The Culture of Complaisance is about to get a lot more expensive.

If you notice item 12 on the Fullerton City Council agenda for Tuesday, good for you. It means you have pondered other idiocies – from the moronic CSUF “College Town” boondoggle through the closed session legal embarrassments involving Chief Danny Hughes and his goons in blue.

Which is a nice segue back to item 12. According to staff the City’s insurance well is dry due to a couple of big payouts in 2012. That’s bad news because now the City will have to issue a big chunk of debt so that the FPD payouts can proceed apace and Garo Mardirossian can get that 2014 Ferrari.

Of course the cash, raised by the sale of bonds will cost the General Fund a nifty $500,000 a year for the next couple of decades. City Manager Joe Felz will be enjoying his massive pension by then, so who the Hell cares, right?

Ironically, the cases of Veth Mam, Trevor Clarke, Edward Quinonez and Ron Thomas will drain the coffers yet again, requiring even more debt for fiscal year 14-15. The staff report says we need to protect Fullerton’s credit rating by issuing new debt. That’s a creative argument. I think we could protect Fullerton’s credit rating by eliminating the Culture of Corruption.

  1. If I was the insurance company for the City of Fullerton, I would drop their insurance ASAP. Looks like City of Fullerton will have high risk insurance for the next decade or so.

        I know that Fullerton used to have insurance above the self-insurance amount; that may have changed. They still are a member of a multi-agency insurance pool that functions as a secondary insurer.

        1. Yes, they do participate in the insurance pool’s liability program (see the 02-05 agenda item about appointing a rep to the ICRMA). A check of ICRMA’s pooled liability shows the following:

          1. First (primary layer) is the self-insured retention ($500K for Fullerton)
          2. Second is ICRMA (up to several million)
          3. Above that are three insurance companies:
          Argonaut
          Torus
          Score Re

  2. I agree that the actions requiring these settlements were wrongful and needed to be stopped. The removal of the pre-Recall majority did that. The post-Recall majority, though, had no real plan to stop such abuses other than subcontracting police services out to the OCSD — a plan on which they had not campaigned and that didn’t show much likelihood of actually solving the problem.

    So, now, a new bipartisan Council majority is in place and a new permanent Police Chief (who at least offers ideas for improving policing and seems well aware that the FDP can’t continue to rack up the butcher’s bill it did in the past) has finally been hired. There’s legitimate basis to hope for improvements. That should include a good settlement in cases such as Veth Mam’s, real learning from the wrongful acts that we see on video, and better officer training and supervision. Critics such as we see here could choose to contribute productively to such if they chose to do so — but I don’t see that here.

    Instead, I see insults, sniping, back-slapping and grim celebration of the supposed impending bankruptcy of the City. Why? Because preventing this sort of excessive use of force by police was never actually the main driver of the politics for most people here. They want to break the public unions and to renege on pension obligations — and focusing on police misconduct was mostly just a convenient way to work towards that end. (It worked once — and it almost worked twice.)

    The day that the professions of concern over the treatment of Kelly Thomas turned into anti-homeless NIMBYism here (with some honorable exceptions) was the day that everyone could see that Kelly Thomas was primarily — not exclusively, but primarily — just a vehicle for anti-government ideology. It did not have to be that way, but FFFF’s true agenda always determined its reactions — with, again, some honorable exceptions, many of whom seem to have stopped writing here.

      The documented culture of corruption of the FPD proves such to be true. Such “evil” did not evolve in a vacuum. Those over the FPD and the police union are to blame for the FPD de-evolving into the shameful organization that beat Kelly Thomas to death.

      The obscene compensation including pension of FPD and city government officials represents even more evidence of FPD and city government corruption. The illegal water tax and the refusal to return same is yet more evidence of such corruption which stems from the belief that one is better than another; i.e. Elitists.

    2. I’m confusezed, Greg. I understand that Fullerton is putting its trust in Dan Hughes as the correction to the FPD old guard, but no one has told me why.

      He seems to be the next in line from the old guard, the most immediate in daily control in the old guard, and the protector of many of the bad charactors from the old guard.

      Plus, it is promised that questions in the upcoming trial will use the stragegy of exposing Hughes as the key progenitor of the old guard.

