                1. You still don’t get it. That 2/3 number wads cooked up by a paid-off consultant and was not even accepted by the Water rate Committee.

                  In any case, Prop 218 requires a legitimate fee study – not some self-serving BS to hang on to as much ill-gotten gain as possible. You are obviously unaware (among many other things, I’m sure) that the City already charges directly to the Water Fund for all water-related expenses – including those that were described in the ordinance. It was a pure, double-dip rip off.

                2. I’m satisfied with saying that the amount of the water fee that went towards what water fees are actually supposed to go for was not “an illegal tax.” The best estimates I’ve heard about that figure are: about 2/3. Do you think that the water system has required no money at all for the past decades?

              2. If the renters pay a SEPARATE water tax since they would be paying for their own utilities, then they deserve a tax rebate. If renters do not pay separately for utilities and it is buried into their monthly rental fee, they would not be reimbursed. If I pay $1000 a month property tax on a 4 unit rental and each unit has a different size and each unit uses different amounts of water, how am I going to divvy up the water tax refund? If I get a property tax reduction because I petitioned the county assessor, do I also give that back to the renters?

                2. You’re right — they would not be reimbursed. It would be a windfall for landlords who, at the time that the property was being rented, were passing the fees on to their tenants. The difference between us is that that disturbs me and you seem to think that it’s just fine.

                3. X-hippie — it’s actually really easy. No refunds should be given for rental property at all unless it’s clear that they would go to those who rented the property at the time (which would be mostly long-term tenants.)

On apts, owner gets the bill; on single family homes–depends, but owner will usually get shut off notice no matter who get iniital bill. I would think refunds would no to the account holder (one gets the bill).

              1. Guess your not familiar with whether utility costs are figured into the rent charged to tenants for their apartments. Tenants paid more rent based on this assessment; now you want landlords to get the refund.

                By all means, take that argument to the voters!

                  Can you imagine what would FFFF would say about that expense of public money — reimbursing people for money they never actually paid — if it weren’t, um, so “landlord-friendly”?

                  Maybe the city could set up escrow accounts for tenants instead of giving landlords money that the tenants paid (and will not have the individual means to use the court system to obtain. Classic class-action situation.)

                  It’s more efficient (and for all I know only possible) for the property owner to pay the cold water bill. It’s understood that an estimate of the water usage goes into determining the rent — and that if I am running a swimming pool filling business out of my apartment that I should expect a rental increase. Wouldn’t you think?

      1. From a marketing standpoint it is brilliant. Everyone in Fullerton gets the Pennysaver. Not everyone reads it but ALL see and read the cover. It does not have the same feel as a gloss mailer and remains the household in plain view away from the trash can considerably longer. Not to mention the 50 year anniversary of the publication lends more credence to the supposed cover story.

            1. Greg if your looking for partisan reading, may I suggest the current edition of the Fullerton Observer?

              They love to bash Kiger, Whittaker, and Sebourn, yet they fail to mention who the author is of these partisan pieces?

              1. To be honest, I rarely read the Observer unless someone I know sends me a head’s up to read a particular story, which isn’t that often. If you had a criticism of their partisanship, for all I know I’d agree with it. (Of course, that the Observer may be partisan doesn’t mean that FFFF isn’t.)

                I came into this debate as a foe of the previous Council majority’s retaining control — and as one hopeful that if there were a new libertarian Council majority it would at least stay its hand in doing anything too radical before the November election. Well, I got half of what I wanted.

                My feeling right now is that Fullerton needs checks and balances within its city government. I think it’s healthy right now for Fullerton not to have any single faction in charge — neither the Ackerman majority of old or the Bushala majority of new. That’s pretty non-partisan.

                Now before anyone says it — yes, I’m rooting for both Democratic candidates, who if elected would with Doug Chaffee give Fullerton a Democratic majority — but I think that the Democrats are least likely of the three major factions to overreach. Especially with Sebourn still on Council (and Whitaker likely to retain his seat), there’s plenty to keep them honest in the upcoming labor negotiation with FPOA.

                I can absolutely believe that the previous contracts have been too slanted towards police — but the solution to that is a fair contract, not some sort of revenge. I think that Democrats will understand that they can’t roll over for the FPOA’s maximalist demands, even as they also will understand that it’s stupid to try to destroy that union.

                (Note: as a party official, given the endorsement of Flory and Jaramillo by the DPOC, I can now no longer promote Jane Rands’s candidacy — that’s part of the price one pays for being a party official — but obviously I went on record about it before that endorsement took place.)

