So Who (Besides Bruce Whitaker) Hasn’t Seen The Video?

Here’s an article by the pathetic Lou Ponsi in the OC Register about a guy named John Huelsman,  an ex-cop, who unluckily happens to be the step-father of Jay Cicinelli, the Fullerton policeman charged with the beating death of schizophrenic homeless man Kelly Thomas, last July.

This man popped up at the last council meeting nattering the same nonsense about what an angel his step-boy is, so this isn’t really news. What is news is this guy’s claim that he has been able to review the City-owned video that captured the Thomas killing.

Let’s assume for the sake of argument that Huelsman is actually telling the truth. This begs the question – who hasn’t seen the video? We know that our elected representative, Bruce Whitaker is being illegally denied the opportunity to see it. But, really: the freakin’ step-father of the accused gets to watch it? Really? And a Fullerton council member may not?

So who let this guy watch the video? Was it the FPD? Was it the District Attorney? Such questions seem not to have occurred to the incurious idiot Lou Ponsi whom we can all count upon to miss the real story while peddling pro-cop bullshit.

Somebody better explain soon why some clown from who knows where can watch the video, when the people’s elected representative can’t.

So who let this creep watch the video?

Hughes, care to answer? Is he a liar?

  2. #2 by just a guy on March 2, 2012

The city is liable for the creep Cicinell’s actions. It’s goddamn unconscionable that city leaders can’t watch the tape but this fool can.

  3. #3 by fullerton lover on March 2, 2012

I think the DA should subpoena his stepfather ASAP and find out how Mr. Huelsman was able to freely watch this video, whereas Kelly’s own mother, Cathy Thomas, has to hire an excellent ex-deputy District Attorney named Brian Gurwitz to try and force the DA to allow her to see the video?

  4. #4 by merijoe on March 2, 2012

I heard from another blogger (ACU) that Cici most likely had a copy because it’s evidently his right to have one, so he must have showed daddy.

  5. #5 by Tuco Ramirez on March 2, 2012

Hey the city liability is in the over $10,000,000 class and guess what? The city council that has to pass judgement on the size of the payment can’t even get to see the video. Ooops, Pat McPension and Tricky Dicky Jones saw it. But thats ok, one is a Doctor and the other is an ex police chief.
Well, Fullerton, you sure will need a water tax INCREASE when this all gets over with. So call off those Howard Jarvis taxpayers Association wolves now since you need the money for Pensions and beatings, killings, stealing, and sexual perversions with “bad girls” in back seat of police car!
I wonder what Sgt. Goodlie has to say about all this?

Merijoe, Huels watched the copy of his sons tape he no doubt now has, and is entitled to have by law.

So pops comes over to sit down and look at this tape for himself.

I would too if I could.

  7. #7 by vw type 53a on March 2, 2012

The LEO’s involved had chance upon chance to change their reports, so they obviously had ample time to review the evidence. It will be so fun to watch their demise…for far too long they have had the upper hand and I, for one, will giggle as they squeel like the true pigs they are. I just hope at the end of the tunnel we aren’t responsible for paying their bloated pensions…

  8. #8 by Goodie Goodbar on March 2, 2012

We all saw the video when we wrote our reports. We all made copies. Duh. That’s why I’m surprised some disgruntled cop didn’t come forward with some internal lies and BS and sue like everyone else. I guess FPD must be all happy and loving inside with no leaks. I like Mr Goodbars.

  9. #9 by AntiCorruptionUnit on March 2, 2012

    ATTENTION EVERYONE!!!!!

The officers accussed of this crime Ramos & Cincinelli have copies of all or most of the evidence against them, given to them by their attorney’s after discovery was filed by the defense.

NOTHING ILLEGAL going on here WHATSOEVER!!!!

I am sure the defendants have been instructed by their attorney’s to review the material and let them know if they see any problems, or address any question they have. AS attorney’s should do with their clients.

I am sure Ramos & Cincinelli have reviewed that tape themselves many times, making notes or pointing out something in that tape they think their attorney should be aware of.

Those guys might have a friend or family member sitting with them going over things assisting them for whatever reason.

So it would not be unusual for a family member to have seen this tape at this point in time, as Cincinelli’s step dad obviously has.

He commented on it without being specific, and he is entitled to his opinion like anyone else.

  10. #10 by Big Friend on March 2, 2012

What kind of question is that Sipo? The answer is simple; the only ones who can watch the video are the good folk who side with (trumpets please)Law Enforcement. They aren’t going to allow people like Whitaker, terrorists, gangsters or FFFF bloggers know anything because they could use the knowledge for evil purposes.

