So Who (Besides Bruce Whitaker) Hasn’t Seen The Video?

Here’s an article by the pathetic Lou Ponsi in the OC Register about a guy named John Huelsman,  an ex-cop, who unluckily happens to be the step-father of Jay Cicinelli, the Fullerton policeman charged with the beating death of schizophrenic homeless man Kelly Thomas, last July.

This man popped up at the last council meeting nattering the same nonsense about what an angel his step-boy is, so this isn’t really news. What is news is this guy’s claim that he has been able to review the City-owned video that captured the Thomas killing.

Let’s assume for the sake of argument that Huelsman is actually telling the truth. This begs the question – who hasn’t seen the video? We know that our elected representative, Bruce Whitaker is being illegally denied the opportunity to see it. But, really: the freakin’ step-father of the accused gets to watch it? Really? And a Fullerton council member may not?

So who let this guy watch the video? Was it the FPD? Was it the District Attorney? Such questions seem not to have occurred to the incurious idiot Lou Ponsi whom we can all count upon to miss the real story while peddling pro-cop bullshit.

Somebody better explain soon why some clown from who knows where can watch the video, when the people’s elected representative can’t.

  2. I think the DA should subpoena his stepfather ASAP and find out how Mr. Huelsman was able to freely watch this video, whereas Kelly’s own mother, Cathy Thomas, has to hire an excellent ex-deputy District Attorney named Brian Gurwitz to try and force the DA to allow her to see the video?

      1. Yes it is true. The DA said that in order for me to watch it, he wanted me to sign a discloser agreement stating that I would not discuss the content of the video with anyone. Garo and I agreed, but Cathy’s attorney said no. So, he then sued the DA. I think that the real question should be, Why did Cathy get her own attorney?

    The officers accussed of this crime Ramos & Cincinelli have copies of all or most of the evidence against them, given to them by their attorney’s after discovery was filed by the defense.

    NOTHING ILLEGAL going on here WHATSOEVER!!!!

    I am sure the defendants have been instructed by their attorney’s to review the material and let them know if they see any problems, or address any question they have. AS attorney’s should do with their clients.

    I am sure Ramos & Cincinelli have reviewed that tape themselves many times, making notes or pointing out something in that tape they think their attorney should be aware of.

    Those guys might have a friend or family member sitting with them going over things assisting them for whatever reason.

    So it would not be unusual for a family member to have seen this tape at this point in time, as Cincinelli’s step dad obviously has.

    He commented on it without being specific, and he is entitled to his opinion like anyone else.

      So why can’t Whitaker see it?

        FPD, the DA, defense attorney’s and their clients have copies that’s for sure. Investigators have look at it. Many might have made a copy for themselves.

        More than a few have seen it, but their not talking.

        @#19, NO gag order issued on this case to my knowledge. No issue with the step dad saying what he said.

        If you think back a couple LE officials have made comments that what they watched was “horrific” or words to that effect.

        That might be considered the opposite of what step dad said.

        As to Councilman Whitacker, he has ran into several roadblocks in this saga.

        His recourse is to seek relief from the courts if he feels his “right to know” is being blocked by his peers within the city.

        The reason he is being blocked should be obvious to those paying attention.

        But it’s up to Whitacker to take action on this. Otherwise everyone will continue to ignore him.

          When Whitacker gets before a judge, the judge will see the denial of Whitacker’s viewing of the recording as incoherent given the access to the recording given to other legitimate parties. Judges hate incoherency.

          It won’t happen, but I would love to see McKinley put under oath to be asked if he has seen it. Then again, McKinley may have been “smart” enough not to see it but to trust a detailed “need to know” description from someone else at FPD.

                As I was pointing out in an earlier post today, there is a huge paradigm shift that occurs when someonein authority transposes the two words “you will!” into “will you?”

    Such attempts usually result in a gag order. Lets see if anyone notifies the judge.

              1. Whitaker does have an official capacity: a capacity bestowed upon him by the electorate. What he does with this authority is between him and the voters. No city manager can overrule him, nor can the city attorney who works for him, as well. The prosecutor has no such authority to deny him such access, nor does a majority of the city council.

                When a judge in the proper court tells Whitaker he can’t view city property, the denial will be legal

    Probation officers allegedly hurt hundreds of juveniles in their care

    Even under the watchful eyes of federal monitors, Los Angeles County probation officers still are being accused of using excessive force on hundreds of juveniles in their care, according to a report released Wednesday.
    The report from the Office of Independent Review also noted that off-duty misconduct by probation officers resulted in 69 arrests in 2011 – half of them for drunken driving.

    It added that some teachers in juvenile halls and juvenile camps were found to have instigated “gladiator fights” among the wards in their classrooms, but could not be disciplined fully.

    The local watchdog agency issued the report after the county Board of Supervisors ordered it to take a closer look at how the Probation Department investigated the conduct of its employees.

    “Severe misconduct is frequent enough to have resulted in the discharge of 14 employees last year,” the report said. “The reasons for the discharges ranged from lying about an improper use of force against a client minor to defrauding a federal loan program to carrying on a covert relationship with a felon.”

    “Off-duty behavior resulting in arrests also continues to flourish,” the report added. “For example, 69 employees were arrested by other law enforcement agencies or were named suspects in a criminal investigation, almost half of them for driving under the influences.”

