      “The proposed pension changes, which would increase city workers’ retirement ages, eliminate automatic cost-of-living adjustments and alter formulas that calculate pensions, are estimated to bring about $8.5 million in savings. The thought of such changes is hard to stomach for Hollywood Police Officer Greggory Forsyth, 42, who hopes to retire in February after 22 years with an annual pension worth 80% of his salary. If the pension changes pass, he would instead get about 67% of his pay if he retires in February and would have to work five additional years to attain 80%.”

      Do you guys all get this? A 42 year old is upset because he may have to work until he’s 47 in order to still get an 80% pension. That is, AFTER THE REFORM, the 47 year old cop will retire with an 80% pension. And the gentleman finds this “hard to stomach.”

      This absurd sense of entitlement, and complete disconnect from economic reality, are both hallmarks of union indoctrination. It is the UNIONS that are the core problem here. Police organizations are too powerful to also have union organizers step in and become the shadow governments. Anyone running to replace the recalled councilmembers must commit to outlawing public sector unions, especially the ones that organize the police and firefirefighters.

    1. It really is beginning to look like this entire department is totally out of control. They really believe they can thwart a Constitutionally Just demonstration by We The People through petty intimidation? These fools are digging it deeper and deeper. Gads, do I wish I lived there so I could get one of those Golden tickets! Whoever is currently in charge needs to be immediately replaced by someone from an entirely different PD. Way too much cronyism in FPD, and complete incompetence. The Fullerton taxpayers are getting screwed by their own PD!

      After the recall and election of a new City Council, Fullerton needs to do a nationwide search for a police chief with a proven track record of cleaning up dirty PDs. Then the New Fullerton City Council needs to back him to the hilt. I would submit, there should be NO promotions within the FPD until at least FIVE years after the new City Council is satisfied the department has actually been rid of ALL the bad apples. I would also suggest reducing the size of the department to help defray costs of lawsuits against the city due to the PD. That does not preclude firings for officers who commit unnecessary violent acts during arrests.

      Others have suggested a Citizen’s Review Board of Officers with complaints of brutality. That sounds like a great idea in addition to the above.

      Also, who negotiates with the Police Union and how often does that occur? Find out who is responsible for negotiations and replace them with new untainted blood. This union needs to have it’s claws trimmed.Just my 2 cents.

If they have time to send a team out to reduce honking at a protest, then the department is either poorly managed or we have too many cops.

        1. A) there is no such thing here in Fullerton as “business parking spaces”, as all parking on the street is public access. However, the owner of the antique store and clock shop posted a sign in front of their shop, and I “watched” (no pun intended) those spots all day and asked that the protesters honored their wishes and leave those spaces open, even though they had every legal right to park there, and everyone complied and left them open. Protesters are savvy enough and considerate enough to realize that these people are trying to make a living and tried to help. Personally, if they were my shops I wouldv’e offered a protesters and honkers welcome and advertise a 10 % discount “justice or just us” discount to get them to shop in my store.

  12. Time, place and manner rules have been upheld by courts as being exempt from the 1st Am if they are not based on the message or content of the speech. I browsed through some case law on line for honking of horns.

    If it is really prolongued and “merely” designed to harass an individual (the case I read was 10 minutes solid in front of a neighbor’s house who the defendant was having a dispute with). The honking in Fullerton was clearly intended to send a message protected by 1st Am – not to harass or annoy someone.

    For this story and the companion one on Goodrich to be more effective, I’d record the honking going on as well as the cops reaction. I’d cite the local statute at issue, and I’d consult with FFFF’s friendly first amendment attorney for an opinion or get a statement from the cops about what is excessive and why. Even if the statute can be interpreted to ban the honking, that statute might not be in line with the constitution.

    But frankly, the argument that the cops can’s enforce any law because of what they did to Kelly is a weak one. Deal with the speech issue on its own terms and you’ll make a stronger case for yourselves and with the public.