  11. #11 by Lifesaving Service on March 2, 2012

If Huelsman saw a copy that his stepson has – I wonder what the stepson’s attorney thinks about Huelsman commenting at the last City Council meeting.

Or, perhaps the attorney has no issues with it, but it’s pretty damn stupid on Huelsman’s part to come out and say he saw it when at least one council member (Whitaker) hasn’t.

Probation officers allegedly hurt hundreds of juveniles in their care

    Christina Villacorte, Staff Writer
    Created:   03/02/2012 11:37:26 AM PST

Even under the watchful eyes of federal monitors, Los Angeles County probation officers still are being accused of using excessive force on hundreds of juveniles in their care, according to a report released Wednesday.
The report from the Office of Independent Review also noted that off-duty misconduct by probation officers resulted in 69 arrests in 2011 – half of them for drunken driving.

It added that some teachers in juvenile halls and juvenile camps were found to have instigated “gladiator fights” among the wards in their classrooms, but could not be disciplined fully.

The local watchdog agency issued the report after the county Board of Supervisors ordered it to take a closer look at how the Probation Department investigated the conduct of its employees.

“Severe misconduct is frequent enough to have resulted in the discharge of 14 employees last year,” the report said. “The reasons for the discharges ranged from lying about an improper use of force against a client minor to defrauding a federal loan program to carrying on a covert relationship with a felon.”

“Off-duty behavior resulting in arrests also continues to flourish,” the report added. “For example, 69 employees were arrested by other law enforcement agencies or were named suspects in a criminal investigation, almost half of them for driving under the influences.”

Cynthia Hernandez, an attorney with the OIR, said the agency looked at 303 disciplinary cases against

probation officers in 2011, and the vast majority of them involved allegations of using excessive force on juveniles.
Many of the allegations have yet to be resolved.

She said one of the most egregious disciplinary cases involved a female probation officer getting into a fight in a restaurant, shattering a wine glass and using it to cut another patron’s face and neck. The victim was permanently disfigured and the probation officer is now serving a four-year sentence in state prison.

Robert Miller, deputy chief attorney for the OIR, raised concerns about certain teachers arranging competitive fights among students in their classrooms.

Since the teachers are employees of the Los Angeles County Office of Education, the Probation Department is limited in its ability to discipline or punish them, Miller said.

Neither Probation nor LACOE immediately responded to requests for comment.

Federal monitors are separately looking at Probation to determine whether it has implemented all 41 reforms required by a federal consent decree.

The point of the post is pretty obvious to anybody with a 10th grade education: at this point the video is virtually in the public domain.

So why can’t Whitaker see it?

  26. #26 by The Fullerton Harpoon on March 2, 2012

Precisely. One of the reasons Whitaker is not permitted to see the video: he might talk to Lou Fonsi.

Law enforcement wishes to remove videos to protect against defamation but google chooses transparency

    Googles responce…

Google has hoped to make their position clear with their Transparency Report.http://www.google.com/transparencyreport/
The report corresponding to the first half of 2011 has an interesting little extra tidbit: “We received a request from a local law enforcement agency to remove YouTube videos of police brutality, which we did not remove.

We live in a society where every single word can and will be used against you in a court of law. But silence many times proves to be the undoing and is purly defensive. Transparency is the positive assertive way to resolve conflict.

Fulleton can learn from its mistakes and realize that focusing on liability only will cause more problems than not.

  29. #29 by AntiCorruptionUnit on March 3, 2012

It sounds like the video is in the public domain but it’s actually not. I would agree a certain circle of people are in the know.

FPD, the DA, defense attorney’s and their clients have copies that’s for sure. Investigators have look at it. Many might have made a copy for themselves.

More than a few have seen it, but their not talking.

@#19, NO gag order issued on this case to my knowledge. No issue with the step dad saying what he said.

If you think back a couple LE officials have made comments that what they watched was “horrific” or words to that effect.

That might be considered the opposite of what step dad said.

As to Councilman Whitacker, he has ran into several roadblocks in this saga.

His recourse is to seek relief from the courts if he feels his “right to know” is being blocked by his peers within the city.

The reason he is being blocked should be obvious to those paying attention.

But it’s up to Whitacker to take action on this. Otherwise everyone will continue to ignore him.

WE will know if the defense attorney’s think that if the ask for a change of venue in this case.

If that happens, and this case is moved out of the area, someone is going to be spending a lot of gas money to watch this episode from start to finish.

    From Ron Thomas’s Facebook ”
    Ron Thomas

Now that it is coming down to the wire, it appears that the defense strategy for Jay Cicinelli is to have the Cicinelli Family verbally attack me. Starting with the stepfather, and now the sister (see Ron Thomas on Facebook). I’ve always quoted facts, and told the truth on every issue. When lashing out in anger Jill Cicinelli, be sure that you have done your homework. My time with the Sherriff’s Department for two days, or forty years has absolutely nothing to do with the murder of my son. Another fact is that everyone (but you) knows that Kelly’s mother filed a restraining order on Kelly. NOT ME! Do I know something that you don’t about your brothers actions? Evidently I do.”

