Slidebar’s Noise Assault: Is It Even Legal?

Ah, late night music in downtown Fullerton. The louder it gets, the more people show up.  And at the Slidebar, the party rocks on every night of the week.

Sure, it’s fun if you’re visiting from the 909 on a Thursday night. But to the rest of the public, nonstop amplified outdoor music is known as something else: a Public Nuisance.

Here’s what the Fullerton Municipal Code’s Limitations on Permitted Uses section has to say about music on outdoor patios:

Accessory Outdoor Dining or Patio.

15.30.040.I.7.c.ii.     No amplified music or amplified entertainment is permitted outdoors, except recorded background music for dining establishments wherein normal conversation is not impeded; no music or entertainment shall be permitted on a patio past 10:00 p.m. Sunday through Thursday, and 11:00 p.m. Friday and Saturday.

So whose job it is to police the downtown bars and night clubs that have patios with outdoor amplified music?

It’s obvious that the Slidebar Cafe’s Jeremy Popoff has paid the city council off by sponsoring their political campaigns, so I’m sure that the Fullerton Police are laughing their asses off every time you’ve tried to complain to them to have the noise abated, have you ever considered suing the Slidebar in small claims court to have the noise abated by them?

          If your neighbor keeps disturbing you, you can sue, and ask the court for money damages or to order the neighbor to stop the noise (“abate the nuisance,” in legal terms). For money damages alone, you can use small claims court. For a court order telling somebody to stop doing something, you’ll probably have to sue in regular or Superior court. If it were me, I’d also consider having your neighbors nearby join you in a class action suit to abate the nuisance.
          Of course, what you really want is for the nuisance to stop. But getting a small claims court to order your neighbor to pay you money can be amazingly effective. And suing in small claims court is easy, inexpensive, and doesn’t require a lawyer.
          To win, you’ll need to show:
          There is excessive and disturbing noise.
          The person you are suing is either creating the noise or is the landlord and therefore responsible.
          Your enjoyment of your home is affected.
          You have asked the person to stop the noise.
          To prove your case, use police reports, witnesses, your own testimony, or even a recording.
          Like I said Tony, the good news is that it only cost $75 to file in small claims court against the Slidebar Cafe , and you’ll have a potential of winning $10,000, and the satisfaction of “abating the nuisance” ; – )

        2. Mr. Tony, funny you should bring that up. I’m writing a post on the subject of selective law enforcement in Fullerton, a sad situation that is worse than ever.

  4. Code enforcement is worthless in Fullerton. It took them three years to act on a simple complaint I made against an unnamed Fullerton bar which was violating multiple building code sections. This is after I was told they were unsure if any codes were being violated because it seemed like more of an operations problem even when I submitted the code sections to them with the complaint.

  5. They let Roscoe’s (AKA Jack Franklyn) violate city law with impunity. There’s rules for them and there’s rules for us.

            This call now would involve politics and public perception. Due to that, this call would be handled by the book. No variation at all.

        Video cameras have automatic gain and it is not at all “clear” how loud it really is. A $30 investment changes things from subjective to hard numbers.

        I’d even go as far as to set up a “demonstration” outside city hall. Get a boom box. Play the exact same song (or better, get a five minute recording outside the Slidebar with the crowd noises and all). Stand 10-20 feet from the boom box and crank up the volume until your sound meter reads the same as outside the Slidebar. Anyone in that same 10-20 foot zone will be able to physically experience the actual volume level.

        Keep in mind this isn’t an exact replication because at the Slidebar you are much farther away from the source. If you set the boom box 50 feet away it would be much more realistic, but you probably can’t find a boom box that powerful and you’d be created a very real and significant disturbance doing a demonstration of that size.

    I realize Slidebar is “the enemy” or something like that, but if they are reasonably not impacting anyone but a few passersby then I view this as a “live and let live” situation. It’s just attacking Freedom to lodge a complaint where there are no truly aggrieved parties.

    Hence, I need more information before I can form an opinion, and I am inclined to disagree here. Similar to sidewalk smoking bans… temporary inconvenience… get over it.

    1. Kevin, I would not have made this an issue had it not been for the fact that I know several people who live downtown that can’t get a good night of sleep because of the loud noise emanating from the Slibebars outside patio.

      I believe and I’m sure you agree that it is very important for people and businesses alike to understand that it’s not cool to disturb the peace of others. And if someone is disturbing the peace of others, they should be held accountable.

        Is it possible for the residents downtown to start videotaping outside of these establishments after 10PM, while simultaneously holding a smart phone displaying the time with a noise meter applet that shows what the noise level is currently at?

        These videotapes could go a long way in convinciung a Judge in Municipal Court/Superior Court to seek immediate relief for residents from the continual noise, by seeking a noise injunction, as was done by residents in Costa Mesa to get the Pacific Amphitheater to stop at 10 PM.

        The best part about this methodolgy is that it is done within civil court and does not require interaction of the FPD or the City Council to enact.

        1. I wouldn’t go alone. It would suck getting beaten to a pulp by some drunk off duty thug for “not gettin’ the fuck out of my face with your camera, bro!” aka Penal Codes 69 and 415.

