Dear Madam Mayor & Council Members,

We cannot pretend that Fullerton is serious about reform when those involved in the murder of Kelly Thomas, the illegal arrest and imprisonment of Veth Mam, and the many other documented cases of police misconduct, are still employed by FPD. We contend that you as our representatives at city hall, now being fully aware of the extent of misconduct by certain officers, that it is your duty above all else to protect the citizens of Fullerton, including those that may now feel targeted because of their public involvement in seeking justice for Kelly Thomas. There will be members of the community who will not comply to the orders of Officer Kenton Hampton, Sgt. Kevin Craig and Cpl. James Blatney, as they feel that these officers do not hold any moral authority over them. This reality puts all residents and peace officers in danger, and makes any contact by these men with the general public unwise. The adoption of the attached resolution by you, and the eventually firing of any officer who cannot live up to the ideals of a post Kelly Thomas Fullerton Police Department, will not only benefit all residents of Fullerton, but it shall restore public faith in the department itself. In doing so you will stimulate public trust to the benefit to those  other officers who have always conducted themselves professionally. Professional officers with good intentions deserve to work in an environment which is free of the stigma that the continued employment of these accomplices in a taped public execution places on the entire department.

Only by publically setting standards for peace officers which embody excellence in public service and respect for all Fullerton citizens, and by demanding the termination of all those who represent the worst of FPD’s past, can we move forward with confidently that reform and change has resulted from the tragic murder of Fullerton resident Kelly Thomas on July 5th, 2011. The city attorney, while perhaps well intentioned, has an established propensity to filter his advise through the fear that one of these subpar officers may litigate on grounds of wrongful termination. We advise this council to also consider what may result if any of the officers in question, who have now returned to active duty, are again involved the death or injury of one of our citizens.  Prudence dictates that they must be removed before they are given another opportunity to harm the public and burden the city with additional million dollar settlements.

Civility and healing will come to Fullerton when our leaders are responsive to the public and  we are not required to pry  every hint of justice that this case has brought forth over the last 14 month from the clinched fists of a stubborn leadership at city hall, the DA’s office or  FPD. Today we  present you with yet another opportunity to partner with us in seeking justice. We urge you to take advantage of this opportunity.

Cops have THE best best protection of ANY government employee unit. Good luck getting the Council to be able to take action. They can’t, the Council has no authority. The law and their contract protects the cops — especially the bad ones.

    My question is this: Can a class action suit be brought against the City for the actions of the PD. I imagine the suit would have to show a pattern of abuse of power, perjury, and illegal activity by Fullerton officers. In other word, make the case for ‘culture of corruption’ in open court.

    I’ve been told Mr. Bushala likes being the power behind the scenes. Bankrolling a class action suit might be worthwhile endeavor, if its possible.

    Furthermore, those that have been entrusted with the power to take another human being’s life for the good of the People should be held to a different, higher standard. Not a lower standard, as we have seen in the City of Fullerton.

    Mentally ill and homeless, Kelly Thomas had dozens of run-ins with police in the years before his fatal beating at the hands of six Fullerton officers, according to an internal document from the District Attorney’s Office.
    The document shows that Thomas was frequently stopped and questioned by officers throughout north Orange County, occasionally arrested for low-level crimes such as trespassing, and was once jailed for assault with a deadly weapon. It details 92 police reports that involved Thomas between 1990 and his death last summer.

