The Phone Call. Was it Made? If So, By Whom And Why?

Oh, you haven't seen the last of me...

From the very beginning of the Kelly Thomas beating death at the hands, Tasers, fist and feet of the Fullerton Police Department, that department’s spokeshole, Sergeant Andrew Goodrich told the public that the fateful incident was intiated with a phone call: a phone call to the dispatcher stating that somebody was breaking into cars in the vicinity of the Transportation Center.

From the get go, the story sounded absurd to people who knew Kelly Thomas and who averred that Thomas wasn’t violent or a thief. And of course to a public that has come to understand that Sergeant Goodrich seems incapable of telling the smallest bit of truth, the idea that there was a call at all became a matter of doubt.

Tellingly, the police have issued no information about this mysterious phone call and who made it, and so far they have given no indication that they have the slightest iota of evidence that anybody was breaking into cars at all.

This is important, because it lends credence to the idea that the phone call, if there was one, was made in collaboration with the police themselves. This could implicate both caller and cops in a conspiracy. A conspiracy to do what? Since the result of the incident was the bludgeoning death of a harmless man, that question is almost to horrible to contemplate. But at the very least the facts lead to the reasonable deduction that the conspiracy, if it existed, was meant to deprive Kelly Thomas of his civil rights – a violation of the First, Fourth, Fifth and Fourteenth Amendment right, to be specific.

Of course making a false report to the police is some sort of crime (although Goodrich has yet to make an honest report to the public, which seems to be A-OK to his higher ups and the City Council). So somebody should be in big trouble for that alone.

Was there a call? If so, who made the call and why? I don’t know, but I admonish the Do-nothing DA and the Federal investigators to find out. You can bet Ron Kelly’s attorney Garo Mardirossian and his investigators will. Soon.

Time to come clean.

    Jeremy didn’t make the call. A Slidebar manager did. That person feels awful for following Jeremy’s policy to call FPD in a particular manner (reporting that a crime is in progress) that allows them to be aggressive from the get-go. I believe this method was developed between Jeremy and his FPD cronies because Jeremy thinks the homeless scum is bad for his business. Well Jeremy, let me tell you what is ultimately bad for your business. When your staff is questioned by the FBI, and they will be, and it comes out that you have an internal policy dictating that staff call in false claims of criminal activity, you will face the following:

    Your self described fame will turn to infamy and your business will fail.
    You will face numerous state and federal criminal charges.
    You will loose whatever wealth you have accumulated to the various civil lawsuits that will come from the Thomas family, and in all probability, your staff.

Even if he ran and was resisting arrest the FPD aren’t judge, jury and executioner! But they sentenced him to DEATH and carried out the execution. Kelly was never arrested or charged with a crime.

      Even a cell phone call can be traced. It would have gone thru the nearest cell tower to the FPD. This info can be subpoenaed from the cell phone companies. Also, the easier way would be to subpoena the phone records for ALL non-emergency lines at the FPD. It can then be narrowed down regardless of whether the call was a land line or cell phone call. I really hope the Thomas family atty. does this and makes this information public.

He was doing what he normally did which was living HIS life the way he was capable given an illness that made it impossible for him to live what most of us would consider a “normal” life. Mental Illness is an equal opportunity destroyer. Any of us could wake up tomorrow and start exhibiting signs of many forms of mental illness and it would be BEYOND our control. Those of you who bash Kelly for the way he lived should be ashamed of yourselves and should also start praying hard that you and your loved ones don’t wake up someday feeling as helpless as he did knowing he was losing all control of his thoughts and mind.

    I am so proud to see the love and support and PROTEST against the FPD, DA, and all others responsible, that Kelly and his family are getting.

    I want to know who initiated this murder. I think it is key. Don’t give up FFFF on getting the answer to this very important question.

    1. I know someone whose boyfriend works at a downtown Fullerton restaurant where Kelly would come in and ask if there were any odd jobs that he could do in exchange for food. When they didn’t have any work, they would still send him off with a little something to eat, because that was just the way it was between them. That was their relationship with him.

    corrupt is right. It is not legal to shoot someone to stop a property crime. Murder in self-defense is exactly as it sound. You must prove that given the situation, the average person would have feared for their life or physical welfare.