        I disagree with your assessment of Hughes. I admit up front that I could be wrong and I reserve the right to change my opinion in light of new evidence, but I think that there’s a major generational and philosophical difference between Hughes and the trio of former Council members. In part, Hughes better seems to understand the dangers to the FPD and the need to prevent future tragedies. In any event, I don’t see him as being worse in this respect than Bill Hunt or the OCSD leadership, which were the other options offered.

I wish that I could devote more time and effort to the issue, with my dedicated friends at Occupy Santa Ana and the circle around local activist and expert Dwight Smith. I look forward to helping activists in my party form coalitions with such people, as I’ve got a foot planted in each camp.

      I and other activists would love for homelessness not to be a problem at all. We have other issues (foreclosure, racial acrimony, violence, pollution) that we could pursue. Your anonymous claim is the sort of thing that excuses your own lack of activism and honest sympathy by imputing that onto people like me.     As a fullerton city council person, McKinley was aware his own police force had violated the civil rights of :Veth Nam, Trevor Clarke, Edward Quinonez, Kelly thomas.
    McKinley’s response to the Kelly thomas beating death was to call in his colleague from the Orange County Human Relations Commission, Rusty Kennedy, to assuage the righteous outrage of Fullerton’s community over the fact their police force beat to death a malnourished, homeless man.
    Rusty Kennedy’s solution was to organize “mind-mixers” where select members of Fullerton’s community would find a way to decrease homelessness in Fullerton, offer sensitivity training to Fullerton PD.
    What is wrong with this picture?

        2. Let me clarify in the overview. Civil rights in 1776 were considered individual rights. As time went on, civil rights issues were often defined as class rights issues. Slavery was abolished, women got the vote, segregation was abolished, housing restrictions were put aside, and now the whole gay rights thing.

          In the 1950’s and 1960’s my family came to fame (and fortune?) in the fair housing issue. Rusty and I were raised on civil rights as a class issue. These issues gave rise to Rusty’s career. If Kelly Thomas exemplifies a member of a class of homeless being mistreated by the police at large or by society at large, then Rusty would be right on top of things as an expert in civil rights as a class issue.

          If however, Kelly Thomas is an issue of a person being denied his civil rights not as a member of a class but as an individual, then that is not Rusty’s forte. If Kelly Thomas died as a result of criminal misconduct by one or more police officers, then the situation is way outside of Rusty’s perview and belongs in the criminal justice system, of which Rusty is not part.

It revealed Fullerton PD’s “culture of corruption” that the good people of fullerton did not know existed until the FFFF refused to let the truth about kelly thomas death be hidden by bright , shiny awards to the Fullerton PD from Rusty kennedy and his Orange County Human Relations Commission.

            what is especially perplexing about this scenario is the fact that Fullerton Police Chief Pat Mckinley, the same police chief named in Ron Thomas, father of kelly thomas, wrongful death lawsuit, served on Rusty’s commission as a board member.

            1. My first thought is still the first thought that I had when I heard about the Kelly Thomas killing on KFI. How can this happen in Fullerton where my family is supposed to be in control?

              My second thought (again) is that I have seen Rusty’s view of civil rights as how the government treats the “black community”, or the “Hispanic community”, or the “gay and lesbian community”. I have never known him to have the authority nor the expertise to step in and question a cop’s individual handling of arrests. That function is vested in internal affairs, the DA, the FBI, and in the civil courts.

              My third thought is that in the history of this blog you have exhibited an integrity in your intellect, point of view and finally your frame of reference. You are the best one to answer your own questions. Obtain and audit records. Ask questions. Interview McKinly, interview Rusty, interview others. Report back to us.

The Kennedies were labled as “communists” by 1958 for their opinions in the PTA at Golden Hills Elementary School. This was the aftermath of the McCarthy era. This was when I was two years old and Rusty was six.

                  Ralph would have lost that election anyway. The registration issue certainly cost him hundreds of votes and the issue gave the Daily News Tribune an opportunity to write and editorial taking a neutral stance on the registration issue but pointing out that Ralph’s politics did not represent most people in Fullerton. This likely cost anothr couple of hundreds of votes.