  36. #36 by merijoe on March 3, 2012

    Facebook from Jill Cicinelli

Jill Cicinelli Ron Thomas…… my name is Jill Cicinelli, Jay’s sister. I have sat back and been silent for months now and I just can not be silent anymore. I would really like to say these things to your face but this will do for now. First of all, we are all sorry that Kelly lost his life but that was from choices that he made. At first I was even sorry for his family but now I am not. Here is why. You have used your son’s name and this incident to create such a circus and I have some questions for you. Why have you told everyone you are a retired LEO when you actually didn’t even pass probation. Why are you making it out that Kelly’s death is such a loss to you when you had a restraining order against him and hadn’t seen him for some time? WHY WHY WHY on earth did you not give him this attention when he was ALIVE? If so he may not be dead now. You are feeling so guilty for everything YOU did or did not do and now you are trying to blame it on everyone else. You are some piece of work Ron Thomas. It really does not matter what you think of my brother because the truth will come out that he DID NOT murder Kelly. He is a good man, a good and true Police Officer and an excellent father to his children, something you might have a hard time understanding. I would suggest some professional help might be in order for you to deal with your actions and what role you played in Kelly’s life and death. Get the help you need Ron Thomas and quit blaming everyone else. JUSTICE FOR JAY!!!! And I don’t want to see one comment from anyone on how I can say these things to “poor ron thomas” You have all been calling my brother a murderer for months now as if you know all the facts, you haven’t a clue.

Everything you say on this subject seems true, ACU.

When Whitacker gets before a judge, the judge will see the denial of Whitacker’s viewing of the recording as incoherent given the access to the recording given to other legitimate parties. Judges hate incoherency.

It won’t happen, but I would love to see McKinley put under oath to be asked if he has seen it. Then again, McKinley may have been “smart” enough not to see it but to trust a detailed “need to know” description from someone else at FPD.

    Jill Cicinelli,

Like your unfit, psychotic husband, you obviously have NO idea what it is like to parent a kid with schizophrenia, nor do I have the time to educate a small-brained individual as yourself.
I happen to be a single parent of a kid diagnosed with bipolar 1 and schizoaffective disorder. The only thing that hasn’t been evident yet is him ‘hearing voices’, which usually classifies one who does as schizphrenic, like Kelly Thomas was.
Take into account that Kelly was a thirty-seven year old man at the time your poorly trained police husband went off and violently MURDERED him!
Once you hit the age of 18, you as parents do not have the control you had prior. Schizophrenics often experience paranoia. You’ve heard the term paranoid schizophrenic.
To give you a better example, go watch the movie, ‘A Beautiful Mind’ starring Russell Crowe as mathemetician genious John Nash.
For your kind and others like you, the only way you could possibly see this from Ron Thomas’ and his family’s perspective is if one of your kids where bludgeoned to death at the hands of law enforcement officers. Perhaps that will be your fate someday.
Perhaps when your kids are out one night having fun, they may have an encounter with a group of rogue cops (like Jay) and get their faces bashed in and possibly die as a result.
Now, imagine if all the above were to come to pass and one of THOSE people (like yourself) said it was “all YOUR fault because YOU failed to care for them.”
    How would that feel?

The hospital photo of Kelly Thomas, taken by his dad that night completely demonstrates that officers were ‘out of line’.
Murder victims of white supremacy gangs and Asian Triad gangs (whom are some of the most violent) do NOT do this to their worst enemies.
What your badged-thug of a husband did to Kelly Thomas was animalistic.
Kelly’s face looked worse than the face of that man who was attacked by his pet orangatan a few years back.

    In closing Jill, you are an ignorant C U N T !

OMG ! You people have reached a new level of stupidity I didn’t think even you all capable of!

PLEASE DO try to explain how the father of a defendant speaking out on behalf of his child is ANY different than the Thomas family speaking out with their opinions?

“A blantant attempt to pollute the jury pool” ? If that is how you feel, wrongly I might add, how is it you don’t equally apply that logic to the Thomas family calling him a murderer, over and over and over?

They are both grieving family members who can say whatever they like. They are not involved in the investigation, have no authority.

As to why the father a saw the video – i agree with ACU – defendants & their attorneys are entitled to acces to the evidence that will be presented against them, and it appears he has his father joining him during his meeting with his attorney. How freaking hard is that to figure out????

