The attorney for the Thomas family released some medical reports from UCI today. They say that Kelly Thomas was brain dead from head trauma as the result of an assault and there were no drugs or alcohol found in his system

    In the time between Kelly’s beating and his death the local coverup was in full swing. So much so, there was no turning back. They had no idea you folks in Fullerton would react with such outrage.

    Now they are caught. The only defense they have is silence. They can’t answer anything without incriminating themselves. With teams of Lawyers and the feds breathing down their necks they dare not try anything.

    IMO, it’s just a matter of time before the Mayor, DA, Police Chief, and the Police involved in the beating go away for a long time. There is no loyalty among thieves. These men will break and turn each other in.

    2. a suspicious death did occur down by the tracks with a homeless person about just prior to the july 5th death of Thomas. 4 homeless kids passing thru. Only three the next morning lined up on the wall being questioned by the police. It was rulled as a suicide but there are many suspicious things involved. I heard that his belongings where found at the police dept. where he suposedly walked in an left them the night before. It was interesting to note the death occurred by the only spot on the tracks near the parking lot.The alleged suicide happened at 4:30 on a wed morn. in June.

    1. I took videos a few years ago of three sheriff’s deputies sitting at Theo Lacy while they were playing solitaire and video games. If I hadn’t had my son with me at the time I’m pretty sure that they wouldv’e been more heavy handed with me for doing so. I subsequently asked the Sherriff’s Department Internal Affairs and wrote to Ms. Hutchens asking if they hadn’t learned their lesson from paying out millions for similar incidents? I’m still waiting for a response from either party and that was 18 months ago. Not even a phone call, letter, nada.

        1. My kids and I were visiting the OC animal control center which is next door to Theo Lacy. These deputies had there backs to the window that we passed by and you could see that they were ALL playing solitaire at $30 an hour and I found it outrageous enough that I shot a video of it as proof.

The leaders of police departments and the command staff are 30 year cops from the old days and have adopted a mix of styles from those days and the current. The command staff in place at Fullerton isn’t going anywhere. So a new Chief and then do you think that the PD will change that much? Policies in place now are used by numerous PD’s across the US. Will be interesting to see. As I said, 2 years from now I will look at all the saved posts and compare them to the current at that time.

      Fact is OC juries, like juries nearly everywhere, generally side with the cops. Here’s a bit from the OC Weekly’s Scott Moxley that explains the situation with an example:

      “Orange County juries have a long, pathetic history of siding with cops, even obviously dirty ones. In one infamous case, an Irvine police officer disconnected the GPS unit in the trunk of his patrol car (so that dispatchers couldn’t track his whereabouts), tailed a woman outside of his jurisdiction, pulled her over on false pretenses, then masturbated and ejaculated on the shocked woman’s chest. DNA testing later matched this cop’s sperm with the sticky matter left on the woman, and yet a 2007 OC jury–mostly old, white men–couldn’t bring themselves to find the officer guilty of any crime.”

      So blame the DA if it makes you feel better about us, the citizens, but the truth is we get what we tolerate, and OC juries bend over backwards to give cops the benefit of the doubt. And the cops know this.

      In the case of the People vs. Deputy Christopher Hibbs, the prosecutor became so frustrated by the cops’ lies and sudden memory losses on the stand that he openly called them out in closing, talking to the jury about the “blue wall of silence.”

