Domer Quits As Fullerton City Manager

Late yesterday afternoon the City of Fullerton announced that City Manager Ken Domer is quitting. Observers have noted a growing dissatisfaction by a majority of the council with Domer’s lack of management ability.

The City press release quotes Domer, thus: “I really can’t stay any longer. It used to be so easy to do the things I do, in the way I do them. Now I have to try to answer embarrassing questions all the time. It’s not supposed to work like that.”

Most recently Domer tried to get the council to go along with privatizing the business registration function – a move that would actually cost the City money, and, by relocating an existing employee, maintain the current employee headcount. This item was rejected by the City Council in a 3-2 vote, now a familiar trend.

In the press release, Domer continues: “I will always value my four years in Fullerton. Working with Jennifer Fitzgerald and Jan Flory was so rewarding for me. And I mean that literally. And of course Jesus Quirk Silva and Ahmad Zahra always had my back, and I had theirs.”

In his brief tenure as City Manager Domer will be remembered for unbalanced budgets, a failed sales tax scam, crumbling infrastructure, lack of code enforcement, bending over backward for downtown bar scofflaws, ridiculous vanity construction projects and many other accomplishments. But he may be best remembered for the City’s reckless lawsuit against this very blog, and the incredibly corrupt decision to approve Joe Florentine’s forgery of an official city planning document.

When reached for comment, former councilperson Jennifer Fixgerald noted, “Ken Domer is a real treasure; a pleasure to work with; worth his weight in gold.”

Fullerton’s Nuisance Noise and The Ongoing Saga of Incompetence and Corruption. Part 2

In the past 10 years or so, Fullerton has had four different planning directors: Al Zelinka, Karen Haluza, Ted White, and most recently an individual named Matt Foulkes. Pop quiz: what else do these folks have in common?

Haluza. The closer you looked, the worse it got.

Time’s up. Answer: none of them enforced the city’s noise ordinances, and each seemed to be dedicated to ignoring zoning and land use regulations in downtown Fullerton. We’ll get to the “why” of it in a later post. For now I want to point out the trajectory of this mess. As scofflaws like Jeremy Popoff’s odious Slidebar and the Florentine Mob’s various enterprises refused to comply with our laws, the Planning Directors noted above began an ongoing project to lower and lower the legal bar until even the lowest nematode could wriggle over it.

Now if we contemplate this downward spiral of our “experts” in the Planning Department and Code Enforcement we notice that it hit a virtual rock bottom in January 2019 when Matt Foulkes pretended that he didn’t know what a property owner was and approved the submission of an official document forged by Joe Florentine pretending that he, Florentine, was an “owner.”

Of course all of this malfeasance was amply documented here on the FFFF blog. And guess what? Nobody in City Hall cared; or to be more precise, nobody cares, still. See, in Fullerton incompetency and blatant corruption are so common on the part of our City Attorney, Dick Jones and the cadre of drunk, venal and just plain dumb City Managers and staff that our threshold for outrage is as low is almost worn away.

But not quite. Stay tuned for noise. And by noise I mean the noise generated by city staff to ignore, dilute, obfuscate and dodge the Noise Ordinances.

The Cost of The Florentine Sidewalk Scam

Of course everybody is now familiar with how, in 2003, the Florentine Mob successfully put a permanent building on an area that only had an “outside dining” encroachment agreement. The details of the case reveal an incompetence and misfeasance on the part of city staff that is truly mind-numbing, the principle party being F. Paul Dudley, Planning Director, who “approved” the illegal permanent structure as it was being built in June, 2003. He also seems to have personally approved a loan to the Florentine crew, and rental terms on the space that weren’t approved by the City Council.

Of course it wouldn’t be Fullerton unless our legal-eagle Dick Jones also played a part in the fiasco, and in the inevitable cover-up. He actually put his signature on a completely different agreement in August, 2003 – two months after Dudley did his sleazy back-room deal. How’s that for staggering incompetence?

