Scott Markowitz Arrested For Perjury

Scott Markowitz, the phony 4th District Candidate was arrested by District Attorney personnel last night for perjury. He was booked into the Santa Ana City Jail.

As FFFF has continually claimed, Markowitz was a set-up candidate, created by prominent Democrats to draw votes away from Linda Whitaker to help her opponent, Vivian Jaramillo.

I’d sell out my mother for 10 votes, and I have…

Apparently, Markowitz’s nominating signatures were collected by somebody else, but he signed the affidavit claiming he did. That’s perjury, and substantiates our conclusions about the rest of the sordid scheme.

Perjury is a felony, and whoever set him up for this had better hope that Markowitz is willing to keep his mouth shut. If he sings he may very well incriminate the people who dragged him into this perjury, in which case we would have a conspiracy to commit a crime, which is also a felony.

Democrat Ajay Mohan is in this up to his eyeballs, of course. What about others? I keep hearing the names Ahmad Zahra and Aaruni Thakur, Ada Briceno and even Congressman Lou Correa.

Did Fullerton Observer Diane Vena know about this? She seems to have concocted tales to tell the gullible about the details of her participation. What about any of the other nominators? What about the Fullerton Observer itself, that has studiously avoided any mention of the perjury scandal.

The immediate question is what impact this will have on the 4th District election. Mass circulated campaign material has already tied Markowitz as a set up to help Jaramillo, so this is just more ammunition for the next couple of weeks. The beneficiaries of this news are obviously Linda Whitaker and Jamie Valencia, the former of which can point to the conspiracy as evidence of her own election chances.

Hello Kitty. Ouch.

Fullerton Taxpayers for Reform has just introduced Vivian “Kitty” Jaramillo to 4th District voters, and it’s a pretty tough introduction. A kind Friend in Fullerton’s 4th District forwarded this mail piece.

Side one goes after Jaramillo’s supporters for creating the phony candidacy of Scott Markowitz, and notes the DA is investigating.

The backside informs D4 voters that Jaramillo has been a vocal advocate of marijuana dispensaries in Fullerton, supporting Zahra and Jan Flory’s MJ ordinance in 2020 that would have allowed dispensaries a mere 100 feet from residential zones.

Nice work. This mailer is right for Fullerton.

More Hypocrisy from Fullerton BooHoo

If you were paying attention in 2022 you may recall that the City of Fullerton went through a redistricting process based on the results of the 2020 Census.

The legacy of Jan Flory’s “Bar Owner’s Map,” ostensibly created by Douchebag Supreme, Jeremy Popoff in 2016, was fresh in everybody’s mind. Three districts had been gerrymandered with tentacles to reach into downtown Fullerton – in violation of one of the basic tenets of district map making – compaction.

The train of thought was weak but it sure was short…

One consequence of the 2016 map was to give recently elected at-large Jesus Quirk-Silva a shot a running early for the first District 3 race in 2018 against Greg Sebourn, a race that Quirk-Silva won.

When 2022 rolled around and the Council created a redistricting committee Fullerton’s lefties squealed in displeasure that Sebourn was appointed to it. He’s going to make a district that he can run in, cutting out Quirk-Silva, so they said. How dastardly. Members of the committee must forswear not to run in a district they created, so they said.

Well, the districts were cleaned up, Quirk-Silva who had been gerrymandered into D3 was removed from it, and Sebourn didn’t run again.

But one fact seems to have gone unnoticed by all the self-righteous libs clamoring against the Council, the new map and against Sebourn. And that fact is that current Council candidate, Vivian Jaramillo, the person who sued the City to make a district she could run in, was also on the Redistricting Committee.

Not only did she support new gerrymandered maps that would protect Quirk-Silva, she supported the district she is now running in. How’s that for ironic hypocrisy?

But it’s not surprising. In their sanctimonious world, the boohoos of Fullerton’s left can’t accept the possibility that their own interests and beliefs might be effected by any sort self-serving or let alone bad behavior, which is why no one mentions the unethical and possibly illegal effort by Team Jaramillo to work a phony candidate on the ballot, a sham candidate whose only job is to divert votes from candidate Linda Whitaker.

