What is a Brady Cop? And What Did Vince Mater Do to Become One?

Update: When you’re trying to pierce the veil of secrecy in a police department bent on concealing its officers’ misdeeds, some of the details come through a little fuzzy. I recently received some corrected information on officer Mater’s role in the arrest, highlighted in red below. Note that Mater is still the officer who (allegedly) destroyed his audio recording and was later fired.

I’ve also noticed that almost an entire year has gone by, but Officer Mater has not been charged with destruction of evidence. The DA is reportedly still “working on the case.”

A Brady Officer is a cop with a sustained record for knowingly lying in an official capacity. A Brady cop’s testimony in court is almost worthless, which makes you wonder why a police department such as Fullerton would bother to employ one.

But on to the story. Remember that odd Fullerton jail suicide of Dean Francis Gochenour last year?

The word was that the jail arresting officer by the name of Vince Mater had broken apart his audio recorder and smashed the chip containing a recording in the immediate aftermath of the suicide. Whatever was captured on that recording before and during the arrestee’s suicide, we’ll never know.

Dean Gochenour died in the Fullerton City Jail on April 15, 2011

A few months later, Officer Mater was quietly fired.

Well, now we’ve found new state court docs revealing that the DA had also declared Mater to be a “Brady officer.”

We don’t know how Officer Mater earned his status as certified liar, but if it was so bad that even the FPD couldn’t look the other way, well…it must have been pretty bad.

Mater’s name did appear in an OC Register story in November 2010 about the wrongful incarceration of Emanuel Martinez at the hands of the FPD, in which Mater was johnny-on-the-spot with a gang tag that helped send the wrong guy to jail.

Fast forward to 2011, when the FPD ends up with a dead guy in jail, a smashed recorder, another cop on paid leave and presumably another set of lawsuits.

Oh, and one more thing: for all the City’s talk of transparency and its employment of several highly-compensated Public Information Officers, all of this information was kept from the public until…well, today.

    Yes keeping guys like this employed with the baggage they carry, then someone dies is called, “negligent retention”. Usually good for a significant amount of damages at the end of the day.

    IF FPD wanted to show transperancy in this case, they would have charge that jailer with destruction of evidence PC 135 if I recall correctly.

    Yes a brady cop is useless across the board. They are in reality liars and should have NO credibility every time they speak.

    When you have to complete daily tasks that require honesty and ethics to be applied, WELL a brady cop is not in the scheme of things.

    But this guy could have been someone’s fair haired child and they took care of him by putting him in the jail where they thought he’d be safe.

    OOPS!!! that didn’t work out either.

    Let’s hope Ron Thomas’s attorney knows all this, and won’t settle for some money in order to make them go away like corrupt agency’s do ALL the time.

    Kind of like Michael Jackson did to avoid his REAL history from becoming known. He bought the victims silence for a mere $16 million.

    With ALL this crap coming out, it should not be about money at this point.

    Maybe FPD can hire Dave Ellis to do some mailers on their behalf?

  3. Journalists have their own version of the Brady list and Andrew Goodrich is on it. The journalists should corner the new Public Information Officers (isolated from each other) and ask them all of the questions that Goodrich declined to address transparently over the past few years.

    Don’t let them use the “old news” line because the new news is how they project Hughes’ new “transparency”.

      Did you read the court doc? The entire appeal was about the city attorney going to extraordinary lengths (and cost) to hide the cops’ personnel records from the defense attorneys.

        1. Other way around. Mater’s Brady status led to part of his personnel record being disclosed to the defense attorney, but the other cop was shielded.

Couldn’t “Haggerty supra” be used as an argument in a motion to gain access to specific information about force complaints in Cicinelli’s personnel file? Regardless if he is on the “Brady List” his actions are at the center of the dispute. And it also seems that NOT being on the Brady List is one of the main reasons a DA won’t go after you. If you can’t be reliable on the stand, why cover up all of an officer’s punishable misdeeds?

