Time to “Rethink” The Fox

Ever since the City of  Fullerton climbed aboard the “Save the Fox” bandwagon, something was just plain wrong.  Somehow the redevelopment bureaucrats inculcated into the public mindset the story that the only way the Fox could be “saved” was by appending it to another massive downtown housing project. To facilitate the latter the city had to relocate a fast food franchise; to accomplish that they had to buy up property on Pomona Ave. at exorbitant prices.

And so the initial make work myth has created a cascade of expensive, almost comical decisions by the city council.

Why was the linkage between the Fox and a new project a quote “myth”? Let’s apply some common sense to the issue. It was assumed (correctly) that the theater was going to require massive subsidy to restore and to operate; but somehow the city believed this loss could be rolled into a larger, profitable project by some private developer, or to be more precise, the city staff believed they could sell this bag of magic beans to the public. Three city council members (Don Bankhead, Pam Keller and Sharon Quirk) are still waiting for the beanstalk to grow.

There is no logical connection between restoring the Fox and the development of any new project! The fact is that whoever developed this “project” will receive massive subsidies from the Redevelopment Agency which will cover the cost of the Fox, developers do not do anything for free.

And so why doesn’t the city at least be honest: come out and acknowledge the cost of restoring and operating the Fox-and if it is deemed a worthy municipal value grant the money directly to saving the Fox. Or better yet why not let the people vote on weather or not to create a permanent Fox restoration and operations budget? Honesty and transparency. Two other civic values.

The Fullerton Observer continues to sink to new lows in its coverage of important Fullerton issues. Or lack of coverage.

In its most recent edition it published a redevelopment article which was simply an interview with RDA Director Rob Zur Schmiede, whose very job depends on RDA expansion. Wow, that’s cutting edge investigative journalism!

The Observer has completely ignored the story that has excited even usually tepid reporter Barbara Giasone. They will NOT embarrass the council majority that it helped elect with their endorsement. Jones, Bankhead, Quirk, Keller were all backed by the Observer.

Could it also be that the Fullerton RDA–is paying for quarter page ads in the Observer?

The Observer has published two pieces by Supervisor Norby expressing the County’s opposition to the RDA expansion, but only after leaking both articles to city staff in time to write rebuttals. The rebuttals themselves are not fact-checked by anyone and are filled with lies.

In the current July 2009 edition (Page 4) Kennedy bewails the 1994 recall of Bankhead after he “voted to support a ½ cent utility rate increase to keep the city from going bankrupt”. Three wrong statements in one sentence!

It was NOT a utility rate increase, but a utility TAX on gas, water, electricity and cable TV. It was NOT a half cent but 2%. It did NOT keep the City from going bankrupt.  In fact, it was repealed soon after the recall and has saved us Fullerton tax payers over $ 100 Million dollars over the past 15 years and the City is just fine!

True to form, the Observer has supported every city, county and state ballot measure that increased taxes, most of which went down in defeat. It especially likes sales tax hikes, which disproportionately affects the poor–the supposed constituents of a “progressive” paper.

If there is Blight in Fullerton, Who’s Responsible For It?

The proposed redevelopment expansion in Fullerton hinges upon on the city councils ability to discover “blight” in this vast area. Two of the biggest cheerleaders for this expansion of government power are councilman Dick Jones and Don Bankhead who are happy to make the necessary “finding” of blight.

Let us reflect for a moment on the irony of the situation. Bankhead has been on the city council for over 20 years, and Jones has been on it since 1996, 12 years and counting! So what have we got going on here? According to Jones and Bankhead “blight” has been proliferating at a record pace on their watch! So what does this suggest about their competency to fight blight, are these the guys we want  running even more redevelopment?

The whole thing would be sort of comical if the potential consequences for the property owners in the proposed expansion area weren’t so serious.

Donahieu Pact: Late Revenge for the Recall

Word has it that Don Bankhead has endorsed Hieu Nguyen for Clerk-Recorder, joining Dick Ackerman’s anti-Norby jihad. This is a slap in the face for the lone councilman who supported Don’s quixotic bid for Sheriff back in 1990. Ackerman supported Brad Gates, who easily turned back the Bankhead challenge.

bankDon was first elected in 1988 with the promise that he–like Norby–would back Molly McClanahan for Mayor (an Ackerman/Catlin/LeQuire triad had blocked her for years). That broke the annual mayoral controversy and restored the rotation that continues today. So Norby and Bankhead began as buddies. Norby even endorsed him as late as 2002, much to the ire of some longtime loyalists.

