The Mighty Peculiar Tale of Officer Joe Wolfe

By now everyone is at least casually familiar with the personage of FPD cop Joe Wolfe, who along with Manny Ramos, happened to be the first to confront the homeless schizophrenic man, Kelly Thomas, in the Fullerton Transportation Center, on the sultry night of July 5th, 2011.

Allegedly responding to a call claiming somebody was breaking into cars, Wolfe and Ramos were near enough to get to the scene first. Some folks think this was not a coincidence.

According to the DA, Wolfe searched Thomas’ backpack at the rear of a patrol car as Ramos hovered over Thomas around front – a mere 10-15 feet away. The fact that this implausibly lengthy “search” took place during Ramos’ physical and verbal intimidation of Kelly gave the DA his justification for Wolfe’s subsequent behavior.

What happened next (according to the DA) is that Kelly, who finally realized he was being queued up for an ass kicking one way or another, got up, and backed away from Ramos, hands and palms up; Ramos had pulled out his baton. And who was there to meet Thomas with drawn night stick, having circled around behind the patrol car and who suddenly seemed very much aware of what was going on?

Right. Officer Joe Wolfe.

This corpulent cop, who was so thoroughly engrossed in picking through Thomas’ scant belongings that he supposedly had no knowledge of what was happening a few feet away, suddenly became as nimble as Nijinski, allegedly slamming Kelly in the leg with his night stick, and with Ramos, tackling Thomas. As Ramos held Thomas by the neck and punched him, Wolfe was on top too, kicking and punching as the beat down and the pile on began.

We are asked (by the DA) to believe that Wolfe was completely unaware of Ramos verbally threatening Thomas, and donning his latex gloves; and that he was merely coming to Ramos’ rescue. Could it have happened that way? I guess so, but it really strains credulity to believe that Wolfe was not aware of the provacative behavior of Ramos, even if there were no pre-arranged set up of Kelly involved. And the DA provided no credible explanation for the sheer violence of his physical assault: we are left with the inevitable conclusion that Wolfe meant to do Kelly great bodily harm.

How many times did Wolfe hit Thomas before the one-eyed cop Jay Cicinelli arrived on the scene to finish him off? Only those privileged cops (and city councilmen) who have  seen the video know.

Many questions remain unanswered about the role of Mr. Wolfe on the night in question, and despite the DA’s effort to absolve Wolfe of complicity in the killing, many observers, including me, remain unconvinced.

One thing we do know for sure: Joe Wolfe joins an ever growing list of Fullerton cops who can’t be let loose on the street or trusted to testify in court. He has been on paid leave since August. And until the Gennaco report on the Thomas killing comes out, there he will stay.

  1. I agree. The DA seemed mighty eager to exonerate Wolfe. Can’t have too many loose ends out there for when you drop the whole thing!

    1. I agree. Seems to be a national crisis, overweight, out of shape cops. Is this why they have such a need for tasers? It seems to be rampant, cops tasering people for things as miniscule as not gettting their license fast enough, or backtalking an ‘officer’. There needs to be STRICT regulations on this, and more…apparently. Seems that a damn cop should be in good enough shape to handle someone with, no gun, no weapon….Hell, no shirt! Things have gone TERRIBLY wrong.

    He said he felt he could NOT prove “criminal responsibility”. My opinion he left the door WIDE OPEN on that.

    FPD exonerated the other 4. But one or more of them could indeed be a prosecution witness.

    Glad he didn’t say he isn’t filing charges in the “interest of justice”.

    Again the preliminary hearing scheduled to go in March, that I don’t think will go AT ALL, will tell us a better story.

      1. Surprisingly Calif cops are in better shape than other states. Look at the office down site. So many cops from east of Calif die of heart attacks in training, fights, chases. Doesn’t happen often in Calif but I know most big cops don’t chase at all. They just rely on the radio, perimeters, dogs.

  12. Officer Wolfe has also recently underwent his second surgery to repair his shoulder from the damage inflicted by Kelly Thomas. As most of you know Ron Thomas is a trainer of police and military in the fighting arts of the orient., Kelly was trained by Ron in these fighting methods because of his traing, Kelly was able to inflict great bodily injury on Officer Wolfe a person working a job to feed his family.

    1. I did know about Ron Thomas being a martial arts trainer in the military and he trained other deputies how to properly apprehend (without hits to the facial area of course).

      So what your saying is that Kelly wooped up on one or two of these officers and they simply ‘lost it’.