        2. Your noise meter app won’t mean much in court. Buy a real SPL meter at Radio Shack. They go for like $30. Make sure you put it on the correct setting (dbA-weighted or other… check the muni code to see how it is supposed to be measure).

          Then, make LOTS of video clips with the date/time turned on in your camera (if possible). Otherwise, capture your cell phone clock because that is synchronized to very accurate time. ALSO, make certain your face appears for a moment because you will need to give testimony that it was you that took the video and that you have first hand knowledge of each instance. Keep a log of each instance.

          When you have LOTS of these clips, have FFFF put together a video showing 20 of them back to back. Make a formal complaint IN WRITING to the city planning department, council and police. Get a second copy of each complaint date stamped “received” from each department. Do this at least twice or three times so you can show the city ignored you. THEN you can go to court, if necessary. You can also go to the press at that point because the video will be compelling.

          If you actually go to court, I’d hire an audio professional. It would be nice to get a certified expert sound engineer, but it would be fairly compelling to have just about any recording studio or P.A. technician from the local music store who has experience with an SPL meter (sound pressure level).

          And… if safety is an issue, have another friend videotaping you in case the thugs attack you.

      Anybody who lives within earshot around or nearby to that classy establishment, and, there are people who do LIVE nearby.

      Sound carries for miles, loud ass annoying music is a nuisance, there is law against it after certain hours and it demonstrates clearly the selfish disregard and cocky unconcerned attitude of the management and those patrons that frequent that bar. (Not to mention FPD).

      Has nothing to do with who’s an enemy and who isn’t, the same rules apply to everyone regarding when to shut the loud noise off.

      Some folk have to work or get up early in the morning.

      Publicly disclosing this noise issue as well as various other issues that concern the Fullerton community is very responsible whether you feel it important or not.
      If more had the spine to show activity of these types of community issues, there would be many others, including businesses and government, who would think twice before selfishly trampling on other’s rights and simply acting out of self interest.

    1. I’ve made numerous complaints to the Police over the years. I’ve been woken up probably over a hundred tinmes from a dead sleep at the hours between 11:30 and 1:30 by huge blast by the DJ ‘s. It’s very difficult to force yourself out of bed at those hours and deal with cops. They have even had the audacity to claim that they needed to enter my home to listen from my bedroom to verify. I’ve had enough too. SHUT DOWN SLIMEBAR!

With women and children present isn’t there a ordinace in the law to file a complaint for profanity if the recipient , which can be anyone near this area, were to find this offensive?

    Assuming that you are NOT the narcisstic dolt that used to be our interim Chief Of Police here in Fullerton, I’ll take it that you are of reasonable intelligence and can understand or comprehend that these noise standards after 10PM are the same for the Slidebar as they are for ALL of us that choose to live and/or conduct their business within Fullerton so that our families can eventually fall asleep at night.

    Imagine if you lived downntown and had to try and fall asleep with a band or DJ blasting and rattling your windows till 2 AM each morning, and I’m positive that you would be more interested in having the noise law evenly applied.

    1. F.L.– I think I made it fairly evident that I advocate doing something when someone is actually impacted, but not just to go after someone because you can. While I think moving downtown obligates anyone to be more lenient than if they lived in the country, if it is unreasonable then complain by all means. If it is not just surrounded by commercial and industrial uses, then complain.

    THIS IS A FACT…..not that I dont like music, its just after hearing the same songs at levels that Im pretty sure can make me deaf…its disturbing- I live off Malden and I can attest to hearing the bands from my roof, a block away from the PINT house, I can hear it clearly…until the wee hours of the morning…I walk by there and the people are shouting at each other, because they cant even hear themselves making asses out of themselves…do i need to take video, from my roof and then while tape is still rolling walk the block – and end up 100 feet away from the establishment? Just curious…its really bad.
    I know people will say ( cops have told me- my fault for living Downtown) look where you live..yes Im aware of my metropolitan area, but I already have to clean puke, piss and condoms up, now i have to wear ear plugs to go to bed…Really?

      If there is that much noise as Citizen M says, it’s an officer safety issue because FPD cannot communicate with anyone without screaming at them to hear their commands.

      The dispatcher might not be able to hear what their officers are saying over the radio with that much background noise.

      We would not want some bar patron beatin for not following the directions of the police, or some cop simply speaking into his/her radio, and some dispatcher thinks he or she needs help when they don’t and panics.

      Hows that RI for potential reality??

      Don Bankhead lives on Valencia Mesa around 5 or 6 houses east of Bastanchury, and has a “Stop the Recall” “Fullerton is Not For Sale” sign in front of his house next to the road to try and create sympathy for himself.

      I’m sure that if you parked a van in front of Don’s house and opened up the cargo doors to offer a simulcast of the band and patron noise that your experiencing as a resident, would get an immediate call to the Fullerton PD to offer you a ride back to the station and maybe even get a “screen test” along the way.

      However, if this were to actually be played out, it would go along way towards proving that the noise law is being applied arbitrarily capriciously and could provide a venue for all residents affected to seek long term relief in a civil court, as well as provide the teeth that come with a Judge’s order to curb similar noise infractions downtown in the future.

