More Fitzgerald Fun: Bid Rigging and Nest Feathering?

In Fullerton, reasonable people may be forgiven for their skepticism regarding the probity of the folks in City Hall causes them to consider cynical possibilities.

In this case, the object of scrutiny is once again our former Mayor-for-Hire, Jennifer Fitzgerald, who has ditched Fullerton after years of working as a lobbyist on our dime. On her way out the door, Fitzgerald got some sort of gig with a company called Tripepi Smith, an outfit that hires itself out to governments to promote stuff like bond floatations and new taxes.

Yes, that is the answer!

Well, so what? you say. Somebody at Tripepi Smith thinks Fitzy is a useful addition to their stable of government string pullers; and they also think there is some way in hell she can peddle her wares in Texas, where she has fled.

The thing of it is, Tripepi Smith was given a contract by the City of Fullerton in 2020 to broadcast City Council and Planning Commission meetings. But that’s not all. The first RFP went out early in the year and there was only one respondent. You guessed it: Tripepi Smith. The incumbent 25-year contractor cried foul, claiming he hadn’t been notified, despite assertions to the contrary from now-fired City Manager, Ken Domer. And it turns out that Domer’s second in charge, Antonia Graham, actually had a testimonial on Tripepi Smith’s web page from when she was employed by Huntington Beach.

The embarrassed council put the gig out to bid again in April, and in August 2020 Tripepi Smith was once again selected – over the incumbent – by a hand-picked collection of cities – one of whom Tripepi Smith actually works for.

Now, what Fitzgerald’s efforts in this peculiar procurement were is, of course, a matter of speculation. But we do know that she controlled what went on in City Hall, and we also know that when it came to personal opportunities, she never missed a trick. Was she in cahoots with Domer to make sure the applicant pool for this service was small and that Tripepi Smith would inevitably get the job? I can’t say. But I can say that a suspicious bid process was followed by some sort of personal opportunity for Jennifer Fitzgerald. That is all.

By now all the Friends know that our former Mayor-for-Hire, Jennifer Fitzgerald, has crammed all the loot she could stuff into her bags and is hightailing it for a state that has no extradition treaty. But her name still resonates, of course – a symbol of government treasury looting.

Well, here’s something interesting- a FitzySpark story that has several layers, each one suggestive of fraud.

For the past several years Fitzgerald reveled in the title of “Vice President” of Curt Pringle and Associates, an elevated title that suggests she was a valuable employee. But was she?

Here’s a snap from a report showing that Fitzgerald received a little government stimulus cheese to help out “payroll” for her little influence peddling operation “CL& Communications.”

Hmm. So she’s working for Pringle for years and yet collecting PPO money? And of course her little one man show has been around a lot longer than 2 years or less. In fact, here is some helpful corporate info on Fitzy’s biz:

Please notice that CL7 Communications has been around since 2009. Has the government been defrauded? I don’t know. You could try asking Dick Jones. Notice also that this business continued to exist through the years when Fitzgerald was supposed to be an officer of Curt Pringle Associates.

Well at least Pringle’s been around longer than two years so there’s a rare bit of honesty from the greasiest lobbyist in Orange County. He got $175,000, also for “payroll” and one wonders if that included 1099 payments to Jennifer Fitzgerald, who gives every indication of not being a Pringle employee at all, but rather a contractor. And if that’s true, Pringle and Fitzgerald have violated California employment labor law and the Federal tax Code. See, the IRS wants employers to pay for stuff like Social Security and Medicare through withholding; and the State wants to make sure employees are not being exploited, and that Worker’s Comp insurance is in place by the business.

Now I don’t know that SparkyFitz wasn’t a real employee of Pringle; and I don’t know if Pringle was faking it to dodge paying taxes. But something smells here, and it isn’t overripe government cheese.

Hmm. Former Fullerton Councilcreature for Hire, Jennifer Fitzgerald, may be getting out of Dodge. Word out and about is that Jennifer Fitzgerald wants to move. Out of Fullerton? I don’t know.

I’m sure not complaining about it, I’m hardly even wondering why.

During Jen’s 8-year career driving Fullerton to the precipice of insolvency and immanent infrastructure collapse, she made it pretty clear that she was in it for whatever she could get out of it for herself, her campaign supporters and her boss, lobbyist Curt Pringle. Now there are only two candidates willing to be “influenced” Fitzgerald: Jesus Quirk Silva and Ahmad Zahra. And the latter may soon have his legal troubles advertised for his constituents to peruse.

I’ll drink to that!

So maybe Fitzy figures it’s time to abandon the smoking wreckage she masterminded courtesy of two utterly incompetent but willing co-conspirators – Joe Felz and Ken Domer.

Maybe she figures her work here is done.

But the problem is that everything she says is a lie. Don’t believe me? Then read this self-satisfied “I’m Done” statement sent out this AM.