For Don, though, it’s still all about his being recalled by Fullerton voters. Norby opposed the utility tax passed by Bankhead, Catlin and McClanahan which led to their recall in 1994. He’s been sore ever since. Norby did not actually support the recall, but his later hiring of organizer Bruce Whitaker is a constant reminder of the utility tax/recall fiasco, foisted on Fullerton by then-City Manager Jim Armstrong.

Other Hieu backers with grudges against Norby include: La Habra Councilman      Tim “Taxman” Shaw (mad at Norby for pulling his endorsement when he supported the 1/2 cent LH sales tax hike), State SenMimi Walters (mad at Norby for supporting Harry Sidhu against her), Ackerman (mad at Norby for beating his hand-picked council candidates) and Cynthia Coad (mad at Norby for beating her for Supervisor in 2002). It ain’t no secret, the Republican party is the party of grudge holders.

The fact that County Counsel is actively opposing the proposed redevelopment expansion further fuels Bankhead’s bile. Perhaps, Bankhead thinks the County should just lay down and let the RDA steal the County’s money for that all-important Commonwealth blight fight.  But, it appears the recall is what really keeps galling Mayor Donahieu.

The Laing of the LLC is John Laing Holmes. Laing is a home builder with a reported debt of $500 million to $1 billion and is in Chapter 11 receivership. And furthermore, the word on the street is the front men of the LLC Hamm & Pellican are also on the verge of financial protection.

Exactly what kind of negotiations could our financially unexperienced City Council be doing with a group of financial wizards who are running amok in debt? When is the Redevelopment Agency going to realize the housing market has collapsed? If this project goes forward it will be a financial wreck for Fullerton.

Dear Friends, how many of you realize Pam Keller, Sharon Quirk, Don Bankhead and Dick Jones have already voted to place the Fullerton tax payers on the hook by guaranteeing the developer who’s in bankruptcy a 15% profit?  Who besides us are willing to admit this project was a turkey from day 1?

Pam Keller Appears to Like Fake Old Buildings

Pam Keller seems to think it’s a good idea to make the new 6.5 million dollar subsidized McDonald’s look “more like the high school” than a “fast-food joint.” She appears to believe that a visual “upgrade” helps justify the huge expenditure of public money. We don’t think it’s an upgrade at all, but just another example of Redevelopment shoving crappy architecture down our throats. Strike two.

On the other hand, maybe Keller is hoping the architectural “blend” will keep people from noticing that the city spent 6.5 Million dollars on moving the McDonald’s 150 feet closer to the school!

Because of the health concerns caused from fast food, Sharon Quirk is said to be considering changing her vote. Maybe Pam Keller will too.

Right on, Frazier. And thank you Supervisor Norby, for your Fullerton legislative history update on the importance of vote-changing, when changing one’s vote is simply the right thing to do.

In one corner, a huge corporation, under guise of a local businessman; in the other, City of Fullerton, hoodwinked into abetting the feeding of malnutritious food to its young residents! On this issue, I must entirely side with Council members Jones and Nelson. McDonald’s shouldn’t receive ONE DIME from City of Fullerton! Long-term costs upon Fullerton’s citizens to provide financial assistance to this global firm are catastrophic!

By eating this food, Fullerton students become less prepared to excel at school, less productive citizens, and will suffer crippling long-term health problems! Obesity, cardiac distress, diabetes! This isn’t idle speculation, but medical fact! Our Latino population’s particularly susceptible to these complications! Not even to mention high civic costs to clean up paper and plastic waste, which is daily generated from this eatery!

I defend, though not happily, McDonald’s or any firm’s rights to build wherever it wants; pay the going rate, meet all governing local, state and federal rules and requirements.