    1. Texan, the California Police Officer’s Bill Of Rights was passed (post 911) to protect officers from being harrassed by unfounded complaints. Yet it is so strong that it prevents citizens agianst justice from corrupt cops. Add this the unrealistic pension rights given to cops in the dot com boom and you have a priviledged class on one hand doing a great service for the public but on the other hand raping the public.

      The FBI will prosecute the most egregious cases, but it is up to our State goverment to bring our system back into balance. Pray for us, the prospects do not look good so far.

      1. At my urging, the Michael Gennaco led internal investigation/review will include this disturbing death-in-custody case. Gennaco will report those findings soon.

        I inspected the jail a few months back. At that time my aim was to determine whether additional video and audio surveillance within the jail would have likely captured details about Gochenour’s death, and any exchanges between Officer Mater and Gochenour.

        Deliberate destruction of a DAR (digital audio recorder) is in my opinion such an extreme and suspicious act that only a COMPLETE release of ALL facts, source data and related evidence will suffice.

  12. Actual quote from the original article from the O.C. Register says, ” Fullerton police investigators say Dean Francis Gochenour’s death was a suicide, with no suspicious circumstances”.

    Am I the only one that thinks that Mr. Gochenour was actually murdered at the hands of Officer Mater and that the DAR was smashed to eliminate a potential “witness”?

    Has this case been followed up by the District Attorney’s investigators as it stated in the article?

    I’d really like to see the results of the DA’s whitewash into this death, and if it smells like BS, we should see if we can’t get this case re-opened to try and bring some sense of justice to Mr. Gochenour’s family.

    1. I read somewhere that the Coroners Office. told the family he was being embalmed to check for bruises, very unusual, “Cover Up” they had Something really big to hide.

    Based on FPDs (Fullerton’s Pathetic Disaster) responses as well as theories from commentors on this post and my own personal incarceration experience, this WAS a “Murder by Cops”. Conveniently committed in THEIR domain!

    That alone demonstrates obvious guilt! However, our wonderful legal system doesn’t see it that way, but a reasonable judge or jury would take that highly into consideration.

    Yes the PRA would be the best start. If any of you out there have GOOD friends who work the criminal defense arena, they too might be able to help you.

    You all might be surprised at what you find.

    The reason is, if a Brady Cop is part of a case about to go to trial, IT IS the District Attorneys DUTY based on Brady vs Maryland to give the DEFENSE attorney the names of Brady Cops.

    Brady covers ANY witness in all fairness. I don’t want everyone to think it’s just about cops.

    Brady Cop is a law enforcement judicial term often used.

    NEGATIVE Travis, absolutely not correct. Please don’t assume this is a standard based on the document attached to this thread or the case surrounding it.

    If a “pitchess motion” is denied by the Superior Court Judge, it can be appealed. Well if you lose you lose. But it isn’t the standard in the State of California.

    A list of Brady Cops, is SUPPOSE to be maintained BY the DA’s office at ALL TIMES. It’s suppose to be an ongoing system updated as frequently as needed.

    You can find out if the guy is a Brady Cop by filing a “pitchess motion” which happens all the time by defense attorney’s if the cops conduct comes into question.

    Not being on a Brady list IS NOT a basis for giving anyone a pass.

    SIMPLE term people.

    If your name is on the local DA’s Brady list, the DA is suppose to give those names to the defense at somepoint prior to trial.

    Second most Brady cop ARE NOT working the street becasue if their on the list, the DA won’t file cases from the get go.

    Are their Brady cops out there, that are working the streets and should be on the list, YES!!!

    There is a chance a cop department did not report his Brady conduct to the DA. Generally happens during administrative hearing stuff and the department fail to inform the DA.

    If a “pitches motion” is successful and the judge releases information in the officers file that SHOW he or she lied during the official duties or during some court process, then that cop SHOULD BE on the DA’s Brady list.

    Is it possible the cops department failed to inform the DA of this conduct YES!!!!

