A Tale of Five Killings

See those guys over there? They didn't do it!

I wonder if I’m the only person who sees the irony in the way law enforcement has pursued the recent killings of homeless men in north Orange County, versus how they dealt with the murder of Kelly Thomas – another helpless, homeless man.

An army of cops was mobilized to locate the murderer of four homeless men in and around “The Canyon” area of Anaheim. Without getting into the details of the capture of the suspect, I note that the police and DA Tony Rackauckas were only too willing to immediately discuss and share evidence about the recently nabbed suspect. Charges were brought, post haste. Forensic evidence studied? Naw. Lab tests performed? Of course not. Has the Coroner weighed in? Hell, that could take months! Why wait?

Now consider the murder of Kelly Thomas, a killing captured on government-controlled video, a killing witnessed by dozens of people who will testify that Thomas offered no resistance and that he was physically intimidated by Ramos and piled on by three other cops. We waited for 10 long weeks while the the Coroner did some sort of forensic work or other, even though it was known from blood samples taken at UCI that Kelly was not intoxicated.

The DA made a big deal about all the witnesses his investigators interviewed; but, what the DA was really doing is now pretty clear to me. It looks to me like he was working the system as hard as possible to avoid making a case against the killers. Defending the cops and propping up the rickety justice system in this county must have been the mission. Wolfe? Exonerated. Blatney? Exonerated. Hampton? Exonerated. Craig? Exonerated. Rewritten reports? Who cares? Superiors covering up? Not his problem. True, Ramos and Cicinelli were eventually popped, but only after a public outcry never seen before in OC. And Cicinelly who allegedly knee-dropped and repeatedly face-smashed Thomas was given a laughable $25,000 bail. You get more for shoplifting.

Then, of course, there’s the wretched abuse of justice perpetrated against Veth Mam, and no doubt others like him rung up on false charges because it fits into some crooked or lazy cop’s path of least resistance.

Any doubts about who the DA is working for? I have some.

  1. Amazing how they practically declared martial law complete with checkpoints. The whole key to this thing is like you stated “government controlled” Guess what? We aren’t!

      Prosecutors said he appeared to drive through the police checkpoints deliberately, the last time just hours before his arrest.

    1. Fred murder is murder. HOWEVER THERE IS NOTHING MORE ABHORRENT THAN WHEN THE GOVERNMENT SUMMARILY EXECUTES IT’S OWN CITIZENS. Such was the case with Kelly. The post is right on the money. The irony in BOTH events is that is was the PUBLIC’S involvement that forced the outcomes. For the recent murders members of the PUBLIC caught and chased down the killer. For Kelly the members of the PUBLIC forced charges and arrests. One thing is certain-the people still have alot more power than the establishment wants us to beleive.

    1. I agree. This is a great post Joe. Instantly felt the same way when the DA had a press conference earlier. The contrasts are telling. All that justification for ultra secrecy in the Kelly Thomas case appears now as nothing more than a ruse.

  4. I am convinced if people did not have a huge outcry over the Kelly Thomas murder, that the DA would have found nothing wrong at all. Either no charges or misdemeanor charges. The big uproar resulted in DA Rack finally making charges. And frankly, Wolfe is the luckiest guy in Fullerton PD, he should have been charged and may be in a federal lawsuit. By making the two charges, the DA is hoping to prevent a Federal lawsuit which would make him look bad in the year just before his re=election. Go figure!

Also, let’s not forget the medical findings that were disclosed to the public by Ron Thomas and Garo Mardirossian. Those are irrefutable facts!

  5. I heard the killer of the four homeless men is charged with “special circumstances” (i.e. to allow consideration of the death penalty), for crimes which on their face suggest that the perpetrator is totally insane.

    Whereas, the six Fullerton policmen who murdered Kelly Thomas were in the middle of their ordinary (outlandishly overpaid) work a day job duties and yet they attacked and murdered a man who was “well known” to them, for all of his limitations, but also certainly for his long time predictable NON-threatening demeanor.

    If ANYTHING involves “special circumstances” of evil-mean intent and prejudice and hatred, it is the murder committed by the Fullerton Policemen, rather than the homicidal insanity of a former (drummed out of the service) soldier, who visciously-crazily-multiple stabbed several homeless men in their sleep.

    DA Tony Rackauckas’ JOB is to correctly figure out the criminal charges which fit the crime committed. It seems that Rackauckas is not only corrupt in his dishonest biased favoritism, but it seems that he is incompetent-stupid and the type of CREEP who would use false tactics for obvious self-aggrandizement and I suppose future campaign purposes – throwing around his “tough on crime” death penalty charges among brain dead (or stupidly uninformed – like me) voters.

      1) the conscious intent to cause death or great bodily harm to another person before a person commits the crime. Such malice is a required element to prove first degree murder. 2) a general evil and depraved state of mind in which the person is unconcerned for the lives of others. Thus, if a person uses a gun to hold up a bank and an innocent bystander is killed in a shoot-out with police, there is malice aforethought.

