Born To Lose: The Do-Nothing DA’s Recipe For Failure

I’ve been thinking about this for months. It’s been gnawing at my spinal cortex. It’s been chewing on my psyche. It’s been snag-toothing the back of my brain. There is no polite way to put this. OC District Attorney Tony Rackauckas’ case against the goons who killed Kelly Thomas is designed to fail.

There are just too many lose ends overlooked or ignored by the DA. Too many unasked questions. Charges that are mystifying, flimsy, dubious, ultimately useless.

If ever anybody looked like a patsy it was the obese clown Manny Ramos, who, as Rackauckas pointed out,  initiated the brutal contact with the schizophrenic, undernourished homeless man.  But other than possibly joining the pile on, Ramos is not said by the DA to have been part of the actual beating laid down on Thomas. That was said to have been perpetrated principally by the one-eyed cop Jay Cicinelli, who was hit with paltry charges and a paltry bail.

The Second Degree murder charge against Ramos won’t stick since his lawyer need only point to the damage done by the other cops, four of whom have already been exonerated of any crime by the DA. And Cicinelli’s lawyer will argue that a cop tasering and beating a man’s face into his brain case is not to be considered excessive force by an OC jury, let alone manslaughter, since it never has in the past.

Joe Wolfe, whom we are supposed to believe had no knowledge of what was going on between Kelly and Ramos, a mere 15-20 feet away, and who actually delivered the first blow – a swing of the baton to Thomas’ leg, and who immediately piled on, was inexplicably given a pass by Rackauckas. Is it too conspiratorial to propose the possibility that Wolfe was actually waiting for Kelly to run away from Ramos? How long does it take to search a backpack?

And then there’s Kenton Hampton, whose thuggery has been well-documented on these pages; who arrived on the scene in time to hold down Kelly’s legs as he was being tortured and beaten by Cicinelli. He got a get out of jail card from our DA, too. So did Blatney and Craig, arriving on the scene to participate in the mop up operation, and possibly in phone/film collection activities.

Will the DA even bother going after Ramos anymore? With the preliminary hearing scheduled for March 28th, I wouldn’t be surprised if charges will be dropped, maybe even the charges against Cicinelli, as well.  Could Wolfe or Hampton still be charged if the DA has second thoughts about his strategy, and assuming he actually wants to convict somebody of something in this killing? Yes, it’s possible, but not very likely.

I’m starting to think the whole thing was just an elaborate whitewash of a conspiracy; a charade in which a weak DA ostensibly succumbed to public pressure, but never had any intention of vigorously prosecuting any cops. If so we are all in deeper trouble than we can possibly appreciate. I hope I am wrong.

And I hope if I am not wrong that Federal and civil trials will bring to light all of the information our Do-Nothing DA, by his action, or lack of action, seems intent on not disclosing.

  1. I have felt this same way since the charges were read. The DA charged the officers involved as an answer to the outcry of citizens, not to actually try them criminally. He did the bare minimum in regards to bringing only 2 officers up on charges. What about Wolfe? He was there from start and heard everything that was going on, he was only 15 feet away. There are too many buddies that work at the DA’s office that are ex Fullerton police officers. This is is going to be swept under the rug just like everything else. They wanted the waters to calm and the phony charges did just that.

  2. Wow! Excellent post Joe.

“an elaborate whitewash of a conspiracy”

Elaborate, but impromptu, they were fumbling around like imbeciles. I’m quite sure McDodo was called that night for advice, because Sellers sure seemed not know what to do.

As elaborate as the cover-up is, seeing through the propaganda is relatively easy at this point.

    Feet to the fire!

  3. This is a very good post. I have had very similar thoughts and feelings on the subject. I remember reading a post that implied the recordings which the DA used to base his case upon came from Wolfes’ DAR because Ramos had turned his off. Is this true? If it is, it would cast suspicion on the assertion that Wolfe didn’t know what was going on. I don’t buy that anyway. What happens if the DA intentionally blows the case, anything?

    1. The stranger, because he cannot be controlled and ordered, is always the object of fear; he is the potential mugger, the person outside of society’s borders who is constantly threatening. Bauman’s most famous book, Modernity and the Holocaust, is an attempt to give a full account of the dangers of these kinds of fears

Look at this, its happening everywhere.

      http://www.ocregister.com/news/loggins-340272-deputy-dominguez.html

Some people, around here, that were watching the D.A. announce those charges were puzzled by all the info he was divulging, It seemed as if he was deliberately sabotaging the case against them.

This trigger happy tuff sucks. deputies killing unarmed decorated marines from camp pendleton are permanant solutions to temporary problems.

Weber described the eventual effects of rationalization in his Economy and Society as leading to a “polar night of icy darkness”, in which increasing rationalization of human life traps individuals in an “iron cage” (or “steel-hard casing”) of rule-based, rational control.

    1. Under the interstate commerce clause?

We the people need to rise up and go to law school.

      All of us.

  4. I actually hope the charges ARE dropped. That way we can get on with Fed and civil trials free from the incompetence and or crookedness of Rackauckas.

    1. Its got to you too, I see

Its the same stuff, just a different day.

Its painful to watch everyone walking around in their sleep.

  5. Dang Joe, TO BAD the Chief of Police position is not an ELECTED position, I’d vote for you. BUT you would have to put me in charge of Internal Affairs, LOL!!!! GOOD commentary AGAIN!!!!

You know you can’t put thoughts such as this on OFFICIAL paperwork though??

As much as I hate corruption, one must be fair in the process.

First off when Ramos made the famous statement, “see these gloves, they are going to F you up”.

If in fact that statement by the DA was not a complete statement and Ramos did SAY, in total comment, “if you don’t do what I say and comply”, is ABSOLUTE crap for the DA to include HALF statements.

Such comments by cops have been said many times, and if saying such prevents you from having to hurt someone, I SAY go for it.

It simply is inflamatory and WRONG!!!

If this is the things to come in the prosecution DA RACK might very well have his head handed to him and he will have earned it.

If the DA is simply hammering these guys and JUST them, I can see every Police Union is So Cal coming together to see he is not re-elected.

Yes the 2nd degree murder charge against Ramos is excessive if Ramos was NOT the one pounding on Kelly. Ramos might be an accessory to Manslaughter since Ramos took no action to stop Cincinnelli.

Not a charge the public could put their arms around, BUT a more applicable one that a JURY might.

Overcharging a person, JUST to look cool in the eyes of the public is nothing but a disaster waiting to happen.

But overcharging HAS BEEN done knowing full well you can’t meet the burden of proof and will get a NOT GUILTY.

The DA will reach out to the unknowing and simple say, “we tried” hoping no one will call BS at the end of the day.

The other glaring issues is not only did the other 4 cops avoid prosecution, they were exonerated in the administrative investigation as well.

OKAY, then Chief Hughes and the others before him, along with the Union should be YELLING BS on DA Rack, BUT their not. WHY???

If they yell once a NOT GUILTY is announced, THEY have nothing to be proud of either, WAITING for things to be safe before they come to the aid of one of there own. SELECTIVE courage is NOTHING to be proud of either.

For those who say that’s BS, there are OTHER police agencies to work for who handle their business in a different way than FPD.

For a Chief to allow his employees to face such charges IF HE or SHE believes they are being made the FALL guy just to make the public happy, is a COWARD for a leader.

Again we did NOT see DA Rack give ANY kudos to FPD during his public comments.

Just a lot of questions yet unanswered.

    1. ACU, how in the world could they be exonerated in the administrative investigation? So, the administration is saying it’s “OK” to beat a man (even one whom they suspect might have committed a crime) to death?

    2. Cities need, politically suicidal, kamakasi politicians that are willing to sacrifice their political careers for the greater good of the constitution. And we need to elect them relentlessly, one after the other, to avoid all this inhouse back scratching that deprives citizens of their civil rights.

Now that everythings gone digital, tax farming may bankrupt our cities, nationwide, like a theif in the night.

      http://en.wikipedia.org/wiki/Tax_farming

“Tax farming practices are believed to have contributed to the fall of the Roman empire.”

  6. Wrong Guy :
Could the FBI charge the DA for failing to do his job properly?

If the DA failed to prosecute other who should have been charged and didn’t and clearly ignored them for political reasons?

I believe an obstruction of justice charge could be made against the DA.

    Politics aside.

But even if the Feds don’t say much to DA Rack if they come behind him and hammer anyone he DID NOT, it’s about as big a slap in the face as one could get.

A smashed ego in the public spotlight can be fatal for sure.

    1. You can bet that such an occurrence would be made a big deal out of by Todd Spitzer who just can’t wait to go after the Rackauckas machine.

    2. Law and order.

If only these barbarians could have just detained him, took him to the county hospital, put him back on his meds, we wouldn’t be having these conversations, and all this expence could have been avoided.

      But nooooo!

They had to act as if they were the midevil Varavgian gaurd, hired to kill off the compitition of Constantinople.

      Stupid is what stupid does.

Killing a skinny, homeless man is sooooo weak.

This should apply to all those involved:
“He who oppresses the poor to increase his wealth and he who gives gifts to the rich–both come to poverty.”

      -Proverbs 22:16

  7. Concerned Texan :
ACU, how in the world could they be exonerated in the administrative investigation? So, the administration is saying it’s “OK” to beat a man (even one whom they suspect might have committed a crime) to death?

    Agreed!!!

I am not suggesting the others beat Kelly equally or anything like that, I have not seen the video of course.

I was thinking more along the lines of “failure to stop” the beating.

I don’t know of any police agency who does not have such a policy on the books written along the lines of such actions that MUST be taken.

And of course violating a policy within your agency is NOT grounds for a criminal prosecution either. TWO different animals and the public MUST understand that.

Generally policy covers what the criminal statues DO NOT.

Maybe one or more of the other cops did attempt to do so, THAT we shall know in time.

But if they KNOW there was an initial cover up, followed orders to REMAIN SILENT, played stupid, because that’s what Chief Sellers told them too.

Then we all know who else should have been charged by DA RACK.