  13. I wish that the Discovery Channel or some other cable TV channel could produce some documentaries to educate the public about head injuries. People can die from head impacts even when there has been no injury to the skull, for a variety of reasons. Certain blood vessels of the head which are external to the skull are rather vulnerable; boxers have died from being hit there. I would very much like to know if Kelly had any fractures in his skull, or if all of the injuries resulted from “transmitted force” — the momentum goes through the skull, and into the brain. I would like to know if he was beaten on the back of the head with a baton; whether he was beaten on either side of the head with a baton; and to what extent his brain injury was caused by his forehead being slammed on the sidewalk. I know all of this is gruesome, but I think that a police department’s policies for restraining detainees and arrestees would be “informed” by such information about the mechanics of head injuries.
    If the FPD does have such policies in writing, I don’t see any reason why the FPD should not immediately release them, rather than wait for a formal Public Records Act request. If it does not, then perhaps it is time for the City of Fullerton’s City Council to adopt them, after some public process. [I have a hard time believing that there are not already some published guidelines and instructions, but you never know. The police everywhere have to spend a lot of time just to stay current on when and how it is legal to arrest people for various kinds of crimes.]
    Most people don’t know that the councilman “Dick Doc Jones” was a military physician, before he became a successful plastic surgeon. I think that he really could “inform” a public dialogue about the adoption of rules that govern how the police must treat a detainee’s head, as opposed to other parts of the body…. if such rules do not already exist.
    I also hope that there could be some kind of public dialogue about a return to the use of “wild animal nets”, which were used back in the late 70s and early 80s to restrain young men who were high on PCP and acting violent. I still don’t understand why the police coud not simply have “bagged” Kelly with such a net, rather than have to use human beings to “dog-pile” him.

    Can anyone out there tell me if there are formally-adopted FPD procedures that concern the treatment of the various bodily parts of detainees and arrestees?

  23. I have to say, watching the news conference on the KTLA site this morning was really something. When Mardirossian held up the blowup of the Report of Death with the cause listed as brain death, due to brain trauma, due to an assault, it was truly stunning.

    When criminal charges are brought I’m sure prosecutors will do the same thing, perhaps even leaving the blowup where the jury can look at those words for awhile, maybe even while the video plays. That might just be enough for a conviction, even with an OC jury!

  33. In the United Kingdom, an independent organization known as the Independent Police Complaints Commission investigates reports of police misconduct. They automatically investigate any deaths caused by, or thought to be caused by, police action.

    This is what’s required in the US. Stop listening to police chiefs, mayors, city councils, states attorneys, attorneys general. Get the legislature to once and for all put an end to police “investigating” police.

  37. This news conference brings up many interesting questions. Was asystoli caused by repeated tasering from two tasers being used at the same time repeatedly? Was brain death caused by the aspiration of blood from facial/skull injuries which lead to anoxia resulting in brain death? Where the taserings affects on the brains biochemical eletrical functioning and the anoxia caused by aspiration together the reasons for brain death? Don’t know when photo of Kelly in hospital was taken but his nostrils were packed with gauze and it looks like there was suction tubing entering his mouth with fresh blood in the tubing. There was no talk of cerebrospinal fluid leaking from skull so one could assume that the base of the skull was not fractured. The ethmoid bone was fractured, along with the zygomatic processes, which would indicate sustained blunt force trauma to the face. Worked many years ago in an ECT facility, if I can remember correctly, each session delivered about 5000 volts with 3 – 5 amps in short bursts. Kelly recieved numerous taserings, perhaps by two tasers simultaneously and for many minutes at a time. Can’t wait for information regarding the amount of times that these tasers were used per the taser registers.This man may have recieved the equivelant of god knows how many ECT sessions. At least two FPD officers will be charged with aggravated murder. I wonder if these are the same officers who intially claimed that they sustained broken bones as a result of restraining Kelly and then retracted these claims. This case is getting more interesting by the day.

      Officers aren’t investigating officers. That’s why in death or major incidents the DA’s office is called in to investigate. Separate entity. I know, people think it’s a combined conspiracy and the DA can’t do his job. I guess technically that’s why the feds can monitor.

  40. It occurs to me that for all any of us know, Ron Thomas and the OC DA are working together to pressure the coroner’s office into wrapping up, and with a report favorable to the prosecution of the officers involved in the murder of Kelly Thomas.

    All of you conspiracy buffs, think about it for minute: It wasn’t long ago that Mr. Thomas was saying that he was moving forward by working with the DA’s office. Then, a little over 3 weeks ago weeks ago, Ron told PBS that he had put in a request to meet personally with T-Rack.

    Then, just over a week ago, we had the DA telling the OCR that the investigation was nearing completion, and he publicly pressured the coroner’s office, specifically calling out the examiners for the hold up in resolving the question of charges.