    Cynthia Hernandez, an attorney with the OIR, said the agency looked at 303 disciplinary cases against

    probation officers in 2011, and the vast majority of them involved allegations of using excessive force on juveniles.
    Many of the allegations have yet to be resolved.

    She said one of the most egregious disciplinary cases involved a female probation officer getting into a fight in a restaurant, shattering a wine glass and using it to cut another patron’s face and neck. The victim was permanently disfigured and the probation officer is now serving a four-year sentence in state prison.

    Robert Miller, deputy chief attorney for the OIR, raised concerns about certain teachers arranging competitive fights among students in their classrooms.

    Since the teachers are employees of the Los Angeles County Office of Education, the Probation Department is limited in its ability to discipline or punish them, Miller said.

    Neither Probation nor LACOE immediately responded to requests for comment.

    Federal monitors are separately looking at Probation to determine whether it has implemented all 41 reforms required by a federal consent decree.

    The people intend to prove that Officers Ramos and Cincinelli are guilty of the crimes charged, not only from the evidence we will present, but from the “culture of corruption” from within their department.

    It is far from a preceived culture, it can and will be proven, that the conduct of these officers on the night of July 5, 2011 was what happens within their ranks on a routine basis. Criminal activity as we know it.

    Officers and employees who steal, officers who arrest citizens under false pretenses, officer who destroy evidence by ripping up their recording devices, officers who sexually molest female prisoners. Officers who have prisoners die in their presence, while in custody.

    I think we can all agree these are serious issues if they can be proven. I submit to you members of the jury, THEY already have been proven.

    Some of those officers have been prosecuted by this office, others have been terminated from their employment. There are cases pending.

    As part of the people’s evidence, we can show you a judicial opinion from a Federal Judge who gave a scathing legal opinion on how the Fullerton Police Department FAILED to handle a officer who in this Deputy DA’s humble opinion, could be classified as a sexual predator.

    We can show you law suit settlements that suggest there is a problem within the ranks of FPD also.

    All of these incidents ladies and gentlemen, within the last couple of years. I submit that Officers Ramos and Cincinelli were working with these individuals too.

    We submit to you that at least two law suits are pending, and have NOT been dismissed by the courts for being frivelious. Those issues involve matter of one’s civil rights.

    The defense may attempt to re-direct your attention away from all this, by focusing on Kelly Thomas’s past.

    A man’s past filled with mental illness that even members of FPD were aware of, just before events lead up to his death.

    They will tell you that Kelly was a criminal, and suggest you set aside the facts of his death, based on that past.

    We must remember that Kelly Thomas was suffering from metal illness, Officer’s Ramos and Cincinelli were not, nor were the other members of the Fullerton Police Department when they committed their misdeeds.

    The members of the Fullerton Police Department are suppose to be free of metal illness, when they perform their sworn duties. They are also well paid and trained, they are expected to control themselves, in the highest of standards of public service.

    They are trained to take people into custody without killing them, especially when they have significant numbers present to do so.

    Would you hold Kelly Thomas to such standards, a man with a metal illness that is unquestioned?

This video was put in evidence early for that very reason. To prevent it from being released. Evidence has specific laws regarding release. That’s why no one can release it without Racks approval. A judge won’t ever release evidence either before a case is ended. Get a clue.

    I care about my family, friends and my community. They know that I am pretty much an open book. What you see is what you get! I have no hidden agendas. I am 59 years young and have no political aspirations except maybe one day getting elected to the council.

    This series of comments is one of the most difficult things I have ever forced myself to read in my life. In fact, I couldn’t finish. I try to not waste time attempting to convince the masses to change their collective behavior, but I will make an appeal to you, the individual family members of both sides of what has truly become a war of words designed to wound the innocent loved ones of those involved on either side. Please individually consider stopping. Don’t worry about whether others stop. You stop. When words cease to have any productive or educational value other than to hurt innocent people, you are simply being unkind. Sometimes collateral damage cannot be avoided in righting a wrong, but in my opinion this exchange between family members and their supporters no longer qualifies. Unlike a war with guns, this war of words against family ends the moment the other side walks away.

    To the bloggers on the side of wanting to see change in government. Seriously? Do you really need to start name-calling extended family in order to make a point about how ridiculous it is that the council is restricted from viewing the video when a judge has not ordered that the defense cannot share it? Maybe the rhetoric could be raised just a touch. I do not trust the system either and I think the existence of this blog is absolutely necessary to ensure that government cannot operate in the self-serving vacuum that it ALWAYS gravitates toward in the absence of a free press. And, this blog is the only form of free press doing its job. But I have to tell you, I look upon the word choices of some of you and I could not be more disgusted if you walked up to a child and just smacked them across the face. Which, incidentally, there ARE totally innocent children dramatically and tragically affected by your carelessness.         Effective means to subdue a suspect include pepper spray, choke holds, handcuffs, tasers-not to the heart, and not bludgeoning the skull and knee dropping the throat martial arts style.     I personally have difficulty believing that this officer had passes a psychiatric evaluation where PTSD was not diagnosed before employment, and would love to see the paperwork that shows that he did.