Note that “for some reason” the agreement was not formally executed until August. For some reason? Jesus H., Jones, did you even bother to ask why you signed something that was obsolete, or why in Hell you were signing it?

So the embarrassing enclosure was allowed to continue in July, 2003 even though the furor continued for months, and the deal was finally buried in 2004 whereby the parties involved, Shawn Nelson, Don Bankhead, Dick Jones, Mike Clesceri and Leland Wilson surely hoped it was forever interred.

Well, now it’s 2020. The legal party responsible to remove and restore the encroachment area has fled the scene, and the embarrassment of the Florentine addition that squats on public property, remains.

The owner of the rest of the building, Mr. Mario Marivic is apparently embroiled in a legal fight with the FloMob, and good luck to him. But good luck to us, too. Because we, the citizens of Fullerton, have an unowned room addition on our right-of-way, and the people on the hook for its possible removal are gone. Mr. Marovic is under no obligation to remove the structure, and he is not even under any obligation to pay the measly 25 cents per foot that the egregious F. Paul Dudley “negotiated” with the Florentines. The City’s options are limited: it can terminate the encroachment and pay to remove the building addition itself, or it can negotiate a new lease agreement with Marovic, and the sidewalk stays as is. Either way, the public loses.

So this Ghost of Incompetence Past continues to haunt us almost 20 years after the con was consummated. Mr. Dudley has been six-figure pensioned, and the inept councilmen who were indifferent to the notion of government accountability are dead or moved on. But Attorney Dick Jones is still around, profiting off of the gullibility, incompetence and militant ignorance of our “leaders.”

Andrew Cho Steals Images, Gets Busted

Remember the political campaign that got started by a bankruptcy lawyer pretending his vocation was “Fullerton Parent” and who was endorsed by a gaggle of political crooks, liars and bagmen?

Well, it appears the crooked campaign of Andrew Cho got itself in trouble by heisting images from the Friends of Coyote Hills website in order to strike an environmentally friendly posture.

The hills are alive with the sound of Muzak…

The funny thing about this is the obvious attempt to cover ground lost to Cho’s opponent, Fred Jung, on the open space issue. Cho has been repeatedly hit by Fullerton Taxpayers For Reform as a puppet of overdevelopment lobbyist Jennifer Fitzgerald, our departing Mayor-for-Hire who has her fingerprints all over every apartment prison block built in Fullerton over the past 8 years.

Looking Out for the Little Guy (who makes more than $200,000 a year)

A few weeks ago the Fullerton Rag posted City Council-member Ahmad Zahra’s comments to the Black Lives Matter protest in Fullerton on June 6. It is interesting snapshot on an elected Democrat’s efforts to appease the party activists while keeping that sweet PE union cash flowing. It went about as well as you would expect (fast forward to 2:35 to hear the crowd turn):

The latest attempt to thread that needle comes courtesy of Faisal Qazi, a first time candidate who appears to be the Democrats de facto candidate for the Second District City Council race. His facebook page currently advertises a pro-BLM tilt, which one would presume would mean he opposes the longstanding practice of covering up for problem officers. However, this (since deleted) post shows a pretty strong blind spot where public employees in general are concerned, which should call that assumption into question:

Translated: “Lets go after all the waste in the system, except for all the waste in the system.”

Apologies to longtime readers (for whom this will sound like a broken record) but, according to Transparent California, there are almost 200 City employees making at least $100,000 per year. And that is not counting benefits (the $100,000 club has over 600 members in our fair City when benefits are included). On what universe would this be considered “already low wages?”

Oh, and for extra irony, try guess which department most of the public employees in the $100,000+ club belong to?

The problem in our local government, as friend of the blog Dave Zenger put it recently, is that too many people believe “the myth that (civil servants) are underpaid and hence deserve civil service pensions and protections. That may have been more or less true until the employees unionized, but it hasn’t been true for 50 years.”

And the result? Generations of “fiscal conservatives” on the City Council who voted for every pay increase that crossed their desk, followed, apparently, by generations of BLM supporters with a see-no-evil approach in their own backyard to the core issue that gave rise to the movement in the first place. And who will probably also vote for every pay increase that crosses their desk. This is why we can’t have nice things.