    Now this week we have Ron Thomas and his attorney carefully stage managing the release of the medical records. First, KTLA, the most watched so cal station, was given the exclusive ‘teaser’ for the press conference, which they aired the night before. Then KTLA carried the press conference live on their website the next morning. At the conference Madirossian revealed the real juice that KTLA had not been given in the teaser: That Kelly’s doctors wrote in the ‘death report’ that the victim had died from head trauma due to an assault. Powerful stuff, of which I’m sure T-Rack was already well aware.

    If I’m right, the next move will be the DA’s. Expect to see more public pressure from T-Rack on the coroner’s office if they haven’t completed their report by the end of the week.

The DA’s office generally does NOT like to prosecute LE officers because they depend on them for testimony to win trials, they are usually on the same side (much more often than not) and because the DA is an elected position which needs the support of the “law and order” voter and benefits from campaign donations by prison guard and police officer unions.

  45. The Orange County Sheriff-Coroner’s office will have autopsy results “soon” on the death of Kelly Thomas, the seriously schizophrenic transient who died two months ago after being beaten by Fullerton police.

    “I don’t have an exact time table,” said Sheriff-Coroner spokesman Jim Amormino late Wednesday. “I would say a short period of time.”

    He emphasized the Coroner’s office was “not going to rush. We’re going to do a thorough job and we’re not going to be rushed. We can’t take shortcuts.”

State and Federal legislation should be passed to make it a FELONY for pubic safety officers to use or possess HGH steroids for obvious reasons. ‘Roid rage’ has contributed to the lawlessness and wildly out of control behavior we frequently see with police and sheriffs nationwide.     1. Dodge. I agree with your belief about roids and HgH testing. I have never seen any type of random testing in law enforcement in my 25 years. I wouldn’t be against it but the hardest part to get any agreement would be the process. Cops would never agree to something involving the city because they would go with a cheap little medical facility with a poor chain of custody. To get proper testing it would be very expensive. I just read the story of Diana Taurasi in the Sports Illustrated and her test is a perfect example of a tainted test and if not for her being rich she would have been out of sports forever.

      The other thing is your belief roids is rampant in police work. Why do you feel this way? Just because of the anger in this incident? If you lined up the 6 cops mentioned in this incident, do you think they will look like body builders or roid users? I find your belief odd because I hear more talk of fat cops than roid cops. I really can say I knew one guy in 25 years that I thought was on roids. I don’t see rage like you describe at all either.

      1. I can tell you that probably 4 or 5 out of every 10 cops I see on a daily basis look / appear to be juicing or using HGH. Today for instance while at a 7-11 getting lunch I saw a young sheriff with HUGE arms and chest with tattoos, veins popping out, camel hump neck and shoulders. This ain’t normal development and my bet is $500 this cop is using. When HGH cops are challenged by a suspect in any manner, the sky is the limit on what could happen – and that is the point. Therefore all cops should be subjected to HGH tests in order to clean up this public relations problem. HGH use adversely effects a cop’s ability to properly control their temperment in high pressure situations. Yes there are plenty of fat /portly cops as well and they can throw their weight around when needed. Police and sheriffs choose their careers, they aren’t drafted, and this type of performance by FPD is criminal. No excuse for it. All six should be in prison.

    “I am a former Fullerton police officer who
    worked with the six accused of beating Kelly
    Thomas. Two officers are directly responsible
    for the death; one has been a ticking time
    bomb for years. He lives in Corona. Both the
    Fullerton and Corona Police Depts. have covered up his numerous previous altercations.
    All six are terrible police officers and
    deserve to go to prison for manslaughter, pergury, and lying on police reports.
    Chief Sellers is a disgrace to the profession.
    He has made it his captains’ mission to find
    out who is the “leak” at the department and
    has said not only will that officer be terminated, he will be prosecuted. For what? Telling the truth?
    I left the department because it is corrupt
    and full of “Good ol Boys Clubs,” but I still
    know people at FPD. They are appalled by
    the actions of the six officers. The man who

      Anyone who is not a cop and commits murder, would be detained, awaiting trial and/or sentencing. Forced to accept the consequences of their actions, hoping for leniency.