                  It is not all Travis and Tony posting, not even close. It is many, many people. They use fake names. We don’t know who they are. They are speaking only for themselves. Their comments are not moderated but published in real time. There is nobody working full-time on finding every tasteless comments and deleting it. In fact, I don’t even know how many of the bloggers have that capability, but I don’t. Thank God.

                  We can’t control what people post anymore than what people think. A lack of condemnation doesn’t mean people agree, condone or like particular comments. With many of the trolls or idiots, if you ignore them, after a while they go away. So its not worth anybody’s time to go through hundreds of comments looking for things to condemn. If it makes you feel any better, I think about 10% of all comments here are entirely tasteless. It is better some times, worse other times. What’s important to realize is that the people running the blog are not condoning racism, sexism, anti-Semitism, misogyny, discrimination, etc. So if you can’t bring yourself to just ignore it, go ahead and fight it, but the whole point of trolling is to get a reaction, so when you respond, they win.

I think in some respects Fullerton is a great example of political awareness and action that a lot of other cities in the US should follow. I really hope to visit someday.

In a case similer to highly publisized one here in fullerton the circumstances drew swift action from “Los Angeles Police Chief Charlie Beck has relieved the commanding officer of the Foothill division from duty and is demoting him over his handling of a use-of-force incident against a 34-year-old woman in Tujunga last week.

    “I have serious concerns about this incident and I believe the commanding officer of Foothill area was severely deficient in his response,” Beck said. “Proper steps were not taken, including appropriate notifications and the removal of the involved officers from the field. ”

    How can we nominate a chief that also did not as captain respond with appropriate quick reaction to a similar involving police misapropriation of force. Who allowed review of the video of officers to write their police reports.

      He is not being demoted. He is staying as a Captain. He is just getting a paycut from Step 3 to Step 1. So he is being punished for not handling the incident appropriately, but he is not being demoted.

    LAPD rag dolls a cell phone violator on a fast food joint camera and they are placed on leave immediately and the captain is demoted. Sellers goes out out cholesterol leave and Beck rolls heads. The people that DON’T see a problem here are living proof that the booze, the aspartame, and the elevated fluoride and bromine water levels are doing their job.         1. So you noticed the similarities between the two incidents as well? I noticed that significant violence and abuse over a non threatening “suspect” because of language is a common theme. Also, the fist bump at the end made me a little sick to my stomach. What did you think about different positions of the cops? They seem to come from opposite ends of the spectrum; one was a 22 year veteran while the other had been on the force for only 10 months.

          Tell me how you think that Fullerton’s downtown would have fared without redevelopment. Yes, the public would still have a patch of sidewalk outside of a restaurant and there would be fewer bars and fewer drunken fraternity members at night — conceded. What problems were Flory and the then-council trying to solve at the time, though, and did that work. She was making decisions before much of the more recent information about redevelopment came out — and if there’s any material about her personally shoveling money to cronies, we’d be reading about it here every day.

          You’re still fighting Tony’s battles from years ago about Downtown, which when you get past the sloganeering are really of little interest to most people. (And you wonder why I think that Tony writes (or has written) a lot of this stuff!)

          1. It was a nice historic downtown, in need of opening up a few good places that the locals would want to hang out. Instead it became the beneficiaries of 50 bars, many of whom the locals don’t want to hang out at. It would have done much better without redevelopment. The developers funded the election committee of the councilmembers, Dems and Repubs. And redevelopment wasn’t a great thing that turned bad. It was a bad idea that got worse.

    It can’t be proven that all or almost all landlords passed on water rate expenses to their tenants in their rent. That’s a ridiculous assumption. Some landlords will figure that cost in, for others it will remain a fixed cost that they will absorb. For what you say to be true all landlords would have to make a very similar rate of profit off rents. They don’t. So for some the rebates would be just as justified as they would be for homeowners, or for renters who were directly charged.

    Just send the checks to the people who paid the bills. That’s all on record.

  37. Greg, I read the Water study report. It was not really an independent study. Rather it provided a result asked for by the city manager. Garbage in, garbage out.

    Their new and “improved” water fee rate of 6.67% was not backed up by facts.

    The real justifiable fee rate is less than 1%.

    Your comments that landlords who paid the illegal 10% do not deserve a refund, comes right out of the socialist playbook.

    If one follows your reasoning, you could justify robbing every rich person at gunpoint because tyrant Greg does not believe they deserve their money.

    By the way, anyone who provides dozens and dozens of responses to almost every article as you do, needs to get a life or at least another blog in which to bore its readers to death.

      Landlords usually include an estimate of the cost of water they will provide as an element of determining rent. That means that a portion of the rent paid goes to cover the expected cost of water. Is that even controversial? You think that that’s “socialist”? Have you talked to landlords about whether they do this?