    1. California does not have a Castle Law, so you cannot kill someone just because they are in your home. You have to show intent or action of immenent danger to attack or bodily harm. 6 fully armed cops and one skinny unarmed homeless guy…. If the average citizen were to beat to death an unarmed homeless guy running away from them, they would be in prison for murder. The homeless guy running away did away with your claim to great bodily harm or attack. By chasing him down you show that you are now the aggressor and now you are the one who is breaking the law.

    2. If someone is in my house and I fear for my life and my family, you better believe I am gonna shoot that person. That is all I have to say in court. If I catch someone in my house and is jumping out the window. No..I can not. There is no more threat. Whatever your Castle Law is.

  15. In the absence of useful information, one wonders whether anyone actually made a complaint regarding auto burglaries. So far, we only have the word of Goodrich. There are other possibilities.
    For example, according to FPD, the electronic surveillance system auto dispatches units occasionally based on suspicious movement patterns – like Kelly pacing around looking for descent sized ciggy butts? This seems doubtful because one would think a “robo dispatch” would not be probable cause to rifle though Kelly’s personal effects.
    Also, there was a guy who called KFI and mentioned he’d seen FPD having a discussion with kelly a day or so before the incident.
    Hopefully, this did not take place on the 4th of July because it is doubtful they were discussing what actually cracked the Liberty Bell. Anyway, the camera rotates by joystick or whatever. The watch commander could have been monitoring Kelly before any patrol cars even arrived on scene. In this case, the video has captured the entire encounter void any obstructions.
    Maybe no one really made a call. Maybe someone made a legitimate call. It would be tragic if someone made a false complaint because kelly was an eyesore.

  16. I think this is a hugely important question. It would show conspiracy if a person could be proven to having been coached by the FPD on what to say and how to report a homeless person for the maximum possible effect (i.e. removing him/her from the vicinity).

    I just can’t believe that the FPD would not look into who made the alleged phone call. It would help their case a little if that person came forward and testified that he/she *saw* KT breaking into cars, right? Since the witness is not coming forward, then in my opinion either the phone call never happened, or the person who made the call is afraid of prosecution (for good reason).

    So how did those animals know to zoom in on Kelly Thomas- since they had no info?
    Someone must have mentioned an identity of someone on that call

    1. I didn’t say they didn’t have info. If no call came in the cops behavior could have been based on earlier agreement with, say, a local business owner/employee. Or it might have finally become personal with no third party involved.

      As I recall the original “statement” from Goodrich described a call that referred to somebody matching Kelly’s appearance burglarizing cars. In the absence of any evidence that a crime was committed, that naturally leads one to the conclusion that the call was in fact, bogus – a set up.

      I became suspicious that the police could have been involved in setting up the victim because the changing stories told by Goodrich were so transparently illogical and it seemed like such a crazy overreaction to suspicion of burglary.

      Of course I don’t know if this is what happened, but I want find out.

          Judges and Juries will sentence defiant people with power trips and bad attitudes, full term with no parole.

          One would think, here in America, that Lawyers, Judges and Juries have a hand in running things around here.

Everything else is he said and she said, but the bottom line is Kelly received blunt force trauma to his skull! Ever good officer Ive ever seen apprehend somebody, I have yet to see one of them strike a suspect in the head!

It seems to me that it would give them reason to be in the vicinity, and to’ perhaps make contact with K. Thomas, but not to beat him to death. On the flipside of that, if anyone in the slidebar, where the call MAY have generated from, has any information/proof that the call was made in collusion with the fpd for the specific purpose of depriving K. Thomas of his cival rights ought come forward, it could be very lucrative, with the right attorney representing you, it must be very stressful to have been subjected to this “cover-up” (if one exists) to try to do your job, and fear being subjected to an escalating level of scrutiny when the FBI starts digging, if a BLOG considered this possibility, I’m sure the FBI will too. After all, wasn’t stress one of the factors to cause cheif M. Sellers to go on medical leave? It is going to take intervention from the feds before any serious investigation gets done. Thankfully, the FBI is on it. T-Rack’s own investigator had close ties with FPD. So typical. I cannot believe that crook is still our DA. Hopefully the feds turn up some dirt on his crooked ass while they are at it.