But it’s just wrong for Fullerton to subsidize McDonald’s operation, in any way. Wrong for Fullerton to favor one company over another. Wrong for Fullerton to justify such future ugliness, in the name of civic beautification. Wrong for Fullerton to victimize its young, to enable old people feel good about themselves. Wrong. Wrong Wrong.

I strongly urge Council members Keller, Quirk, Bankhead to carefully reexamine their votes, and put Fullerton first! Put Fullerton first; provide a safe, healthy environment for its young! Put Fullerton first; cautiously rein in civic waste! Put Fullerton first; focus not on global corporate greed, but on local civic virtue!

Every time Fullerton citizens drive by Fox Theatre, and marvel at its future apotheosis as local cultural shrine, please think of thousands of Fullerton young children, teen-agers, young adults who’ll have paid the price to make this happen. Very soon, they’ll have even fewer steps to pick up their Egg McMuffins, Mcfries, and six dollar dollar Super-sized Big Macs.

It hardly seems possible!

THE STRANGE & TRAGIC TALE OF HILLCREST PARK

We do so in order to highlight the fact that the park – suffering from real blight – is in the Redevelopment project area, and stands as yet another testament to the failure of Redevelopment. Loyal Friends of Fullerton’s Future, gather ‘round the cool glow of your computer terminals and follow a sad saga of miserable municipal negligence.

Located in the center of Fullerton is a resource of inestimable value, overlooked by almost everybody in and outside of City Hall: Hillcrest Park. Included in an early vision of the city it followed upon the City Beautiful, and natural urban park elements of the Progressive movement; and coincided nicely with the new auto culture of the 1920s, positioned as it was, along the original Highway 1.

Developed fully during the Depression in a rustic mode, the park soon after began a long decline into municipal irrelevance, and if anything, seemed to be perceived by many as a liability rather than a great asset.   This tragic trajectory is a shameful blot on Fullerton’s history and is akin to placing your eighty-five year old mother in a criminally negligent nursing home.

After Don Bankhead and Fullerton’s Finest chased out the acid-dropping hippies in the 1960s, the park became a haven for perverts; trees began to die and were not replaced; erosion claimed many of the north and west facing slopes and was not arrested; as the infrastructure crumbled it was replaced by City Engineer Hugh Berry with incongruous cinder block walls and concrete light poles.

In the mid-1990s Redevelopment Director Gary Chalupsky, in a philanthropic mood, decided that Redevelopment funds could be used to address Hillcrest Park issues – the first official over-the-shoulder glance toward the park in years.

And here, dear Friends, the story turns from a chronicle of benign neglect to one of outright incompetence and, one might plausibly argue, a form of bureaucratic malevolence.

In 1996 the usual scoping/charette pantomime was performed with an historic park landscape architect, specially imported from Riverside. An odd thing happened: every time the consultant prepared a list of priorities for the park, the Community Services Department’s wishes kept getting pushed to the top. The Director of Community Services was Susan Hunt, a woman long known for her mindless turf battles with her constituents – (including the Isaak Walton Cabin in Hillcrest). Hunt was determined to hijack the process and divert resources from where they were needed to facilities that she and her department could control and perhaps even profit from.

Hunt was successful. The consultant, knowing whom it was important to please, seemed only too happy to abet the fraud that was perpetrated. The city council (including current Jurassic members Bankhead and Jones) went along. Chris Norby was there, too. Now he’s in charge of the County’s parks.

A new playground replaced the old one in the Lemon parking area even though no one had complained about the existing one that parents seemed to like. More egregious still, a new facility (known as Hillcrest Terrace) was built behind the Veteran’s building that could be rented out for social functions. But the real needs of the park – slope stabilization, plant cataloguing and replacement, the removal of inappropriate elements – went unaddressed – and the problems have continued unabated to this day, ten years later, as interest in the park waned again.

Last fall the City once again roused itself from its somnolence and created an ad hoc committee to consider issues related to Hillcrest Park. The time is, perhaps, propitious. Susan Hunt has disappeared into an overdue and well-compensated retirement, current Director Joe Felz is much more amenable to citizen input. It’s time to reclaim this park.

Hillcrest is still in the Redevelopment Area and remains affected by indisputable blight. This should become a priority for Redevelopment Director Rob Zur Schmied.