      1. You may think that’s true, but it’s really not.

        Let’s say you and another guy decide to fight. You fight and he dies at the scene. You stay there and you say that he came at you and in self defense you fought back. There are 25 witnesses that saw everything.

        The cops don’t know exactly what happened. They talk to people, some say it was all you, some say self defense, some say it was the other guy.

        The cops take you to jail and book you. Now the DA has 48 hours to file charges and arraign you. But if the case still has questions, witnesses need to be interviewed in depth, businesses swept for cameras, blood tests, coroner report, etc, then you have to be released pending the investigation of the case. It happens often.

        In this case, if the DA felt there might be enough to have a case eventually, he could have arrested whoever he wanted. Problem is they would be released in a day because of lack of evidence to arraign them. Then we are in the same spot as of now and the city or county could be open to liability if it was proven that the arrests were just done as a PR stunt and there was no evidence to show that the other 4 did anything at all.

        That’s a short version and I probably missed some key points but I see what you are saying, but that’s not always true for a variety of reasons. I haven’t taken people to jail for felonies before just because I wasn’t positive, and I knew that the gang guys or homicide robbery guys could get the best information during their follow up.

Well, right off the bat I’ll concede 100% that you are right that nothing is that black and white (no pun intended) But here’s the thing, if I’m in an altercation where someone dies as a result and I am confident that it was justifiable and could be proven so, I am going to cooperate fully with the authorities and let due process run its course. And own my responsibility….I’d have no choice but to. Anything less would rightfully raise suspicion.

          In this case, the officers in question have done the opposite. Just ran and hid. And from the average persons perspective it just looks like they have something to hide. If they did no wrong, all of the supporting evidence would have been released to exonerate them and they would all be back on patrol now… I’m guessing. Probably an over simplification, but they’ve not produced anything to dispute the allegations. And until they do, it just doesn’t look good no matter how it’s spun.

There will always be a few bad cops here and there, just a matter of finding them sooner rather than later. I’ve seen at least 25 cops get fired in my career. There have been many times at restaurants where I have wanted to talk to the police there, but they act like they wanna kick my ass. It really IS a small world. Maybe we are neighbors?     1. Yes all the time. I walk business areas, go to all the neighborhood meetings, talk to the kids. It’s great.

      Funny you say restaurant. That’s the worst place actually. We get 30 minutes to eat and stopping to have a conversation in the middle of dinner is the worst. I do it, but I’m sure you can see how that would be hard.

      Everywhere else I love it. It’s the best for police relations also.

We gotta start somewhere.

    I guess unfortunate is a word for it. In any industry or profession there will be moments where the bigger picture must precede protocol and policy. And the process in this instance, has only prevented transparency that the public needed in order to keep their trust in the police force. Remember, the authority that the good cops have over society is granted by law abiding citizens. And every time a bad cop violates that authority, the process alienates the public and chips away at that authority. If something doesn’t change about the process, it will only be a matter of time before those average law abiding citizens also lose complete trust and faith in the police. You referred to a PR stunt earlier, in this case I think better PR from the PD and it’s chief would have gone a long way in stemming the anger and frustration. Now they have made their bed, this is not going to go away, and a young man… who was a friend of mine, is dead. Unfortunate is putting it mildly I think.

The issue is not that all cops are bad cops, there are alot of good cops out there. the problem here is that these 6 “officers” (maybe not all 6, but none of them are telling what really happened, so they are equally as responsible) are rogue, dirty scum thugs. Not thugs as in street gang thugs, because not even street gangs do this kind of damage to eachother. this is a brutal beating-murder and they need to be made an example of. Even if Kelly did resist, he was 135lbs maybe 145lbs. These cops probably have a record of picking on these helpless homeless men and as you can see all the history sotries are coming out every day.
    At the end of the day they need to be made an example of and medical professionals who treated Kelly Thomas that night said he was brain dead that night due to blunt force assault.
    That alone should be enough to put these guys away and along with video and a few witnesses, these officers are going to get what they deserve. If not death then life in prison with the criminals they are supposed to be out to get.