            I say there is some connection with Dave Ellis,
            I also say there is a connection with a ” journalist” in Fullerton who supports Sellars.
            as a coincidence,it is reported (by a lawsuit filing I found on the web)that Sgt O’Malley just so happened to have beat a man (7/4/11) that was later killed by Pomona police force in October 2011. Last name Avila, family is suing the Pomona PD, it can be googled. I am not saying it was justified or not, just an eery coincidence to Kelly and the date, etc.
            I am sure there are links we don’t know about, possibly Sellar connection, etc etc.

            There is no doubt in my mind who “he” is but it doesn’t really matter, he is still a cop troll no matter what his name is. He has no impact on Fullerton other than to stir up shit on this blog and push people’s buttons. Fullerton Ruler wants you to beleive he is in the “inner circle”, but I call BS on this.         1. I know you’re having fun with all of this, and to a certain extent it is funny, in a serious kind of way. The problem is that people are getting hurt and killed for NO good reason.

          The war on drugs is not working, nor or those DUI checkpoint that you love. The jails have become the de facto mental institutions for people who should be getting help instead. PDs all over the US are run under a cloud of secrecy, even when they clearly are committing criminal acts against the very people they supposed to protect. Criminalizing everything is not working.

  15. Mr. Peabody, you indicate that there are privileged city council members who have seen the infamous video. Who has and who hasn’t seen it? If not all of them have seen it, why are others being excluded?

    1. Unless Mr. Peabody responds back, I believe we could only speculate that the cop-council has seen the polecam video. That is McKinley & Bankhead because they were fomer FPD cops.
      Since Bruce Whitaker has requested to view the video and Mr. McArrogant says he ‘violently opposes’ all council to review the video, one can read between the lines and through the bullshit.

  16. I’m willing to give Wolfe the benefit of the doubt at this point. He might not have heard everything Ramos said if a train or bus was passing through or his radio was blaring in his ear. You’d think he would get the clue looking at body language, but I don’t know…

    The video should settle this once and for all.

    1. I’m not feeling so charitable, although at this point we obviously don’t know what he knew or didn’t know. I am going on the DA’s description and find it very hard to explain Wolfe’s alleged violent attack on Kelly Thomas.

      It seems so out of proportion that premeditation has to be considered.

      1. Scroll up to the top of this page and examine the photo of Wolfe. Although it doesn’t show him the night of July 5th, it shows something that should be examined further to determine his role.

        He wears his speaker microphone on his chest. In noisy environments, a lot of sound is lost because the speaker is facing outward, away from a person’s ears. The volume must be increased considerably to compensate — so much so that it drowns out other people’s voices in front of you.

        I’m not trying to exonerate Wolfe here, I’m saying that a combination of train, bus, and loud radio noise may have prevented him from hearing everything Ramos said to Kelly. The only way to know is to synchronize the video with the radio recordings and DAR and watch how Wolfe reacts.

  17. Prior to his death when was the last time the Thomas family saw Kelly?
    The Thomas family has said the police released a photo of Kelly that was not him.(The one without his shirt on)
    What if that photo is in fact Kelly Thomas?
    The family does not recognize him? Is the last photo they have of him other than Kelly with a bloody face a photo of a teenage boy in a cowboy hat? Kelly was 37 years old. How long had it been since the family had seen him? It factors into their monetary compensation of their loss.

      1. Come time for the civil suit, I’m certain the city’s attorney will attempt to use that ‘when was the last time you’ve seen Kelly’ as a negotiating point in terms of value in the monitary settlement.

    The report by independent consultant Mike Gennaco on the Fullerton Police Department’s response in the Kelly Thomas case will be presented to the Fullerton City Council at its Tuesday, Feb. 21, meeting.

    The meeting will begin at 4:30 p.m., in the council chamber at Fullerton City Hall, 303 W. Commonwealth Ave., and the Gennaco report will be the first item on the agenda.

    Gennaco, chief attorney for the Los Angeles Office of Independent Review (OIR), was hired by the city to respond to specific questions from the public that arose in the days immediately following the Thomas incident, which occurred last July.

    Thomas, a homeless man, was involved in an altercation with Fullerton police officers attempting to arrest him on suspicion of auto burglary. Thomas died five days after the incident.

    The district attorney’s office has filed a second-degree murder charge against one of the officers involved in the incident, and one count of involuntary manslaughter against a second. Both are awaiting trial.

    This will be the first of two reports to the council by Gennaco. The second, which is slated to come to council in late March or early April, will be the results of Gennaco’s review of the police department’s overall policies and procedures.

    The third report, which will be presented to Dan Hughes, acting chief of the police department, will be the results of Gennaco’s review of the individual response by all officers ultimately dispatched on the Thomas incident.

    Following the presentation of Gennaco’s report Tuesday, the Council will go into its regularly scheduled closed session. The Gennaco report will not be discussed during that session.