That remains the mystery at this time.

  8. Erin :
I feel sorry for Fullerton if these 2 POS’ aren’t charged. There just may be a lot of blood in the streets.

I’d bet my butt DA RACK is having some sleepless nights.

    1. The only thing that is keeping Tony Ra-cock-u-lous awake at night is all those pro cop schmoozers he no longer get invited to. It aint Kelly Thomas, or the other hundreds he has refused to assist in bringing justice…

  10. Interesting. Question for you though, Joe. Why would T-Rack be so stupid though as to bring charges in the first place if he has a weak case? That would spell disaster.

Helloooooooooooo anonymous person from DA’s office, please weigh in.

    1. I would think that it would be to appease the public. I believe a DA has a lot of his career dependent upon police officers. I wonder how many of his convictions could be overturned if SIX police officers were found guilty of crimes such as perjury and murder.

    2. The weak part of my theory is that it involves the DA eating crow, although, frankly I doubt that Rackauckas ever dreamed people would still be talking about this six months later.

Still, eating crow later might have been deemed a small price to pay for taking the heat off immediately last September when the wolves were howling at his door.

      1. Dont forget about the female coroner who’s cause of death was changed by her supervisor at the request of the DA and who will testify to that

    1. I still think that would be STUPID to bring a case to appease the public. I agree though, a DA’s career is dependent upon police.

    2. I think most people hope it all works out in the end, and really don’t want to get involved. That means most people do nothing unless there is a huge incentive, like the Kelly Thomas murder and subsequent cover-up.

    3. Its possible that a war with Iran may bankrupt us like Nepolians army, starving in the russian winter.

By then the economy may be so bad, citizens and politicians alike, may be faced with one hungry group of soldiers that may not want to put up with this bs when they get back home,.

Last I heard, we have one of the largest standing armies the world has ever seen.

      Look here:

      http://www.ocregister.com/news/loggins-340272-deputy-dominguez.html

The unions are trying to pass this one off just like the kelly case.

      This article shows the pattern.

      Neatly rapped and tightly packed.

If the unions keep this shit up, I fear they may ignite a full blown civil war with our troops. and we the people would only be caught in the cross fire.

I witnessed a military wife today visibly upset about what happened in San Clemente last week.

I fear the union may be adding insult to injury in this article. How does a union rationalize a deputy killing an unarmed, decorated marine in front of his 2 daughters. That is like kicking a rabid dog.

I’ve seen bullshit but, but now its taking on the form of pure arrogance.

      1. Thank you for providing this link, CC. This makes me cry and so angry. Their damage control efforts are pathetic. I mean, REALLY? They admit all the changes in their story but wait…this one is the truth…and we’re suppose to buy it. I call bullshit.
The deputy heard the kids and went back to the vehicle. So either he left them to resume pursuing the Marine or did he or someone else stay with them and then just stand there going “duh” when their father returned and was able to get by and get back into the vehicle? Where was this supposed fear for the kids?
Also, if this latest crap is to be believed, why didn’t they simply shoot out the tires? Instead, they shoot him with the kids in close proximity.

Owning a home in this city is an embarrassment these days. It use to be when you told people you live in Fullerton they would say, wow what a nice city to own a home in. Now all I get is, that place is a dump and the corruption runs real deep. What is a homeowner to do with this and the fact that we have so many corrupt council members and cops?
I still stand by disbanding the FPD. It and a new city council the ONLY way the city can recover.

  12. From the California Penal Code.

This would apply to the other 4 officers, the Watch Commander,Sellers, and the other 3 Captains as it relates to Kelly Thomas.

    32. Every person who, after a felony has been committed, harbors,
conceals or aids a principal in such felony, with the intent that
said principal may avoid or escape from arrest, trial, conviction or
punishment, having knowledge that said principal has committed such
felony or has been charged with such felony or convicted thereof, is
    an accessory to such felony.

I think the wording is rather obvious to one who has the most basic level of intelligence.

So if Sellers made ANY attempt however slight to cover this up, HE TOO should be standing tall before the People of the State of California.

And no I don’t need a freakin title of District Attorney to make a case like this.

I did it as a cop more than once. I like many other cops put the case together. ALL the DA had to do is methodically put the FACTS before the jury. It doesn’t take YEARS of law school to accomplish this task.

    1. ACU, tell me when this has ever applied to LE? They have carte blanche to do whatever the hell they want. It’s obvious

  13. From the California Penal Code.

This might be considered a LESSER included offense to Penal Code section 32.

The first 3 lines are for the ones I just mentioned.

If the DA was concerned about JUSTICE for all, who would have used one of these two section to TAKE out all the trash.

    31. All persons concerned in the commission of a crime, whether it
be felony or misdemeanor, and whether they directly commit the act
constituting the offense, or aid and abet in its commission, or, not
being present, have advised and encouraged its commission, and all
persons counseling, advising, or encouraging children under the age
of fourteen years, or persons who are mentally incapacitated, to
commit any crime, or who, by fraud, contrivance, or force, occasion
the drunkenness of another for the purpose of causing him to commit
any crime, or who, by threats, menaces, command, or coercion, compel
another to commit any crime, are principals in any crime so
    committed.

    1. Proving the “possibility” is hard. DA’s don’t charge people for fun. DA’s reject cases against normal people all the time. Battery with John and Joe. No witnesses. Minor injury. Rejected by the DA. Many factors involved but rejected. DA’s offices file cases they can prove not to appease the public.

  14. Erin :
ACU, tell me when this has ever applied to LE? They have carte blanche to do whatever the hell they want. It’s obvious

It has applied to the rank and file from time to time, AS LONG as the powers to be have not been involved.

Carte Blanche is ALWAYS applied if accepted among the UNKNOWING!!!!

I simply put all that up there in case some troll came along and yelled BS at me. (insert smile)

Erin remind me never to piss you off ok????

  15. Concerned Texan :
How does a community correct a problem that is so overwhelming like the “Rackauckas machine?”

You recall his butt, just like folks did with the 3 Amigos.

A bigger undertaking I am sure.

    1. You CAN recall a DA? Awesome!

Just because you might be able to make an educated guess on this, how many of Rackauckas’ convictions could be over turned if the DA successfully prosecuted those 6 officers?

    2. A recall of the O.C.D.A. is looooong overdue, as this guy has been covering for his billionaire buddies like George Argyros, who get him re-elected every term as a sort of “business insurance” for Arnel Management which has raped the poorest of O.C. residents for thousands of dollars each over the last thirty years in the form of un-refunded security deposits and bogus charges for carpet cleaning and painting .

      http://en.wikipedia.org/wiki/George_Argyros

Absolutely the only way that the Orange County’s District Attorney will ever not be re-elected with George Argyros and his ilk around to insure that he’s always going to get re-elected, is to do an end around the big money contributors and the police unions, by getting the residents of Orange County focused on the extent of the damage that T-Rack’s corruption and cronyism throughout his time as a District Attorney, and then once people see how this has affected their everyday lives, we get them to RECALL him from elected office once and for all.

  16. It’s about time someone spelled it out. I’ve been saying this the day the charges were filed.

Too bad Ron Thomas drank the DA’s kool-aid and doesnt want the video released because it may “jeopardize” this bullshit case. The video should be released NOW so there is such an outcry from the public that it forces the DA to actually do the right thing.

  17. Concerned Texan :
You CAN recall a DA? Awesome!
Just because you might be able to make an educated guess on this, how many of Rackauckas’ convictions could be over turned if the DA successfully prosecuted those 6 officers?

If they all turn out to be Brady cops, many.

Convicting cops for excessive force would not set aside the work those cops have done prior to this incident.

  18. Joe, I agree with everything you said, well written, Sir! I would like to add another observation in the set up to fail charges. The hospital’s cause of death clearly points to Cicinelli being at fault. All Ramo’s attorney has to do is plant doubt in one juror’s mind. He’ll do this by using the hospital’s report and going on how this was made off keen and first hand observation and knowledge…and it was the other guy responsible, not his client.

Just curious, was Wolfe’s DAR also turned off?

On a side note, it will be interesting to see how T-Rackemup handles the obvious death by cop – the Camp Pendleton Marine who was executed in front of his young daughters by an OCSD deputy. Those who think the OCSD are any better might want to rethink that btw. If the DA fails to charge this cop, there needs to be a

    1. That deputy won’t be charged. Just like the Monterey Park cops won’t be charged. Deputy was in fear of danger to the kids. MP were in fear of a crazed drugged out wild man.

    2. …there needs to be a list made of this, Kelly’s death and his mishandling of it and ever other case he mishandled and handed to him with a demand for his resignation.

      1. Hard to do though without actual facts of cases. You would need victims and witnesses to step forward with actual complaints and actual information that shows a good case that was handled wrong. 2nd hand he said she said wont work. You can always try though. I’m a DA. We try our best.

    3. Marines that are currently stationed at Camp Pendelton are ready to wage their own war with the OCSD if charges aren’t brought over this cowardly deputy who shot an upstanding Marine in front of the Marine’s two young daughter’s as the family was exercising and praying together.
We should all be saddened and dis-heartened, that a Marine who risked his life for us all 24/7 for over 10 years is gunned down by “friendly fire” of a deputy that we as citizens of O.C. employ.

    4. Let’s not forget the play of events as they changed throughout the day:
The deputy was sitting in his car doing paperwork when the SUV came by at a high rate of speed, crashing through the gate arm (funny how there’s only minimal damage from such a high speed crash).
This later changed to the deputy was in pursuit of the speeding SUV.
First it was the officer feared for his life when the Marine started to walk toward him…so he shot him. Keep in mind, in the statement released by the OCSD, there was nothing to indicate the Marine had a weapon.
This was later changed to: the Marine walked toward the SUV and the deputy feared for the kids because the Marine didn’t follow his instructions.
This was later changed from walking toward the SUV to about to get in it. So he shot him, fearing for the kids.
If he feared for the kids, why fire a weapon at someone with them in close proximity, especially when the windows are tinted and he had no idea where they were in the vehicle at that moment or if they were about to jump out to jump to their father putting them in much more danger than the father ever could have if any of this was true. But it’s not as the first statement clearly said the deputy feared for his own life simply because the Marine walked toward him. He never reached for his waistband and I’m surprised this tired card wasn’t played.