Defender of the Faith

While checking out election disclosure Form 497s yesterday, I noticed that some rich dude named John Phelps had made two significant contributions – maxing out at $5500 apiece for Jan Flory and Vivian Jaramillo.

Obviously that made me wonder who John Phelps is. So I reached out to occasional commenter “Fullerton Old Timer” for a helping hand. Here’s what FOT wrote:

John Phelps is one of the last of the old guard defenders of anything emanating from City Hall bureaucrats. While his clan has been around for a long time he really made his fortune courtesy of the Fullerton Redevelopment Agency that helped develop the massive shopping center on the southwest corner of Harbor and Orangethorpe. He is the epitome of the government-aided developer.

He’s been supporting liberal causes for a long time but has been mostly interested on defending the status quo, Democrat or Republican. It’s no wonder he’s digging deep for Flory and Jaramillo, since they represent Fullerton statism, instead of accountability. His name appears on Jaramillo’s list of endorsers where he is erroneously listed as a former mayor. That will never be fixed.

It’s interesting to note that Phelps also gave the max to the pro sales tax, Measure S a few years ago; in 2022 he gave the maximum amount to the prevaricating Ahmad Zahra’s re-election. He will be likely be supporting the sales tax 2.0 as well.

Well there you have it. The Fullerton Circle of Life.

Dysfunction Junction

Denial is a fairly common human condition, but normally it involves interpersonal relationships and fact isn’t always that easy to ascertain. It is also quite common in politics where one’s emotional beliefs and prejudices are set against somebody else’s. And then there’s the case when bald facts are staring you in the face and you just can’t allow the cold truth to intrude upon your fantasy.

Nowhere is the latter situation better seen than in the City of Fullerton’s attitude and actions involving the “downtown” area.

It’s not real complicated. The City has known for almost two decades that downtown Fullerton was a money loser. A big money loser. And yet nary a word of complaint or criticism of the booze culture of downtown Fullerton has been uttered by the bureaucrats and politicians.

The most recent analysis was essayed 7 years ago. Here’s the money shot:

In 2017, the taxpayers of Fullerton were subsidizing the bar owners to the tune of almost $15,000 per liquor joint, each and every year. Three quarters of a million a year. Of course this was just for “public safety” as noted:

“We focused on the public-safety facets of this study alone, and did not include the development and maintenance services costs Fullerton audited. We illustrate below Fullerton taxpayers were effectively subsidizing bar and restaurant establishments – to the tune of about $15,000 per establishment – all to cover the costs of police, fire and rescue services provided to the establishments and their patrons.“

We know that maintenance and code enforcement and the legal services of Dick Jones and his I Can’t Believe It’s a Law Firm jack up the cost to well over a million bucks – $1.4 million being the overall cost previously discovered. And there are now over 50 bars.

Think of it. During hard times and good, the taxpayers of Fullerton subsidize the likes of the Florentine family and the Marovic mob and the Poozhikala posse, while they make a fortune peddling fish bowls of booze to out-of-control miscreants and ignoring the law.

And still City staff insists on describing downtown Fullerton a glowing success story, a triumph to be built on; of course they aided and abetted in the charade by city councils that are marked by political cupidity, stupidity and a desire to look like they have accomplished something. Anything. For decades these people have crowed about their achievements in DTF, even as they desperately crammed more and denser housing blocks in and around main streets – hoping a captive audience would somehow help. It didn’t, and by the early 2000s the City decided an open air saloon was just the thing. And then the restaurants morphed into bars and then the bars morphed, illegally at first, into nightclubs.

As things got more lawless, and even some like Dick Jones lamented the “monster” he had created, the only thing that happened was that things got worse. Blasting noise, random violence, sexual assaults, human waste, mayhem, shootings, sadistic and pervy cops – you name it – caused no retrospection in City Hall about what had, and what was happening. It was all a big victory, and you don’t second guess a victory.

Well, things are looking glum fiscally for Fullerton according to last years budget projections and we will be told Ahmad Zahra and Shana Charles that we must bear the burden of a new sales tax jack-up in order to keep the creaky old jalopy going.

I say fix the financial sinkhole that is downtown Fullerton before you stick your hands in our pockets.

