Yesterday a strange creature crawled out of the ooze – a fellow named “Roy” (fake name), who claimed to be the jury foreman in the 2013 Kelly Thomas murder trial.

This pathetic SOB sent in a request for a hearing on the John and Ken radio show to set the record straight about the verdict. Why now? Apparently he and his fellow pumpkins on the jury have been subjected to all sorts of mean social media ridicule and threats (he says), even after three years. It didn’t take John and Ken long to get sick of this whiner’s attempt to dodge, deflect and then diminish what the cops did to a skinny, sick, homeless guy.

You know “Roy” is soon to get his ass handed to him when he describes, Lou Ponsi-like, the brutal assault as a “scuffle,”

“Roy” doesn’t recognize Ramos trying to intimidate Kelly, and it doesn’t bother him a bit that Wolfe actually struck the blow that caused Kelly to run – a perfectly natural move for someone who has been threatened and hit with a cop club.  Those provocations were really at the heart of the episode: the entire drama was caused, deliberately, by Ramos and Wolfe.

It is particularly nauseating to listen to this moron explain away Cicinelli pulverizing Kelly’s face as a necessary tactic against the struggling homeless man; and then declaring that Kelly died not of facial injury anyhow, but by “chest compression” whatever the Hell this dimwit thinks that means. The fact is that the blood inhaled from Kelly’s severe facial injuries caused asphyxiation at the same time the cops sat on his chest.

And of course this human vegetable ignores the aftermath – the Fullerton cops willfully ignored the unconscious guy who was dying in the gutter – as they got their little scrapes band-aided by paramedics.

File this one under “better to keep your mouth shut asshole, and just go away.”

  1. I listened to this on the way home from work yesterday. This juror is a sick apologist for the cop culture of brutality. He is responsible for the aberration of justice known as the Kelly Thomas trial and he deserves whatever torment he is still receiving.

How the Hell did 12 ppl find these bastard cops not guilty!? If it had been their child in the video that got beat to death they would have wanted justice like anyone else…the police department has to have a hand in the jury paying them off, etc..
      Nobody that watches this video could say their not guilty and not just the two that started with Kelly Thomas but ALL of them…if it were me I would take some of my settlement $ and their ass would pay out the ass for what they did!! This infuriates me! Its sad!! I don’t trust ANY cop!

    2. You have the right to resist any unlawful arrest with necessary force up to and including lethal force. A cop loses his enforcement powers the very second he breaks the law, not later when his supervisor takes his gun & badge. So, if you know what a cop can’t do, which the government has always counted on you not knowing , it completely changes the dynamic. The Thomas jurors weren’t aware that cops
      must follow the law, evidently.

  2. Listen to this dolt and you can see how the video was broken into tiny little segments by the defense in each of which no serious offense occurred. Then the murder is re-assembled as a hundred no-fault incidents – no greater than the sum of its parts.

    The whole thing is written off as some sort of mistake, an unavoidable “tragedy” in which no one, really, is to blame.

    And that dead man over there who was alive only twenty minutes before? Well there’s really no telling how he got that way and certainly no way to blame anybody.

    1. Simply correcting a statement made that was not true (“a 30 minute beating caught on tape”). John and Ken ignore or stretch the facts in order to sensationalize issues. There is a lot here to disagree about already. No sense in making misleading statements.

      1. The point is that a 20 second beating could suffice to be the ultimate or decisive cause of someone’s death. Neither the exaggerated 30 min nor the only 2 minutes are appropriate statements. The jury foreman talk is very alarming as to his judgment to reach a just verdict

        1. You are absolutely correct that sustained trauma, for any length of time, could be deadly. But you are conflating two issues here. Nobody suggested that the police were any more or less at fault due to the duration of the trauma. One of the radio hosts said this was “a 30 minute beating caught on tape” and he was called out on that for irresponsible reporting. The vast majority of the public either did not see the video or only saw/heard excerpts. So the host’s statement was incredibly misleading.

          2. I watched the whole 34 minutes. The beating began the minute the lucifer minions arrived. First the intimidation then the massacre finally the removal of the body. What the h— is wrong with society. Anyone that took part or witnessed and did nothing should face a very long time in seclusion. They do not deserve this world anymore. I have thought a long time, if I had a gun I would have killed one of the minions. And I would have been aquited. The real reason this happened is because we are cowards.

