoing criminal investigation,” that some folks reasonably think is nothing but another dodge to avoid releasing incriminating video and audio records that were made when the cops arrived at the crash scene. No one has even bothered to explain to the public what possible crimes were committed, or who may have committed them. And of course our City Council members have not expressed any curiosity about that, either. Sooner or later our mush-mouth City Attorney is going to have to admit a big problem with his “criminal investigation” yarn, to wit: nobody was arrested that night. No evidence of drunk driving was collected. We don’t even know if a citation was issued.

When Felz goes, he will save the the taxpayers the cost of that so-called “independent person investigation” that the City Attorney thoughtfully cooked up to stall and obfuscate the matter. If so, it will be the one and only time Felz ever saved the taxpayers anything, and that going out the door.

Of course the open question is this: what sort of windfall will be offered by our ever-helpful council to grease the skids of Felz’s departure? If he quits he won’t get his guaranteed payola, but the circumstances of his Wild Ride may make that a moot point.

Whatever happens, rest assured, we will told as little as possible, as late as possible.

Felz After a Fortnight

The last official word we heard on the status of our City Manager post the Sappy McTree incident was that, besides apologizing, Joe Felz was on leave for 2 weeks.

The Official Story, if you recall, started on 15 November 2016 when the City Attorney, “The Other Dick Jones™“, told us that City Manager Joe Felz would be on leave for 2-weeks which prompted Jones to ask Mayor Fitzgerald to immediately put forth an emergency motion to appoint Gretchen Beatty as “Acting City Manager” and once that was done she’d stay in the Acting City Manager position until the Council voted to remove Ms. Beatty from said position. None of this was 1) an emergency or 2) needed as legally we don’t need a City Manager but I don’t expect the City Attorney to bother with such details as State Law.

The pertinent issue is that nobody on Council bothered to ask timely questions on this matter and so the fact that there wouldn’t be a Council meeting 2 weeks later (yesterday) never came up. Now 2-weeks has passed with the next Council Meeting scheduled for 06 December 2016 and it’s at THAT meeting that the Council would have the first opportunity to remove Ms. Beatty from her Acting position in order to put Joe Felz into his chair again.

Does that mean that Mr. Felz is back now twiddling his thumbs with nothing to do (2-weeks later as stated) or that he’ll stay gone until next week when the Council can remove Ms. Beatty from her Acting position or later due to the ongoing Felz/FPD investigation? Who knows with answers not exactly forthcoming from City Hall. We won’t even know if it’ll be on the Council Agenda until this coming Friday night.

As for the inevitable “What difference does a week make?” question I will posture that it speaks to the nature of our City Government and the way our city is run. It’s slapdash thinking & haphazard decisions over even such basic calendar items that showcases the culture in City Hall where there is almost zero attention paid to details. This sort of intellectual laziness is how we end up with unaccountable bureaucrats spending time in Las Vegas or elsewhere while the city bleeds red ink and puts our kids further into debt with only high-density boondoggles on, and blocking, the horizon in order to offset the bloated spending.

We shouldn’t have to point this sort of stuff out but our so-called leaders can’t be bothered to do the jobs they voluntarily took and that leaves us, the malcontents and rabble-rousers, to do the job of making sure that somebody is paying attention.

City Manager Felz Involved in Potential DUI Accident After Election Night Celebration

We at Friends for Fullerton’s Future can report and confirm that Fullerton City Manager Joe Felz was involved in an alleged DUI accident last night.

Coming home from the Downtown Bar scene where several election parties were taking place, Mr. Felz allegedly lost control of his vehicle.

According to the internal memo below, outgoing Police Chief Dan Hughes was informed of the situation and having allegedly passed a field sobriety test Mr. Felz was driven home by officers and his car was towed.

We are awaiting details as to the length of time between accident, phone call to the chief, field sobriety test and ride home.

Mayor Jennifer Fitzgerald was informed at the time per procedure but no comments have been forthcoming.