And So It Begins…

We all knew that we were going to be bombarded with political mail in support of the City Council’s proposed 17% sales tax hike on this November’s ballot. And we all knew that the City Council hired a PR outfit to blow our money to educate us about the beauty of the thing – to the tune of $130,000. Of course none of this is legal, but this is Fullerton where everything is legal that the deplorable City Attorney “Dick” Jones says is legal.

Some of the Friends have already received pro-tax propaganda from our masters in City Hall and here is a sample:

As usual, government tries to con us into bailing it out after it has failed so spectacularly the past decade to maintain reserves, balance budgets and pushing back against never-ending salary and pension demands from the public employee unionistas. Care about the homeless? Vote for our tax; Want potholes fixed? Tax! Youth programs? Who doesn’t love ’em – vote for our tax. Seniors? Ditto. Emergency services? They’re really getting hungry. A usual, the propaganda is larded up with misleading information and scare tactics and, gosh, we should be scared.

You will not be asked to reflect upon the reality that this same operation has dismally failed to fix roads in the past; that this bureaucracy has no intention of starting now. A Culture of Corruption in the Fullerton Police Department? Oh, we fixed that years ago – no, don’t look at that body over there, we have no idea how it got there. You’ll have to sue us to find out!

This crew has burned through tens of millions in reserve funds while its spokeholes on the council Jennifer Fitzgerald and Jan Flory lied about balancing the budget.

Ken Domer — Domer. There’s a lot less there than meets the eye.

Good luck, passing this obscentiy, boys n’ girls. The public is hurting badly at the moment and your first recourse was to try to harness us oxen with the yoke of a new and regressive tax. Well, guess what? The yokes on you, City Hall, and you’d better have a Plan B stuffed into one of Domer’s desk drawers if you know what’s good for you.

So Now We Know

Some recent commenters on our humble blog have wondered aloud who outgoing Mayor-for-Hire, Jennifer Fitzgerald was going to pick to be her choice for successor. Now we know.

Today a Friend forwarded some sort of statement (an English version) from a fellow by the name of Andrew Cho. Who is this person? Nobody I’ve asked today has ever heard of the guy; but, one thing is certain: he was chosen to be a reliable vote for all the things the Curt Pringle lobbyist Fitzgerald holds near and dear. I’d rather not slam the guy right out of the chute, but, hell, just look at who this mysterious person reports as his endorsers.

First, of course is the utterly unspeakable Fitzgerald.

If that weren’t bad enough, number two (and I really mean number two), the completely corrupt Dick Ackerman whose record running a fake non-profit to pay his wife, creating a fake address so she could run for the legislature in our district, and illegally participating as a lobbyist to promote the 2008 OC Fair swindle, have been well-documented on these pages.

Next we discover Ling Ling Chang, our current State Senator who originally ran for office pretending to own a business and attending Harvard. Both were lies, but that mendacity didn’t seem to put a dent in her armor of shamelessness.

Then there’s the support of Young Kim, the bubbleheaded perpetual candidate and her slimy husband Charles, who foisted the incomprehhensible nitwit Julie Sa on Fullerton way back in 1992.

Of course poor Cho must not have a clue that these endorsements will do a lot more harm than good, and if he doesn’t yet, he soon will.

Well, now that the names of those receiving Trump Bucks as part of the Great Federal Covid Giveaway 2020 have been published, we here at FFFF thought we’d see if we could dig up some local recipients of government welfare, you know, just to see if we knew any names on the list.

Jones has made a fortune dispensing bad advice to cities across Southern California and here in Fullerton he has made a name for himself by suing honest citizens to hide his own errors. On one issue alone, Jones managed to cock up the law, participate in a conflict of interest, and support the forgery of public documents

Fitzgerald Is Quitting, She Says

But the problem is that everything she says is a lie. Don’t believe me? Then read this self-satisfied “I’m Done” statement sent out this AM.