    i used to travel around for work, and the pd’s that i came across, all seemed to know the homeless in their town, some on a first name basis…
    fullerton is such a small town, the bus depot so close to the pd station, i cannot believe they didn’t know kelly and what his issues were…
    and to think that 6 officers allowed this to go as far as it did is heartbreaking..
    this is really bad.,. i’m so sorry to see this happen to any city..

It permeates my life, every day. It has changed how I feel about city gov’t. Makes me realize all citizens should take a good look at who’s running the city.

    I was impressed by the demonstration; considering how blasé we sometimes are here in SoCal — I say this by way of confession — it’s borderline miraculous that what the FPD assumed was just business as usual has blossomed into a thriving, growing anti-police brutality crusade.

    After driving through the demonstration a couple times and taking it all in, I drove over to where Kelly was attacked. Like everyone else, I’d seen it at least a dozen times on YouTube and the news, but what struck me when I saw it up close and personal is how small an area it is. And granted, I was there on a very busy Saturday afternoon, but even so, I imagine this would be a busy place on a summer evening as well. Busses and commuter trains coming and going, restaurants and pubs all over the place, people driving in and out; it seems a little unlikely that a lost soul like Kelly would be roaming those parking areas looking to break into cars. Something doesn’t fit there. He would have better luck rummaging around in the dumpsters behind any number of businesses instead of trying his hand at breaking and entering. If I’m not mistaken, his backpack contained some trash he found in a lawyer’s garbage can.

    So the truth behind the non-911 call is worth digging for, even as certain players in this dirty game are trying their best to bury it deeper.

  51. I think the if a large percentage of the protesters drove in from other cities to support the citizens of Fullerton in thier struggle, that is a good thing, right? There is even a guy that drives in from S.D., I think, to participate. No violence occured, no windows of any business’ were broken city hall & the police station were not razed to the ground.   68. I mostly agree with Ed. Though I’d hate to turn away voices, I’d be careful not to let ANSWER take over and would encourage unaffiliated protesters not to use ANSWER advertising (signs) to march. Spend a few bucks and make your own signs and banner to distribute.

    I’d be okay with any ANSWER people marching in the group as long as they are not sending unrelated political messages, and don’t let their name become the lead or spokesholes for this. If they persist, then ask them to stand as a separate group and not mix.

    Cops from all over America violate our 4th amendment by saying they received a call and from that they have probable cause. I say that is not probable cause unless they have proof of the actual call. I don’t know about you guys but I’m really sick of cops using that just to give them the right to check your papers.   78. A call was made to FPD that reported a person trying to get into several cars. KT was watched for several minutes as he tried multiple cars including the persons car who who called. If it was not a 911 call it will still be recorded. I know that all business lines at FPD are recorded. This will be provided at some point. You guys that believe this was made, I’m telling you right now, that was not the case.

I will say that now that these things have come to light I am more proud now to be from Fullerton than ever. The people standing up to these injustices are amazing and I am so proud to be affiliated with them.     1. You need to spend some time with the homeless by the Fullerton Transit Station. You should donate you time time there – at least one day a week, and provide them some food and clothing.

      You should spend time advocating for the City to provide shelter for them and other comodities for these decent unfortunate souls. I do.

      Instead of bashing your city, work with your city and make positive changes. Try not to get involved because of a tragity that could have occurred anywhere in this country.

  88. In regards to the original topic of this blog post…we ALREADY know who made the phone call. We can safely say that Jeremy Popoff, co-owner of the Slide Bar, is the one who made the fake call to the police. He called the non-emergency dispatch number, and so there isn’t any 911 recording. Since the Slide Bar is apparently a cop hang out, one of his regulars probably coached him into making a false call to the police, claiming that a crime was taking place (someone was trying to break into cars) to give the police an excuse to go there and “remove” Kelly Thomas. AND we can also safely say that he called the non-emergency number deliberately, so that there wouldn’t be any recording. One of his cop friends no doubt told him how to do all this.