    The council will reconvene at approximately 6:30 p.m. to consider the rest of its formal agenda. Two significant items on that agenda include a request by Occupy Orange County for the Council to consider several issues, including how the City invests local funds, and the setting of a recall election.

    The council meeting will be broadcast live on the city’s government cable channel, Time Warner Channel 3. Viewers must be Time Warner subscribers.

    The meeting will also be video streamed over the city’s website, cityoffullerton.com.

    Further information about the agenda may be obtained by calling the Fullerton City Clerk’s Office at (714) 738-6310.

    Persons requiring special accommodations to attend the meeting are asked to notify the City Clerk’s Office prior to Feb. 21.

        Silvia – was it an altercation? or an incident? As a PIO for Fullerton (PD and otherwise) do you have a degree/experience in “Communications” and/or English (the use thereof in your position)? If yes, you know there is a difference between “altercation” and “incident”. To use both terms in the same sentence is [violently – hah!] contradictory.

  20. Wow.  That’s all I can say after closely reviewing your recent campaign disclosure filing for the Committee Supporting the Recall of Pat McKinley, Don Bankhead, and F. Richard “Dick” Jones.  I call it “your” recall committee because you donated all but $550 of the $170,000 total (I count your brother’s $20,000 as I imagine you reimbursed him for it).  The Lake Forest nurse, the San Mateo artist and Hayward tax preparer who donated the $550 must be thrilled to be listed with you big dollar guys.  Couldn’t you find one of your paid signature gathers willing to put in a few dollars for the cause they support so passionately?

    I know you find these campaign reports to be burdensome and beneath you.  The ongoing FPPC investigation into your failure to file as a Major Donor is another example of how the rules don’t apply to you.   While it’s nice to see that you did file a major donor report for 2011, it seems like you only follow the rules after someone calls you out.  

    Before another FPPC complaint is filed against you, we are going to give you a chance to correct and amend your December 31, 2011 460 form.  Since you started self-funding the recall you have hired over 40 paid petition circulators and correctly reported their information.    

    On page 19 of your filing you report paying Tim Whitacre $64,177 as an “independent contractor, signature gatherer.”  You code the payment correctly as PET (petition circulator).  Whitacre is widely known in GOP circles as a coordinator of signature gathering campaigns, e.g. the failed recall of Assemblyman Anthony Adams.  In fact, Whitacre made calls to GOP activists trying to recruit them as paid circulators for your recall effort.

    This is where it gets a little dicey for you.  FPPC regulation 18431(d) [CLICK HERE TO VIEW] requires you to list all of Whitacre’s sub-contractor petition circulators.  And, so you don’t get in further trouble with the Internal Revenue Service I suggest that you send each paid signature gatherer the required 1099.  

    I will give you until Wednesday, February 22 to amend your report to include Whitacre’s sub-contractors.   I’m sure Mr. Whitacre would prefer to not receive the 1099 for $64,177.  If you can’t locate him or he did not keep the required records rendering you unable to amend your report, an FPPC complaint will be filed and the IRS notified.

      Mr. Bushala is not required to file a Major Donor Report, which is California Form 461. The term Major Donor is shorthand for “Major Donor Committee”, and of course a “committee” under the Political Reform Act could be just one person.
      It is rather basic “administrative law”, that rules and regulations must be promulgated within the bounds of the statutes, which are created by the Legislature.
      Form 461 refers the users to the Fair Political Practices Committee’s “Campaign Disclosure Manual”. That Manual, in turn, states that the governing law is the Political Reform Act [“PRA”]as codified at Government Code sections 81000-91014. And if you go to the PRA, you will find that only Government Code section 84504 purports to explain or define the notion of a “major donor”:

      84504. (a) Any committee that supports or opposes one or more ballot measures shall name and identify itself using a name or phrase that clearly identifies the economic or other special interest of its major donors of fifty thousand dollars ($50,000) or more in any reference to the committee required by law, including, but not
      limited, to its statement of organization filed pursuant to Section 84101.
      (b) If the major donors of fifty thousand dollars ($50,000) or more share a common employer, the identity of the employer shall also be disclosed.
      (c) Any committee which supports or opposes a ballot measure,shall print or broadcast its name as provided in this section as part of any advertisement or other paid public statement.
      (d) If candidates or their controlled committees, as a group or individually, meet the contribution thresholds for a person, they shall be identified by the controlling candidate’s name.

      This section occurs within an “article” to which it solely applies, beginning with Government Code section 84501. Under the terms of the definitions which appear there, a petition-sponsoring committee simply is not described. Now, once an election has been declared, it is now an “election committee”, to which the article applies (i.e.. sections 84501 et seq.), and thus the Major Donor Committee provisions apply.