    A “pitchess motion” if granted WILL BE held “in camera”, meaning in the judges chambers, OUTSIDE the presence of others.

    Usually present is the judge,dda, defense attorney and the custodain of records. Usually a member of the departments internal affairs.

    Bottomline is, a police department does not want ANYTHING in those files getting out into open court.

    Well in this case, the defense attorney’s are COP attorney’s. So the dynamics change BIG TIME.

    Can a cop witness against Ramos and Cincinelli be challenged on Brady issues YES!!!!

    If the testimony to be given is damning to their clients, and that cop is a Brady cop, yes they will be challenged.

    If the testimony is so damning and the defense attorney’s fail to bring that information out it MIGHT be grounds for a serious malpractice claim later on down the road.

    MIGHT be grounds for an appeal too.

    My concern is Michael Swartz (Cincinellis lawyer) law firm DOES NOT care about cops who lie. Again more on that later.

    It’s not about bashing ALL cops. It about the corrupt ones.

    Specificially THEIR leaders who are the MOST responsible for allowing or being part of a culture of corruption.

    That would include city leaders who turned a blind eye to this stuff for whatever reason.

    THERE are MANY,MANY good cops out there who need not work for bosses who have their own agenda, play politics everyday while they try and do their jobs.

    For those cops who are corrupt and play their bosses game, may the rath of public scrutiny descend upon them.

    ALL of you must understand the good cops out there are AFRAID to speak up and suffer the rath of the corrupt ones which I hope is a very small group. VERY small.

    DO NOT treat every FPD officer as if he is a crook.

    YOU have every right to be suspicious of everyone of them. Keep an OPEN mind, but be WATCHFUL of their conduct at this time.

      You’ll find if you smile at most any cop, in a public surrounding, they will give you the same back. Cops are people too.
      That being said, I’ve been friends/acquaintances with some cops over the years who were either neighbors, my son’s baseball coach, etc. and they were all seemingly normal and pleasant individuals. I would bet, however that they would immediately turn their backs on me if one of their more ‘trouble making’ counterparts started to harrass me in public.
      This I say from experience.

    1. Indeed friend. I know a couple of people at the FPD and they seem like pretty good folks. That said, not one has stood up and spoken the truth about not only Kelly, but the long standing, serial abuses committed by the department. The blue wall protects dirty cops and doesn’t protect the citizens who pay their liberal salaries, benefits and pensions. At the end of the day, their silence in the face of so many despicable incidents can only mean that the agree with that behavior.

    At this time I would not be to comfortable attempting that.

    WHY, because I don’t know how solid a case the DA has or will attempt to present.

    The DA’s sidestepping the other cops involved threw up some red flags for me.

    As mentioned before by others, is this case designed to fail? I just don’t know right now.

    As to the lawyers, one specifically, I’d rather go on a rant about them when a specific thread comes out talking about the LAWYERS.

    I hope it will, becasue that is a WHOLE other issue of police corruption. Behind the scenes stuff. Union corruption.

    No I don’t think we met. I haven’t appeared at any recall tables in my day. Yes I am former law enforcement. 20 years.

    No my former department is FAR more corrupt that FPD. FPD would be the LAPD Dragnet style in comparison to where I’ve worked.

    1. I suppose not. The person I met is still actively employed with an office in L.A. county. He spoke very well of the different phases of taking care of a bad station from resistance to enforcement and finally compliance. He is not with the sheriff dept.

  32. In reading the ENTIRE court ruling from the 4th District in this thread, it appears BOTH Ramos and Cincinelli’s ENTIRE personnel file will be up for discussion, since THEY are defendants in a criminal trial.

    Despite this court ruling you can BET it will be argued by defense counsel again.

    That is of course if the DA even filed a “pitches motion”.

    BUT all is not lost if all one gets is names,addresses and phone numbers from previous complaintants.

    In fact if SOMEONE didn’t do their job and left things out, the IA guys lied and cheated at the behest of the Chief, we again have another scandal.