    1. Kelly Thomas, first off, should always be remembered, no matter what kind of gross actions his father took before or after his death. Having a father lacking in character is not justification for being murdered by the police. Kelly was brutally murdered, this murder which was caught on camera that I know many people can’t even stomach to watch. His existence dependent on hand-outs from good people, dumpster diving for food and curling up on the streets was his bed. Due to his mental illness and its manifestations, Thomas met the legal criteria as a person with a disability. Fullerton PD targeted Thomas because he was disabled and they beat him to death. The trial of the police officers responsible for his death diced the facts from three men beating a mentally ill, malnourished man to death into an unrecognizable event much like Kelly Thomas’s face when Ramos, Cicinelli and Wolf were finished beating him. Fullerton’s provincial liberals labeled Thomas murder an “altercation in downtown”, The objective eye of Gennaco, and I write that subject with sarcasm, for big bucks from Fullerton city council, changed Fullerton PD from thugs into merely being smug/complacent. fullerton’s civic leaders, its provincial liberals have no shame or pity.

(Roys photo shop in Fullerton owned by one of the disgraced engineers from same place, I believe,) Ralph et al laid off and made prematurely old. So, how did you “Measure” his social functioning and determine his orientation? The GAF scale is used for Global Assessment of Functioning. There is no “Acceptable for society” category rating. I have to wonder how a professional can render an “acceptable for society.” There is no such category of functioning in the GAF that I have seen. However, I won’t dare to opine in this public format.

          The point is Kelly Thomas, was a PERSON first! He was a young man about my son’s age and my heart goes out to his family. He may have gone back on some things he said, but you know what? Keep the money, nothing could ever be enough to lose a child this way.

          My friend knew Kelly and they met at TRC. He was a mild mannered kid. When you forget and post this way you are dehumanizing this son, child, man, brother, human being. Please don’t!

          Kelly was a human being. Period! What happen does not require any other categorization.

          2. Yes, I do have a degree, Dixie State University. Although I may not have a doctorate yet, I am educated enough to see that he was compliant enough to sit on a curb as directed. This is a demonstration of social functioning. I guess I was referring to Oppositional Defiant Disorder. Althoug DSMV has altered, in some cases, the criteria spectrum, ODD is a disorder that is in correlation with schizophrenia. I was not commenting on his character. Most people with schizophrenia do have good characteristics. However, schizophrenia is a disorder that carries a plethora of social disfunctioning. My comment was to merely point out that it was the behavior from the police that resuted in Thomas’s death and at the time his disorder had no immediate role.

    secondly, its my belief that sargent Kevin Craig by denying other officers on duty to take off hadcuffs that would have helped him breath ulitimatly lead to the death of Kelly. In the Genoco confidential report , in which he was repremanded for misconduct,it also states that Craig had his foot on kelly “holding him down” after he was near comatose.     1. This theory (that the asphyxiation occurred after Kelly Thomas was handcuffed) was not presented at the trial but it always seemed the most logical to me. Another contributing factor was the possibility that the suspect was HIV positive and neither the police nor the EMT were eager to confirm a clear breathing passage. Before Kelly Thomas was identified, the dispatcher mentioned another name and indicated that he was HIV positive. Also, the ER doctor testified that Kelly Thomas was not properly intubated and may have been denied oxygen for several minutes before the tube placement was corrected. The EMT denied this but it makes more sense than “chest compression” during the struggle.

  12. If you want to believe that the jury was threatened by the police, paid off by one side or the other, or too stupid to be objective, feel free. Those perceptions exist in large part due to the one-sided reporting and media coverage. My goal was to explain what evidence the jury was permitted to consider, what evidence/theories were deemed credible or relevant during deliberations, and how the ultimate verdicts were reached. Unfortunately that was cut short by the hosts’ self-righteousness and moral grandstanding. Nobody is asking for sympathy.

      Indeed it was, describing the event as “tussle, scuffle, a veritable pillow fight until Kelly just sort of dozed off from boredom never to wake up again.