The 2024 4th District Election

As the Friends know, Fullerton’s First, Second and Fourth City Council District representative jobs are up for election this fall. And while it’s a little early to speculate on who’s going to run and what the outcome might be, it’s fun to do a little introductory review.

Incumbents Fred Jung and Nick Dunlap are incumbents in the First and Second Districts, respectively. If they want to run again, and I haven’t heard they won’t, the power of incumbency is hard to beat.

The Fourth District, currently represented by Bruce Whitaker will be wide open. Whitaker is termed out after 12 long years on the Council and his replacement will decide the balance of the Council if Dunlap and Jung run, and are re-elected. The current 3-2 division is based on ideological difference, the difference is between looking out for the taxpayers – at least once in a while – and doing whatever idiocy the bureaucracy wants to perpetrate.

At this point the candidate pool seems weak. Last time Whitaker squeaked by past a dude named Aruni Thakur, a school board member who didn’t live in the district. Could Thakur do the (fake) carpetbagger routine? He had the full support of the unions and the County Democrat Party four years ago, but it wasn’t enough for poor Aruni, who was hammered with his carpetbaggery. With no incumbent this time around his political greed might pull him in.

Then there is a woman named Vivian “Kitty” Jaramillo, an individual who has made a nuisance of herself recently attacking the Council majority with the usual feigned outrage. Ms. Jaramillo is retired from “work” as a life-long municipal employee whose professional career started in Fullerton handing out parking tickets and graduated into being a code enforcement busybody. She would be a perfectly reliable yes vote for anything floated by city staff, and just the sort of running buddy Ahmad Zahra dreams about to support a sales tax. Word on the street is that the OC Dems are already behind her candidacy, which would preclude the aforementioned Thakur from getting involved.

Jaramillo ran for the City Council in 2012 and came in 7th in a city-wide election. Two years ago she was appointed to the redistricting committee where she championed the failed, ridiculous district map meant to keep the lamentable knucklehead Jesus Quirk-Silva in office.

Jaramillo’s other claim to fame, besides pestering the City Council these days, is suing the City in 2015 to create city council districts – very likely so she could run herself someday when Whitaker termed out.

So far no one from a more responsible philosophical perspective has raised their hand in D4, but as noted above, it’s still early in the year and filing doesn’t take place for almost another five months.

Mayor Nick Dunlap

On Tuesday Nick Dunlap was appointed Mayor of Fullerton by the City Council.

Dunlap seems like a decent fellow. He’s been courteous and collegial and always seems to be engaged in meetings. Congratulations to him. Apparently he’s turned down the job in the past, maybe because he’s got a couple of young kids.

I’m not voting for Zahra and you can’t make me…

Fred Jung, the outgoing Mayor was chosen as Mayor Pro Tem, the person who runs meetings if the Mayor is indisposed.

The real story here is that once again Ahmad Zahra was passed over. Oh, the humanity.

Intelligent commentary was not forthcoming…

His band of followers spoke emotionally for him. Why, you’d think he was the incarnation of St. Joan, St. Francis, Albert Schweitzer, Tiny Tim and Mighty Mouse, all rolled into one. Of course that little cavalcade was also the same group of folks who show up every week to challenge the ethics and honesty of the Council majority – at Zahra’s behest.

The system of rotation must be upheld they cried passionately. Fairness, they wailed. One guy got himself so wound up he looked ready to take punches at the air. The agitation. The furor! District 5 will have no Mayor some of the underserved proclaimed. The wailing and gnashing of teeth!

Even former Councilcreature Jan Flory hauled herself out of inebriate haze to deliver comments whose sole purpose was one last attack on Bruce Whitaker, challenging him to put aside his ill-humor and do the right thing by Zahra, hilariously neglecting to observe her own 30-year old, still unsatisfied vendetta against Whitaker. Clearly the stick up her backside remains firmly in place.

And this was before the vote.

But none of the offended folk seem to have reflected that there must be an excellent reason for Whitaker, Dunlap, and Jung to deny Zahra “his turn.” Those three obviously don’t like Zahra and don’t trust him. His penchant for self-promotion and his demeaning attitude toward them, so typical of the left-leaning know-it-all, has probably worn very thin. They know it is Zahra who has been orchestrating the ongoing harassment of them through his collection of oddball minions.