First let’s celebrate this announcement, if actually true. It means everybody’s life is going to get better in Fullerton as the sticky webs of self-interest entangling Fitzgerald and the taxpayers are cut.

And now let’s examine the stockpile of dishonesty this statement contains.

No, Ms. Fitzgerald, you did not “comprehensively” reform a corrupt police department. In fact, you permitted the fester to continue with zero accountability and more massive legal settlements. When anybody tried to uncover your malfeasance, you used public resources to sue them into submission. Even that failed.

No, Ms. Fitzgerald, you did not discover stable sources of revenue to address water and sewer. You continued the rip-off of the water fund by diverting a massive amount of money to pay for general fund expenses. And as you passed out more pay and pension increases to your union friends, you told everybody the budgets were balanced, a reckless lie that led Fullerton toward insolvency.

No, Ms. Fitzgerald, you did not increase road repair in your 8 long years. The roads in Fullerton are now the worst in the county according to your own pals at OCTA.

No, Ms. Fitzgerald, Hilcrest (sic) Park is not rehabilitated. It’s landscaping is still a disgrace and dying faster than ever, retaining walls and paving are deteriorating. Instead you wasted millions on poorly built, ramshackle woods stairs and a ceremonial bridge that nobody uses.

Yes, Ms. Fitzgerald at the behest of your developer buddies you are personally responsible for adding thousands of “housing units” – mostly in the form of massive, overbuilt tenements-of-the-future that made a mockery of Fullerton’s zoning and have placed an even greater burden on our frail infrastructure.

Yes, Ms. Fitzgerald you sure did prioritize “downtown revitalization,” if by that you mean running interference for scofflaw bar owners like Florentines and the douchebag Jeremy Popoff; defending a scene of nightly mayhem that cost the citizens $1.5 million more per year than it generates in revenue. Your “improved working relationship” with business owners meant directing staff and the City Attorney to ignore serial code violators and even to tolerate forged official city documents; and to harass people who didn’t fling themselves at your feet.

Sorry, dear, but nobody is going to be unhappy to see you go, if in fact and at long last you are finally telling the truth. You may feel “immensely proud” of all your alleged good works, but that’s just obvious self-delusion. Your constituents almost without exception – at least the ones paying attention – are feeling immensely relieved at the happy prospect of your departure; and immensely disgusted at your legacy of putting the interest of you and your friends above the interest of the city.

 

 

 

Is Fitzgerald Out?

Rumor is circulating that our Mayor-for-Hire, lobbyist Jennifer Fitzgerald isn’t going to be running for election to represent District 1 in Fullerton this fall. Good news, indeed, if true, for those who care about honest, competent government.

But is it true? No pronouncements have been forthcoming from the woman herself which suggests that the rumor isn’t true, or that the influence peddler is going to try to slide in a candidate of her own choosing – one who may just be amenable to continuing the Culture of Corruption in the FPD and the Culture of Incompetence in City Hall.

What her departure might mean for her future value for the swamp known as Pringle and Associates remains to be seen.

Well, I guess we’ll know in about six weeks. And if Her Highness is just playing games and is going to run after all, we’ll be reminding voters of her:

  1. Promise to take no pay or benefits, and then doing just that.
  2. Lying about a “balanced budget” for years while depleting reserve funds to pay for ever-greater pension obligations.
  3. Covering up the drunk driving of her best buddy, City Manager Joe Felz, a spectacle that has embarrassed the City, ever since.
  4. Ignoring the roads of Fullerton until they have become the worst in Orange County , as determined by the OCTA.
  5. Presiding over the shoddy or incompetent  construction of vanity projects that put money in the pockets of her campaign contributor.
  6. Working as a lobbyist while representing the City of Fullerton.

So bring it on Jen.’ We’ve been paying attention and we’re gonna make sure your neighbors know all about your record. Stooge endorsement from recalled former council buffoons, corrupt liberals and government camp followers and a new tsunami of prevarication ain’t gonna cut it in 2020.

 

Fitzgerald’s Empty Promise

We’re all used to politicians who can lie on demand. Then there’s our own councilcreature/lobbyist Jennifer Fitzgerald who has turned lying into a virtual cottage industry. Here’s a repost from 2017 telling a story that I promise is going to haunt our ethically devoid Mayor come election time, this fall.

She probably hopes that Fullerton citizen have either forgotten or are unaware of this issue. If either is the case, some of us will work to rectify that.

In March of this year our lobbyist-council person Jennifer Fitzgerald began to receive the typical council pay check, plus 100 bucks a month to not enroll in the City’s health insurance plan.

“So what?” you may be saying to yourself. Well, here’s the problem. In her self-promotion for political office in 2012 Fitzgerald got way up on her high horse about refusing compensation for “public service.” She even made a promise!