I am not here to bash Ron Thomas. If Ron Thomas is happy with everything that has happened so far, GOOD on him.

But if Ron Thomas was ever a cop and worked the streets hookin and bookin crooks like many of us, HE WOULD know or SHOULD know when and where to call BS on some of this.

Sometimes his silence makes me wonder about some of this too!!!!

If Ron had even the slightest clue of internal issues within LE, he’d be speaking up himself.

Ron would know it’s just as important that the brass be held accountable as the street cops.

For him to ignore that has me scratching my head.

    His choice though!!!!!

    1. So true ACU. His actions are odd. I think it has to do with him being a deputy in the jail and he realized it wasn’t his thing. I think he was forced out and resigned. He clearly didn’t have negative experiences like you or he would be outspoken like you.

  20. From: http://www.fullertonsfuture.org/2011/mckinley-hired-jay-cicinelli/#comment-60357

If it wasnt for the public’s pressure, the ‘do-nothing DA’ would have done exactly that.

Of course to quell the public’s anger, the ‘do-nothing DA’ submitted an extremely weak case full of holes that the defense will rip apart and knowing full well that a jury won’t convict.

Jerry Brown did the same thing with the Bell corruption case.

it took them months to charge the officers involved despite having, audio evidence, video evidence and over 100 witnesses.

And lets not forget that the whole time they claimed that they were waiting for the corners report to complete their investigation which interesting enough took them less than 24 hours to “complete” after “officially” receiving the report.

It seems to me they were dragging their feet and hoping that the outrage would die down over time but when that didn’t happen, they decided to submit a weak BS case full of holes which the defense will tear apart.

They did that because they want their hands clean, they want to say “hey we charged them, don’t blame us, blame the jury for not convicting them”.

      1. These officers will be acquitted without a doubt.

The DA submitted a crappy case full of holes to absolve himself of responsibly and to quiet down protesters.

A few months ago the DA Tony R said on KFI that the combined weight of the all of officers caused Kelly’s death not the actions of one or two officers (Funny he didn’t name which officers were on top of Kelly).

Good luck getting Ramos convicted for 2nd degree murder based on that and the DA’s case against Jay Cyclops is even weaker because his actions according to the DA did not cause Kelly’s death and lets not forget that they completely skipped over Wolfe’s actions.

If any of the recordings start shortly after Officer Ramos contacts Kelly, the defense lawyers are going to say “gee we don’t know what was said or done before hand” also I have a feeling that Ramos ““i’m going to F you up” comment either didn’t happen or didn’t happened the way the DA put it which will further weaken the case.

The DA is just filing this case because they want their hands clean, they want to say “Hey! We charged them. Don’t blame us. Blame the jury for not convicting them”.

In the meanwhile I expect some sort of multi million dollar settlement with Ron between the time this goes to trial and before the verdict to shut him up.

They’re not going to work with Garo Mardirossia to go over additional evidence, they are not going to call all of their witnesses and they have no interest in the medical reports released.

The so-called Gennaco “Investigation” is nothing more than a scam meant to bilk tax payers out of thousands of dollars and in return they will get a nicely worded report that makes the public feel warm and gushy and the city say “gee that wasnt so bad”.

Gennaco isn’t working on an “official” capacity, he is a private citizen/entity (like this blog) so the city, police department, etc has no obligation to cooperate with him or give him accurate information.

This is not justice for Kelly. This is a whitewash.

        1. the same Gennaco highly recommended by CEO of the Orange County Human Relations Commission and long-time resident of Fullerton, Rusty Kennedy? Isn’t it nice that Rusty’s commission professes to protect the public from abuses committed upon them by law enforcement? If you don’t believe me, then ask Pat McKinley who proudly served Rusty as a member of his commission’s board.

        2. It’s not up to Ron Thomas regarding charges being dropped. The cases are titled The People v Ramos and Cicinelli, not Ron Thomas v Ramos and Cicinelli. Crimes were committed and charged, a settlement would only be between the city and Ron Thomas and have no bearing on a criminal case.

          1. It’s not up to Ron Thomas regarding charges being dropped.

I never said or remotely implied that.

This is what I said: “I expect some sort of multi million dollar settlement with Ron between the time this goes to trial and before the verdict to shut him up.

No matter how you slice it, they (by that I mean the DA and the City not “the people) expect the case to fail and when it does they do not need Ron Thomas screaming outrage and the community demanding justice. I suspect what is going to happen between the trial and verdict is they’re going to make him a nice offer and fast track it provided he agrees to their terms (and of course most settlements are confidential so don’t expect any parties involved to disclose the terms).

Judging by his reluctance to have them release the video and his attorney’s sudden silence makes me think an offer has already been proposed.

They’ve already tried to pay him off once before but the amount of money was laughable considering the crime committed.

This is not justice for Kelly. This is a whitewash.

            1. Settlement negotiations are confidential, but the city must disclose any actual settlement as soon as the deal is done.

              1. Would they be required to disclose the full terms or just the amount?

For an example if they reached a settlement for $4,520,980.98 and one of the stipulations is that Ron cannot say x, y and z about the city as it relates to the death of Kelly, would they be legally required to publicly disclose what x, y and z is?

                1. The terms are written on to a piece of paper to be signed by both parties, and that piece of paper is a public record.

                2. Do we know the terms and conditions of the settlement involving Albert Rincon’s victims?

I looked into it and all I see is this LA Times article which quotes unnamed sources:

Rincon is now on administrative leave and the city has agreed to a deal to resolve the lawsuit filed in December 2009, Sgt. Andrew Goodrich, a department spokesman said. Sources familiar with the settlement but not authorized to discuss it put the settlement amount at about $500,000.

I don’t see any articles here or in the media which spells out the exact amount of the settlement, the terms and condition or copies of documents.

            2. It’s too late for a settlement to affect the criminal trial. Ron Thomas won’t be a witness.

OTOH it would suit the Three Dead Batteries to make the specter of the civil suit go away. But the quicker it goes away the more they (we) are going to have to pay.

  21. Fullerton Ruler :
Proving the “possibility” is hard. DA’s don’t charge people for fun. DA’s reject cases against normal people all the time. Battery with John and Joe. No witnesses. Minor injury. Rejected by the DA. Many factors involved but rejected. DA’s offices file cases they can prove not to appease the public.

There is no public outcry in them either.

And if you think those cases were rejected because he could not prove them versus just clearing off the desk a little, because there are already too many cases on the desk, THINK AGAIN!!!

Are there those case that can’t be proved, OF COURSE!!

I had a few cases like that with the WE CAN’T prove this or that.

WELL HELL I’d ask, it’s obvious YOU didn’t read the damn report. UH oh yea, I didn’t see that.

Take the case RIGHT back over to the DA and raise hell. Case filed defendants pled out.

    But lets forget that.

THIS is a high profile case without question.

A man of DA Rack’s brilliance and previous experience SHOULD have taught him that an EXPLANATION was needed as to why those others were not prosecuted.

Not the “we feel we can’t prove any criminal responsibilty” on the other officers. THAT’s it, the simple because I SAID SO answer???

Let me remind you DA Rack did not mention ANYTHING thanking FPD for their wonderful cooperation in light of the public outrage of a cover up already in progress.

Again if you wish to answer the obvious with a germain maybe he can’t prove it. OKAY!!!

I submit he might not want to put himself in a postion to EAT CROW later by being to bold on some of this.

Remember the DA did not go after Mike Carona either.

  22. Fullerton Ruler :
So true ACU. His actions are odd. I think it has to do with him being a deputy in the jail and he realized it wasn’t his thing. I think he was forced out and resigned. He clearly didn’t have negative experiences like you or he would be outspoken like you.

    MAYBE!!!!!

Or he doesn’t know about this stuff becasue he didn’t pay attention when he was working, or could care less like many others.

I am the exception to the rule in most of this, because I always found it interesting, informative, and would SAVE your butt at the end of the day.

Knowledge is power. If you don’t know anything on the subject matter your TOAST.

I have know 30 year veterans who never once read the “Peace Officers Bill of Rights” never been in trouble.

When they got into trouble, “clueless” on what to do. Just lost, scared shitless. They quickly sot out those in the know just minutes before their demise.

    But such is life!!!!!!!

  23. Fullerton Ruler :
Praying together? You make it sound so simple.

As Clint Eastwood once said, “a man has got to know his limitations”.

A cop once told me you have to know how far you can push an issue, then back off or suffer the consequences when all hell breaks loose.

The USMC is a “true brotherhood”. If that is happening right now I am sure the Generals are breaking out the leashes to put on those pissed Marines.

Let’s hope so because they have faced the true enemy fire and cheated death themselves, I doubt they fear a handful of cops. Maybe some, but not all.

A handful of Marines could easily stike terror in those cops during darkness, or a the local cop watering hole. Drunken brawls break out all the time in military towns.

    Just my thoughts!!!!!!!1

  24. Fullerton Ruler :
A majority of cops have never read pobar.

If you think the average cop, especially the younger generation can come in here and debate, inform with any accuracy and resolve.

My 56 years on this earth would say NO!!!!!!

Again exceptions to what I say, but NOT the norm in any sense of the word.

  25. Then hopefully Ron Thomas would comment here to let us supporters know what his take is on all this BS from the DA.
How about it OFTB? Ron resides in Cypress.

    1. He’s focused on the prosecution and his civil case. Nothing else. He did say he supports the recall publicly.

  26. Fullerton Ruler :
Praying together? You make it sound so simple.

What’s so complicated about praying together? Could you be more specific as to what your trying to imply what they were doing together at that time of the morning, rather than praying and exercising together?