    The whole thing was a setup from the very beginning. Kelly Thomas wasn’t just murdered, he was virtually executed. I say “virtually” only because at this point I don’t think Jeremy Popoff wanted to have Kelly Thomas actually killed. But he also didn’t care what happened to Kelly. He wanted him out the way and gone, by whatever means necessary. The Slide Bar is a cop hangout, and he no doubt knew the cops who would be on patrol that day, and who would have been sent to respond to the call. I’m sure he knew full well that Jay Cicinelli and Kenton Hampton were capable of being violent. But that’s who he wanted to get the “job done.” He probably figured they would remove Kelly Thomas, probably kick his ass a little, and finally get rid of him once and for all. I don’t know whether he imagined that they would actually beat him to death. That’s the only reason I’m saying that Jeremey Popoff “virtually” had Kelly Thomas executed.

    But…I leave all possibilities open. I think that when we finally get to the bottom of all this and the whole truth is exposed, the real story is going to be more shocking and disgusting than anyone can imagine. We have a whole department of corrupt, rogue police, and a local business who uses them as their hired guns.

    By the way, I’m planning to go to Fullerton myself to do a little investigating of my own. My friend’s dad is a former police officer in another city, and his mom also works for the district attorney’s office (in another county, I won’t name which one). His dad often overheard a lot of shady conversations and dealings between city officials and local businesses. They were just sitting at a restaurant, talking about everything. He was sitting at a nearby booth and heard everything. You’d be amazed at the things that crooked officials will talk about if they think that no one is listening.

    Maybe I’ll go to Fullerton and do a little snooping and see what else I can find out.

    The man, whose name and age has not been released, was first spotted causing a disturbance inside the lobby of an undisclosed motel at 10:35 p.m. Saturday.

    Cathedral City officers responded to a call from the innkeeper, escorted the naked man outside and helped him get dressed, police Lt. Glen Haas said.

    About an hour later, officers were called to the Cathedral City Auto Center in the 68100 block of East Palm Canyon Drive and found the same man lying on the sidewalk, wearing only shorts, Haas said.

    The man tried to run away when he saw the officers, but he was subdued and handcuffed when he attempted to resist.

    “Shortly after handcuffing the subject, officers saw that the subject appeared to have labored breathing,” Haas said. “Officers attempted to assist the subject until paramedics arrived.

    “Paramedics treated and transported the subject to Desert Hospital, where he was pronounced deceased,” Haas said.

    We’ve heard that the reason the Slide Bar made the fake call to the police was because they wanted to get rid of the homeless people who kept using their restrooms (and especially Kelly Thomas). Well, I just talked with someone on Facebook who has actually been in the Slide Bar. He asked a bartender if “street people” have been a major problem there. This is what he said…

    “The bartender said he didn’t think so, and pointed out that very little of their patio actually is street-side. The place is always busy and boisterous. Timid “street people” are not going to risk a lot of hassle by walking through all of that to the middle of the establishment to use the non-locking, multiple-person restrooms there. (They’re not by the door, like in some places.) If in fact Slidebar is involved here, saying this is about homeless people in the restrooms is just an excuse.”

    So my question is, if the Slide Bar didn’t make the fake call to the police because of Kelly Thomas hanging around and being a nuisance and using their restroom all the time…WHY did they make the call? It seems to me that they deliberately singled him out for another reason.

    And when are you going to get through your skull that there was very little Ron Thomas could to do help his son? Mentally ill people CANNOT legally be held against their will. They tried to help him, but if he refused to stay in a treatment center and was not a direct threat to himself or others, he couldn’t be kept against his will. They had to release him. He had been in and out of hospitals and treatment centers for years. His family helped him as much as they could, and he would go to their house now and then. But they couldn’t force him to stay.

    And the knee-jerk cop lovers like you need to understand how serious this issue is. Those cops (especially Jay Cicinelli) are psychotic. And there might be others like them out there. They will snap with little or no provocation and then beat someone else to death. And it could happen to anyone. Even you.