And that’s not all. Enjoy this lecture on the high moral ground Fitzgerald stakes out for herself in 2013. She made a big deal about her refusing compensation when she first joined the council. Could the moralizing get any thicker?

Between 2013 and now a lot has changed for Ms. Fitzgerald, most notably a vice presidency at Curt Pringle and Associates, the notorious lobby shop where no public asset is too valuable for cheap disposal. It may very well be that Fitzgerald now has a completely different attitude toward “public service” than she did five years ago.

The paid lobbyist leach that is Jennifer Fitzgerald is officially running for Fullerton City Council again in 2020.

Do you love having a council member who is bought and sold more than a penny stock in a bull market? Here’s your chance to own a stake just like all of the downtown bars.

Prepare for sad face Fitzy as she complains about Sacramento and blames everybody but herself and her own voting record for why we’re broke with crap roads.

Unaccountable police perving on your daughters in the High Schools? Don’t fret, she’ll promise them raises and higher pensions as long as we get no accountability in return.

Fullerton may run out of property to sell to pay for her cronyism and mismanagement, but she’ll never run out of integrity to sell for a few votes and to feather her own nest.

So get ready for Fitzgerald 2020 where she’ll be towing child actor and chronic crony cuck Chris Gaarder along in the VP spot the same as she tried to do with Larry Bennett in 2016.

Could Fullerton do better? Obviously. But the real question is do we deserve better?

Fitzgerald Targeted Restaurant D’Vine

While it shouldn’t come as a surprise to anybody paying attention that the government, at all levels, only works for those who are well connected and make the correct donations. Usually proving this truism is often difficult but we came across an example here in Fullerton that seemed noteworthy.

It appears that Mayor Pro-Tem, and Curt Pringle & Associates VP, Jennifer Fitzgerald decided to weaponize our city government to go after the business “D/Vine” for “word on the street” indicating that they had a promoter in violation of the municipal code.

That seems innocuous and even reasonable from a law and order and agency perspective. After all, what’s the problem with a council member & Mayor Pro-Tem being worried about a business running afoul of local law?

Nothing if the local laws were applied equally and in a just manner. But we know that to not be the case.

While Fitzgerald is super worried about public safety over who promotes what music at D’Vine she gleefully ignores other violators of our municipal code when it benefits her. As an example of such would be when she holds events and parties at The Slidebar.

The Slidebar which for years has violated local amplified sound ordinances while operating without so much as a Condition Use Permit or even an Administrative Restaurant Use Permit (ARUP).

For those new to these issues – in this city you cannot operate a restaurant without an ARUP and you can’t sell alcohol and have live entertainment with a CUP and a Live Entertainment Permit. The following screenshot is from the City Staff’s own presentation to City Council on April 16th, 2019:

The Slidebar only has the Live Entertainment Permit despite not legally qualified to have one thanks to their just ignoring the law regarding the ARUP/CUP. Nearly every other business is required to have these permits and for 7 years Fitzgerald has said bupkss about it.

Fitzgerald, like so many others on the dais before and still, has no problem holding fundraisers and heaping praise on some businesses in clear violation of the most basic of rules required to run a bar in downtown but when the wrong promoter plans the wrong type of music – now there’s a need for a call to action. Rally the troops! Tally-Ho! The scourge of banda music must be stopped… because Banda music is… bad?

Let’s look at that. Banda music is what exactly? From Wikipedia:

Banda is a term to designate a style of Mexican music and the musical ensemble in which wind instruments, mostly of brass and percussion, are performed.”

This is something Fullertonians have complained about before it seems but I didn’t realize it was such a problem. I sort of expect to hear this music at places like Revolucion Cantina and in fact they have a “Banda Wednesday”. This negates the idea that the music itself is a problem.

The shooting is a cause for concern if you’re worried about what CAUSED the shooting… but if it isn’t the music causing people to be shot (because the shooting happened during a “Purge” themed Halloween party playing Hip-Hop) then Fitzgerald must blame the promoter?

Can a promoter rationally be blamed for the wrong people showing up to a show? Fullerton doens’t seem to blame the local bars for bringing in undesirables who urinate, vomit, fight and graffiti all over downtown. Hell, Fitzgerald herself recently blamed “Pre-Gaming” in the parking lots for much of the mayhem and DUIs around town.

Thus using Fitzgerald’s own local logic let us dispense with the idea that the promoter caused the shooting in Riverside. After all, it might have been “pre-gaming” in a parking structure that led to the shooting. To do otherwise would be an especially comical problem when we have a fire & life safety issue in downtown related to a business owner whose family is alleged to have burned one of their own previous businesses to the ground.

Because city staff works at the behest of the City Manager and the City Manager works at the whim of the City Council, when the council says “Jump!” or “Look Away!” that’s exactly what happens. No need to apply the law evenly or justly – just do what the bought and paid for council demands.