  10. The similarity in the Ocampo case and in the Kelly case is the level of public involvement in enforcing the law.

    The Kelly case happened where I lived from 1960 to 1977 and where I did business from 1980 to 2011. The Ocampo case happened from where my wife’s family lived from 1966 to present and where I lived from 1977 to 2004.

    Very different cases. Clear loyalties for T-Rack in the Ocampo case, confused loyalties for T-Rack in the Kelly case.

  11. How about a big thank you to the Guardian Angels for showing up to help? Also with resources from 3 different police agencies, Anaheim, Brea, and Placentia, why didn’t they take Mr. Berry seriously and keep him under surveilance or refer that information to the Guardian Angels?

    1. The Guardian angels after anouncing that they would be patrolling didn’t seem to be around according to many near the area of the slaying. They where emailed immeadiatly after thier announcement to coordinate and help around the transportation center but where never heard from.

  15. This is a national problem of the highest order of importance. The so-called new government powers were granted by the Congress using fear of the terrorists. All these municipal, state, and Federal police departments depend upon the fear of the public of the police department. Even worse, the district attorneys operate as gate keepers to the Justice department. We need to eliminate the gatekeeper. If we can have these decisions made by a sitting grand jury instead of the district attorney, we have a jury of our peers deciding who would be arrested and who would not be pursued based on the law and preponderance of evidence. A sitting grand jury would reflect the sentiment of the community that it serves. As things stand we are no closer to a responsive police department now as we were before. We need a leader, a real leader to get things moving in the direction of freedom and equal justice for all. Although it seems that the municipal government is…ahem…unresponsive, the real problem is that we can’t even get these bad police officers before a jury. Let’s get the system changed in such a manner that decisions to prosecute are not dependent on a district attorney but instead upon our fellow citizens, friends, and neighbors.

  17. Mr. Bushala, you are a moron. The DA already filed charges against the Fullerton Officers; so stop trying to revive all your dramatics by constantly bringing it up…over….and over….and over. The sad part is, even after these Officers are charged, the only thing you can result to is allegations, conspiracy theories, and political agendas. Give it a rest already and let the justice system run it’s course. My guess is a JURY won’t even convict these Officers once all evidence does come to light.     And for someone who claims to know SO much about the justice system, then you should know that the reason why any videos and other evidence hasn’t been presented to the public yet is because it is…….EVIDENCE. You cannot make it public until the case had run its course, otherwise you taint any possible trial, and lose any possible convictions.

Why can’t be just cut to the chase and put a petition out there to remove the district attorney as the gatekeeper to justice and replace him with a citizen’s committee to decide whether or not a person is prosecuted or not. All of those delays and coverups and other wrongful things would not have happened. There would have been no need to remove municipal officials, etc Can’t we get a plan going to correct this thing instead of all this wheel spinning? If we had this system already we would have six police officers up on charges and a jury deciding whether these six are guilty or not. You can replace anybody you want but until changes are made this problem will go on and on.

    1. Cristobal, a “citizens’ committee” would be an anonymous mob, whereas DA Tony Rackauckas is “easily” known and his record can be exposed and criticized and, through elections, he can be replaced.

    2. T-Rack is in elected office until 2014. He has stated that when his term expires, he will run again and hope to be our District Attorney all the way until 2018.

      That means that the only way that the voters of Orange County could rid themselves of T-Rack before that time, is to petition to have him recalled from elected office by gathering signatures of at least 10% of registered voters who voted in the last election for Orange County District Attorney.
      According to the procedure to recall an elected official, the only requirement for voters to recall someone from elected office is because voters are dissatisfied with the job that they are doing. No more. No less.
      People like Molly McClanahan and Larry Bennett who have gone on record as saying that the only reason that an elected official can be recalled from elected office is malfeasance or some other level of criminal conduct, is nothing but an out and out lie that can be easily proven by anyone tha bothers to read this link to the California Secretary of State’s Office…

    It must be a terrible thing to be scared of your boss and the public, and have to hide your cheerleading efforts.

    I do believe the FBI is in a holding pattern for now, let’s not assume they won’t be doing anything until THEY SAY it’s over.

    If the FBI is satisfied the DA is moving ahead they will wait. There is no statue of limitations on murder. I am not sure what the statue of limitations is on Civil Rights violations?

    I will bet money that one or more of the 4 cops not charged with Kelly’s death, WILL be a witness for the prosecution. The DA might have made them a witness instead of a defendant just for that reason.

    Not prosecuting the lessor of the evil happens all the time. You let the little guys walk in order to fry the bigger fish. Most of you should see that in the drug wars. It is what it is folks. SORRY!!!

    You should also know that the internal administrative investigation is a different animal than from a criminal investigation.

    Legally speaking the DA doesn’t tell the Chief what he expects the outcome to be in the administrative investigation, and the Chief doesn’t tell the DA what he wants to see in the criminal investigation. Politics being another issue in itself.

    What is glaring and clearly unexplained is how 2 cops are charged with serious felonies, but the other 4 cops are exonerated in the administrative investigation???? SOMETHING is not right about all that.

    Actually it’s much easier to punish bad conduct through the administrative process than the criminal one.