    And yes, I would like very much for the cop who ultimately killed Kelly Thomas to be put to death. Or at least life in prison with no possibility of parole. He is a danger to the public, the same danger as a serial killer. Heck, for all we know, Jay Cicinelli might even be a serial killer…maybe there are other incidents that we don’t even know about and were covered up by the FPD. At this point, I would not be surprised to find out that this monster had committed other murders and excused it with the catch-all phrase “resisting arrest.”

    Or maybe the Slide Bar had another one of their cop buddies “eliminate” other witnesses. From what we’re seeing, the corruption in Fullerton is endless.

    Also, Jay Cicinelli was hardly the “best qualified.” Even if it weren’t for this incident which revealed him as being psychotic. After he was shot back in the late 1990’s, even the LAPD didn’t want him anymore. He had only one functional eye and his lack of depth perception made him no longer physically qualified. My guess is that the LAPD also realized that he had psychological damage too. They realized he was a ticking time bomb and a huge liability (which they definitely didn’t want after the Rodney King incident and the Rampart scandal).

    I just don’t get it…do knee-jerk cop supporters like you just switch off your common sense at some point? You can look at that picture of Kelly Thomas in the hospital (which made it hard for me to sleep) and still make absurd statements like “oh, we don’t have all the facts.”

    Okay…so tell me, under WHAT scenario would horrific injuries like that actually be justified. Let’s try this the other way around. You imagine a scenario where crushing a man’s windpipe, breaking facial bones, and putting him in a coma would be justified? You can’t. Because there is no scenario. There is NOTHING which would justify it.

  103. Well, I’m certainly done with him/her.

    I said earlier that we should all just ignore “Reality Is,” “Outraged,” “Allen” and “I love Cops.” They’re just trolls. And I strongly suspect that it might all be the same person (or maybe two people, at most) posting under multiple screen names.

    Until they showed up, all the comments in the blog were useful, with people posting links to articles and new videos showing up on YouTube, etc. It was coherent, with good discussions and we were all working toward the same goal…uncovering corruption in the Fullerton Police Department and the Orange County DA, and getting justice for Kelly Thomas.

    Then the trolls showed up recently, and they tried to create the illusion of “another side” that didn’t exist. That’s what trolls usually do. There is no other side to this one. The mutual feeling is outrage, and that these cops brutally MURDERED Kelly Thomas.

    I admit I got suckered by jaynbond this time, but I’m done with the trolls. If we stop bothering to respond to them and ignore them, they’ll go away. Or at most, they’ll just look like a few idiots that post a random comment that doesn’t make any sense and no one is replying to.

    I really wish Tony would moderate the blog comments a little more though.

    1. If not for the trolls you people would be lost in your own dream world. At least now you are opening your eyes just a little bit to what is actually going on, and what actually happened at the event. Then when the DA makes his decision you will already know some of the facts. You would be surprised who is on this site monitoring the opinions of Tony and the activists he brings to town. Knowing the names of people that hate the police from both in and out of town is very valuable information to have. I’ve already said the solution to the trolls, make a blog site that only allows Facebook log ins. That’s what newspapers and sites are doing and it works great. It limits the responses in a big way and would probably cut this site down by 80% or more, but it makes most people use their real sign ins because fake Facebook profiles are harder to make.

    Maybe that was the REAL reason why Kelly was singled out? Maybe he had seen something earlier that he wasn’t supposed to? Since we have been told that the Slide Bar is a cop hang out, it is definitely possible that one of Jeremy Popoff’s cop buddies coached him into making the false call, to remove Kelly Thomas as a witness. It would have been a win-win for both Jeremy Popoff and his crooked cop buddies. He would get rid of a homeless person that annoyed him, and the cops would be able to remove a witness to something they had done wrong earlier. I don’t think those cops necessarily set out to kill him from the beginning in a pre-meditated way. They probably just wanted to arrest him, and maybe “kick his ass” (their words, according to many sources) a little to scare him off. But they certainly wanted to kill him once they had started beating him. Jay Cicinelli just couldn’t control himself. He’s a true psychopath.