    1. Hint. Driving unsafe, crashing thru a gate, leaving your kids in a vehicle alone, hiding, coming back and attempting to flee. That’s not sitting in a car praying. But you are right. Hang the cop.

      1. That sounds like Andrew Goodrich’s version of events. I don’t recall that anyone has ever indicated that this Marine’s daughter’s were in any sort of distress, or had indicated in any way shape or form that they were being held against their will.
Bottom line is that the deputy grossly over reacted and killed the girl’s father right in front of them in cold blood, and you’re saying that it was justified for the deputy to shoot first and ask questions later.
Your a bigger moron than I first suspected.

    2. To be clear on the whole thing per first reports. He and his family did morning prayer walks at the field at San Clemente high school with bible in tow. The mother is almost 9 months pregnant and stayed home with their toddler. No one knows why he crashed through the gate but damage to the front of his Yukon was very little, as seen in pictures. His speed obviously wasn’t that great imo. Nothing ever said he tried to run or hide. He merely began jumping walking toward the deputy. For whatever reason he didn’t or couldn’t follow instructions, the deputy shot and killed a man who had no sign of having any weapons nor reached for his waistband, in front of his 9 and 14 year old daughters.

      1. He merely began jumping walking…? Not only does my phone auto correct, it also auto inserts and this one got by me. lol Scratch jumping in that line.

  27. Thanks RI, but the prosecution IS being handled by the DA which is exactly what THIS post is about.
Did you go with a new moniker hoping your RI posts didn’t get deleted?

  28. Does anyone know if the FPD Union contributed to T-Rack’s campaign? If so, wouldn’t that create a conflict of interest? You would also think that the defense attorney would move to change the venue for a fair trial (similar to the BART cop incident in Oakland).

  29. A “conflict of interest”.

    What does that mean, really?

I say anything that would create you grief in having to explain anything that might be questionable as to circumstances, YOU should have known about prior to you taking action.

In the many city’s I patrolled, and the one I lived in, I had friends like anyone else.

Sometimes those friends got into trouble or called the police for help.

I got the call in some of those cases.

I had TWO immediate conflicts to consider.

    Example 1.

A couple I know are having a domestic dispute and it sounds like violence between the two has taken place.

    Example 2.

A friend of mine has called police who is having a dispute with his neighbor, trouble is brewing and this fued is not the first.

In reality HOW am I going to handle this problem, and everyone is happy with my decision and avoid a potential future complaint that I was baised towards one party because of said friendship or known association?

If I handle the domestic dispute, one party will no doubt think I am siding with the other.

If I handle the neighbor dispute, and the neighbor finds out I am friends with the guy who called, and rule against the neighbor, then I am covering for my friend.

If I rule against my friend, then I am no longer his friend or never was according to him, cause a friends would never do that.

    A NO WIN situation.

What should I have done. NEVER handle the call to begin with. I pass it off to another cop and let him handle it and AVOID the appearance of conflict PERIOD!!!!

If you gamble and lose, you ONLY have yourself to blame because the little man in your head told you so the second you got the call. Hopefully your experience of seeing others get into trouble has taught you well.

    My point.

If DA RACK has any friends, close associates on FPD or within the city for whatever reason, is reluctant to prosecute EVERYONE who is deserving of prosecution, HE should have avoided getting involved in this case in any way shape or form from the start.

The DA should have passed this WHOLE mess off to the FBI and BEGGED them to handle it no matter what the outcome.

Who could and would truely say the DA is a bad guy if he stood up before the camera’s and said, I have alot of friends in this City, I do not feel it would be fair to them or the people if I handled this case.

He is avoiding the appearance of conflict, and I for one, WOULD NOT think bad of him for doing such having been there done that myself.

If we find out the DA took the gamble, and he is covering for ANYONE, then what ever he get’s, he deserves at the end of the day.

If I know that, so should a man who handle’s hundreds of cases a year and is in a position to change the outcome of a situation like this?

  30. Fullerton Ruler :
True but they are also VERY aware of the dynamics involved in split second, life taking and saving decisions.

They may be aware of KILLING on a mass scale, but unless it is cold blooded murder as we have seen in some cases, the USMC does not have EACH and every killing in WARTIME reviewed by the DA, or Judge Advocate’s Office.

And we know what happens when an insurrgent kills a US Marine. They are hunted down with a vengance and KILLED.

I hope Sheriff Hutchins has the forsight to see this as a potential problems and will meet with the base commander, then maybe those troops who are upset. ASAP!!!

A step in the right direction.

  31. Ful99 :
Does anyone know if the FPD Union contributed to T-Rack’s campaign? If so, wouldn’t that create a conflict of interest? You would also think that the defense attorney would move to change the venue for a fair trial (similar to the BART cop incident in Oakland).

YES!!!! Another reason T-Racks should pass it off to the FBI.

  32. SherBear :

You should notice how the specifics of this fear ARE NOT explained.

So far I am just scared, so BLAM!!!!

Articulation in such circumstances WILL save you butt if your telling the truth to begin with.

    1. It’s possible the cop was right, right? Cops can be right, right? Even though early media reports appear otherwise? Right?

    2. The only thing mentioned to try to support why he was was askeered was the Marine failed to follow his instructions. Hell, even if the last change in story was true (not), why would the deputy not shoot the tires if he concerned about the kids and their driving away with them? Why further endanger these girls with them so close to the intended target? Once again, there was no indication there was a weapon. Of course, that’s if you believe the bullshit change of events. Perhaps this was just a trigger happy cop who panicked and freaked.

          1. And he insisted in an earlier post that he’s a DA. A district attorney might be slimy, but far more educated and articulate than that.

              1. I know. I know. I just get so frustrated when the troll is on here constantly posting to almost every comment. Is his goal to hijack the post? It’s annoying.

                1. My advice is to just ignore O’ Malley. Sooner or later he will just go back to beating up Mexicans.

  33. Tu sabes :
Dont forget about the female coroner who’s cause of death was changed by her supervisor at the request of the DA and who will testify to that

    Wowwww!!

  34. The officers responded to a radio call. They attempted to lawfully detained Mr. Kelly. He attempted to flee and was lawfully detained. He resisted the officers attempt to restrain him.

  35. Fullerton Ruler :
Hint. Driving unsafe, crashing thru a gate, leaving your kids in a vehicle alone, hiding, coming back and attempting to flee. That’s not sitting in a car praying. But you are right. Hang the cop.

If you are Reality Is, you truely are a pathetic cop if this is your way of defending your profession.

Again I will be happy to tell you that in person. Hopefully one on one.

But at this point I would care if your pals were standing behind you either.

Just remember I am not Kelly Thomas.

  36. Steve Black :
The officers responded to a radio call. They attempted to lawfully detained Mr. Kelly. He attempted to flee and was lawfully detained. He resisted the officers attempt to restrain him.

You tell me what restrain is all about. Hopefully you have done that a few times in your life?

RESTRAIN is not punch to SHIT out of someone when you have 3 or 4 other cops with you.

Put some MUSCLE into your efforts and HANDCUFF they guy and IT’s OVER!!!!
But if your ASS is so fat you can’t bend over or get down and handcuff someone, it’s time to get to the gym.

Now your explanation was what sir???

  37. HEY Admin,

I know you all respect free speech and all, I agree.

But if we have trolls coming in here under different names asking stupid questions that have long since been discussed, HOW ABOUT calling BS on those comments coming from the same IP address?

    1. ACU, why do you even respond to the troll? I get that it is a free speech blog and all, but do you know that little about human behavior?

          1. It was a nonsensical statement, a reaction. I have to watch myself when it comes to the trolls.

The truth is that disinformation is interjected into this blog all the time, and the BS is obvious.

  38. So the game plan is to lie, delay, twist facts, intimidate the public, manipulate the public with the prestitute media, and rub injustice in our faces. Guess what? We are not backing down. We will systematically take Fullerton back and remove the vermin infestation over on Commonwealth. Good things take time and nothing good ever came easy. We are on the right side, we have time on our side and we will prevail. When they turn the lies and disinformation up a notch then we will just increase the TRUTHBEAM’S INTENSITY AND CONTINUE TO ALTER ITS FREQUENCY. The days of wine and roses are over and this thing is just gettin’ started. Fasten your seatbelts gang.

  39. Ron Thomas knows that the eyewitnesses reported on this blog were full of shit. They do not exist it was embellished. The DA embellished this case. Tony use these lies to initiate a recall for political purposes and of story.

  40. Fullerton Ruler :
No. Former cop. Now a DA.

Then speak your wisdom and experience versus this stuff your talking MR. DA????

Or is it going to take weeks and months for you to present your case?

  41. Steve Black :
Ron Thomas knows that the eyewitnesses reported on this blog were full of shit. They do not exist it was embellished. The DA embellished this case. Tony use these lies to initiate a recall for political purposes and of story.

Then Steve you should encourage Chief Hughes to tell the world. He has to power and postiton to do just that.

  42. And another thing, why are the Dead Batteries worried about the video making them biased when it comes time to decide on discipline? Are they waiting for the criminal trial or the Gennaco Report to finish before decisions are made? What about the other four on paid leave, when will their fate be decided?

    1. It’s all obfuscation. McKinley, of course has already seen it. Probably Blankhead, too.

The reason they don’t want it out has zero to do with discipline or justice. It has everything to do with a cover up.

  43. Fullerton Ruler :
It’s possible the cop was right, right? Cops can be right, right? Even though early media reports appear otherwise? Right?

RIGHT!!!! So tell us then and make it RIGHT!!!!!

Of course if you were SMART you might agree the press release was lacking in some DETAILED facts explaining the Deputies FEAR, it might have helped in establishing RIGHT, thus stopping some of the PUBLIC rath. NOT all but some.

Seems some leaders are NOT paying attention to what is going on around them and writing things that avoid the hoopla.

Easy to do!!! Because it’s done all the time, just seem folks in Orange County are missing out right now.

Or don’t you see that from your vast experience?

    1. Press releases aren’t police reports. Due to possible criminal charges, only the basics are released. You know that.

  44. Fullerton Ruler :
Wtf is reality is. An ffff term? Blog term?

I won’t ignore the specifics as you do.