    OH YA! THERE IS NO RECORD OF A CALL TO FULLERTON POLICE REPORTING ANYTHING ABOUT KELLY OR ANYONE ELSE STEALING THINGS FROM CARS AROUND THE TIME THAT HIS BEATING TOOK PLACE.

I’ve stood at that door myself, but was turned back until a later day. So, I KNOW you will be there someday too.       The Atlanta Police are conducting humiliating and illegal searches, according to the Citizen’s Review Board, who documented cases of officers pulling down people’s pants, touching their genitals and even conducting cavity searches in public. The purpose, the board says, is to intimidate and frighten.

      This week the city paid out a $200,000 settlement in one case and another lawsuit is on the brink of being filed after another officer allegedly touched a teenagers genitals in an illegal search.

      “There’s a custom and practice among Atlanta police officers to illegally search people, including strip search them. To pull down their pants, to touch their private areas, and in some cases to do rectal cavity searches out in the field,” said Attorney Dan Grossman.

      The Citizen’s Review Board met to recommend the termination and suspension of several officers accused of using these disturbing intimidation tactics.

      “This type of behavior shouldn’t be tolerated,” board member William Harrison said.

      The board documented a pattern including strip searches, touching genitals, and conducting cavity exams, in public which they say is against the city’s policy.

      “It is completely illegal and against Atlanta policy for a police officer to stick his finger inside someone out in the field,” Grossman agreed. “And yet, they admit doing it in their own police reports. It is typical of what they do, trying to use these tactics to intimidate, scare and terrify people.”

      Grossman represents three young men who he says were illegally searched by the police. One of the teens is 17-year-old Olajuwan Wilson.

      “Without any reason to suspect him of anything, police officers came up, and a police officer stuck his hands down 17-year-old Wilson’s pants,” Grossman said.

      In another case police pulled over two of Grossman’s clients for running a stop sign he says didn’t even exist.

      “They wound up pulling down Mr. Venegas’ pants and made his spread his butt cheeks on the side of the road,” Grossman explained.

      The police found no illegal contraband in either of those searches. Both cases were brought before the review board to recommend disciplinary action against the officers involved.

      “I think we should consider termination,” board member Paul Bartels said.

      The officers were part of the now disbanded Red Dog unit. But Grossman says the problem reaches all the way to the department’s top.

      “People should be surprised by this. You should be surprised that Atlanta police officers are doing rectal exams out in the field. It’s surprising. It’s surprising that Chief George Turner doesn’t discipline these guys. Anyone should be surprised by that. I don’t know why we as a city have allowed Chief Turner to get away with this,” Grossman said.

      The board recommended the termination of two officers, and the suspension of one more in the Venegas case. They will reconvene next month to discuss discipline of the officers involved in the Wilson search. Those recommendations will be sent to the chief for his review.

  83. Police Thugs, like many of us, you sound very angry, and it’s obvious you would like to see the officers involved go to prison. Now let me ask you, do you want the OC DA to go off half cocked and charge the cops with lesser crimes for which he might be able to get convictions, or would you like for him to wait for the coroner to provide the findings of the forensic pathologists so the DA can possibly make a much stronger case for more serious charges?

    I too would like to think that the attending physician’s blunt assessment of the cause and means of death are enough to convict on charges such as murder one or two, but if the coroners report is less blunt and more ambiguous, that’s not gonna happen. The defense attorneys will simply point out that the people’s own experts, the medical doctors with specialized training in determining cause of death, don’t agree with the attending physician, and bang, just like that you’ve got a hole in the case big enough to drive a truck through.

    Fortunately the OC DA understands this, and he knows he must wait for the all-important autopsy report before determining what kind of charges he has a chance of going to court on, and winning a conviction that will send these police officers to prison.

    I know I sound like the devil’s advocate, but I’m simply trying to provide a little clarity and understanding of the situation.

      The cops legal team could care less about that medical document. The doctor that wrote it will be ripped apart in court in terms of explaining how he decides that Kelly died from assault. This is all part of the game.