    Please note: I am not saying ANY of the honking tix were appropriate. I am simply saying deal with the details of the First Amendment issue, not with unrelated issues. An example would be if there was some kind of demonstration supporting the troops and honking went on just as lengthily and no one was ticketed.

      You’ve missed part of the the point, and nobody is seriously arguing that. The point is not that they shouldn’t enforce the law, but rather the irony in that their picayune application. One guy gets a ticket for honking. Six others walk away from a murder. Which does hint at their lack of moral (not legal) authority to cite anybody for anything

      Of course nobody gets a ticket for honking in support of troops or even fake heroes like the cops themselves.

      1. A friend told me she was at a bar in DTF a couple years ago and that a girl there was injured. She and a few other friends were leaving when a guy friend went back inside to find someone. As he walked past the girl, he said, “Are you okay?” (Yes, he was drunk at the time and therefore voiced his concern freely.) One of the officers with her said, “We don’t need any of YOUR kind around here.” So the guy walked back to the car where his friends were, while purposely using his middle finger to scratch his head.

        My friend said the next thing she heard was her friend’s knees hit the ground because the cop took after him, hit him at his knees, then put him to the ground and cuffed him. My small, unintimidating friend asked, “What did he do? Where are you taking him? I don’t know where the station is here in Fullerton.” The arresting officer replied, “If you ask one more question, then you’re next.” They put her friend in the patrol car, and one of the cops had enough decency to walk back to my friend and let her know how to find the station.

        I’m so sick of these immature, antagonistic frat boys. Clear them out and leave only the best ones. I’m sure there’s a line a mile long of respectable men and women who would be thrilled to have the opportunity to serve in Fullerton.

Sadly, especially for Kelly thomas and his family members, the FPD has been corrupted by its current and past leadership and encouraged and furthered by Fullerton city council members tacit approval. On a sadder note, the weekly protesters from the community who seek to stop our civic leaders from covering up a murder by the FPD, now are intimidated by the police. This is how Bankhead, McKinley and Jones respond to the genuine concerns and moral outrage of their constituents?

  32. A suggestion to get more drivers to honk:

    Instead of YELLING at them to honk, or GETTING CLOSE to their vehicles, just give them a thumbs up or a peace sign or a friendly wave.
    I have been at 6 protests and I’ve learned that this type of approach has been more effective to achieve a significant amount of honks.
    I noticed one guy that has been there and he walks right up to the cars, pointing his finger at them to honk and that only works 10% of the time. Most get the impression that he is some hopped up drug-crazed idiot and give him weird looks at best. His heart is in the right place, but his rally methods are off-based.
    Just a suggestion.

  39. FPD seems to escalate any situation to which they become involved. In an otherwise peaceful environment, they manage to introduce havoc.

    Think of the night of July 5th. The transit area was thriving with normal activity. People were coming, people were going. A few entered a bar, a few others stumbled out. A homeless family and Kelly were sitting on a bench passing time before they would go to sleep behind some church for the night.
    What changed that otherwise peaceful environment into one of shrieks, violence and shrill terror?

    Enter FPD.

    “Attention citizens, we are here to conduct some business. The constitution has been suspended until we are complete. Put away all recording devices. Come here Kelly, and bring your backpack too.”

I asked him about the ticketing and he said as far as he knew only two people got pulled over and both had their tickets torn up at the station. I suggest you call him and ask.   43. Great suggestion John. Captain Dan Hughes is capable of doing the “right thing”, however he was pinned in a lie by one of the leaders of Kelly’s Army yesterday. I captured a video moment where she was letting Captain Dan know that “he lied to her”. Apparently he told her anyone getting pulled over for honking accessively will get a simple warning first, then a citation if caught doing it again. Such was not the case. No one was given a warning; just a citation, first time around.
    Yes, he’s reasonable when he would like to be, however he is just as capable of lying as many upper ranked officers in Any Police Department in America.