The bullshit was piling up so fast we needed wings to stay above it…

First let’s celebrate this announcement, if actually true. It means everybody’s life is going to get better in Fullerton as the sticky webs of self-interest entangling Fitzgerald and the taxpayers are cut.

And now let’s examine the stockpile of dishonesty this statement contains.

No, Ms. Fitzgerald, you did not “comprehensively” reform a corrupt police department. In fact, you permitted the fester to continue with zero accountability and more massive legal settlements. When anybody tried to uncover your malfeasance, you used public resources to sue them into submission. Even that failed.

No, Ms. Fitzgerald, you did not discover stable sources of revenue to address water and sewer. You continued the rip-off of the water fund by diverting a massive amount of money to pay for general fund expenses. And as you passed out more pay and pension increases to your union friends, you told everybody the budgets were balanced, a reckless lie that led Fullerton toward insolvency.

No, Ms. Fitzgerald, you did not increase road repair in your 8 long years. The roads in Fullerton are now the worst in the county according to your own pals at OCTA.

No, Ms. Fitzgerald, Hilcrest (sic) Park is not rehabilitated. It’s landscaping is still a disgrace and dying faster than ever, retaining walls and paving are deteriorating. Instead you wasted millions on poorly built, ramshackle woods stairs and a ceremonial bridge that nobody uses.

Yes, Ms. Fitzgerald at the behest of your developer buddies you are personally responsible for adding thousands of “housing units” – mostly in the form of massive, overbuilt tenements-of-the-future that made a mockery of Fullerton’s zoning and have placed an even greater burden on our frail infrastructure.

Yes, Ms. Fitzgerald you sure did prioritize “downtown revitalization,” if by that you mean running interference for scofflaw bar owners like Florentines and the douchebag Jeremy Popoff; defending a scene of nightly mayhem that cost the citizens $1.5 million more per year than it generates in revenue. Your “improved working relationship” with business owners meant directing staff and the City Attorney to ignore serial code violators and even to tolerate forged official city documents; and to harass people who didn’t fling themselves at your feet.

Sorry, dear, but nobody is going to be unhappy to see you go, if in fact and at long last you are finally telling the truth. You may feel “immensely proud” of all your alleged good works, but that’s just obvious self-delusion. Your constituents almost without exception – at least the ones paying attention – are feeling immensely relieved at the happy prospect of your departure; and immensely disgusted at your legacy of putting the interest of you and your friends above the interest of the city.

Is Fitzgerald Out?

I’m not telling the truth and you can’t make me…

Rumor is circulating that our Mayor-for-Hire, lobbyist Jennifer Fitzgerald isn’t going to be running for election to represent District 1 in Fullerton this fall. Good news, indeed, if true, for those who care about honest, competent government.

But is it true? No pronouncements have been forthcoming from the woman herself which suggests that the rumor isn’t true, or that the influence peddler is going to try to slide in a candidate of her own choosing – one who may just be amenable to continuing the Culture of Corruption in the FPD and the Culture of Incompetence in City Hall.

What her departure might mean for her future value for the swamp known as Pringle and Associates remains to be seen.

Well, I guess we’ll know in about six weeks. And if Her Highness is just playing games and is going to run after all, we’ll be reminding voters of her:

Promise to take no pay or benefits, and then doing just that.
Lying about a “balanced budget” for years while depleting reserve funds to pay for ever-greater pension obligations.
Covering up the drunk driving of her best buddy, City Manager Joe Felz, a spectacle that has embarrassed the City, ever since.
Ignoring the roads of Fullerton until they have become the worst in Orange County , as determined by the OCTA.
Presiding over the shoddy or incompetent construction of vanity projects that put money in the pockets of her campaign contributor.
Working as a lobbyist while representing the City of Fullerton.

So bring it on Jen.’ We’ve been paying attention and we’re gonna make sure your neighbors know all about your record. Stooge endorsement from recalled former council buffoons, corrupt liberals and government camp followers and a new tsunami of prevarication ain’t gonna cut it in 2020.