Reality Is the name of a blogger who much like you attempts to explain things in some cases in short sentences.

Sometimes his detailed response was what he believed, but was short on fact or left some important information out. In some cases didn’t not respond or sidestepped the tuffer questions.

No doubt this person was the “spin doctor” for FPD and on occassion like to tuant some with little clues and was just trying to be funny.

RI was eventually challenged to meet fact to face and to date has declined.

If you want more on Reality Is go back and read past postings.

I was Type A with him too. So don’t feel your being picked on.

  45. Fullerton Ruler :
Press releases aren’t police reports. Due to possible criminal charges, only the basics are released. You know that.

WOW, to say that the officer was fired upon, the suspect had a weapon, the suspect attempted to attack the officer could not be included?

General FACTUAL statements are not a problem. DON’T do a press release then unless you can give a more detailed explantion in light of the present climant.

That’s almost like DA Racks general comments that he felt he could not prove the other 4 cops were criminally responsible for Kelly’s death.

You stick with your general comments if you wish.

  46. Anonymous :
ACU, why do you even respond to the troll? I get that it is a free speech blog and all, but do you know that little about human behavior?

YES I do. But if this person claims to be a DA or cop and they are a troll, the bigger picture is exposing their mindset which doesn’t help their cause in the big picture.

I dealt with trolls or people like this in person who spew whatever, when they persist, shut them down or challenge them.

Once they have layed down a nice barrage of BS, then it’s obvious it’s time to move on.

There is a method to my madness.

    1. Also one of McKinley’s puppet’s.

He’s like my goofy dog Zachary; he can’t help himself when he does dumb things.

        1. I’m not ignorant at all. The truth is this individual FR/RI is very similar to my dog: he/she has hardly any self-restraint.

    2. Haha.

Yes, of course. We know that. When the smilies appear he will be gone – again!

      And that’s his new reality.

  47. I would say that the case should go to the feds right off the bat to avoid any efforts by the DA to protect the cops in this trial.

    1. Hopefully the FBI has a lengthy laundry list on FPD and OCDA concerning THIS Kelly Thomas murder alone.

Then when the DA is done with his half-assed debacle, the Feds could reveal ALL the corruption practiced by both entities and justice will be served.

              1. The attorney had the authority and offer. Approval of his offer can only be done by city council. It never got that far.

          1. Ha and Ron Thomas did not take it as he knows he can get alot more for a child he did not support. Yes, I finally said what a lot of people are thinking

  48. U.S. Attorney’s Office and Civil Rights Division Announce Town Hall Meeting Regarding Portland Police Bureau Investigation

The United States Department of Justice seeks community input concerning the investigation of the Portland Police Bureau’s (PPB) use of force policies and practices. The United States Attorney’s Office for the District of Oregon, in conjunction with the Special Litigation Section of the Civil Rights Division, will conduct a town hall meeting with members of the public on Tuesday, February 28, 2012 from 6:30 to 8:30 p.m. at the St. John’s Community Center located at 8427 N. Central Street in Portland.

On June 8, 2011, the Justice Department opened a civil investigation pursuant to the Violent Crime Control and Law Enforcement Act of 1994, 42 United States Code, Section 14141, in order to determine whether PPB has engaged in a pattern or practice of use of force which amounts to a violation of civil rights. During the first week of August 2011, the Justice Department conducted numerous individual interviews with members of the public in three locations throughout Portland. The Justice Department is returning to Portland as part of the investigation and invites any individual who has specific and recent information they would like to share about their personal interaction with PPB officers to participate in this town hall meeting.

Throughout the course of the investigation, the Justice Department will seek to determine whether there are systemic violations of the Constitution or federal law by officers of the PPB. The Justice Department will consider all relevant information, particularly the efforts that Portland has undertaken to ensure compliance with federal law. The Justice Department has taken similar steps involving a variety of state and local law enforcement agencies, both large and small, in jurisdictions such as New York, Ohio, New Jersey, Pennsylvania, the District of Columbia, Louisiana, and California.

The Department of Justice’s Civil Rights Division, Special Litigation Section and the U.S. Attorney’s Office for the District of Oregon are jointly investigating this matter. If you have any comments or concerns, but are unable to attend the town hall meeting, please feel free to contact us at community.portland@usdoj.gov or 1-877-218-5228. You may also feel free to contact the U.S. Attorney’s local Civil Rights Hotline at either 503-471-5577 or by email at usaor.civilrights@usdoj.gov.

    1. We have a homeless guy beaten to death, multiple women raped and tow truck drivers harassed and prevented from assisting people all by Fullerton PD so my question is, when are we going to get our community meeting with the Department of Justice?

      WHEN?

  49. AntiCorruptionUnit :

    There was no cover up…..

    1. Forgot one small detail. The Fullerton police called the DA and asked them to take over the Thomas incustody injury investigation. Kelly died 5 days later after Ron pulled the plug.

Facts just get in the way of a good story.

      1. Wow, you clowns haven’t been pitching that one for six months!

BTW, the DA did the follow up to see if Fullerton was going to call them in or not. Two days after the beat down.

        Another inconvenient fact.

He had to appease all the people protesting at his front door. He was getting death threats. I think he said, I will deal with this later.

    1. If the criminal suit fails greatly… all the better for the civil suit.
I sure hope the focus is on the criminal case and not the civil.

      1. Criminal will be interesting and exciting. Civil will be nothing. Quiet. Won’t hear much about it. Simple statement and agreement.

        1. Wow RI are you full of it! The civil case is always more interesting as depositions are entered and in these depositions all the lying comes out. Around the middle of the trial the city settles. If Ron has lots of guts and really wants to make a foundation for the homeless he will wait for the verdict which is based on the preponderance of evidence and does not have to be unanimous. A killing that is unjustified will be a huge award. They will have to double the water tax! Funny thing is the composition of the city council may be the ones who kicked out the 3 wise dyspeptic old men. They will have to decide on an award settlement just before the jury comes back. Wow! Reality is stranger than fiction.

    2. a-Non-Miss….Ching ching aint the reason…clang clang…is the reason-clang clag of the jail cell..for those who took his sons last un-assisted breath..and every last one of em that hid, lied, covered up, implied, stole, held him down, washed the blood, made money from, journalists to the boot licker- to old rich evil hill dwellers…so ching ching..all you want- he is noteven close to being done, just that he isnt in public givin you a blow by blow…save it Barry- no donuts left in the lounge?

  51. Fullerton Ruler :
Sorry. Thought blogs were for that. My bad.

Think of blogs like online conversations. When face to face within a goup conversational setting, it isn’t socially polite to respond to every point anyone and everyone makes in a rude, inflammatory and condescending manner. Blogs have many purposes. I don’t agree that a blog exists just to feed your need for attention.

  52. Bullies spend their lives picking people apart, creating fear. Then one day, someone isn’t afraid. And everything is lost.

This is pretty much what has been happening in Fullerton, for the past 20 years in interactions with the City Council and the FPD.
People that stood before the CC were made out to be ignoramuses and ridiculed.
The FPD has harrassed, baited, provoked, and escalated situations for personal and departmental reasons.
All hell will probably break loose after the preliminary hearing and the US Atty General opens office in Fullerton.

      1. You know the old saying- when there is no justice in the courts then there is justice in the streets. Let’s hope that it doesn’t come down to that. The American people have shown great restraint against the endless usurpations of our rights. One has to wonder if the LE brass are insane. I tend to believe that some of them very well could be. However their are vastly more insane members of the general populace that they should be worried about. Like I have always said, it is never too late to do the right thing. Lets hope ALL INVOLVED do just that.

  53. This ACU nut, whoever he or she is, has certainly found an audience. I’m guessing it’s a disgruntled ex-cop, if even that. Their limited, error laden information about the criminal justice system is entertainment for these types of blog. What’s scary for society, is that these regular FFFFers are taking it hook, line & sinker. Thank God they are all just legends in their own minds. Too bad for Kelly Thomas that FFFF has used him as a puppet for their own agenda.

    1. How can a dead man be a puppet.

How about the Three Dead Car Batteries are puppets of the cop union?

  54. I agree with this post greatly. I’ve was upset immeadiatly after Tony’s news conferance that the real perpetrater was getting a slap on the wrist for his action against Kelly. I believe thats why Tony does not want the tape out which would contradict the picture he painted of who he wants us to think is the perpetrator.
The aspect of this I don’t understand is why McKinnley is “violently” opposed to releasing the video. A failure of the criminal suit would increase pressure to do damage in the civil suit which would increase the potential “liablility” against the city. The liability of the city is what the council seems most interested in. Let Whittiker see the Tape! He has a good reason for wanting to see the tape. Some one has to hold the unpredictible DA accountable. Allowing Ron to have that leverage of knowing what Whittiker (a city leader who has earned trust) doesn’t seem balanced.Whittiker could have no possible vested intrest which would sway his opinion for containing the video. If after he views it he says the same as Ron that its in the best intrest to keep it concealled then this general decision made mostly by law inforcement viewers would mean more.
I believe failure of the criminal case could rest hugely on the decision of the release of the tape to the public. It could be that the public will never in fact view the tape at all if the case is dismissed. It was the public view of the tape that eventually got justice in the Rodney King trail.

Well I see you don’t say anything in your post either that proves much or counters much.

I must have finally hit a nerve and the posse is rounding up.

Bring it on!!!!!! I’ve been here for several months and this is all you got?

    Sad to say the least.

Tells us about the criminal justice sytsem please after all this time?

    1. My theory is that it’s one person posting the same garbage under multiple names. I think it’s interesting that this particular post really brought out the trolls.

Well I was kinda of going to try and do the Karma suggestion of “intentional ignoring” but that doesn’t seem like that is going to work at this time.

We will see what the big hitters for FPD have to say.

“BIGSHOTS” turned a City into a “SHITHOLE”, now they cant even show their faces, because of the mean ole Media cameras and Citizenry. I do feel sorry for them, but not much. Hey we are babysitting them something has to keep them from harming others and themselves.