While we wonder if the Hillcrest Park committee will actually display the necessary independence from staff manipulation, and that they possess the necessary technical abilities, we wish them well. And we encourage citizens to make sure that this time any assessment of Hillcrest will objectively address the needs of the park and report directly to the City Council. Recommendations should be included in the City’s Capital Budget.

Hillcrest Park can and must return to being the crown jewel of Fullerton’s parks.

A Little F-Town History – James L. Armstrong – A Case Study in Arrogance

In the year 1992 Fullerton’s City Manager Bill Winter was just about out of gas. He had been running on fumes for quite a while and figured it was time to rest on his threadbare laurels. He could also see the handwriting on the wall. A practical cipher, he had let Hugh Berry run the city and the Redevelopment Agency. A culture of permissiveness obtained at City hall during his tenure. Things were about to change – but not for the better.

The Council hired James L. Armstrong to replace Winter. He had been in Anaheim as an Assistant City Mananger and had also done a term at Hanford located somewhere out in the miasma of the San Joaquin Valley.

Armstrong arrived just as the 90s recession was beginning to sink its teeth into the local government wallet. Revenue was falling and something had to be done to protect city workers. Lack of revenue threatened automatic “step increases,” raises, and City PERS contributions. Perhaps Armstrong felt he had the solid backing of the City Council, but the Fullerton novice certainly had no reading of the mood of the electorate.

Within six months of assuming his new job, Armstrong had persuaded Molly Mc Clanahan, Buck Catlin, and Don Bankhead to go along with the imposition of a new Utility Tax. They deliberately denied a plebescite – knowing as they did that it would be rejected. And so they held the usual dog-and-pony budget hearings, passed a budget based on the Utility Tax, and approved the tax, too. Bankhead and Catlin were allegedly conservative Republicans, but that soon became an apparent farce; even worse, Bankhead had run for re-election in the fall of 1992 promising no new taxes!

The citizenry rose up in fury! Raising taxes during a recession just to protect city employees? The tocsin was sounded and an strange new locution echoed through the corridors of City Hall – Recall! The word had never been uttered in staid, conservative Fullerton before. The statists and the public employee unions, and Fullerton’s good-government liberals were aghast. The newly energized pro-recall  crew were seen as outsiders – who are these people, they’ve never served on one our precious committees! Barbarians at the gates! God, almighty! Civilization itself was at stake.

Within a  year the Recalls Committee, gained their signatures, placed a recall on the June 1994 ballot, and successfully recalled Catlin, Bankhead and McClanahan. He had only been on the job eighteen months, but our hero Armstrong had instigated a municipal civil war, and had managed to mismanage three of his supporters into ignominious political humiliation.

The way things ultimately worked out, the new Councilmembers were no better than the old. But the Utility Tax was repealed during the interregnum; without it the City got along just fine. But because the Old Guard had managed to hang on to elected office the managers in City Hall never had to confront the consequences of their point-blank refusal to reconsider the way they ran their departments. This was Fullerton after all.

Meantime Jim Armstrong was a busy fellow. He presided over just about every Redevelopment fumble, boondoggle, and cover-up of the 1990s; he made it very clear that when bureaucrats blundered the wagons were to be circled and nobody (in City Hall) would be any the worse for it. The jewels in his tarnished crown were the attempt in 1993 to forestall the Depot corrective work caused by incompetent design (full story coming soon), the complete mismanagement of the new Corporate Yard project, the deployment of attack dog Susan Hunt – whose job was to kick all citizen groups out of city facilities and keep them out, and his mania to turn public facilities into cost centers administered by city employees (see related post on Hillcrest Park).

An aura of arrogance clung to City Hall like the ripe aroma surrounding  the local Materials Recycling Facility; the City Council was just there to ratify Armstrong’s policy. If they liked that, so much the better. And they sure seemed to.

Armstrong’s miserable misrule came to an end in 2001 when he took the top job in Santa Barbara – you see in Jim’s line of work nothing succeeds like failure. And he set the bar high for his successor, Chris Myers, who learned from the best: when you find a cushy spot like Fullerton where nobody demands accountability, stick to it like a barnacle – until something better comes along. In the meantime – close ranks, clam-up, and cover up.