      Mr. Bushala has not broken any rules, by failing to file a Major Donor [Committee] report on Form 461.
      I will not fault you at this point, Mr. Bennett, because I view you as being a victim of the false information which the anti-recall forces have been feeding to people who, for various reasons, are naturally sympathetic. Just this one little bit of disinformation and misdirection from them, now that you know about it, should admonish you to get away from them, and keep a far distance from them.
      Whoever informed you, wants to use you as a pawn, to your peril. Let the King — or perhaps the Queen? — who is running the Anti-Recall Chess Team put himself or herself out onto the Playing Board. But do not be their pawn!
      All you need to do is act like an FPD administrator: get sick and disabled in the face of battle. But you need to get off the battle field, before you are carried off.
      Believe me, Mr. Bennett, the Rulers inside of Fullerton City Hall rarely expose themselves, and they set up others for taking the political consequeces of their dishonesties.     They don’t know if the call is legit or not. They simply type the information into the computer as it is received from the caller.

    Dispatchers ask questions if they feel the need. If it’s a 911 call, the ADDRESS it came from should be coming up on the screen. Should be part of a perminant record subject to SUBPEONA.

    If it’s not a 911 call, and comes into a direct line to dispatch, if the department is set up they too might know the location of that call.

    All incoming calls should be tape recorded and on file.

    Now cutting to the chase, could a cop or whoever make a bogus call to 911 for whatever reason? YES!!! ABSOLUTELY!!

    Cops have been caught making a bogus call themselves, in order to FABRICATE a call that would in fact create, PROBABLE CAUSE to contact a residence or a person.

    Is that the case here? I don’t know.

    Many callers to 911, refuse to give their name. Some 911 calls are from cell phones.

    Some courts have held that even anonymous calls, still establish probable cause to INVESTIGATE.

    Even if someone made an illegal accusation against Kelly just to get the cops out there to get him to move along, it STILL DOES not justifie the use of force.

    But if the call was made to try and justifie the BIG picture at the end of the day, IT ISN’T going to work. BUT it damn sure could help paint the picture of a cover-up, if TRUE!!!

    If they had found stolen property on Kelly, open cars doors or forced entry into vehicles, THAT might have some teeth to it.

    But again, unless Kelly fought the cops, toe to toe, it still doesn’t justifie the use of force resulting in his death.

    Just because I catch a burglar doesn’t not mean I can kill him because he get’s scared and try’s to run.

    Especially if I know he is mentally challenged.

  29. Officer Wolfe is a good guy. He is on PAID administrative leave while the city figures out a way to completely exonerate him. A good guy gets lots of vacation time sort of like his good guy police chief, Sellers. Problem is that Fullerton cannot afford too many good guys like Wolfe.

    Joe Wolfe was trained by Pat McPension, who sees no wrong in the huge increase in crimes in Fullerton under his watch and the huge increase in the number of stupid incidents by FPD members. There are all good guys or good ‘ol guys!

  37. As a Fullerton resident this completely annoys me to no end. Our PD is full of egomaniacs with axes to grind. Protect and Serve, not beat and kill. As a concerned citizen I am appalled by all the on lookers that took phone video, stood by and listened and did nothing to help Kelly Thomas. As for keeping down town area safe, lets look at all the RAPES that have occurred in that area of Slide Bar. I would feel safer in Compton than in Fullerton…

  39. I am beyond sickened and disturbed after watching the entire video. If these “law enforcement” officers don’t get the maximum punishment I will be sickened yet again. That poor, poor man. Calling out to his Father time and time again, repeatedly apologising, desperately hoping his pleas were falling on the ears of decent humans, his voice changing sickeningly as his breath escapes him and his throat is damaged, then his last words before tragically going silent to his Daddy. OMG. How can civilized society permit this??? I am devastated for him and his family.

The fact that these officers have been on the job for at least a decade in Fullerton knowing the area, the people, the location of surveliance cameras, in front of witnesses while wearing their audio recorders -DID THIS IN PLAIN VIEW-speaks volumes of the mindset of these individuals as well as the other 140 or so officers who have remained silent. If they can get away with murder on video on national television-NO ONE IS SAFE-NO ONE. may Justice prevail.

  42. I am very doubtful that justice will be served fur K. Thomas and his family. I say this because the entire judicial branch of government in California has admitted to being corrupt. SEE SBX211 section 5. The county has been bribing the judges and you need not look any further then the county prosecutor to identify where the bias is and how this could effect the judges ability to be unbiased.