“MY OWN WORST ENEMY” (Slide Bars Band). Its uncanny how things may work out in the end with some help.

  58. Reality Is :
    I still love you ACU.
I’ll still meet you for a beer at the Slidebar before the meeting on the 21st.

LMOA, now we wanna meet ALL of a sudden. PRICELESS!!!!!!!!!!!!!!!

    1. Yeah, police tactics, now you’re talking. And we all know anonymous blogger ACU has been down and dirty many times, just ask him. He can tell you how it’s done, because he’s done it all. Anytime you want to talk about use of force, tactical retreat, laws of arrest, arrest control techniques, verbal judo, you name it. Could be fun with someone like you. I might even let you think you’re winning, as that’s really why you’re here, right? Don’t go Type A on me now, unless you want to talk about W&I 5150. I can do this all day.

      1. LOL on anonymous blogger, did you give your real name, along with your department, rank and resume, and I missed it?

Continue on, your setting a new standard for LE with your awesome comments.

      2. RI – Stalking is a felony in California, so get help for your stalking behavior – and get off the meth coward, before you pee yourself.

      3. “I might even let you think you’re winning,”….

This is NOT a contest. This is (supposed to be) a free exchange of ideas or thoughts concerning the possible motives of the DA. The question is: Is Tony Rackauckas presenting a case designed to fail? This is not a personal attack on ACU. The only thing that you, RI, and FR have done is to try and steer the conversation away from such topics towards irrelevant commentary. And yes, people who comment here regularly see through your tactics.

          1. When you look at the comments said here, take the issues of suttle retaliation for ones position on an issue say during the recall, the circle of the “good ol boys” regime is pretty complete.

Take the Bushala issue and the hit & run story.

Take Chris’s issue with being cited while he collects signatures for the recall.

Those cited for honking their horns during protests.

Take Bob’s towing and all the tickets they recieved, followed by the 600 page report, and one beloved city councilman defending the citation as, issued for “attitude”, it explains a lot in the big picture.

Now you take the approach of various people and how they choose to EXPRESS their views or direct actions all vary among us.

You will see a Type B approach or a Type A. All meet with opposition from the regime and their followers. OKAY!!!

The cops haven’t figured out yet it’s not just about Kelly, which was the straw that broke the camels back, it was a collection of other issues that have been ongoing for sometime.

The cops haven’t figured out yet they keep taking the same approach to just about every situation.

Sellers wasn’t even smart enough to go in front of the press shortly after Kelly’s deal, tell the world of the incident, and say as a routine all the officers involved were being placed on administrative leave until they gathered all the facts.

Not even the slightest hint business was being handled accordingly. When the poop hits the fan, we see what has happened.

Myself I am a hater, disgruntled, Type A, lol. All cops who hate should be gone.

These dumb asses aren’t even smart enough to ask why that might be before they fire away.

I guess the Jewish people are wrong for hating the Nazi’s too??

They have no concept of why someone might blow the whistle on some of this and they don’t care.

It’s HOW DARE you question us and speak badly of us. It’s US vs THEM and it’s SHOWING.

Just knuckle draggers who are in awe with themselves. But YOU have to decide that by what everyone posts.

No real corruption within SPECIFIC organizations ever mentioned, JUST little leadership issues with minor discipline to follow.

As RI said last night, NO Rampart scandal within FPD. OKAY, I am sure he won’t mind if we hear that for ourselves at somepoint.

I’ll rap my arms around the Federal Judges opinion on FPD and the Rincon case before I believe an anonymous blogger. At least that is something to look at.

One should note, ALL who have been attacked by the ones in power or some of their minions, despite various approaches to handling the problem or commenting on it.

Let the battle rage. Hopefully the Type B person will prevail.

              1. I am type A, just as you said. An asshole too, something I have NEVER denied.

I was cheerleading for the type B, figured you divert your attention to that type for awhile.

                Just a thought!!

  59. Funny thing the Slidebar is a partner in the fundraising over at my kids school. They have been bringing home colored papers with the the Slidebar’s name at the bottom. I dont know what an elemenatary school is doing branding a watering hole. I guess anything goes these days. Whenever the D.A.R.E officer from the FPD shows up the kindergartners end up drawing syringes and straws and the so called “art” ends up on display at the school. What some people will do for money is beyond me. Good thing we are about to change alot of things in our town. Yes folks times are a changin’ like it or not.

    1. A bar that serves alcohol is allowed to market to children and the Fullerton School District is allowing it?

        1. “To protect and serve, right? What’s up with all these bad cops today in Fullerton ?! Fine, you get one bad apple. No, make that another one. Fine, now make that a third. No wait, let’s make that one a fourth…… Big lack of professional skills hopefully the FBI will conquer”

  61. We should never again elect or appoint a former police officer into any public function. Look what has happened here in Fullerton. I hope that everyone who reads this blog has learned at least that.

One of the earlier comments dealt with the patience of the public, the general population. We will get justice one way or the other. Deal it out in the court or it will be dealt out in the street.

We have had it “up to here” with this whole thing. We will regain control of our government, we will restore our rights no matter what that takes.

Can’t you see the warnings all through this blog Mr. and Mrs. Government official. We are going to take this battle to each of you if that is what it takes.

  62. Reality Is appears to have been there, done that as a real cop, unlike ACU. This is clearly evidenced by the obvious fact that Reality Is still is one. It’s probably good for us that ACU is no longer, according to his anonymous claim to fame. All of your recent war stories about attempting to file cases with the District Attorney’s office are actually good examples of a real fact of life in the Criminal Justice System. Sometimes things are done in the interest of justice, and that ACU is reality. If you were really a cop, you would know that. However you seem like a know it all mindset, so you probably never really understood how things really are. I feel sorry for you, but you are entertaining, and that’s what the Internet is really all about.

If I was one of your six police officers I would be very worried about my future. If I was one of the three conspiring council members I would be very worried. If you are not worried you are all very stupid. Can’t you see that time is up!

    1. Is this a threat on the officers and council members? Remember they also have people who backing them up.

Interesting analogy based on an earlier comment. It’s obvious you haven’t been reading to long.

It appears you read half a chapter and know the whole story. That would be typical.

    Continue on by all means.

“I think it’s interesting that this particular post really brought out the trolls.”
Interesting and telling. They’re running scared.

Yes the dogpile method is one of the older tricks in the book. It’s never been effected, but let them have their fun.

But the bottomline is, the readers may decide for themselves. Much like the jury will in much of this.

  66. Reality Is :
True. Dogpile is now an approved method of the LAPD.

You mean that the guys dogpiled on Kelly, is that what you meant, or did you mean to say they used the swarm?

I am sure Chief McKinley taught you to dogpile, but suggested you use the term, “swarm” in your official reports.

Creative writing 101, I am sure you attended the class and now teach it.

Feel free to change your answer at anytime.

  67. Jane H :
“I think it’s interesting that this particular post really brought out the trolls.”

I personally would really like to know what you are saying or trying to accomplish by making such a statement.
I have seen the word “troll” used for quite some time now on this blog.
You really know how to alienate people from a call in the time for unity.
Good luck, Halloween is nearly 9 months from now.

    1. I meant no harm; I’m just stating my own perceptions. TO ME It is very telling when a post about Kelly Thomas and the FPD bring out the people who post trying to undermine and sidetrack the original subject. It is just a diversionary tactic.

      That is all.

“Good luck, Halloween is nearly 9 months from now.”

I’m not sure what you meant by that, but whatever.

      1. It’s Carolyn Phillips again. She literally doesn’t understand what the term “troll” means. She thinks it’s a story book ogre reference. Merijoe spelled out the definition of internet troll below. Hopefully she’ll realize that we’re not actually calling a “person” a disfigured imaginary creature.

        1. “Hopefully she’ll realize that we’re not actually calling a “person” a disfigured imaginary creature.”

That is hard to say. I believe she was calling me a troll too. Not to worry.

  68. Reality Is :
You used dogpile. I repeated the word.
No. Swarm dogpile doesn’t include batons tasers and flashlights.

Let’s include “tag team” like we see going on now. You know what I meant by dogpile, don’t be funny then backpedal.

If this is the best YOU all have, oh my.

Do you really think the thousands of people reading this are going to flock in support of FPD?

Based on your past comments and now your pals?

Well how about when you got several people’s body weight on top of a man and your using impact weapons, tasers on a guy, and no one is cuffing him up before his face looks like a busted melon?

Where is the muscle of 3 to 5 guys on a little dude? Pathetic shit across the board, and not an injury among you. MAYBE some scuffed up shoes.

If the number is lower on the swarm, what are the others doing standing around picking their nose?

You guys screwed up big time with that many coppers around this guy, and now your pissed because your getting hammered.

You come in here spewing your support, but have no fortitude to take it outside this blog and onto the streets.

Let’s face it, you have NO BALLS to go public with what you would like us to believe here.

That simple, and your truely perplexed about it all.

If Kelly would have punched and kicked Ramos from minute 1, the story would surely be different and not the hoopla.

    We both know that!

  69. AntiCorruptionUnit :
    From the California Penal Code.
This might be considered a LESSER included offense to Penal Code section 32.
The first 3 lines are for the ones I just mentioned.
If the DA was concerned about JUSTICE for all, who would have used one of these two section to TAKE out all the trash.
    31. All persons concerned in the commission of a crime, whether it
be felony or misdemeanor, and whether they directly commit the act
constituting the offense, or aid and abet in its commission, or, not
being present, have advised and encouraged its commission, and all
persons counseling, advising, or encouraging children under the age
of fourteen years, or persons who are mentally incapacitated, to
commit any crime, or who, by fraud, contrivance, or force, occasion
the drunkenness of another for the purpose of causing him to commit
any crime, or who, by threats, menaces, command, or coercion, compel
another to commit any crime, are principals in any crime so
    committed.