Fullerton’s Redevelopment Chairman Don Bankhead, and members Pam Keller and Sharon Quirk led the charge  to spend $6 million in tax payer’s money to relocate McDonalds 2oo feet closer to Fullerton High School. As part of the total figure, the Agency previously spent $3 million to buy and demolish four historic California bungalows  on the site.

Redevelopment Agency Director Rob Zur Schmiede said “funds for the project had been set aside years ago”. Governments flawed incremental approval process at work again.

The move will pave the way for The Fox Block  project– a proposed parking structure type development fronting on Chapman Avenue between Harbor Boulevard and the new McDonald’s which will resemble a McMiniature McSpanish McCastle.

Not everyone favored the deal,  longtime Fox critic, Councilman Jones opposed the deal, indicating that he was disappointed a big corporation like McDonald’s was not putting a nickle into the multimillion dollar burger deal.

“This is a huge cost of the citizens’ money,” Jones said.

Councilman Nelson asked if it were possible to postpone the final decision until the Fox Block developer, Arteco Partners, could come up with a plan and a feasibility study.

With nothing at stake and everything to gain, the out of town Developer’s spokesman Jerry Tessier said the new proposed parking structure and project would not work if McDonald’s stayed in its current location. Yet, he could not provide any guarantees for much.

Councilwoman Quirk agreed it was time to move forward. “We have the funds, and we need to get sales tax in.”

1cb2d563c6c212d4As a school teacher, Quirk must know what causes obesity in children; eating too much of the wrong kinds of food and not getting enough exercise. Now the kids wont have to walk as far to get their subsidized happy meal deals.

McDonald’s franchisee Mr. Frisbie reminded the Redevelopment Agency members that the City staff approached him to relocate his business, which was started by his father, James, in 1969 as a family business. A recent study shows the presence of an fastfood outlet within easy walking distance of a high school — about 530 feet or less — resulted in a 5.2% increase in the incidence of student obesity compared with the average for California youths, a correlation deemed “sizable” according to the findings. Great job Quirk, Bankhead and Keller!

Fullerton’s City Lights – FUBAR From The Word Go – Chapter The Fourth

Loyal and Patient Friends, our long narrative of the City Lights SRO is coming to a sordid climax, and a merciful denouement. We have witnessed incompetence, vindictiveness, cultural vandalism and bureaucratic usurpation of authority, But we’re still not finished. The SRO project appeared dead. The elected representatives had killed it. Democracy at work! But as long-time city-watchers know, the project is only dead when staff says it’s dead, and none of the architects of this disaster – City Manger Jim Armstrong, Planning Director Paul Dudley, or their puppet, Redevelopment Director Gary Chalupsky, wanted it dead. Because that would be an admission of what everybody else already knew – they were largely incompetent.

We left off with Dick Jones at a March, 1997 meeting waxing voluble about drug users and their nefarious ways. Nuh-uh, not in my city! Unfortunately, Jones discovered that getting the foot into the mouth is a whole heckuva lot easier than extracting it.

Jones was not  acute enough to pick up on clues that the City Manager, Flory and Bankhead were not going to let this die. He should have been clued in during the March meeting by the Agency attorney, who,  at the insistence of Flory, Bankhead, and a clueless Julie Sa, gave a legal opinion in public stating that Mithawalla could have a case against the Agency. Here’s where the story gets a bit murky, culpability-wise, and who orchestrated what, so rather than accuse anybody we’ll just let you – the Friends of Fullerton – draw your own conclusions.

A civil rights lawsuit was adventitiously filed against Jones and the City by some guy nobody knew, claiming that the targets of Jones’ tirade were protected under the Americans with Disabilities Act; Mithawalla was waiting in the wings to go after the City for breach of contract – although clearly no contract had been established. With enough proper coaxing from people who wanted this project to live, Dick Jones, the Big Man with The Big Mouth suddenly experienced a case of shrinkage.

A new hearing was held in May 1997. The stage was re-set to take up the SRO project one more time. It didn’t matter that the Council majority had already spoken. The City Staff, the Redevelopment Attorney, Flory and Bankhead were determined to have the last word in order to remind everyone who really runs the City of Fullerton.