Zahra has been said to have filed a complaint to the police against Fred Jung for being a meanie of some sort, a claim that was refuted by everybody present. Zahra lied about being exonerated for a crime to which he pleaded guilty to have his record expunged. These aren’t good ways to earn trust and respect among your colleagues. And then there’s his ties to Melahat Rafiei the dope lobbyist and bribery queen who was just rung up by the US Justice Department.

Then, that very night, the public discovered that Zahra had gone behind the Council and City Manager’s back to talk to a State agency all by himself.

And who knows how many other shenanigans have been played by this unemployed, self-righteous, utterly transactional individual; and who knows what other skeletons might be inclined to tumble out of his closet?

And the end of the meeting Zahra was brought to tears by the injustice, choked up like a little child who wasn’t allowed to play on the monkey bars. The pathos was so thick it brought Zahra’s remaining followers in attendance to weep right along with the object of their affection.

Mario’s “Bump Out” Heist Subject of Litigation?

This item popped up on tonight’s City Council Closed Session Calendar.

Could this relate to the northwest corner of Commonwealth and Harbor? If so we are dealing with one Mr. Mario Marovic, who opened two bars on this property that he owns at this corner. Why anticipated litigation? What claim did he make against the City? Let’s review a bit of history, shall we?

Sit down and grab some sidewalk, fratello…

By now the Friends are well-familiar with the Saga of the Florentine Stolen Sidewalk, one of Fullerton City Hall’s more egregious and embarrassing fuck-ups, a high bar to clamber over, indeed.

Back in 2003 the Florentines purloined the public sidewalk on Commonwealth Avenue by putting a permanent structure on it without permission. The whitewash was that the City would now lease the land under the building addition to the Florentines. And the Florentines owned the addition, not the owner of the adjacent building to which the addition was attached! In the lease the Florentines were held responsible for removing the addition at the City’s discretion.

But the underlying problem of who owned what and who was responsible for what, never went away.

The comic opera took a new turn in 2020 when the Florentine Mob bugged out, abandoning their addition and their responsibilities for their sidewalk leasehold. Who owned the “bump out” as the encroachment was now charmingly referred to? Why, the people of Fullerton, of course. We assumed ownership, and responsibility. But this didn’t stop the owner of the attached building, Mario Marovic, from trespassing into the bump out and from beginning to modify it as he was remodeling the rest of the old Florentine establishments for his new bars.

Meet the new proprietor, same as the old proprietor…

What a mess, all predictable and all avoidable had the City staff and the City Council done the right thing back in 2003. Well, if the Queen had…never mind.

The most recent twist became public last fall when, behind the scenes, our feckless City Council made deal with Marovic. He could assume the Florentine ground lease, and open his new establishments; in return, he would be responsible for removing the encroaching structure from the City sidewalk, and all would be well with minor embarrassment to the City. Marovic’s deadline to start demolition was the last week of March 2023, to be complete by July.

Well, March came and went. So did April, May, June, July, August, September, and now October; and nothing has started. Nada. Marovic has been in breach of the agreement for seven months, reaping revenue from his saloons and from our property, too.

I really hope this item about a claim made by Marovic because it will inevitably raise the issue of his delinquency, although if it is, and this being Fullerton after all, I suppose the Council will end up letting the scofflaw keep renting our bump out on our sidewalk and maybe even pay him for the honor. It would be yet another effort to keep the City from more institutional embarrassment. Can’t have that, can we?

Here’s what should happen since the City has inexplicably decided not to go after the Florentine Mob for damages. The City should suck it up: cancel the existing ground lease with Marovic, demolish the bump out once and for all, and replace the open wall with whatever was there before this whole damn thing started.

Bang Bang, You’re Dead

Mostly predictable banality and stupidity mark events in Fullerton political opinion, but every now and then something unexpected happens. In this case an opinion piece in the Fullerton Observer that takes the police department to task for its hyperventilation rap-riddled recruiting video that begins with loud, dramatic music accompanying a fake chase scene through downtown Fullerton that ends with a canine grabbing hold of the bad guy. The author complains (rightly) that the video obviously sends the wrong message to potential recruits who may be more interested in violent video games than in community policing.