I’ve seen bullshit but, but now its taking on the form of pure arrogance.

does anyone have anything to say about this common thread?:http://www.ocregister.com/news/loggins-340272-deputy-dominguez.html

Dude, I am not butt hurt, ACTIONS speak louder than words, and we aren’t seeing ANY action from FPD employees except financial contributions to the anti-recall effort, backed by some more money from PORAC in Sacramento. WOW ok.

You have already called BS on the justice system early on in your suttle comments. Go look back at your August 11,2011 comments. You post so much crap in here YOU can’t remember yourself.

Some anonymous commentary in support of FPD. I bet my check it’s a couple using more than a few names.

If there is no case against Ramos and Cincinelli, the charges are way over the limit, and YOU ALL know it, then get after DA RACKS ASS NOW!!!

You aren’t because you CAN’T. How about Chief Hughes who has already admitted to “leadership” problems within. THAT’s it for the Chief. WOW.

Where the hell is your Union Prez at? Has he no cajones? He can speak for the membership JUST like ALADS people do when they have a case of the ass at BACA.

I submit you have no real Union, because they are controlled by managment at the end of the day.

Everyone within FPD must be telling the FBI and Gennacco to pound sand in their ass when they come around for interviews right? I mean your as brave with them as your are me, CORRECT???

I noticed you haven’t mentioned how the FBI and Gennacco will give a CLEAN bill of health to FPD when all is said and done. Or did I MISS all that before I came here?

As to the number of readers on this blog, feel free to give us an estimation of the numbers you think actually read all this?

If it’s just a few and you really believed that YOU wouldn’t be here.

And I read for quite sometime how YOU were attempting to EDUCATE the readers who you might think are just a few versus thousands RIGHT?

No YOUR butt hurt pal, because if this blog was a joke and you knew it, YOU wouldn’t be here.

As far as your credibility goes, I notice you didn’t call BS when I commented on HOW no one teaches at Golden West that is from FPD according to the two ladies I spoke too.

You keep trying though, maybe your pals will buy you a beer.

  73. “What do you think the marines are talking about right now”.

I hope it’s not about going to war with OCSD.

I am sure the USMC brass are handling this issue like they should.

    1. It does not look good. That is going to sink in deep in the minds of alot of people.

Killing a father in front of his kids and with his wife expecting.

Cops killing family men like its normal? Just another day on the job? business as usual? I can understand if it was for something violent, but for taking his kids to school, speeding and not responding to commands fast enough?

I see total lack of value for human life in part of the cop and the union.

Its happening again out of San Clemente like clockwork, just like the Kelly case. Its so bizare that it reminds me of those goose stepping morons from central Europe.

How does a guy get shot dead in front of his children for apearing or seeming threatening?

      candy coating,
      playing it down,
      pretending its policy?
      http://en.wikipedia.org/wiki/Rationalization_(sociology)

kelly and loggins death were a perminant solution to a temporary problem.

Some poor judgement on the part of these “15 year police vetrans”, makes me wonder if they really work.

  74. Fullerton PD needs to be disband and contracted out to OCSD. Haha
Those deputies would shit if they had to patrol any place other than whitieville south county. People of color scare them. Just think what they would do to a coked up king tony b riding his bike home after scoring some dope in the hood?

  75. Great posts to read by everyone. ACU and that reality is. Great exchanges. I got emails on all of them but now all of Reality’s posts are gone. I couldn’t respond. Where did they go? I see them quote in a few posts. What am I doing wrong? A setting?

    1. “…and that reality is” who the hell talks like that? RI himself
and again, all concerned about RI’s disappearing quotes and how they are seen in others posts

Gadz-Shit, will a restraining order against this psycho help?

  76. The trolls are like the tangled pieces of a plane crash, Sad, and probably due to human error, the bird just wasnt really meant to fly. The damage hasnt been enormous so far, but very intentional.

A lot of times the biggest lessons come from others in the exact same profession.

China Corruption Museum – This is Really Going to End BadlyA planned anti-graft museum in southwest China is asking the public to nominate the 100 most corrupt officials of the past century, state media reported Saturday.

  77. You’ve already boondoggled these FFFFers into thinking you’re some good cop whistle blower. And if your anonymous bio about having been LE in the Inland Empire is true, that explains your crazy conspiracy ideas. This is the OC! Most of the LE down San Bernardino way that know anything are usually laterals from elsewhere. Keep on bragging about yourself ACU, I just might stick around and watch. Be honest and admit you would never leave your keyboard and show up at a council mtg or the Slidebar. It’s all just part of the blog game, not reality. Keep having fun, while some of these locals carry on with their lives here in the OC. Don’t ya just love the Internet. By the way ACU, if I’m from the OC and you’re not, I think you are the troll, que no?

    1. I hope you do stick around, your comments are indeed entertaining. Now we can hear how the OC cops are really the best of the best, can’t wait.

Yes more than a few laterals from OC and LA county’s over the years. Unfortunately some of them got a first hand look at corruption from the IE crowd.

Sad actually, those guys I worked with were a hoot and most were hard workers.

You are up to about 6 postings now, all pretty much say the samething. Your starting to sound more like a boot who just got off his FTO program, but keep after it whoever you are.

      Carry on RIMH!!

    2. Troll definition for any of you GED dumbasses who buck their teeth out like a horse while they type, is someone who posts inflammatory, extraneous, or off-topic messages in an online community- not someone who lives outside the OC-fool, and that describes your insane ramblings.

Yes, monkey brain moron, only you are to be believed, not ACU, cause he aint from OC…derrrrr

You are giving yourself away with your arrogant condescending posts and zooming in on ACU probably just another moniker for RI.

Meet him face to face for a debate like he requests, you coward. And stop the stalking behavior.

      1. Thanks Merijoe for that explanation. I was going to try and answer that one but I thought twice about it because I remember another commenter who was upset about the word troll. Yeah, my new theory is that plain ornery is Nancy Wood i.e. Carolyn Phillips. I’ve noticed other similarities in earlier comments. Hopefully your explanation will be enough to satisfy her and move on. By the way, what do you think about the amount of “trollage” on this blog post? I felt like I needed some sort of mechanism to measure the amount of paranormal troll activity yesterday. Do you have any thoughts as to why there was / is so much?

        1. CT-I think all the increase in troll-ocity you see are different monikers from one person, RI. who constantly gets “das boot” everytime that arrogant dickwad posts under RI and, like most stalkers is looking for reaction-so he uses different camouflage in hopes that will fool us into giving that sick knuckdragging punkass what he wants.

      1. Yes a place off duty cops with half a brain would hang out. It’s part of the culture of discount booze or free booze, a opportunity to pick up some girls.

One has to hope that things don’t go bad, you have to kill someone, and your blood alcohol isn’t over the legal limit in addition to explaining why you would hang out in a place you have to conduct business in.

Of course if police management doesn’t care, then I guess one has no worries.

Myself, a nice quiet watering hole is a little smarter thinking.

  78. what happened? From this press release, OC DA Rackauckas and CEO Orange County Human Relations Commission Rusty Kennedy seem to sincerely create an honest relationship between OC communities and their respective law enforcement with this social outreach program.
Oh, I forgot that talk is cheap and paying off law enforcement’s crimes with settlements is free for cities because all they have to do is raise a bogus tax and use our money to buy off police officers’ crimes against the community.
    Orange County District Attorney
    Press Release

    ——————————————————————————–
    Tony Rackauckas, District Attorney
    401 Civic Center Drive West
    Santa Ana, CA 92701

    For Immediate Release
November 5th, 2003 Contact: Todd Hart
    (714) 347-8413

Santa Ana – November 5, 2003 – The Orange County District Attorney’s Hispanic Advisory Commission will host a Police Community Relations Forum.

The Forum provides a unique opportunity for community members to discuss their public safety concerns with community leaders including Bishop Jaime Soto, Santa Ana Police Chief Paul Walters, Garden Grove Police Chief Joe Polisar, Amin David of Los Amigos of Orange County, Rusty Kennedy of the Orange County Human Relations Commission and community activist Victoria Zaragoza. Special guests include State Senator Joe Dunn and Assemblyman Lou Correa. Santa Ana attorney Jess Araujo will serve as moderator.

Panelists will each give a short presentation about the importance of constructive community relations between law enforcement and members of the public. Police agencies will bring staff members to hand out surveys, take questions and set up follow-up appointments for the audience.

The Police Community Relations Forum represents one of the many efforts by the District Attorney’s Office to improve communication between residents, criminal justice professionals, and government leaders. Under the leadership of District Attorney Tony Rackauckas, a Community Education Services program was established to help Orange County residents better understand the criminal justice system. The program formed advisory commissions with leaders of the Hispanic and Vietnamese communities to address any concerns people may have about the legal system.

The Police Community Relations Forum will take place on Wednesday, November 5 from 5:30 p.m. – 7:30 p.m. at Santa Ana College in Phillips Hall. Members of the public are invited to attend.

    1. Rusty Kennedy and the word honest should never be used in the same sentence. The same would apply to Sharon…both Sharons as a matter of fact,

Social outreach my ass, it is just another corrupt Fullerton greasy PR commission.

      1. its worse than that; it is a county-wide social outreach that only reaches into our wallets with Rusty Kennedy’s continued demand for our tax dollars to subsidize his do-nothing Orange County Human Relations Commission. In typical fashion for the political animal , Rackauckas, press releases like the one above are facades to sway voters to vote them into office of DA over and over again. Meanwhile, the good people of Fullerton , at least since Pat McKinley proudly served Rusty Kennedy and fullerton as police chief, has suffered beatings, molestations, false arrest, perjury from law enforcement and now murder.
Hey, way to go , shout out for Kennedy and Rackauckas for giving our communities the chance to participate their Police Community Relations forum.

            1. except when the media supports it accusations with strong evidence and it shows a pattern of same behavior within a political entity with further evidence

  79. Fullerton Ruler :
That deputy won’t be charged. Just like the Monterey Park cops won’t be charged. Deputy was in fear of danger to the kids. MP were in fear of a crazed drugged out wild man.