      1. John, can you borrow a bicycle and order a helmut-cam quickly online? If you order it second day shipping today, it MAY be at your door by Saturday morn, but I would order it overnight myself. The FPD may issue a trumped up citation if you have a car drive you to where they are ticketing, or even run you in for creating a BS hazard, but I think you could get away with a bicycle pretty easily. Trying to do it on foot, trying to keep up with patrol cars isn’t realistic.

        Also, have you guys considered picking up some citizen band walkie-talkies to stay in touch and help get to incidents quickly? One of the police’s most powerful tools is instant communication. No reason you can’t use the same tool. The helmut-cam will run you $200-$300, but imo would be well worth it. The handheld radios should be more like $150-200 for four of them. Check your local Best Buy, or even Costco. If you can’t pick some up locally check online electronics stores. I usually get my equipment from B&H in New York because of having done business with them for well over 30 years I trust them, but you can doubtless find a reputable electronics retailer right there in OC!

        Good luck keeping video records. Wish I could be there to help.

          Point taken, though it is my understanding (didn’t see it myself last Saturday) that the sign didn’t say ‘stay away from my store,’ it said “Protesters, please don’t park here- we need this for customers.” Having once been in a similar situation with a small business, I would tend to take that sign at face value, he’s saying “hey, no offense but I’m trying to make a living here.” Any other interpretation would be as big of a stretch as me possibly being Ms. Schroeder… but I’ll take that as a compliment because regardless of her politics, she’s a helluva smart woman.             Exactly. Occam’s Razor, or the Law of Parsimony, says that when faced with two competing theories that are equal, the truest will most likely be the one that makes the fewest assumptions.

            In the Mam case, one theory is that a grand conspiracy was in place involving numerous police officers, DA’s office investigators, as well as a deputy DA herself, who ended up being humiliated when the tape contradicted her.

            Another theory says simply that it was a matter of incompetence.

            The numbers do indeed add up, and Occam’s Razor tells us that they likely equal a simple human error.

    When the Detectives Commander was made acting police chief, I saw several postings that he was a straight shooter type and no nonsense. Great! I thought, now we can have some semblence of order and peace while awaiting the coroners reports and tox screens.
    Then the ticketing of motorists who are horn honkers, by guess who? The police union president and vice-president along with a few other followers.
    Where is the new acting police chief in all this? Nary a word! He should be taking the tickets and tearing them up and writing up the two donkeys for fomenting public dismay for the PD.
    My guess is that the acting chief simply does not care. He is following orders from the City Manager and Mayor. Very sad indeed that Fullerton residents have to be ticketed by their police union for supporting a demonstration.

  56. The police officer told the ticket recipient that he did not know what he was referring to when the citizen told him that he was not anti-cop, only anti-murder. The officer added that he was only doing his job.

    My older brother taught me in high school not to trust anyone who claimed that they were only doing their job. He taught me to trust people who were building their carreers, leaning on logic, and pertaining to priciples.

  59. Well, here is some unsolicited advice.

    If you are going to protest in Fullerton, then go in a group. Break the group up over an area with each member filming another member. This method will keep everyone under video surveillance.

    Another method is to go in a group and have some members detach. The detached members would not take part or otherwise attract attention to themselves. They would do nothing but observe with a camera.

    Ultimately, you want to document the number of the police cruiser. Each officer is assigned a vehicle by number. You want that number. If the situation got out of hand, or something serious happens, there will be a record that shows what individual, or individuals, the vehicle was assigned to.

    Never, ever, argue with a police officer or lean forward to obtain the badge number. At that point, the officer will look for an excuse to become violent with you. The vehicle number is as good as a badge number. You will be in the same situation as Kelly Thomas. Surrounded by people watching you trying to survive.

    Do not play stupid with these people or leave yourself open to victimization. If you believe these people to be corrupt and guilty of murder, what do you think they will do to you when given the chance?

    Food for thought. In 1994, Michael D. Schwartz defended one of two LAPD officers accused of shooting at a CHP officer. These two officers were drunk and shooting at targets while they drove. One of the individuals ended up being a CHP officer.

    Needless to say, these two police officers were portrayed as really nice guys who did something stupid. They were suspected of shooting at a city bus among other targets. The six police officers involved in this will also be portrayed as wonderful people.