And yet at the end a man is dead, choked on his own blood as the cops that did it are standing around laughing and having their boo-boos tended to by the medic. From the very first words out of Ramos’ mouth, his body language spoke volumns the way he stood there flipping his baton in his right hand and later switching to his left hand flipping the flashlight in it—both of which are similar gestures of slapping their palm with either tool to INTIMIDATE the person before them. I have RARELY seen an officer do a flippantly intimidating gesture as this. Then when he slaps on his gloves and tells Kelly, “you see these, they are going to f*ck you up!” At which point Kelly was not resisting or combative, Ramos worked himself up into a killing frenzy from the moment he began to question Kelly. It was obvious that he knew good and well to whom he was speaking and went way overboard with the name and id stuff. Then the beating begins with Kelly quickly being put down to the ground, but after watching the videos (a few different angles and versions), it quickly becomes evident that Ramos begind to cover his ass by saying Kelly was fighting eyc. Who on earth in their RIGHT MIND can view that video or read the transcript and honestly believe that Kelly Thomas was even being aggressive?!?! Let alone resisting?!?! Yes, it sounds as though he tried to flee, but by his words saying , “I’m sorry …etc… there was NEVER one single moment that ane one of those officers felt threatened!!! BUT in the midst of their murderous beating, you can tell when they began to regain some control when CRamos’ voice tone changes to like (uh oh wtf have I/we done. Both Ramos and Cicarelli then begin to attempt to JUSTIFY their actions REPEATEDLY to the emergency crew members who had arrived. They sound similar to anyone who is guilty of WRONGDOING trying to cover their assess because they were caught with their hands coming out of the cookie jar. You idiot, Roy, or whoever you are said on this show that they were trying to cuff him and he was fighting so that’s why they kept having to beat him. According to the videos I listened to and the written transcript, Kelly was cuffed early on in the scuffle shortly after they took him to the ground (yet Ramos kept insisting that he must have been on something cuz he was so strong fighting them off.) He repeatedly made these claims, including being bitten on the leg. So Ramos, “you claim Kelly must ne on something because you couldn’t get him down but yet he bit your leg?!?! Were any pictures taken of this so called BITE he felt thru his pants?!?!?! I am sorry that you people on the jury had such low opinions of Kelly Thomas because he was homeless, a transient and mentally ill that you could not really have studied the cold hard FACTS right under your noses and let these guys off scott free simply because they fit into what each of you find acceptable. All persons are to be treated EQUALLY under the rule of law, but that was non-existent in this matter! Oh, and Roy, I just read your rediculous comment about the possibility of Kelly being HIV positive—what the hell does that have to do with this case?!?!! And you claim to have gotten threats, but you search out comments in the case yourself—as you said, no one sends you threats to your home or social media…so you, too, are being rather sensational a wee bit there!
      I would love to stand face to face and have you look me eye to eye so I can see if there is even a glimpse of a soul there. However, I would rather not breath the same air around you.

Roy, I find it hard to even FATHOM how any of you sitting in the jury could have EVER seen Ramos as he was slapping in his gloves and thrusting them at Kelly saying, “you see these, they are going to F you up (and he didn’t use just the letter) and proceeded to literally beat Kelly to death.

      I remember to this day that as u watched the video of the exchange between Ramos and Kelly that it was simply a matter of Ramos reaching a turning point where he was fed up with trying to readon with Kelly, who simply couldn’t sit still like a child, and wanted to hurry up and get it over with and at no point in the exchange was Kelly truly resisting and not obeying commands to the best of his ability! He wasn’t being rude or smarting off, he just simply couldn’t sit still and Ramos reached his boiling point and as a result decided he was going to “f*ck” him up beat the life breath out of Kelly. Kelly suffered over 50 skull fractures and they did the knees drop on his chest which crushed his chest. I have his picture saved on my Google pages. It is an event I will never forget and never comprehend that any jury would acquit the officers involved. This situation was not ok and was incredible excessive use of deadly force for really NO reason that any reasonable person would see. So every single member on that jury has Kelly’s murder on their hands as far as iM concerned along with Ramos and the other two cops. I hope none of them have been allowed to continue in law enforcement but I imagine they have.

      I hope you see Kelly’s bloody, bruised and batterered face and head every time you look into the mirror and I hope that image visits you in your sleep!

      Rodney Kings beating was just as awful, but at least he was a big guy who didn’t die from it but he sure had his nervous system with PTSD afterwards. And to know that all those cops got away with it like these should never happen in this country or in the world again. It should be charged as a crime against humanity!