      The defense will have a high paid Doctor to counter what that Doctor said, as well as the hired Doctor for the prosecution. It all comes down to who does the jury believe. They will be buried in testimony from both sides just related to cause of death and deep, in depth analysis of the injuries, treatment, plug pulling, etc. It will get nasty

    Does that sound like Kelly Thomas, who’s signs of trauma and abuse by the cops the world has become all too familiar with?

      1. I have heard excited delirium many times in my career. I hear it mostly when someone dies from a taser, or related to taser use while on drugs. If someone is acting crazy and not obeying commands, I don’t think about are they nuts, are they delirium, are they drunk. I think about I need to hit this guy in the right spot to get both darts in him and put him down. Impossible to know if they are delirium or whatever it is.

        The other odd thing is that I didn’t know about the newest directive from Taser not to shoot in the chest. I have always aimed directly in the stomach and chest area when I shoot the taser. Even during taser practice on targets. I’ll have to look that one up on the Taser web page.

      So how about it, on what do you base your opinion that Thomas was suffering from this disorder other than your own wishful thinking? Was he insensitive to pain? No it does not appear that he was. Was he running around naked and screaming like a madman? No, witnesses say he was jut chillin’.

    I just don’t see how cops can make a split second decision in determining if a subject is suffering from schizophrenia and then diagnose him/her with excited delirium on top of that, all before they decide what to do in detaining him/her.

    It is a tough job and a thankless one as you can see. The Police need our support and yes there are some bad ones, but there are bad ministers, priests, doctors, lawyers, gardners, meter readers, clerks, teachers… on and on. So I say SUPPORT YOUR LOCAL POLICE!

        Balaban charges that police officials are using the diagnosis “as a means of white-washing what may be excessive use of force and inappropriate use of control techniques by officers during an arrest.”

        So there is no consensus on whether this condition is real or not. But even if it is, it describes “overweight” individuals who generally have cocaine or PCP in their system. While the precise cause and mechanism of these deaths remain controversial, we have demonstrated abnormalities in brain that define and confirm the occurrence of the excited delirium syndrome.

    THERMAL, Calif.—A deputy used a stun gun to subdue and arrest a suspicious man at Coachella Valley High School today, a sheriff’s deputy said.

    Around 8:20 a.m., school security personnel told a sheriff’s deputy assigned to the school at 83800 Airport Blvd. that a man was trespassing on campus, sheriff’s Deputy Angel Ramos said.

    “The officer located the (man) and learned that he was in possession of a knife, which is illegal to possess on school grounds,” Ramos said. “The officer arrested the man but during the arrest the man resisted as he was being handcuffed. The officer deployed his Taser, and after a short struggle was able to subdue the suspect without serious injury to the officer or the suspect.”

    It was not known why the suspect, 29-year-old Matthew Aguilar, was on campus. No one else was injured. Aguilar was arrested on suspicion of taking a weapon onto school grounds and resisting arrest, and was booked into the county jail in Indio.

Kelly just died because of excited delirium, right. If you believe that one there is a nice bridge in Brooklyn for sale… As far as homeless people needing to be off of the streets, it was the government, local, county, state, and federal who closed the vast majority of psychiatric hospital in the early 70s. The idea was that there would be clinics , halfway houses, sheltered housing etc. to help the mentally ill. Well almost 40 years later the government still hasn’t lived up to their end of the bargain. This can be seen by visiting homeless shelters, jails, prisons and the streets because a large precentage people there are mentally ill. By and large our society doesn’t care about those who are mentally ill.

    Was a complaint filed with that department? Yes
    What was the result? I made a formal written complaint, and it was disregarded by Chief Eileen Miller and I then went to the City Of Santa Monica and the Santa Monica Police who said that Santa Monica College Police were a separate department. I then went to the President of the Santa Monica College, Dr. Piedad Robertson who eventually decided not to investigate the policeman.