                2. In fact, this answers much of the confusion between us. My perspective is 1958 to present. Your perspective is 1975 to present. At times you wrote as if you were much closer to my cousins than I was, which is true, although I sensed that there were things missing from your perspective.

        1. “…My family has been in Law Enforcement since 1871. I spent my adult life as a Police Officer and have personally seen this behavior many many times. Each Police Department has an assigned Internal Affairs Department or person who is tasked to Independently investigate Police conduct. The process is simple.
          1. The incident scene is closed and protected. Forensic Investigation begins under the supervision of IA and an assigned Deputy DA. The Officers are immediately separated and taken to interview rooms. Their equipment and clothing are confiscated. Their Patrol cars are searched and processed. All videos of the incident should be requested from the parties holding them. Under no circumstances should they be “Confiscated”. City video camera footage should be confiscated.
          2. They are advised of their rights and the fact that nothing said to Internal Affairs can be used in Court for Criminal or Civil Litigation therefore as Public Safety Employees “They must tell the entire story truthfully without exception” and can be immediately terminated if they misrepresent a Material Fact. The Police Association Attorney can be present but cannot object to questioning or give advice. If the Officer asks to invoke his 5th Amendment Rights he should be dismissed and then Terminated without Appeal.
          2. The Officers involved should complete their interviews and be advised to remain at home on salary during their shift hours and given a “Direct Order” not to discuss the case with anyone including each other.
          3.An Autopsy should be completed to determine cause of death and forwarded to all parties involved in the Investigation.
          4. After review of all evidence and witness statements the Officers should be either charged or exonerated.
          5. If suspected of wrong doing, it is paramount that the Officers stand trial for the alleged crimes.
          Now The Real World of 2011
          Since 1974 the Federal Government has offered Cities Federal Funds to increase the size of their Police Departments before their tax base could support the growth. The requirement for the money was simple, maximum age 40, no fixed height requirement, no fixed weight requirement, women, men, all races, gay or Lesbian and a minimum GED Diploma. Criminal Records were allowed including prior drug use. Hiring began and the money flowed. This created a quality problem in that for many recruits they had little personal success and nothing to lose if they misbehaved and got in trouble. Just a job that they got very easily. By 1980 Police across the Country started compiling serious misbehavior. Cities were in financial straights from law suits over failure to protect. The Federal Courts stepped in on the Warren Case and stated “Police owe no duty to the Individual Citizen“. This was the new training Mantra. A great job, I can act incompetently, even maliciously and the City and I can’t be sued. A great job, high pay and no responsibility.
          Now with promotions and increased hiring from a sub standard citizen pool, we start to bend the Justice System in half. Instead of Police Departments and Cities investigating and prosecuting Criminal Conduct, they began to become Attorney’s and Protectors of Criminal behavior. If you add in the fact that they have lost control of their departments and can’t afford the litigation payouts you begin to see the corruption. Cops know they now can’t be held accountable. And they can’t. Police prosecutions are almost non existent. A Santa Clara Officer was just convicted for selling police records. This was an offense against his brothers in Blue and that’s why the prosecution. The BART cop who shot a man in the back got the bare minimum sentence and the other involved officers were fired and reinstated. One officer in San Jose molested his daughter on tape and got a minimum sentence. A police Officer murdered his wife, stuck her in a car trunk, tried to collect insurance, then while being chased “Killed Himself”. The Police Department claims it is an unsolved case to protect their image.
          All Police Personnel Records are sealed, all statistics are sealed and no records need be revealed to the citizens. If you do not know the name, date of incident and case number within 30 days there are no records available. This is due to Police Association Lobbying. There is now a solid wall of protection around Police Conduct. Police Officers, City Attorneys, District Attorneys , Police Chiefs and Internal Affairs now work to prepare a defense for their Officers without exception. That’s why the show and tell and rewriting of the Fullerton 6 reports.
          The mentality is now a very structured “Us against Them”. In Santa Clara County they have a new DA, Jeffrey Rosen, (the last one was married to a cop and never prosecuted a single cop) that ran on a ticket that was supported by his claim to be Jewish and understanding the pain of a Nation gone wrong. Well he never reopened a gang rape case as promised, and he just exonerated three Police Murders and his “Exoneration” of one of them was “The Police had to kill him to prevent him from killing himself”. I know you just can’t believe it but that was the reason. The cop that killed that man had rushed into another situation just a few months before and killed another mentally ill person.
          A Police Officer now has the right to kill if he has a fear of being harmed. That fear does not have to be proven, articulated or the same fear a jury would have knowing the facts. It’s his fear and it is self justified. He does not have to put himself at risk by using a taser, Mace or a nightstick. He may go directly to Deadly Force even though there are 10 other policemen standing around watching.
          Old School
          1. Carry a knife or confiscated gun clean and in a plastic bag with you on patrol.
          If you make a mistake, take the weapon out and shake it in the deceased persons coat pocket and drop it near his hand. If a gun it should have been fired at least once before storage.
          New School (Killing Unarmed Persons)