      Here it’s been 12 years since this happened and it still makes me sick that the jury acquitted these cops and that the cops did such an inhumane thing to anyone!

  13. No Justice in this life for Kelly Thomas. Sometimes justice doesn’t happen in this life. Emmitt Till, Robert Leone, Nicole Brown Simpson and Ronald Goldman, Kelly Thomas. Whenever I read cases of wrongdoers getting away with evil, my heart just sinks down so hard, especially in the Kelly Thomas and Emmitt Till cases. But the wrongdoers will not get away with evil forever. Everyone dies, and everyone faces God, and accounts to him for the good or evil they have done in life. It is far better for the wrongdoer to ask forgiveness in this life, than to face God with your sin.

    Yes, I know. Very true!!This is similar to what happened to my cousin. She was beaten up by her husband on a domestic abuse incident. The husband stated during examination: ” I just wanted for her to shut up”

  15. Kelly Thomas not shown mercy by: Fullerton PD, Fullerton city council , Fullerton’s pilars of society. And he never got justice from the court and the court of public opinion’ . These two facts tell us good people of Fullerton that our municipal government is corrupt and it only serves itself, our police department is a menace to our town. For too long , the good people of Fullerton have allowed its city council and police to break the law and public trust.

  16. With the training Roy received and his knowledge on the inner workings of juries, and as jury foreman, he might have manipulated and directed his way the jury deliberations. . I only can say is very suspicious

When the adversarial system is blurred, the defendant’s lawyer might go for what otherwise would be a self-destructive sacrilege: unchallenge a candidate to serve as jury member who had had training as a prosecutor and possessing a prosecutorial mindset. Thomas’case voir dire is a gold mine for phd criminal law students

  18. Of course the lucifer minions got away with it. They knew they would, thats why they did it. Thats why these lucifer minions all over the US do these horrific murders, etc… Because they know the other minions in courts will protect them. Thats why it will never stop. Untill the witnesses, and there is always one or more, feels the power of God and steps in to stop it. We are all cowards, untill we are no longer, this will never stop. It is up to us. For all those who stood by and watched, if it happened again would you do the same thing? I wondered for a long time, what would I have done, I just don’t know.

  19. The Fullerton PD only learned one thing from the Kelly Thomas affair. How to use body cameras to frame suspects. I was recently, wrongfully arrested because city attorney Dick Jones is trying to cover up a child molestation case for the mormon church. Yes, the FPD is helping mormons cover up child molestation. They came to my home searched me twice, then winked and changed positions. while one officer kept the camera on my face the other reached between my legs and grabbed my package. without thinking i spun around and almost knocked him through a plate glass window. fortunately i stopped when i saw the uniform, but not before i barely touched him. fortunately i have a witness. When i was booked they removed 56 dollars from my wallet which they refused to return.

    there criminal actions against me go back to 1970. i was a straight A student, an eagle scout, and i made the mistake of selling a marijuana cigarette to a friend. when i was arrested the police chief brought a reporter into the booking room and the next day my picture was on the cover of the newspaper. totally illegal. Fullerton, shame on you!

    They knew what they were doing. To them Kelly was nothing but a useless weak POS wasting their taxpayer money while on foodstamps. (FYI: HE got no FS and relied on charity not taxes.)

    One of the jurors this fat animal was smirking after watching the brutal video and going out to cast the verdict. You could tell what was going to happen.

  21. So glad that you called him out for that. We all watched the entire video, and heard the audio. Those police treated Thomas as sub human from the very moment they engaged him. What I find most offensive, is the fact that jury and all the other police apologist expect people to just lay there and comply while their heads are getting smashed in, beaten with batons, and tazed. I would like to counter that, I watched a video of a man who was subdued, unconscious, lips turning blue, and the cops were still beating him and screaming stop resisting while on top of his limp and as it turned out dead body. They were literally beating a dead body and accusing it of resisting. You hit the nail on the head when you said some of them are just ticking bombs. This case was so disheartening, the fact that it actually went to trial was a miracle, the jury failed Thomas and their fellow men. They with overwhelming evidence to the contrary found murderers innocent of murder. Their lack of value for human life is equal to the men who actually killed Thomas. They essentially ruled that Thomas Kelly was disposable/discardable and of no value. I hope his screams, and pleas haunt them for the rest of their lives.