It’s sickening that the city can look into D’Vine for their banda/promoter problem while simultaneously Community Development Director Ted White was exchanging text messages with Joe Florentine and emails with Jeremy Popoff, local bar owners, in the build up to municipal code changes of how Florentine’s & Popoff’s businesses, and all bars, would be regulated despite their own flaunting of the laws.

While Ted White was looking into the ARUP/CUP status of D’Vine he was ignoring the very real problems regarding Florentine being, for over a decade, in violation of life safety requirements. To recap – Florentine has refused to follow his own Conditional Use Permit (CUP) requiring fire sprinklers and the city has refused to enforce that CUP up to and including the Chief of Police rubber stamping Florentine’s Live Entertainment Permits year in and year out despite those permits also requiring adherence to the CUP.

It’s nice to have a clear cut example of the city picking and choosing winners and losers. This email from Fitzgerald about D’Vine shows us clearly that our city responds to issues immediately when the council says jump all the while turning a blind eye to worse problems from similar businesses in the same neighborhood. I guess it really does pay to own the right council members.

Today Jennifer Fitzgerald announced her resignation from the Fullerton Council, effective immediately.

It’s a dirty job, but someone’s gotta do it…

“I can no longer even pretend to fulfill all the oaths I swore when I became a councilperson,” said Fitzgerald. “All the developer shakedowns, all the lies, all the influence peddling – I just can’t keep track of it all anymore. Balanced budgets, commitment to roads, honest cops – people want so much and I am so tired. I’m going to spend time with my family,” she stuttered weepily. “The evil has been backing up so much I feel I may burst.”

Mayor Jesus Silva responded to the announcement by saying ” I guess I’ll miss her helping me out at meetings when I started babbling like a boracho pendejo, but it will sure will be nice to have only one woman telling me what to do.”

Quick, get clear of the impending collapse…

Recently appointed Councilwoman Jan Flory had kind words for her colleague. “I’m going to miss Jen’ on council. To my lights she was the heart of the city and represents the very best commitment to service. We accomplished all sorts of things together – good roads, a successful downtown bar scene, an accountable police department, an unmatched string of balanced budges, effective and successful public works projects – you name it. She’s the reason Fullerton is where it is today.

Recently elected councilperson Ahmad Zahra was quick to praise Fitzgerald. “I thought at first  she might be, you know, difficult to work with after she called out my long-winded moral posturing on the council appointment deal. But, later, when the chips were down, and she was willing to screw Whitaker just for the fun of it, I was so happy to make the deal to be on the water board. It was a very successful transaction.”

The council will now have to decide whether to replace Fitzgerald by appointment or by special election. According to the City Attorney a special election in November could cost eighty trillion dollars, which might come close to unbalancing the City’s budget according to City Manager Ken Domer.

Did Jennifer Fitzgerald Just Admit to Illegal Lobbying on Behalf of Jamboree Housing?

Recently Jennifer Fitzgerald circulated to her closest supporters- via her Curt Pringle & Associates  email account – her opening salvo in the 2020 election, an email entitled “2019 – A Year of Resolution and Re-commitment”.

Plus a few people she thinks are her closest supporters. Whoops.

There’s a lot to digest here, and the amount of mendacity, outright falsehoods and terrible policy proposals would take multiple posts to unpack.

But one particular boast stands out above the others:

No, not the one about the budget (although it is absolutely galling how she can still claim she balanced the budget two years after the City admitted we have a serious structural deficit and four years after members of the public started noticing). Instead, look at her claim that “Looking back over my six years of service on the Fullerton City Council, I’m proud of newly constructed affordable housing communities with… Jamboree Housing.”

So what’s the problem? Well, as Curt Pringle & Associates admit on their facebook page,  Jamboree Housing is one of their clients. Which means that Councilmember Fitzgerald just bragged about breaking the law.

That’s the one.

Two important caveats. First, I know from attending most council meetings over the last four years that Fitzgerald has avoided voting on any agenda item involving Jamboree Housing’s low income housing development since obtaining residence at CP&A. However, Government Code Section 87100 doesn’t just prohibit an elected official from making or participating in making a decision in which he or she has a financial interest – any attempt by an elected official “to use his official position to influence a governmental decision” is also illegal.

Second, and probably more important, this is could be yet another example of Fitzgerald misleading her voters about her accomplishments (and possibly CP&A clients, given that this email was sent via jennifer@curtpringle.com)  and taking credit for something she had no role in, or claiming she accomplished something she did not.

So which is it? Did she break the law and influence a decision that she had a clear financial interest in or does she just have a chronic aversion to telling the truth and chose to brag about her influence and effectiveness to Fullerton voters as well as potentially CP&A’s clients?

A quick poll of FFFF staff seems to indicate that “both” is not entirely out of the question as a possible answer, but maliciousness is in the eye of the beholder.