    Attorneys defending three Fullerton officers charged in connection with his death have portrayed Thomas as a trouble-maker who refused police orders. Prosecutors have described Thomas as an unassuming victim – “a sad homeless person that is no danger physically to anyone,” in the words of one prosecution expert.
    The criminal history compiled by the District Attorney’s Office shows that the majority of Thomas’ encounters with police resulted in nothing more than a warning or citation. But it also includes 27 arrests, most often for old warrants, trespassing or violating court orders to stay away from a grocery store that Thomas frequented.
    Thomas was arrested in 2008 after an Anaheim child-care center reported that he was urinating in front of children; court records show he pleaded guilty to urinating in public. He was arrested in 2010 after an Anaheim fruit-stand vendor said he threw rocks at her, and later pleaded guilty to trespassing.
    He was twice arrested on suspicion of assault, the document shows – once for punching a man who asked him to leave a Christmas party, where a 14-year-old girl said he had approached her with the words “hey sexy.” But court records show that he was never prosecuted on that assault charge or on the other allegation, in which a restaurant worker said Thomas threw a watch at him.
    Most crimes were minor
    Court records show that Thomas has faced a series of misdemeanors and low-level infractions, but only one felony case. That was in 1995, when police said he attacked his grandfather with a fireplace poker, records show.
    The grandfather said Thomas bludgeoned him with the poker in an unprovoked attack. Thomas told police the two were fighting after his grandfather looked at him the wrong way, and that he grabbed the poker from his grandfather, according to the District Attorney’s document. Thomas later pleaded guilty to assault with a deadly weapon and was sentenced to 270 days in jail.
    A psychological examination included in the court file quotes Thomas as saying he began using drugs in the fifth grade and had used LSD, pot, methamphetamine and alcohol. The doctor who conducted the exam concluded that Thomas had suffered “organic impairment of cognitive functioning” because of his drug abuse, according to the document.
    Thomas lived on the streets for years and was known to officers in several cities; in 2003, an unidentified Fullerton officer described him in a report as a new transient in the downtown area. The District Attorney’s review found that 13 of Thomas’ contacts with police there and in other cities ended with him getting a warning to move along or to stay away from businesses. Police wrote Thomas citations – for jaywalking, littering and other infractions – 15 times.
    His record of police contacts also included three reports that he had gone missing from psychological facilities, and a report of a jail assault in which he was the victim. His father once reported him to police, saying he stole a $550 guitar, according to the documents. His mother went to police in 2010 with a restraining order against him – a move his family has said was intended to help get him into mental-health treatment.
    But a third of the 92 police contacts included in the District Attorney’s review were listed as “field interviews” or street checks only, or resulted in no apparent action.
    In three of those cases, police stopped and questioned Thomas after seeing him look into vehicle windows or otherwise appear to “case” vehicles, but let him go. A similar report drew Fullerton police to their fatal encounter with him on the night of July 5, 2011, when a caller said Thomas “was roaming” a downtown parking lot, looking in cars and “pulling on door handles.”
    The City of Fullerton has since said that no other evidence exists that “Thomas actually tried to steal anything from vehicles.”
    The District Attorney’s Office has charged former Fullerton officer Manuel Ramos with second-degree murder, saying he escalated that call into the beating that killed Thomas. It also has charged former Cpl. Jay Cicinelli, saying he helped beat Thomas and used his stun gun to both shock and pummel him. Last month, a grand jury indicted a third former officer, Joseph Wolfe, in the beating.
    All three ex-officers have pleaded not guilty.
    Crime-history compilation common courtroom practice
    The District Attorney’s Office confirmed that it compiled the report on Thomas’ police history. Chief of Staff Susan Kang Schroeder called it a common practice, especially when prosecutors expect the defense to use a victim’s criminal history to attack their case.
    “It’s in the typical defense playbook to try to dirty up the victim. It’s defense strategy 101,” Schroeder said. In this case, she added, “Kelly Thomas’ background is mostly being homeless.”
    But the attorney representing Cicinelli said Thomas’ frequent contacts with police “paint a very different picture (than) the one that has been portrayed in the media.”
    “I think the picture painted before was that the police officers were looking to roust a homeless person,” attorney Michael Schwartz said. “I think what is telling is that his own mother had a restraining order against him … This is not somebody who is docile.”

  25. I’ve been wondering for a while about Ron Thomas and his connection to law enforcement. No one at OC sheriff knows anything about the guy. He’s always came across as a bit slimy to me and now I read how he’s playing games with the money collected for Kelly’s Army. most recently I heard he was kicked out of the academy after 3 months due to allegation of spousal /child abuse, and what we perceived as Kelly’s cry’s for Dad to help him were really cry’s for his dad to stop beating him. Anyone else get the creeps from this guy?

        I see what kind of person you are, just another lemming without any ability to explore. Just take whats been spoon fed by the media and ask for more, must have failed critical thinking in college. Does it even occur to you that we are not in possession of all the facts. The stories I’ve heard do not put a nice light on Ron Thomas and I expect everyone’s dirty laundry to be put on display during the trial.
        There are far to many people exploiting this death. Ron Thomas has delusions of grandeur, and Sharon Quirk-Silva is a political hack that has exploited the situation to vie for higher office.

            2. The FBI investigation.
            3. The Gennacco investigation.

            Until at least the first 3 come to sometype of conclusion, Hughes and his crew will simply do what your seeing now, using Lou Ponsi and others giving interviews that provide very selective reporting.

            Hughes is not reaching out to you and me, he is reaching out to those who are not really paying attention, shall we say those other Fullerton residents who could CARE LESS about Kelly Thomas or police corruption.

            Only when some of those “feel good” citizens become a PERSONAL victim of some cops rath will they CARE. Such is life.

            If items 1-3 go badly, Hughes will look more of a fool than he does now. If he makes to many changes some might consider it an addmission of guilt or think they have him on the run.

            MAKE no mistake Hughes has an ego too, and needs to keep an imagine within FPD and his fellow Chiefs around the area.

            We all saw the original “godfather” movie. You all should remember Al Pacino asking Robert Duvall if they had people on the payroll at the local newspaper when they were planning the killing of the police captain who broke Als jaw?

            Well that is the samething your seeing now with these reporters and these interviews.

            The only thing that counters those interviews is THIS BLOG. The nice thing about the blogs is MORE people are reading them and from around the country.

            You have read where I mention San Bernardino County. Folks again if you think you have it bad here, you have NO IDEA!!!

            The past 5 Sheriff’s in that county are the finest example of “good ol boys” known to most cops.

            Getting a ‘good ol boy” as Sheriff spans more than 50 years, YES I said 50 years.

            The present Sheriff grooms someone below him to take his spot when he retires. ALL of them are corrupt to the CORE.

            Thanks to the bigger newspapers who are no doubt just like what you see here, the appointed Sheriff eventually runs for office and in most cases is unoppossed during the election.

            An outsider with little money has little or no chance of suceeding. But if they do some of the “good ol boys” will do their best to sabatoge the under dog.

            It’s a well organized and financed game of keeping a corrupt official in power.

            Hughes SHOULD have started seeing a “good ol boy” regime back when he was a patrolman.

            But with McKinley being in charge for 16 years, I know it happened for sure at that time.

            NO ONE should be in charge as the Chief LEO for 16 years. Such a long tenure BREADS corruption.

            And you either play the corruption game or you get kicked to the curb. So Hughes played the game and made it up to Captain and now Acting Chief.