So FR tell us based on your experience from all the things going on around us, when you believe the citizens can claim the same fear towards the police as the police do from citizens?

I am sure many will say it really isn’t as bad as some would say as to police misconduct towards the public.

Can we use ALL the corruption we see, starting at the White House and working down to the little towns across the country, or is that just nonsense?

I saw the Monterey Park shooting. Looks on it’s face to be justified within the law. Civil suit would be interesting to follow.

The OCSD shooting is another issue at this time.

    1. Yes they can. If they explain their fear legally, they won’t be charged. If they fail, they will be charged and it will be up to a jury. Haven’t heard of moe than a few cases countrywide where that claim has been made. I wouldn’t recommend it.

      1. Haha.

The new reality is that folks are tired of cops blasting people with impunity. The cops in SC panicked and started shooting.

  80. Marv :
Fullerton PD needs to be disband and contracted out to OCSD. Haha
Those deputies would shit if they had to patrol any place other than whitieville south county. People of color scare them. Just think what they would do to a coked up king tony b riding his bike home after scoring some dope in the hood?

Well you sound like a cop. And that USMC Sergeant who was just shot is a man of COLOR.

I hope your not suggesting that the deputy shot the guy because he was black?

You just told all of us OCSD can’t handle working with people of color.

Did you think about your post before you submitted it?

Another ego that isn’t thinking. THANK YOU!!!

  81. This is a little off topic, but I have read a few articles about the Marine shooting that were linked to earlier posts. I found another article that is written from a very “pro-marine” point of view as opposed to the “pro-sheriff” point of view. I found this perspective really interesting. Here is the link for anyone who is interested in reading it.

  82. In response to this blog piece, yes, I’m with you Joe,
it took me a few days to absorb all DA quotes and charges but one thing that concerned me almost immediately aside from not charging the others with anything, was that if this goes to trial (and it should) that it only takes 1 coplicking fascist (gee, wonder if there are any in OC) on the jury to vote not guilty for mistrial to occur-and the same thing would happen in a retrial,
and the DA knows this well.
Yes, I do believe this was all a dog and pony show by the DA, designed to “calm” everyone.
My opinion, more protesting outside of DA office prior to the trial to show that no one is “calm”

  83. Concerned Texan :

I find this interesting in itself.

“Amormino (police spokesman who debriefed the officers) said he did not know why the deputy felt threatened, or how many shots were fired, or whether Loggins was armed.”

A debriefing means as I understand it is to talk about the “what happened”.

So Amormino doesn’t know anything after talking with those involved or investigators? Why waste the ink and your breath then?

Gee does that sound like McKinley on CNN??? Well I was told, but I “don’t know”.

Again neither McKinley or Amormino lack experience in their prospective fields, they can surely do better than this.

    Otherwise just “shut up”.

    1. ACU. You proved the main point. The union President tried his best to explain things yesterday due to all the media versions of what the media wants to say. He failed because he can’t use facts of the case, just generalities. PIO Jim is the same thing. As you know, the cop isn’t talking to anyone outside of public safety specifics. So Jim is going on info bosses are getting second hand, and a general, non specific summary. This day was a perfect example of why people just need to provide the general summary in a press release and leave it at that.

    2. ACU, I was really surprised at the assertion that there has been long standing tensions between the Marines and the OCSD. I suppose this relates a little to Fullerton in the respect that a proposal to disband the FPD and replace it with the OCSD has been blogged about from time to time. Is the author’s position about the longstanding corruption via drugs and prostitution among OC LEO’s a valid one? Does Raukacus work with those offcers as well as FPD? What are your thoughts?

    3. Police claim he disobeyed their orders.

Police have told two stories, one that they had chased the SUV and it “broke through a locked fence,” one that has been open every other day as required. That version has Loggins outside his SUV and refusing police orders.

The second version police have given says that a patrol car pulled behind the high priced Yukon SUV containing Loggins and his two daughters. It all gets very sketchy from then on, police “orders” not heard, not obeyed and, more appropriately, no evidence of “probable cause” for police to have approached the hero Marine with a long record of public service, a continual community volunteer and excellent citizen.

Loggins bullet riddled body was checked, no drugs or alcohol. All that was found were two terrified children and a blood soaked bible. There were no weapons on Loggins, none seen, none in the car.

No one searched police for drugs, no one tested them for drugs or alcohol, nobody got to interview their families, their names weren’t even released.

  84. Fullerton Ruler :
Yes they can. If they explain their fear legally, they won’t be charged. If they fail, they will be charged and it will be up to a jury. Haven’t heard of moe than a few cases countrywide where that claim has been made. I wouldn’t recommend it.

I would agree with that. Difficult for the layman to explain without the guidance of competant council.

But some of us know how to explain and articulate all that.

If some things don’t change, I can see more of that happening win or lose.

    Thanks!!!

  85. Comment #242 by Reality Is my hero:You’ve already boondoggled these FFFFers into thinking you’re some good cop whistle blower. Most of the LE down San Bernardino way that know anything are usually laterals from elsewhere. Keep on bragging about yourself ACU, I just might stick around and watch. By the way ACU, if I’m from the OC and you’re not, I think you are the troll, que no?

Well how long have you been posting on this blog, Reality Is? First of all, you seem to be full of yourself simply because you’re from the O. C. I am also from the O.C , however that’s NOTHING to brag about. For a non-LEO like myself, ACU’s commentary is greatly appreciated by most, which seems to upset you. Since ACU is somewhere in San Berdoo it certainly wouldn’t be a “hop, skip and jump” to the city hall or your Sleazebar hangout. Do you honestly think you and the two other SMALL-MINDED trolls that make an occasional appearance on this blog will convince us all that ACU is ‘full of it’? Think again. Your attempts to dissuade our thoughts about LE corruption and ACU’s credibility FAILED! But keep em coming; it’s amusing.

        1. serious thank yous to the leak!

ooooh this information is rich with pay dirt., I hope everyone catches this juicy tidbit. some serious connections to Fullerton, relatives are Fullerton writers and supporters of Chief Sellers. keep digging people.

          Got a gambling issue RI?

  86. Seattle cop on tape: ‘yeah, i’m going to make stuff up’

Two friends who had planned to visit a Seattle sports bar claim they ended up being kicked, arrested at gunpoint and held in jail for several hours by a cop who said he intended to “make stuff up.”

Part of the arrest of Josh Lawson, 23, and Christopher Franklin, 22, on Nov. 16, 2010 is caught on tape by the officer’s dashboard camera.

But key moments of the arrest that should have been captured on video are missing and it was unclear whether the officer intentionally neglected to turn on the dash cam. None of the released footage shows the officer in the moments he made the stop or kicked Lawson.

The accusations against Richardson are among many that have put a spotlight on the Seattle Police Department and it comes after the release of a Department of Justice report in December that said “serious concerns about practices that could have a disparate impact on minority communities” were raised by its review.

The recording of the arrest was released after ABC News affiliate KOMO began an investigation into missing police dashboard camera videos.

The recording of the arrest of Lawson and Franklin — who were picked up for allegedly assaulting and robbing a man a short time earlier — shows the suspects being helped from the ground and into the patrol car of Officer Brad Richardson.

The officer’s uniform microphone also records Richardson telling the suspects, “Yeah, I’m going to make stuff up.”

  87. If the OCDA flubbs / loses this case, federal authorities will commence pressing civil rights charges against these animals as well as felony assault and murder. The Feds play to win. These animals from FPD deserve to live the rest of their days in a cage for this injustice.

  88. Fullerton Ruler :
Yes. Cops do kill people. Many people everyday. Bad people in this world.

And you should of added a few good people too.

Then added even some of the bad people’s family collect big bucks from counties and cities, because the shooting was preventable or other methods of defense could have been used.

I think if we could add up that cost across the us, the numbers would be staggering.

  89. Fullerton Ruler :
Yes. As you know some good shootings and force also pay out substantial amounts too.

Yep they sure do. And of course the taxpayers are flipping the bill for many reasons.

So I submit that cops and politicians should not be pissed off when the PUBLIC come knockin on your door WANTING answers.

Play stupid and the public will upset your apple cart, because THEY CAN.

  90. Here is more on the OCSD shooting from the UNION itself.

Here I was talking about unions last night, and BINGO these boys decide to step up to speak for one of their own.

I doubt they sought the permission of Sheriff’s Hutchins, since they DON’T have too.

Says alot for OCSD Union versus FPD when you look at what has been said here.

Any chance OCSD reads this blog? NO WAY!!!

    It is what it is.

    http://latimesblogs.latimes.com/lanow/2012/02/union-blames-marine-killed-by-deputy-for-fatal-shooting.html

      1. Of course it made it worse. Because instead of providing information they went into immediate protect the cop mode.

    1. Kinda like LA School Union speaking. Made it worse and made people mumble oh BS the union backing the teachers no matter what.

  91. Fullerton Ruler :
Did them speaking answer anything? I think it made it worse.

I don’t know if it made is worse. I am not down that way to see the mood of the locals or the Marines.

But if you think the PIO after speaking to those involved and still said nothing is better, OKAY!!!!!

FPD didn’t say anything either, IT DAMN sure didn’t help them.

  92. Reality Is :
Criminal will be interesting and exciting. Civil will be nothing. Quiet. Won’t hear much about it. Simple statement and agreement.

You hope it will be quiet.

  93. Obama should be using his attorney general and US Attorney for this district to oversee DA Tony. DA Tony is an Orange County Conservative Republican. Obama is not. Since Republican presidential nominee will march to Orange County to raise funds, what would be better than to embarrass the entire GOP organization in OC than have a second more searing investigation that charges the uncharged and finds the OC DA lacks competency.
Its sort of like getting back at the GOP for the Acorn abuse or that Reverend who spewed forth venom in Obama’s former church.
If I were a democrat, I would be sooo happy with this entire situation. DA Tony is a lacky of the police unions. Just check on his contributions, a few rich OC ultra right wingers and the police unions. What a combination!