    Now tell us what really happened:

    The original crime was that I was sexually assaulted by Instructor Larry Jones in the photo lab of his class at Santa Monica College in 1994, but did not report the assault at the time it happened because I had a suspicion of the outcome and hoped the abuse was a one time occurrence.

    Two years later I reported the sexual assault to Officer Ron Marable at Santa Monica College Police station as part of another “harassment problem” I was having at the school because the teacher became involved in the new problem. Officer Marable who knew the teacher said that he could not make a report about the teacher’s sexual assault as the matter was too old. (This was not true as I have later found out that the statute to report sexual assault is three years!) And at the time I told Santa Monica College Police Officer Ron Marable the incident was two and a half years old. But SMC police officer Ron Marable did interrogate me at the time to find out if what I was describing was really sexually assault and not just a harmless flirtation.

    As the school would not investigate SMC police officer Ron Marable, I took SMC police officer Ron Marable, Santa Monica College Police Department, Santa Monica College, and Santa Monica College Community District to court on the 6th October, 1998, in Small Claims court at Santa Monica Court on Main St.(I’m not wealthy) hoping to get some justice or at least my case heard.

    The Santa Monica Courthouse Sheriff’s department served all the defendants for this hearing, but only SMC police officer Ron Marable showed up for the hearing, and the beating!

    The Judge eventually was Judge Laurence Rubin (A regular Judge at that court.) This Judge refused to allow any cross-examination in his courtroom, and refused to look at the three character references letters from my teachers at the school and refused to hear other circumstantial evidence I wanted to present. The Judge refused to hear my witness who I had subpoenaed, and a tape of her that substantiated my evidence of the Instructor’s inappropriate behavior towards women in classes at Santa Monica College, and Judge Laurence Rubin allowed the witness to leave the courtroom, and refused to listen to the tape.

    The Judge began to close the case without reviewing the evidence, at which point I went to provide my three character references from teachers at Santa Monica College. This was used as a pretext for the police brutality erupting against me, because I was exposing corruption, even though Marable continued to deny this.

    Once the courtroom had no witnesses, one WHITE Santa Monica Courthouse Sheriff deputy bailiff came towards me, not wanting to take the three character references from me. I was nowhere near the Judge and a few yards away from the 5ft 10in, approx. 35year old, WHITE muscular Sheriff Deputy with ash blond straight hair, squinty eyes, when I could see a very angry expression had appeared on his face, and that his whole body had gone into an attacking mode, where his eyes had closed, and his head was tilted down, and as he moved towards me he knocked me instantly to the ground. The next thing I knew was that I was lying face down on the ground and he began twisting my arms behind me. Then two other sheriff’s deputies arrived and began to punch me in soft tissue on my sides near my rib cage, even though I was not resisting this attack on me, and was already restrained by this first WHITE sheriff deputy. Yet they kept punching me and punching me, about twenty times. The sheriff’s deputies dug their fingernails into the skin and bone of my left hand, (I have photos) twisted and wrenched my glasses off my face. (I have a repair note dated 6th, Oct, 1998)

    It was towards the end of the beating when I could see Santa Monica College police officer Ron Marable came to hold me down on the floor along with the other three WHITE sheriff’s deputies, so it was more Judge Laurence Rubin’s WHITE Sheriffs beating me up physically in his courtroom, than Santa Monica College police officer Ron Marable, even though Ron Marable was also holding me down towards the end, adding to the activity by posing in a war like gesture of winning by holding his hand on my back as the other sheriff’s deputies held me down on the ground – for the purpose of frightening me into silence about Marable’s and Santa Monica College et al’s obstruction of justice in the future!

    Santa Monica College Police Officer Ron Marable “did not assist in halting my approach to the judge,” because I was nowhere near the judge, and also Santa Monica College Police Officer Ron Marable never assisted in halting me – period. Judge Laurence Rubin was on a raised platform about fifteen meters away from me, And twelve meter long table also blocked any path to the judge. So Judge Laurence Rubin was nowhere near me, and nor was African American Sheriff Deputy January anywhere near me. Deputy Terry January is Judge Laurence Rubin’s “regular daily” Sheriff for his courtroom, as opposed to the three “irregular” WHITE sheriff’s deputies who were in Judge Laurence Rubin’s courtroom on October 6th, 1998 for my hearing!