    In other words, be careful and use caution at all times.

      As for “not one conviction in 15 years,” I don’t know for sure, but that may very well be true.

      Convictions against police officers are very hard to get, look what happend in the Rodney King case, it was all caught on tape and they were aquitted by a Simi Valley jury on all charges!

      That doesn’t mean the OC DA hasn’t tried. I pointed out the People v. Deputy Hibbs case to you before, here’s another: People v. Officer David Park. Again, the Weekly’s excellent reporter Scott Moxley explains…

      —“Orange County juries have a long, pathetic history of siding with cops, even obviously dirty ones. In one infamous case, an Irvine police officer disconnected the GPS unit in the trunk of his patrol car (so that dispatchers couldn’t track his whereabouts), tailed a woman outside of his jurisdiction, pulled her over on false pretenses, then masturbated and ejaculated on the shocked woman’s chest. DNA testing later matched this cop’s sperm with the sticky matter left on the woman, and yet a 2007 OC jury–mostly old, white men–couldn’t bring themselves to find the officer guilty of any crime.”—

      Essentially, cases against cops in OC are non-starters. Moxley’s right. In a way I’m actually more surprised that the DA keeps trying.

      This is why no one should be so terribly surprised and shocked that the investigation of the Thomas murder is taking so long. If the OC DA is going to get convictions on serious charges he’s going to need a super strong, bullet proof case with the key items of evidence being the video and a favorable to the prosecution autopsy report. Without both the cops will walk and a huge miscarriage of justice will have occurred.

And yet an OC jury, mostly made up of old white guys essentially said, “yeah, no problem.”

    And MeYou thinks the DA might have had a shot at a perjury conviction in the Hibbs case? LOL Riiiight!!! And if he had taken ’em to court and lost, which he would have, there would be those who would have criticized his office for wasting tax payer funds on an unwinnable case.

The officers saw me taping them trying to give other tickets and wrote down my license plate, then waited until i moved my truck and honked only a time or two and pulled me over. So their claim of only ticketing “excessive honking” is a lie. They were trying to bully me for supporting the protest. Here’s the video from before the ticket when they were writing down my plate number:

    And it doesn’t take that many cop cars to chase someone down for honking too much. It was an act of attempted intimidation.

    1. I witnessed this gentleman get in his truck and drive by the FPD and was pulled over immediately because the officer that took gown his license plate had radioed ahead to the patrol cars that onederas909 was on his way through the intersection.
      This guy did a fantastic job of filming his encounter and truly kept his composure throughout.
      This citation contradicts what Captain Dan Hughes had stated when I confronted him about why they were being pulled over for honking, because he had told me that they were only giving warnings. When I took onederas909 and his ticket back to the Captain, he backpedaled and went inside for a couple of minutes and came back out to say that he had dismissed onederas909’s citation.
      One of the best parts was when all of the protesters did an about face and began chanting and making even MORE noise so that the officers wouldn’t be able to think or radio ahead to issue citations. Power was definitely on the people’s side on Saturday and the cop’s dug their hole even deeper on their own without us handing them a shovel. Simply amazing!

    Props for taping them. Have you posted the vid of you taping them trying to give out other tickets? I’ve seen the 3 vids starting with this one on youtube, but nothing shows where they were giving them out to others. Maybe I misunderstood you. And they were definitely trying to intimidate you. If we for a moment can put aside the fact that this was yet one more attempt to bully, intimidate, and harass the public from voicing unfaltering opinions towards the police, and instead only look at the citation from the perspective of job performance, the captain (or whoever gave the order) needs to be fired for incompetence. I actively participated in the protest on Saturday, and it was one of the most uneventful to date. …. up until they pulled this stuff that is. NOW the FPD is back in the news. How could they not not see this coming? I can honestly say that if we had an infiltrator high up in the department, they could not have done any better than whoever was calling the shots that day. The capacity of the Fullerton PD to misjudge the public is mind blowing.