  20. Such a wonderful, up-standing establishment that does so much to contribute to the benefits of the city! Someone should complain about the late-night NOISE POLLUTION at the next council meeting and see where it goes. Get the complaint on the record!

  21. Kirk Warren, head of code enforcement will say anything that serves his best interests at the time. The tax credit -sub standard hell hole I lived in during my hellish six years in Fullerton was supposed to be inspected by the city annually…Sept 19th 2006, city council meeting Kirk Warren was doing a lot of CYA..he said his inspectors spend 30 minutes in each apartment and 30 minutes writing up a report back in the office…BS!!!!!!, I lived there 3 years before I ever saw a city inspector, when they did inspect, the only thing they would find wrong or things the tenants could be charged for and to find these things they had to overlook code violations the property owner was responsible for. When you are a department head of a city and you stand at the podium in city hall and lie through your teeth on camera you should be terminated. He initially refused to meet with my tenants group until we went to the city council and I believe it was Dr Jones that made him meet with us. He told us there was nothing he could do about the municipal code, it was dictated by the state and there was nothing he could do about these sub-standard places where the plumbing is shot except make them repair leaks. Then I see Warren a year or two later at city council asking for changes in the municipal code to go after homeowners with blue tarps on their carports…what a contradiction…nothing he can do about plumbing that looks like it was dredged up from the Titanic, but plenty he could do about blue tarps, I would assume because there is potential revenue to be had going after home owners with blue tarps. Dr Jones said more emphasis needed to be placed on sub-standard housing on 2/19/08 city council meeting. He became quiet animated and angry. The only emphasis the city placed on this issue was on the vocal tenants speaking out. Jones is clueless as to how unscrupulous his departments heads are.

His diversions and barbs often seem to be aimed at getting others to comment on tributary issues or just to get annoyed to let their personality come out.   28. So, who is being disturbed by the loud music? People sleeping their cars in the parking lot or parking structure, or people at the train station. Where’s the closest residence to this place? Come on, really??

    1. It’s the Soco Walk a few hundred yards to the south, as well as people living in the neighborhood south and west.

      You’re not from Fullerton are you?

      1. Plus there are apartments a few hundred feet away in the same block. I think it’s called Fullerton City Lights or something like that.

There are tons of nearby residents and even not so nearby that are still disturbed by the afterhours partying/NOISE… and that’s not the point, the point is that there is a LAW that forbids loud noise including music after certain hours that someone is ignoring and allowed to ignore-all the time.

    3. Many bars with a music venue have been shut down for that reason. Many years ago I worked over on the Westside in a noisy, popular bar that was located very near a residential area. The neighborhood complained enough to have it’s doors slammed for good.

          1. I disagree, it is newsworthy, if the rumor of the BOE raiding a business is true, this person is suspected of ripping off the state of California. That means he possibly stole from all of us. Add that to the fact it is Slimebar on the heals of a FFFF post here about the same business, and it makes it quite pertinent and newsworthy, relatively speaking.

        2. Did some research on BOE investigations/raids. They are generally conducted under 1 of 2 forms. A civil citation, or a criminal citation. The difference being that a CHP officer is always present at a criminal citation in case it is necessary to affect an arrest. They are never present at a civil citation because they don’t suspect criminal activity. A CHP officer was present during this raid.

    When yu observe a violation of the sound ordinances, you are to call dispatch, per Capt Crum, and tell them you would like to place a complaint on a noise violation, tell them the establishment, and then the next day call code enforcement, to tell them the very same claim.
    After the meeting I was at tonight- there have only been 9 complaints due to noise in a year…so lets call people..once they have the numbers to fine or deny them a business after the first offence, ect ect. So lets call people, the only way to get something done here, is call and make detailed notes,with specific bars, nightclubs involved.

    they were closed down due to fire marshall, they had to clear the bars,then clean up,wipe every table, clean all the glasses, have the fire marshall, give them the ok, to open back up, so I was told by one of the closed bars employee.

While I think moving downtown obligates anyone to be more lenient than if they lived in the country, if it is unreasonable then complain by all means.   41. Elm Street Resident :I’ve made numerous complaints to the Police over the years. I’ve been woken up probably over a hundred tinmes from a dead sleep at the hours between 11:30 and 1:30 by huge blast by the DJ ‘s. It’s very difficult to force yourself out of bed at those hours and deal with cops. They have even had the audacity to claim that they needed to enter my home to listen from my bedroom to verify. I’ve had enough too. SHUT DOWN SLIMEBAR!

    Per the LT Crum. who is the weekend supervisor, he stated that only 9 calls in 2 years have been reported, you are to call dispatch and make a complaint then you are to call code enforement MR Zelinka and make him aware of the situtation..just sayin

  42. When I go to the slidebro bar or the slime bar or whatever equally hilarious name you baby boomers call it, most of the people I meet live in Fullerton. Granted after the bar closes we slaughter chickens and shoot up heroin.

    It’s a popular, sometimes fun bar. I’m 27, lived in Fullerton for two years, I frequent downtown often at night. I’ve never seen a fight at Slidebar, or anywhere for that matter. You have a vendetta, get over it.