If you all would cut the crap and stay focused on REAL shit, you’d be alot more productive!

Yes it is true. The DA said that in order for me to watch it, he wanted me to sign a discloser agreement stating that I would not discuss the content of the video with anyone. Garo and I agreed, but Cathy’s attorney said no. So, he then sued the DA. I think that the real question should be, Why did Cathy get her own attorney?

  59. #59 by Ron Thomas on March 3, 2012

The City does not decide on the civil judgment. A jury in civil court will do that.

  60. #60 by Ron Thomas on March 3, 2012

“how is it you don’t equally apply that logic to the Thomas family calling him a murderer, over and over and over?” Well, the fact is that Kelly was beaten to death, Murdered, not the cops. It’s not the same logic at all.

    Evolution of Morality
The development of modern morality is a process closely tied to the Sociocultural evolution of different peoples of humanity. Some evolutionary biologists, particularly sociobiologists, believe that morality is a product of evolutionary forces acting at an individual level and also at the group level through group selection (though to what degree this actually occurs is a controversial topic in evolutionary theory). Some sociobiologists contend that the set of behaviors that constitute morality evolved largely because they provided possible survival and/or reproductive benefits (i.e. increased evolutionary success). Humans consequently evolved “pro-social” emotions, such as feelings of empathy or guilt, in response to these moral behaviors…

…Of historical interest in psychology are the theories of psychoanalysts such as Sigmund Freud, who believe that moral development is the product of aspects of the super-ego as guilt-shame avoidance. -Wikipedia

You haven’t seen anything yet. Kelly will be drug thru major mud. It’s going to get straight nasty. Will be hard to bring much mud on the cops in court with no priors in their jackets but they will try.

    THE PSYCHOLOGY OF EVIL
    Stephen A. Diamond, Ph. D.

Hostility, hatred, and violence are the greatest evils we have to contend with today. Evil is now–ever has been, and ever will be–an existential reality, an inescapable fact with which we mortals must reckon. In virtually every culture there has existed some word for evil, a universal, linguistic acknowledgment of the archetypal presence of “something that brings sorrow, distress, or calamity…; the fact of suffering, misfortune, and wrongdoing.”[1] Yet another of Webster’s traditional definitions links the English word evil with all that is “angry… wrathful,… [and] malignant.”[2] The term evil has always been closely associated with anger, rage, and, of course, violence. But today we seem uncomfortable with this antiquated concept. Our discomfort resides largely in the religious and theological implications of evil, based on values, ethics,…

…But, if finally we accept the necessity of discerning between evil and good, who then shall be the crowning connoisseur of good and evil? The individual? The community? The court? The State? The priest, rabbi, or psychotherapist? How can we make constructive, humane use of such categories? To whom shall they apply? And for what purpose?…

The Los Angeles Police Department (LAPD), The FBI, and the CIA are all trying to prove that they are the best at apprehending criminals. The President decides to give them a test. He releases a rabbit into a forest and each of them has to catch it.

    The CIA goes in.
They place animal informants throughout the forest.
They question all plant and mineral witnesses.
After three months of extensive investigations they conclude that rabbits do not exist.

    The FBI goes in.
After two weeks with no leads they burn the forest, killing everything in it, including the rabbit, and they make no apologies.
    The rabbit had it coming.

    The LAPD goes in.
They come out two hours later with a badly beaten bear.
The bear is yelling: “Okay! Okay! I’m a rabbit! I’m a rabbit!”

FPD goes in next and beats a bear into a pulp so you cannot distinguish it from a rabbit then complains that Fullerton people do not support the FPD. Fullerton people do not understand the FPD. Then FPD goes to the forest council and begs them to withhold all information until their broken bones are healed. The council has three octogenarian bears who sniff their snooty noses at the critters in the forest and go along with the FPD because they received nice political contributions.

It has everything to do with Ron Thomas. If he would of cared for his son, he would not be roaming the streets looking and smelling like a caveman. And he was a nice sensitive individual, give me a break also Ron Thomas.

We have more questions to ask Joe Felz and City Attorney Dick Jones at the March 6th, 2012 Council meeting.

Namely, how can you both claim that Mr. Whitaker is not allowed to see the video, but the step father of the accused officer, Jay Cicinelli is allowed to study the video more than a dozen times? This was reported in the Saturday, March 3rd, 2012 OC Register article written by Lou Ponzi and Greg Hardesty.

It’s amazing how Ron Thomas’ job history is cause for so much anger among the cop-defenders. I wonder why. It’s not like it’s very hard to become and stay a cop.

Jesus, look how long it took the FPD to de-cop Albert Rincon, the serial sex predator. Come to think of it we don’t know if he isn’t a cop somewhere else because McKinley called in a favor – just like he did for Hillman in the case of the disabled Cicinelli.