Thankfully it looks like nobody was hurt when Mr. Felz lost control of his vehicle as the only injury seems to be the death of an unsuspecting city tree.

Mr. Felz may have left a piece of his vehicle behind after doing what looks like considerable street damage. There was no word in the memo about potential charges for destruction of property, littering or the like.

A different car was in his parking spot today at City Hall suggesting the seriousness of the damage to his Subaru.

Felz Blows Off the HJTA. Illegal Water Tax Ripoff Continues. Lawsuit Imminent.

The Howard Jarvis Taxpayers Association fired off another pithy letter to city manager Joe Felz last week, accusing him of intentionally delaying the termination of the illegal 10% in-lieu water franchise tax while continuing to collect over $100,000 per month from Fullerton residents in violation of the state constitution.

The letter states that Joe Felz verbally admitted to the illegality of the fee and promised action within a certain timeframe. But honesty is not a virtue within city hall, and nine months later Felz and his trusted council majority of Bankhead, Jones and McKinley still allow the city to continue its theft without comment or remorse.

Mr. Bittle closed out his letter with a threat of a class action lawsuit that would seek a refund on behalf of all Fullerton water users. As one of the 135,000 ripped-off residents, I’d say that’s a great idea.

Joe, Lou, and Mike; Does Anybody Know What’s Going On?

Here’s a couple of interesting e-mails from the final day of July, 2011, between Acting City Manager Joe Felz and soon to be MIA Police Chief Sellers.

On the surface it seems that Acting City Manager Joe Felz is unhappy with Lou Ponsi for writing “Very Old” news. But maybe he is really upset that the public gets to hear (again) that the cops who killed Kelly Thomas had been out on the streets for over three weeks like nothing had happened; or that maybe Sharon Quirk looks like she is actually in charge. Sellers seems to be concerned with the latter, and he can already see the writing on the wall.

“Hopefully the remaining three council members don’t feel left out” is code for: “Make sure the Three Dead Tree Sumps get lined up, fast!”

“Lou is Not a bad guy from what I understand,” means that Sylvia Palmer and Andrew Goodrich have previously informed Felz that Ponsi is a reliable regurgitator of their crap.

By the way, is anybody else appalled by the weird punctuation and capitalization deployed by these $200,000+ per year bureaucrats?

Will Felz Get A Big Raise in the Midst Of It All?

The city of Fullerton’s website seems to be offline at the moment, but just before it went down I noticed that Tuesday’s agenda included a new employment contract for Joe Felz, the guy who’s been managing the city during the Kelly Thomas catastrophe.

If approved, the new contract would boost Felz’s annual salary to $201,400 plus pension and benefits. His current salary is listed at $166,250. That’s a raise of $35,000 per year, as recommended by the HR department (which ultimately reports to Joe.)

That’s not a bad haul for the man who was steering the ship while Kelly Thomas was beaten to death, not to mention his oversight of the globally embarrassing aftermath.

Is Fullerton Getting a New City Manager?

Item 1 on the Closed Session agenda looks a lot like this:

Since right now we have an “Acting” City Manager, Eddie Manfro, I think we can surmise that this is either an item to select a replacement or to appoint a permanent City Manager, who might be Manfro himself.

Manfro has held a bunch of jobs in Fullerton since his retirement as City Manager in Westminster, a situation that has caused a complaint from CalPERS, the State public employees retirement system, that is currently the subject of possible litigation.

Since I am not privy to the closed door doings of the City Council, it is possible that interviews with other candidates have taken place since the last City Manager, Eric Levitt ditched Fullerton for San Bernardino last summer. If the CM job was posted, it isn’t anymore.

On the face of it, the Fullerton City Manager job can’t be an enviable one what with the looming financial crisis and the roads being the worst in Orange County. Still, the job remuneration will be exceedingly high, and the accountability, as we have seen over the past four City Managers, exceedingly low.

If a decision is made next Tuesday we will be informed at the start of the public meeting.