    To watch a clear and excessive use of force and do NOTHING to stop it, and be exonerated is simple BS at it’s finest.

    Just about every agency has policies on the books to cover these types of problems, and the policies are pretty tuff and have more than a few CATCH ALL phrases contained in them.

    But’s it’s possible FPD doesn’t based on Rincon’s case.

    HERE is the catcher.

    It is VERY possible officers 4, 5 & 6 did roll up AFTER the serious beating took place and DID not see conduct take place that rose to the level of criminal responsibility.

    Sorry folks it does happen.

    IF, I say IF they all sat down at the station and watched the video from the pole camera that the DA speaks about, it was at that TIME, EACH and everyone of them were now in fact aware that a CRIME had taken place.

    Officers 4,5,6, have now seen what they say they didn’t realize took place. THEY cannot claim ignorance.

    The next question is did officers, 4,5,6 complete ANY PORTION of a crime report as to their actions in this case?

    If in their reports they claim they saw nothing illegal take place, but watched the video at the station, then they completed a false report and that is a crime under California law.

    Watching that video IF THEY did, changed the dynamics of this situation dramatically.

    If these cops told their boss THEY didn’t see Kelly getting his ass kicked, then whoever was in charge, should have watched the video first by himself to see if those cops were lying or telling the truth.

    If those cops were telling the truth, then there was NO NEED to have them watch the video as it simply compounds the problem across the board.

    This alone might very well be why the DA has decided NOT to prosecute the others involved.

    It’s obvious the DA doesn’t want to take out ALL the trash on this case.

    When you bring in a group of cops and have them watch a video before their paperwork is complete on an incident, wanting everyone to be on the SAME PAGE is a cover up in the making.

    Any good cop knows witnesses view things differently, cops are witnesses just like citizens.

    I leave you with this. Did the DA’s office in interviewing the 150 plus wittnesses he claims to have allow them to WATCH the video before interviewing them officially?

    I doubt it!!!

  25. If anything EVEN close to this happened, and the DA knows it, and is doing nothing about it because of POLITICS, he too needs to have his head on a stick.

    I am sorry to say this would be selective prosecution at it’s finest.

    I might have missed it, but I don’t remember the DA telling the public there was NO COVER UP and FPD did a fine job as part of the investigative team.

    Would it be acceptable to prosecute Ramos and Cincinelli only when there are others equally evil in this case?

    What happened behind the scenes is as important as what happened to Kelly.

    If the DA is giving anyone a PASS for attempting to cover this mess up in anyway, the DA has NO credibility in anything he says. KICK his ass to the curb NOW!!!

    But if the DA plays to ruff, the POLICE unions in the county might band together to oust him if he attempts to run for office again.

    I’ll say the police unions and many of those who support them.

    The DA might not want to bite the hands that feed him TOO HARD!!!!!

    If the defense attorneys know any of this and want to ROCK the boat, it might be enough to create reasonable doubt and obtain a NOT GUILTY for their clients. That is their job.

    Is it possible a SHITTY investigation was put together with a bigger scheme in mind? VERY POSSIBLE, I’ve seen it more than once.

    I am sure a few bloggers here will be in the courtroom when this thing goes to trial. Some of you are very smart.

    YOU will be able to see in a short amount of time if the Deputy DA prosecuting this case has resolve and conviction in the way he/she is handling their business.

    Could be the DA is protecting certain others from exposure.

    If the DDA handling the case doesn’t say anything, then hopefully either will the defense attorney’s.

    Will the DDA and defense attorney’s talk off the record? YOU bet. And neither side will revial what was talked about.

    I don’t know John Barnett that well, I can’t say anything bad about him.

    Michael Swartz and his law firm is another story all together.

  30. If the DA is not charging the other 4 because he doesn’t want to expose the intial stages of the cover up, that is malfeasance in itself.

    You can’t have your cake and eat it too.

    Put other questionable prosecutions together, frying ALL the fish in one pot, you might have your case.

    Did Chief Sellers or ANYONE if FPD “obstruct” another public official,ie the District Attorney of Orange County by having the officers in the Kelly Thomas murder complete police reports or give statements contrary to what the video evidence depicts?

    If the answer is YES, then they too should have been prosecuted for a violation of PC 148(a) and all other applicable laws.

    Maybe the feds will do that portion of this scandal. It’s possible.

    If they were not, then the DA is guilty of malfeasance. Just that simple.

    Throwing the street cops under the bus in order to protect higher ranking officials is as bad as it get’s in the political corruption game.

    Seller’s immediate retirement and Hamilton’s short tenure simply throw up serious red flags in making such an argument.

    If the rank and file of FPD know that, and are allowing that to happen, they have no clue of what a “brotherhood” is all about.

    A deal could have been forged with the other 4 just to keep them quiet.

    Reminds me of the apparent EMT on this FFFF Blog, throughly pissed about what happened and how they DELAYED him from leaving with Kelly Thomas, for a Supervisor due to a Tazer use report.     I noted in the DA’s press conferance he really didn’t want to talk much about the other 4 cops or anything related to internal matters.