  97. #97 by fullerton lover on March 3, 2012

As you so eloquently stated, defendants and their attorneys are allowed before the trial to see any and all evidence presented against them.
Last time I checked, the stepfather is neither a defendant.

  98. #98 by AntiCorruptionUnit on March 3, 2012

I’ll bet anything that if the Deputy DA in charge of prosecuting this case in his opening statements to the jury said something like this, FPD would just go ballistic. BUT it’s true.

Ladies and gentelmen of the jury.

The people intend to prove that Officers Ramos and Cincinelli are guilty of the crimes charged, not only from the evidence we will present, but from the “culture of corruption” from within their department.

It is far from a preceived culture, it can and will be proven, that the conduct of these officers on the night of July 5, 2011 was what happens within their ranks on a routine basis. Criminal activity as we know it.

Officers and employees who steal, officers who arrest citizens under false pretenses, officer who destroy evidence by ripping up their recording devices, officers who sexually molest female prisoners. Officers who have prisoners die in their presence, while in custody.

I think we can all agree these are serious issues if they can be proven. I submit to you members of the jury, THEY already have been proven.

Some of those officers have been prosecuted by this office, others have been terminated from their employment. There are cases pending.

As part of the people’s evidence, we can show you a judicial opinion from a Federal Judge who gave a scathing legal opinion on how the Fullerton Police Department FAILED to handle a officer who in this Deputy DA’s humble opinion, could be classified as a sexual predator.

We can show you law suit settlements that suggest there is a problem within the ranks of FPD also.

All of these incidents ladies and gentlemen, within the last couple of years. I submit that Officers Ramos and Cincinelli were working with these individuals too.

We submit to you that at least two law suits are pending, and have NOT been dismissed by the courts for being frivelious. Those issues involve matter of one’s civil rights.

The defense may attempt to re-direct your attention away from all this, by focusing on Kelly Thomas’s past.

A man’s past filled with mental illness that even members of FPD were aware of, just before events lead up to his death.

They will tell you that Kelly was a criminal, and suggest you set aside the facts of his death, based on that past.

We must remember that Kelly Thomas was suffering from metal illness, Officer’s Ramos and Cincinelli were not, nor were the other members of the Fullerton Police Department when they committed their misdeeds.

The members of the Fullerton Police Department are suppose to be free of metal illness, when they perform their sworn duties. They are also well paid and trained, they are expected to control themselves, in the highest of standards of public service.

They are trained to take people into custody without killing them, especially when they have significant numbers present to do so.

Would you hold Kelly Thomas to such standards, a man with a metal illness that is unquestioned?

    YES LET’s SLING some mud.

  99. #99 by Joe Sipowicz on March 3, 2012

We are recalling the three dead tree stumps. That is very productive.

If you were a little brighter you would realize the point of my post. Which is that Bruce Whitaker has every right – even an obligation – to understand what happened that night. And he can only do that by watching the City-owned video.

The defendant has ALREADY watched the video, remember? In any case, step-dad has no inherent right to watch it if it’s so damn sensitive. Yet he gets to watch it and Whitaker can’t. Shameful.

Look, DHYB and other coplicking – snobs in blue trolls -
It’s really ironic, because the police you so love are worse than panhandlers. You can ignore panhandlers if you want.
You don’t have to give them money (or anything)
You are free to do as you please.
On the other hand, police are basically welfare whores, but violent.
We know they are welfare whores because we are forced to give them money.
If they were actually providing me a service I desired, I would buy that service voluntarily; the funds would not have to be extracted from me by taxation.
Even worse, you not only have to pay to feed them and keep them alive, they do destructive things with your money.
They beat your neighbors, give you stupid tickets (extortion) and on occasion kill people and animals.

It’s really terribly nonsensical that you’d wish a violent beating/death upon a panhandler who is really bothering no one and was not “breaking into cars” you trash, but show such great devotion for a bunch of undeserving, violent dipshits in uniform who take peoples’ money and resources by force, who dedicate their lives to robbing people of their freedoms, and to contributing to mass incarceration

  124. #124 by Seriously on March 3, 2012

Ron Thomas: you make my point with your reply, are you also polluting the jury pool by stating such an opinion?