    2. I just wondered why would they would “single Kelly out” as well. If he was a witness, he probably didn’t even realize what he witnessed because of his illness. He was probably one of the most docile homeless/drifters amongts all of them there. And that bar is a real Slimebar for being the match that lit the barrage of hate and blows upon Kelly.

      I think it still incredible that anyone would question how Kelly died. Let someone bash your head, face and neck in and see how long you will live and as far as life support, that’s why they call it a life support because without it you wouldn’t be able to live.

It’s reasonable to presume that a “timid”, schizophrenic man, would not hassle walking through a crowd of drinking revelers, loud music, lights, just to use the bathroom, most bars I have been to have “doormen” to prevent those kind of things anyway. Does the slidebar not employ doormen? Some places employ off duty pd for this purpose. I have seen “drifters” sift through ash cans outside of bars looking for “butts” to smoke and chased away by bartender or doormen. My friends brother is kinda a “drifter” and he engages in this activity, I asked him once, If he wasn’t worried about contracting some sort of communicable disease, smoking strangers ciggerettes, he said “no, that he unrolls them, and puts the tabacco into his own rolling papers” Don”t know if this is what Kelly was doing? but to walk through a busy bar just to take a leak?…nah. I think “Chris” was making the point that there are bathrooms within close proximity across the street, when s/he, was distracted by a troll.

Are there any cameras in that part of town that might have captured Kelly’s movements or people that saw him so a timeline can be created for his whereabouts before the beating took place, its not like he blended, he must have been seen. All I have read is that he was seated on a bus bench when accosted by the fullerton6 and he had alledgedly been breking into cars, yea right, more likely looking for “butts” to smoke

  123. nomad, the most important camera was the one in the parking lot at the bus station, which of course the camera that recorded the entire beating and which the city and the Orange County DA are refusing to release.

    (Even though the Fullerton cops were allowed to watch the video WHILE writing their reports).

    There are several other cameras mounted throughout the city. Someone had posted a link to a page which listed the locations for all the cameras, but I don’t remember the address for the website. But it doesn’t matter – the city won’t release any videos from those cameras. Especially if any of them did happen to record Kelly Thomas before the beating. They’ll say it is part of the “investigation” (read: cover-up) and they won’t release the videos.

    Our only chance at this point is if there are any private businesses who have their own security cameras and are willing to post their videos. Surely, there must be a least a few business owners in Fullerton with a sense morality? They can’t ALL be as bad as the Slide Bar.

    I’m seriously planning on going to Fullerton very soon, to do my own investigation. Especially some snooping into the Slide Bar and their relationship with the FPD.

    One of my friends is helping me to work on a system so that videos from a handheld video camera can be downloaded to a remote server in real time…just in case a corrupt cop decides to “confiscate” the camera. There will be another video recording saved on an off-site computer that we have. If we record any misconduct by police, it will be posted everywhere on the internet literally within minutes and there won’t be a damn thing the cops could do about it.

  128. I remember having lunch with some friends on Slidebar’s patio well over a year ago when Kelly Thomas was hounding customers for money and food. He was harmless, but, customers left due to the fact he was bothersome. I actually saw Jeremy give his left over container of food to Kelly and politely asked him to go. On several occasions I witnessed Jeremy taking care of the homeless who lingered around his establishment. He has a good heart and is a good man. Many Fullerton officers visit the Slidebar. When it was brought to their attention homeless people frequent the outskirts of the patio, they instructed the manager and all employees to “give us a call and let us know they are “breaking into cars,” we’ll show up and f*&k with them.” I guess that meant they would show up and beat them to death. So, the phone call made..who’s to blame? The person in the establishment instructed to do what they told him to do or the police who beat the man to death?

  130. I have lived in OC most my life. Fullerton PD have always been know to be a bunch of John Waynes. Anyone involved with this assassination ,”because that is what it was”, needs to rot in prison in the general population. This is so disgusting I want to throw up. Has the system gotten so currupt?. The sad thing is that this is not isolated to Fullerton.This is just but a symptom of bigger problems we are having.