    After being beaten up, and after Santa Monica College Police Officer Ron Marable had finished posing for his peers, the WHITE sheriffs, I was then handcuffed, and a different WHITE sheriff’s deputy told me I was arrested and that they would be transporting me downtown Los Angeles to the county jail. I was then escorted to Judge Laurence Rubin’s holding cell, not charged with anything, and released after an hour.

    So I heard from a amiable (African American) Sheriff’s deputy who had not been involved that the judge had apologized for the police and sheriff’s deputies beating me up and jailing me, but as I am a college student with no record, and as I had already gone through a metal detector inspection when I came into the Courthouse, I should not have had to be treated in this way. Also after receiving Sheriff Baca’s letter of 5th Feb, 1999, I don’t know why Judge Laurence Rubin said he was sorry on 6th, October, 1998, through this Sheriff’s deputy, if he had ever felt threatened in any way by me on that day!

    Santa Monica College Police Officer Ron Marable did not protect and serve me, he trespassed against me, by misleading me and by not taking down my complaint against Instructor Larry Jones in November 1996 for sexual assault, and this year denying that there had been any conversations or interrogations over sexual assault back in November 1996.

    African American Santa Monica College Police Officer Marable may have decided to obstruct justice on his own, but he may have been required to obstruct justice by Santa Monica College. If that is the case – Marable is being sacrificed – even though he has complied – in order to hide white crimes at Santa Monica College, just as African American Sheriff Deputy January of Santa Monica Courthouse is now also being sacrificed to hide WHITE crimes in Santa Monica Courthouse, just as I as a female am also being sacrificed – to hide Santa Monica crimes.

    A last note that adds to the conspiracy nature of these events – why did Santa Monica College police officer Ron Marable not reveal at the beginning of the hearing to Judge L Rubin that I had not sent the defendants of this case the required California government claim! Why did Marable allow the hearing to continue – as he knew on 6th, Oct, 1998, right from the beginning that this case could be closed out on a technicality, (at least that day)? Was somebody hoping for a chance to beat me up? Why did only SMC Police Officer Ron Marable show up for the court hearing, and not the other three named defendants, who had also been served?

    Just a coincidence? Why did Santa Monica College police Officer Ron Marable wait until I wanted to show character references from Santa Monica College Instructors before he mentioned to Judge Laurence Rubin that there was no government claim! Why did the court allow WHITE sheriffs in the courtroom, who are now being hidden?

    I have since sent Santa Monica College et al, and Los Angeles County the required government claims!

    COPCRIMES update: The victim in this matter has since filed a formal complaint against the bailiffs involved. (12/8/98)

    COPCRIMES update: Officer Marable is reported to have continued to harass the victim on campus. He is reported to have followed the victim, and verbally shouted at her while she was talking on a public telephone.

    The victim has since sought assistance from Sheriff Lee Baca (L.A. Sheriff) with regards to investigating this officer. The campus President, Dr. Piedad Robertson, has yet to address Officer Marable’s actions toward the victim, and the safety of the students attending there.

    CopCrimes has contacted Dr. Robertson in an effort to remedy this matter. (12/22/98)

    COPCRIMES update: Sheriff Lee Baca has written a response to the victim that included the following reference to the officers (who are white) being “of African-American descent” – as if that should have anything to do with anything other than Sheriff Baca showing his ignorance. It is clearly a feeble attempt to discredit the victim’s claim that this matter includes racially motivated measures.

    “Although our investigation revealed that you were taken to the ground by Deputy January during his effort to restrain you, there is no evidence to support your allegation that you were struck or punched during this incident. Our investigation revealed no evidence to substantiate your allegation that you sustained injury during this incident. Finally, our investigation revealed no evidence to corroborate your allegation that three Caucasian male sheriff’s deputies were involved in the effort to detain you. It should be noted that both Deputy January and the Santa Monica College Police Officer who assisted Deputy January are of African-American descent. (2-17-99)