“Sipowicz” Whitaker is a SINGLE member of an elected Council. He alone cannot DEMAND,or ORDER, anything. That is why there are FIVE members of the Council. I sat through the “Public Records 101″ class Attorney Dick Jones presented at the Council meeting (and had to repeat several times) which explained this, and sadly it still didn’t sink in. If fat ass would of talked instead of going on vacation those two scavangers wouldnt of thrown him under the bus bcuz they want to be chief. Now one scavenger is leaving and will now only be known as “the bone” bcuz he fucks around. The other scavenger has a bible in
one hand but a knife behind his back in the other. Go figure when he became patrol captain and set up special details “with his people” to go out and kick ass and take names later the problems arose…..hmmmm, and the third scavengers first order of business when he got promoted was to have an affair with the secretary……Felz get rid of the 3, get an OIR and everything will get better quick

1~why is acting chief promoting convicted criminals?
2~gennacco report coincidentally released after recall deadline? Officers just intervirwed in the last two wks?
3~why leave/trust 2 civilians working oppossite ends of wk run property dept and last audit in 2007?

I am not looking for fans! For the past 2 plus years, I have been trying to educate myself to the inner workings (or not workings) of city government. It has been a good experience watching up close how city government operates!

It is not always a pretty picture but the more of us who get involved the better our chances are to have a better city government in the future.

I care about my family, friends and my community. They know that I am pretty much an open book. What you see is what you get! I have no hidden agendas. I am 59 years young and have no political aspirations except maybe one day getting elected to the council.

Ya know, there has been so much discussion about him wanting to watch this dn thing, u really do begin to wonder just how sick he is. What the he’ll does he think he NEEDS to know in his “Official” capacity that is so critical and obvious that MUST KNOW NOW, that the DA wouldn’t have told him. He clearly believes the FPD covered up something (which the DA & Ron Thomas must now know about since they’ve seen it), so what the hell is it he hopes to see?

Whitaker does have an official capacity: a capacity bestowed upon him by the electorate. What he does with this authority is between him and the voters. No city manager can overrule him, nor can the city attorney who works for him, as well. The prosecutor has no such authority to deny him such access, nor does a majority of the city council.

When a judge in the proper court tells Whitaker he can’t view city property, the denial will be legal

    It never will be.

    @Admin
Im pretty sure, the use of the name Troll is incomplete, cyberstalking or cyberharassment is more accurate. (Under Color and even Political?)

    “Cyberbullying vs. cyberstalking
The practice of cyberbullying is not limited to children and, while the behavior is identified by the same definition in adults, the distinction in age groups is sometimes referred to as cyberstalking or cyberharassment when perpetrated by adults toward adults, sometimes directed on the basis of sex. Common tactics used by cyberstalkers are to vandalize a search engine or encyclopedia, to threaten a victim’s earnings, employment, reputation, or safety. A repeated pattern of such actions against a target by an adult constitutes cyberstalking.” -Wikipedia

  170. #170 by Lifesaving Service on March 4, 2012

“CyberAngels has written about how to identify cyberstalking:

When identifying cyberstalking “in the field,” and particularly when considering whether to report it to any kind of legal authority, the following features or combination of features can be considered to characterize a true stalking situation: malice, premeditation, repetition, distress, obsession, vendetta, no legitimate purpose, personally directed, disregarded warnings to stop, harassment, and threats.[4]

A number of key factors have been identified:

False accusations. Many cyberstalkers try to damage the reputation of their victim and turn other people against them. They post false information about them on websites. They may set up their own websites, blogs or user pages for this purpose. They post allegations about the victim to newsgroups, chat rooms or other sites that allow public contributions, such as Wikipedia or Amazon.com.[5]
Attempts to gather information about the victim. Cyberstalkers may approach their victim’s friends, family and work colleagues to obtain personal information. They may advertise for information on the Internet, or hire a private detective. They often will monitor the victim’s online activities and attempt to trace their IP address in an effort to gather more information about their victims. [6]
Encouraging others to harass the victim. Many cyberstalkers try to involve third parties in the harassment. They may claim the victim has harmed the stalker or his/her family in some way, or may post the victim’s name and telephone number in order to encourage others to join the pursuit.
False victimization. The cyberstalker will claim that the victim is harassing him/her. Bocij writes that this phenomenon has been noted in a number of well-known cases.
Attacks on data and equipment. They may try to damage the victim’s computer by sending viruses.
Ordering goods and services. They order items or subscribe to magazines in the victim’s name. These often involve subscriptions to pornography or ordering sex toys then having them delivered to the victim’s workplace.
Arranging to meet. Young people face a particularly high risk of having cyberstalkers try to set up meetings between them…

Cyberstalking is the use of the Internet or other electronic means to stalk or harass an individual, a group of individuals, or an organization. It may include false accusations, monitoring, making threats, identity theft, damage to data or equipment, the solicitation of minors for sex, or gathering information in order to harass. The definition of “harassment” must meet the criterion that a reasonable person, in possession of the same information, would regard it as sufficient to cause another reasonable person distress.[1] Cyberstalking is different from spatial or offline stalking. However, it sometimes leads to it, or is accompanied by it.”