Now juxtapose this video (especially the dog part) with the recent news out of the City Council closed session that announced a $8,600,000 settlement with the family of Hector Hernandez, who was shot a few years ago by Jonathan Ferrell of the FPD for defending himself against one of their attack dogs.

To all appearances it looked a lot like a gang.

For years FFFF has been letting folks know that the Fullerton Police Department never reformed itself in the wake of the Chief “Patdown” Pat McKinley’s reign of error that culminated in the murder of Kelly Thomas. New Chief Mike Sellers took a vacation during the Kelly Thomas protests and bugged out on a stress leave and (tax free) disability retirement. The next Chief, Danny “Gallahad” Hughes – who was neck-deep in the Thomas killing cover-up – said we were misinformed, even as his boys gave drunk-driving City Manager Joe Felz a ride home, warm milk and a cookie. His successor, David Hendricks was arrested in Irvine for assaulting a paramedic and had to hit the road.

Cop coverup artist, drug warrior, IT wizard, this talented cat can do it all…

The current occupant of the Chief job, Bob Dunn, was the former spokesman for the Anaheim PD during the spate of cop shootings that incited riots. He’s the guy responsible for the recruiting video and its awful message to prospective, young Fullerton coplets. Dunn, too will be leaving soon after a short tenure – just like his immediate predecessors. Hopefully the new Chief will be more inclined to de-emphasize confrontation and escalation, armored vehicles and SWAT deployment as policing strategies.

A Disaster in The Making

There are all sorts of names for boobs and knuckleheads that keep making the same sorts of mistakes over and over again. Boob and knucklehead just sprang to mind first.

And so there are many descriptive terms for the collective known as the City of Fullerton, an entity that just can’t seem to help itself avoid the avoidable.

Quick, get clear of the impending collapse…

Exhibit A for the prosecution: the idiotic “boutique” hotel at the Transportation Center, brainchild of the corrupt and fortunately departed Councilcreature-for-hire, Jennifer Fitzgerald.

FFFF has followed the 5 years-long trajectory of this nonsense as it has metastasized into a giant tail-wagging-the-dog embarrassment that leaves a sensible person almost speechless. As the remote plausibility of a hotel brought forward, unsolicited, by an unfunded “developer,” Westpark, became obvious to even the densest observer, a new consortium including TA Partners proposed another prison block apartment attached to the hotel.

In December 2022 there was still no concrete plan, just promises of this and that. But time was running out for people in City Hall who are addicted to this deal. See, it involved the disposal of public property that had been developed as parking for Metrolink riders; this meant declaring it “surplus” despite its obvious utility, and starting in 2023 the State of California was requiring surplus land be offered up to the low-income housing cartel. What to do?

Get rid of the property ASAP was the City’s solution, before the end of 2022 – even though there was no final plan or entitlements in place. There was no approved site plan and project density details to hold to the sale – either by the City or by the “developer.” The development agreement protected the City’s interest in the property – up to a point, but created an entanglement of interests during and after escrow and incrementally pulled the City into a potential morass of unintended consequences.

Oops.

If I knew what I was talking about this wouldn’t be Fullerton!

So the sales agreement and the deeding of the City property was approved before the end of the year. Fred Jung and Nick Dunlap wisely opposed this fiasco, but were in the minority. FFFF just posted the story of Shana Charles’s dumbass rationale for approving, and of course Ahmad Zahra was all for this because he probably believed he could squeeze some cash out of TA Partner’s Johnny Lu along the way. The third vote? It came from none other than Bruce Whitaker, who seems mostly just confused, and even less inclined to show diligent energy that ever.

I swear to pay attention from now on, but I could be wrong…

All along, Whitaker seems to have bought into the nonsense that this property was legitimately surplus, despite its obvious utility to the people of Fullerton. Not wanting subsidized housing, he was willing to go along with the stupid hotel concept; but even he should have balked when the mess ran of the highchair and spilled on the floor. But he didn’t, doubling down on his own incompetence and in the end getting what he didn’t want in the first place.

So the sale went though, followed in the next few months by land use discretionary review and approval instead of all this happening at the same time which is the way it should have happened. Any problematic results of this mismatch may become apparent soon.

The finalized proposal came before the Fullerton Planning Commission last week. I’ll be describing that in the next post.