    I don’t see the court ruling on this particular cop to be a serious issue as it relates to obtaining information from his file. Not all was lost in any sense.

    Someone just had to do a little more leg work.

    Are such phrases to be a standard for future leaders?
    If such rhetoric is to be recognized as an inducement to join the team, don,t be surprised when one of your selected yes persons adds a little extra ingredient to your soup.
    As for internal threats of retaliation by peers against you, don’t select a Brady type for your back-up. You may have a higher possibility of getting shot in the back from your partner than you have from getting shot by that person in front of you.
    There exists a witness protection program. Look into it…

    The prevailing attitude appears to be : shoot first and ask questions later, of course if you shoot all those confronted the only life you save will be your own.
    The general populace may be nearing a point of saturation of abrasive and inhumane procedures and actions by the police powers in this country.

    Dean was my ex-husband, we had a beautiful daughter together in her first year of college. We were friends and spoke as recently as last week about our daughter and how proud we were of her. He would NOT have hung himself, no matter how much he had been drinking. This makes no sense and is so very sad and alarming. We found out about his death early this morning, you can only imagine how upsetting it has been for us and his family. My daughter has had to grow up very fast today. She bravely visited the Coroner’s office to retrieve his belongings (but they never gave her his clothes). She visited the Fullerton Jail to request a police report (and noticed how small of a jailhouse it was); to her it was strange that no one noticed him plotting an “alleged” suicide.     I have absolutely no doubt that cops from Fullerton and other agencies come in here to primarily watch, but also to occasionally harass and intimidate. No doubt whatsoever.

    That’s not why I come here and I really don’t think Fullerton cops care what FFFF says or even want to know what they say. Why would they? There is nothing positive here for them. Goes back to what I said before. You notice how quiet everything is? Mumbling and grumbling here but outside of this box it’s very quiet, business as usual. That’s why the say nothing tactic works in many aspects of life these days, politically and in public relations.

  47. From the LAUSD to the Catholic Church to city government to FPD in this day and age it is all about protecting the guilty and stonewalling the public. How did we get to this level of corruption in our schools, churches and government. If the stonewalling goes all the up to the DA in the Kelly case good luck. It’s all about survival….political and otherwise. I don’t think the three stooges will survive because they are too dumb and are in way too deep. As far as FPD goes, unless leadership is brought in from the outside you will continue to have the same repeated failures over and over again. Replace the three losers, replace the leadership in the FPD and Fullerton might have a chance to rebuild a tarnished but still shine-able image…..

    Yep that would be pretty bad. Again the responsibility falls upon Sellers for sure.

    But something came up along the way, then they threw him into the jail to work.

    So at a glance they covered for him at least twice, when they should have shown him the door.

    Then the third time if that is ALL there is, he screws up in the jail, a man dies, Mater destroys his tape recorder.

    A clear crime. If the DA says their still looking at that, feel free to call BS on that too.

    It does not take months to look at a PC 135 violation and decide to file a case or not.

    I have walk case to the DA myself, sat down with him or her, they read the case, filed it, or got a warrant for arrest within a hour or so.

    My point it can be done.

    But as some have said about criminal cases, NOT FILED in the “interest of justice”.

    A simple rubber stamp for many issues that could be good or bad.

    I bet there is more to this guys FILE than we will ever know.

    But again the “confidentiality” laws are being abused and used to cover up misdeeds.

    So allowing Sellers to retire in the manner he did and skate out the back door is another cover up in itself.

    His high blood pressure jumped up when all this crap came to light, crap Sellers CREATED. Create you own STRESS, it can be challenged in a worksman comp case.

    The didn’t deal with Mater or Sellers as they should, becasue BOTH issues have a ton of STINK attached to the BASIC story.

  51. Simply put Vince Mater is a turd! All Brady cops should be fired. The California code needs revision. If a cop cannot testify in cases he is not fit for duty and should be retired. If he or she does not have enough service, well, too bad! You should have thought about that when you decided to lie or withhold evidence.