    “Another Black Eye?”

  172. #172 by Lifesaving Service on March 4, 2012

Cyber harassment and cyber stalking are often used synonymously to describe the actions of persons who relentlessly pursue others online with the intention of frightening or embarrassing the victim. Sometimes a harasser intends to teach the victim a lesson or solicit information from the victim, and stalkers generally want revenge or attention. Laws against cyber harassment vary depending on the country, and victims should report their case to local authorities. To prevent crimes from occurring, it is important for everyone to protect their identity while on the Internet.

There is no universal legal definition of cyber harassment, but it typically is defined as repeated, unsolicited, threatening behavior by a person or group using mobile or Internet technology with the intent to bother, terrify, intimidate, humiliate, threaten, harass or stalk someone else. The harassment can take place in any electronic environment where communication with others is possible, such as on social networking sites, on message boards, in chat rooms or through email. Posting a general opinion on a discussion board or in a forum is not considered cyber harassment. -wisegeek.com

A cyber harasser often will post comments to the victim that are intended to cause distress and will try to incite others to do the same. The harasser might break into the victim’s accounts and send numerous obscene or hurtful emails and instant messages to the victim’s significant other, family, friends, coworkers and boss. A harasser might even hack into the victim’s computer and take over his or her accounts, change passwords or sign up the victim for things such as pornographic websites and spam. The harasser might set up websites using digitally manipulated, sexual images of the victim or send those images to amateur pornographic websites.

Laws protecting citizens from cyber harassment can vary from place to place and country to country.

Persons who feel they have been victimized should begin to document and collect all harassing messages, postings and other activities. If there is any indication that a perpetrator knows where the victim lives or works or how to find them offline, the victim should contact the local authorities immediately. In some instances, the authorities can track the harasser through an Internet Service Provider and issue a restraining order against the stalker. Victims who cannot file criminal charges against an offender might attempt to file a civil suit, have accounts revoked and have damaging websites shut down. -wisegeek.com

FL, make no mistake that McKinley has seen the tape from start to finish.

If anyone believes the former Chief of 16 years does not know what’s going on behind the scenes, or has not seen the video is drinking a large glass of “kool aid”.

His commentary to the media on that issue alone, tells me he has.

I’d bet anything Hughes and others, have sought his advise on some of this. NOTHING wrong with that I might add.

But for him to give the public the impression he REALLY doesn’t know much, is funny as hell.

His comments should be accepted much like the trolls, because “I said so”.

McKinley just doesn’t want to answer a thousand questions on all that. He truly does have his own problems in trying to keep his seat on the council.

Even the greatest of leaders seek out advise from those who have been there done that.

To the families of Kelly Thomas, Jay Cicinelli and Manual Ramos.

This series of comments is one of the most difficult things I have ever forced myself to read in my life. In fact, I couldn’t finish. I try to not waste time attempting to convince the masses to change their collective behavior, but I will make an appeal to you, the individual family members of both sides of what has truly become a war of words designed to wound the innocent loved ones of those involved on either side. Please individually consider stopping. Don’t worry about whether others stop. You stop. When words cease to have any productive or educational value other than to hurt innocent people, you are simply being unkind. Sometimes collateral damage cannot be avoided in righting a wrong, but in my opinion this exchange between family members and their supporters no longer qualifies. Unlike a war with guns, this war of words against family ends the moment the other side walks away.

To the bloggers on the side of wanting to see change in government. Seriously? Do you really need to start name-calling extended family in order to make a point about how ridiculous it is that the council is restricted from viewing the video when a judge has not ordered that the defense cannot share it? Maybe the rhetoric could be raised just a touch. I do not trust the system either and I think the existence of this blog is absolutely necessary to ensure that government cannot operate in the self-serving vacuum that it ALWAYS gravitates toward in the absence of a free press. And, this blog is the only form of free press doing its job. But I have to tell you, I look upon the word choices of some of you and I could not be more disgusted if you walked up to a child and just smacked them across the face. Which, incidentally, there ARE totally innocent children dramatically and tragically affected by your carelessness. If you do not personally take care to not unnecessarily add to their pain in your efforts to right a wrong, you are being abusive.

To the bloggers who support the police under virtually any circumstances. I understand that your mission is to discredit this blog and its’ contributors in general. Fine. Have at it. But do YOU not even recall that your associates have children? Are you too blind to see when the conversation has shifted to the point where they are going to pay the price for your reckless efforts to defeat that which grows as a direct result of your efforts? Namely, this blog.

To myself. Check that mirror very carefully.