          3. He had a long dangerous criminal history and we were looking for him. (this info is determined after the killing and pretended to be known beforehand)

We had to tase him and tase him because we all know that crazy people have the strength of ten men and we were out numbered. We hog tied him to prevent him from awaking and killings us. His screams of “I’m Sorry, I’m Sorry and Dad, Dad Dad were just to throw us off so he could kill us.
          DA and Department finding. Videos lie and are vague, fuzzy undependable and are deceiving and to audio record the Police Officers may be a crime without their permission 631-632 PC. Eye witnesses are the worst witnesses you can possibly depend on and the Officers were in fear of their lives. They were in a death struggle. We regret this situation involving our up standing Officers who tried to do their jobs and save their lives. Would you take $900,000.00 dollars to shut up and go away?
          So what will happen, well it happened from 1967-1973. Look at the Police Killings (including my uncle due to his beat partner’s history of violence with juveniles) during those years and who committed them.Presently, 16 Police Officers still on Oakland PD have shot and killed 40 people in the last few years. One black man killed four of them. Having nothing to do with the Kelly case, two men drove up to a Patrol Car and Shotgunned the officer in San Diego last week. The cops hunted them down and took no prisoners as happened in Tacoma, Washington State and again in Seattle.Five Officers dead and a murderous hunt down and ambush of the killer.Strap in and be prepared for a rough ride like the “King Case”.Everything will be done by Government to beat the wrap.     In advance of upcoming presentations, meetings, and the development of a management plan, the following provides some preliminary details about the proposed Shelter and Multi-Service Center:

    The Shelter will be owned by the County of Orange and operated by a nonprofit contractor. The nonprofit contractor will be contractually required to operate the facility in compliance with the County’s good neighbor policy which requires collaboration with the City of Fullerton, residents, businesses, and other stakeholders regarding shelter operation and provision of services.

    The facility will be designed to provide emergency shelter for homeless individuals and their families. It will also provide a wide variety of multi-disciplinary services designed to successfully transition clients from homelessness to permanent housing.

    In addition to assisting those who are already homeless, the multi-service center will provide homeless prevention services and support to assist homeless families and individuals that are at-risk of losing their housing due to unforeseen circumstances.

    The proposed shelter and multi-service center will replace the existing shelter at Brookhurst and Valencia which has approximately 200 beds. Design features, including the number of beds, types of services, requirements for services, and collaborative partners will be determined at a future date through the County’s contractor selection process.

    The facility will be staffed by the contracted operator 24 hours a day / 7 days a week.

    The facility will have 24 hour a day / 7 day a week security. Security plans will be coordinated with the Fullerton Police Department and the County of Orange.

    The facility will be managed by the contracted operator in collaboration with various collaborative partners including but not limited to, multiple County Agencies, other nonprofit service providers, and local churches to coordinate services offered to the homeless and at-risk community.

            The 5-0 vote was a formality. It directed the Mayor to complete an employment agreement with Hughes. I believe based upon their statements at the earlier meeting that both who voted against the promotion would have preferred other candidates for the position but they were voted down by the Flory/Chaffee/Fitzgerald majority.

    Maricopa County was spending approx. $18 million dollars a year on stray animals, like cats and dogs. Sheriff Joe offered to take the department over, and the County Supervisors said okay.

    The animal shelters are now all staffed and operated by prisoners. They feed and care for the strays. Every animal in his care is taken out and walked twice daily. He now has prisoners who are experts in animal nutrition and behavior. They give great classes for anyone who’d like to adopt an animal. He has literally taken stray dogs off the street, given them to the care of prisoners, and had them place in dog shows.

    The best part? His budget for the entire department is now under $3 million. Teresa and I adopted a Weimaraner from a Maricopa County shelter two years ago. He was neutered and current on all shots, in great health, and even had a microchip inserted the day we got him. Cost us $78.

    The prisoners get the benefit of about $0.28 an hour for working, but most would work for free, just to be out of their cells for the day. Most of his budget is for utilities, building maintenance, etc. He pays the prisoners out of the fees collected for adopted animals.

    I have long wondered when the rest of the country would take a look at the way he runs the jail system and copy some of his ideas. He has a huge farm, donated to the county years ago, where inmates can work, and they grow most of their own fresh vegetables and food, doing all the work and harvesting by hand.

    He has a pretty good sized hog farm, which provides meat and fertilizer. It fertilizes the Christmas tree nursery, where prisoners work, and you can buy a living Christmas tree for $6 – $8 for the holidays and plant it later. We have six trees in our yard from the prison.

    Yup, he was re-elected last year with 83% of the vote.
    Now he’s in trouble with the ACLU again. He painted all his buses and vehicles with a mural that has a special hotline phone number painted on it, where you can call and report suspected illegal aliens. Immigrations and Customs Enforcement wasn’t doing enough in his eyes, so he had 40 deputies trained specifically for enforcing immigration laws, started up his hotline, and bought 4 new buses just for hauling folks back to the border. He’s kind of a ‘Git-R-Dun’ kind of Sheriff.

    HE IS THE MARICOPA ARIZONA COUNTY SHERIFF

    AND HE KEEPS GETTING ELECTED OVER AND OVER.

    THIS IS ONE OF THE REASONS WHY:

    Sheriff Joe Arpaio (in Arizona ) who created the ‘Tent City Jail’:
    **He has jail meals down to 40 cents a serving and charges the inmates for them..
    **He stopped smoking and porno magazines in the jail.
    **Took away their weights.
    **Cut off all but ‘G’ movies.
    **He started chain gangs so the inmates could do free work on county and city projects.
    **Then he started chain gangs for women so he wouldn’t get sued for discrimination.

    **He took away cable TV until he found out there was a federal court order that required cable TV for jails, so he hooked up the cable TV again…BUT only let in the Disney channel and the Weather channel.

    **When asked why the weather channel, he replied, “So they will know how hot it’s gonna be while they are working on my chain gangs.”

    **He cut off coffee since it has zero nutritional value.

    **When the inmates complained, he told them, “This isn’t The Ritz/Carlton…… If you don’t like it, don’t come back.”

    than usual in Phoenix (116 degrees just set a new record), the Associated Press reports: About 2,000 inmates living in a barbed-
    wire-surrounded tent encampment at the Maricopa County jail have
    been given permission to strip down to their government-issued
    pink boxer shorts.

    On Wednesday, hundreds of men wearing boxers were either curled up on their bunk beds or chatted in the tents, which reached 138 degrees inside the week before.

    Many were also swathed in wet, pink towels as sweat collected on their chests and dripped down to their PINK SOCKS.

    “It feels like we are in a furnace,” said James Zanzot, an inmate who has lived in the TENTS for 1 year. “It’s inhumane.”

    Joe Arpaio, the tough-guy sheriff who created the tent city and long ago started making his prisoners wear pink and eat bologna sandwiches, is not one bit sympathetic. He said Wednesday that he told all of the inmates, “It’s 120 degrees in Iraq and our soldiers are living in tents too, and they have to wear full battle gear, but they didn’t commit any crimes, so shut your mouths!” Way to go, Sheriff!

    Maybe if all prisons were like this one there would be a lot less crime and/or repeat offenders Criminals should be punished for their crimes – not live in luxury until it’s time for their parole, only to go out and commit another crime so they can get back in to live on taxpayers’ money and enjoy things taxpayers can’t afford to have for themselves.