Pigs grunt when they’re happy — like when they’ve been fed, Cops grunt when they’re happy — like when they’re beating someone up.
Pigs are our friends, Cops are our enemies.
Police — calling them pigs is an insult to pigs

That’s a very curious comment considering that so far no judge has even been asked to release anything.

However if the video. was locked up “early on” as you assert, why and how did Dan Hughes watch it 400 times. Is he a liar?

In any case nobody has said anything about “releasing” anything. We talking about an elected city councilman watching the city-owned copy.

well, Steve, since you allude to have the ear of our state assembly, why don’t you discuss your cousin’s role, Rusty kennedy, in the Pat McKinley inspired corruption of our town’s police force? Have you presented the ugly possibility that when Pat McKinley served on Rusty Kennedy’s Orange County Human Relations Commission’s board, fullerton’s community did report FPD’s systematic abuse of their civil rights to Rusty’s “clearinghouse” commission for police abuses against OC communities only to be ignored because McKinley asked Rusty to protect his officers. This is just my conjecture.

The step father can see, it- his son’s lawyer allowed him that, I have zero issue with him seeing it, but as a TAX payer, of this city and the tape is CITY owned property, and they wont allow me or certain city council members that viewing. So, in my world, I pay for that tape, I paid for the camera I pay for the dispatcher to zoom in and out…all me ( citizens)..So, I guess my beef is, that the perp, who did the murdering gets to view the video, rewrite his report- to his fancy, and then he gets to allow snuff film viewing from family members..really? No, then come from El centro, and have the audacity to come to the city where the murder took place , and mock me, the city of fullerton and every good LEO…by saying your son the perp, is really a good guy you saw the tape..what world does the perp get the evidence,to view and we dont, the ones who paid for it- but the Huelsman’s get to comment, see the difference? Have you seen Ron come out and talk about the tape? Did Ron drive to El centro and go to their city council meeting where his son killed a homeless guy and say…get over it, my son was great…didnt think so? See the difference? One is a victim, one is the person committing the murder.

Maybe someday YOU will understand that cops do NOT have the right to knee drop twice on the face and throat of an unconscious man, thereby crushing his throat and face. Maybe YOU will understand that cops also don’t have the right to brutally smash in a man’s face and nose eight times with the butt end of a Taser, thereby causing massive bleeding, choking, and suffocation, after the man is already non-responsive and unconscious. Maybe someday, YOU will understand that the cops don’t have the right to verbally intimidate and physically threaten a person with bodily harm to the point where that person is afraid for his life and is forced to run and to defend himself. Perhaps someday, YOU will understand that six cops don’t have the right to pile on top of a man and crush his thorax and suffocate him to death while that man is screaming for his life, for mercy and for his dad and God to help him. Maybe, someday YOU will understand that abuse, brutality and murder is not acceptable when committed by those who are SWORN to SERVE and PROTECT the public. Maybe, someday, you will understand mental illness. Maybe, someday, you will understand that there is a difference between right and WRONG.

Effective means to subdue a suspect include pepper spray, choke holds, handcuffs, tasers-not to the heart, and not bludgeoning the skull and knee dropping the throat martial arts style. The blood lust is off the charts on this one. I didn’t just fall off of the turnip truck pal. Its done all day long all over the country where the suspects come into custody ALIVE. They are supposed to be brought in for charges not in for embalming. At the rate we are going the kids wont be law enforcement officers. They will probably have the option of becoming the brownshirt likes of some blackawter mercenary force that you are already merging with right now that thinks the roman numerals on the Supreme Court doors refer to a football score.

You know ACU, I think you may have touched on something there, that I think may be at the root of the majority of the problems that these three have with their leadership styles.
As I was pointing out in an earlier post today, there is a huge paradigm shift that occurs when someonein authority transposes the two words “you will!” into “will you?”
I think that these guys whole lives have been spent telling people to do as I say and readily believe what I tell you, as opposed to asking people for their cooperation and trust.
Big difference in the two modes, and I openly wonder if this isn’t a male behavior thats generational, especially with those generations before us, where every able bodied male that was over 18 was involuntarily inducted into the military?

Hey Barry, I just listened to your comments at the city council meeting. You need to check your facts. Officer Cicinelli did pass all the tests necessary at LAPD and at Fullerton. I am sure his stepdad, John Huelsman would be more than happy to meet with you and show you the proof. Why were you pausing during your comments, was your conscience getting the best of you?

I personally have difficulty believing that this officer had passes a psychiatric evaluation where PTSD was not diagnosed before employment, and would love to see the paperwork that shows that he did.

  262. #262 by Anonymous on March 7, 2012

If Kelly would of let himself get handcuffed he would be alive today. But he decided to fight with cops. Like the retired cop said at the council meeting, we are trained to take someone in custody no matter what it takes.
